督管理总局令第86号公布 自 2024年6月1日起施行）(IssuedbyOrderNo.86oftheStateAdministrationforMarketRegulationonNovember28,2023,comingintoforceonJune1,2024)第一条为了加强行业标准 管理，根据中华人民共和国标 准化法，制定本办法。第二条行业标准的制定、 组织实施及其监督管理，适用本 办法。Article 1 Forthepurposesofstrengtheningtheadministrationofindustrystandards,theseMeasuresaredevelopedinaccordancewiththeStandardizationLawofthePeople'sRepublicofChina.Article 2 TheseMeasuresapplytothedevelopment,implementation,supervision,andadministrationofindustrystandards.第三条行业标准是国务院 有关行政主管部门依据其行政管Article 3 IndustrystandardsarestandardsthataredevelopedbytherelevantadministrativedepartmentsoftheStateCouncilaccordingtotheiradministrativedutiesfortechnicalrequirementsthathavenorecommendednationalstandardbutneedtobeunifiedindustry-wideinChina.Anindustrystandardismainlydevelopedaccordingtothedemandfromimportantproducts,engineeringtechnology,services,andindustryregulationintheindustry.理职责，对没有推荐性国家标准 而又需要在全国某个行业范围内 统一的技术要求所制定的标准。行业标准重点围绕本行业领域重 要产品、工程技术、服务和行业 管理等需求制定。有下列情形之一的，不应当制定 行业标准：Noindustrystandardshallbedevelopedinanyofthefollowingcircumstances:(1)Thereisarecommendednationalstandard;（一）已有推荐性国家标准的;（二）要求；一般性产品和服务的技术(3) There are cross-departmental, industry technical requirements; orcross-（三） 求；跨部门、跨行业的技术要(2)Therearethetechnicalrequirementsforgeneralproductsandservices;（四）用于约束行政主管部门系 统内部的工作要求、管理规范 等。第四条行业标准是推荐性 标准。法律、行政法规和国务院 决定另有规定的，从其规定。第五条制定行业标准应当 在科学技术研究成果和社会实践 经验的基础上，保证行业标准的 科学性、规范性、时效性，做到 技术上先进、经济上合理。(4)Thereareworkrequirementsandmanagementnormsusedtorestricttheinternalaffairswithintheadministrativedepartment.Article4Anindustrystandardisarecommendedstandard,exceptasotherwiseprovidedforbyanylaw,administrativeregulation,ordecisionoftheStateCouncil.Article5ThedevelopmentofindustrystandardsshallbebasedonscientificandtechnologicalresearchachievementsandsocialpracticalexperiencetoensuretheScientificity,standardization,andtimelinessofindustrystandards,sothattheyaretechnologicallyadvancedandeconomicallyreasonable.第六条行业标准的技术要 求不得低于强制性国家标准的相 关要求，并与有关标准协调配 套。Article6Thetechnicalrequirementsofindustrystandardsshallnotbelowerthantherelevantrequirementsofmandatorynationalstandards,andshallbecoordinatedwithrelevantstandards.禁止在行业标准中规定资质资 格、许可认证、审批登记、评比 达标、监管主体和职责等事项。Itisforbiddentospecifyqualifications,licensingandcertification,examinationandapprovalregistration,performanceevaluationandinspection,regulators,andresponsibilitiesinindustrystandards.禁止利用行业标准实施妨碍商 品、服务自由流通等排除、限制 市场竞争的行为。Itisforbiddentouseindustrystandardstohinderthefreeflowofgoodsandservicesorcommitactivitiesthatexcludeorrestrictmarketcompetition.第七条国务院标准化行政 主管部门统一指导、协调、监督 行业标准的制定及相关管理工 作。国务院标准化行政主管部门 建立全国标准信息公共服务平 台，支撑行业标准备案、信息公 开等工作。Article7ThestandardizationdepartmentoftheStateCounciluniformlyguides,coordinates,andsupervisesthedevelopmentofindustrystandardsandrelatedmanagementwork.ThestandardizationdepartmentoftheStateCouncilestablishesanationalpublicserviceplatformforstandardsinformationtosupporttherecordationandinformationdisclosureofindustrystandards.第八条国务院有关行政主 管部门统一管理本部门职责范围 内的行业标准，负责行业标准制 定、实施、复审、监督等管理工 作，依法将批准发布的行业标准 报国务院标准化行政主管部门备 案。Article8TherelevantadministrativedepartmentsoftheStateCounciluniformlyadministerindustrystandardswithintheirduties,arechargedwiththedevelopment,implementation,review,andsupervisionofindustrystandards,andreporttheapprovedindustrystandardstothestandardizationdepartmentoftheStateCouncilforrecordationaccordingtothelaw.第九条 行业标准代号及范 围，由国务院标准化行政主管部 门依据国务院有关行政主管部门 的申请及其职责，审查批准并公 布。未经批准公布的行业标准代 号不得使用。Article9Thecodeandscopeofindustrystandardsareexamined,approved,andpublishedbythestandardizationdepartmentoftheStateCouncilaccordingtotheapplicationanddutiesoftherelevantadministrativedepartmentsoftheStateCouncil.Industrystandardcodespublishedwithoutapprovalshallnotbeused.第十条在行业标准制定、 实施过程中存在争议的，由国务 院标准化行政主管部门组织协 商；协商不成的报请国务院标准 化协调机制解决。Article10Ifadisputearisesintheprocessofformulatingandimplementinganindustrystandard,thestandardizationdepartmentoftheStateCouncilshallorganizeaconsultationaboutit;ifthenegotiationfails,itshallbesubmittedtothestandardizationcoordinationmechanismoftheStateCouncilforhandling.第十一条行业标准由国务 院有关行政主管部门制定。制定 行业标准的程序一般包括：立 项、组织起草、征求意见、技术 审查、编号、批准发布、备案。Article11IndustrystandardsshallbeformulatedbytherelevantadministrativedepartmentsoftheStateCouncil.Theproceduresforformulatinganindustrystandardgenerallyincludeprojectinitiation,draftingorganization,publiccommentsolicitation,technicalreview,numbering,approvalandissuance,andrecordation.第十二条行业标准立项 前，国务院有关行政主管部门应 当组织核查，已有推荐性国家标 准或者相关标准立项计划的应当 不予立项。Article12Beforetheprojectinitiationforindustrystandards,therelevantadministrativedepartmentsoftheStateCouncilshallorganizeverification.Wherethereisarecommendednationalstandardoraplanforprojectinitiationforrelevantstandards,noprojectinitiationshallbegranted.第十三条起草行业标准应 当与已有的国家标准、行业标准 协调，避免交叉、重复和矛盾。Article13Thedraftingofanindustrystandardshallbecompatiblewithexistingnationalstandardsandindustrystandardstoavoidoverlapping,repetition,orcontradiction.行业标准征求意见稿应当向社会 公开征求意见，期限一般不少于 三十日。Thedraftofindustrystandardsshallbeopentothepublicforcomments,andtheperiodisgenerallynotlessthan30days.外商投资企业依法和内资企业平 等参与行业标准制定、修订工 作。Foreign-fundedenterprisesanddomestic-fundedenterprisesshallparticipateinthedevelopmentandrevisionofindustrystandardsonanequalfootingaccordingtothelaw.第十四条国务院有关行政 主管部门应当委托标准化技术委 员会或者成立审查专家组对行业 标准送审稿开展技术审查，重点 审查技术要求的科学性、合理 性、适用性、规范性。Article14TherelevantadministrativedepartmentoftheStateCouncilshallauthorizetheStandardizationTechnicalCommitteeorsetupanexpertreviewpaneltocarryoutatechnicalreviewonthedraftofindustrystandards,withafocusontheScientificity,rationality,applicability,andstandardizationoftechnicalrequirements.标准化技术委员会和专家组应当 具有专业性、独立性和广泛代表 性。标准起草人员不得承担同一 标准的技术审查工作。TheStandardizationTechnicalCommitteeandtheexpertpanelshallbeprofessional,independent,andbroadlyrepresentative.Astandarddraftershallnotundertakethetechnicalreviewofthesamestandard.已有全国专业标准化技术委员会 能够满足行业需求的，不再新增 专业领域的行业标准化技术委员 会。Ifanexistingnationalstandardizationtechnicalcommitteeisabletomeettheneedsoftheindustry,nonewstandardizationtechnicalcommitteeintheindustryshallbeadded.第十五条行业标准一般不 涉及专利。行业标准中涉及的专 利应当是实施该标准必不可少的 专利，其管理参照国家标准涉及 专利的有关管理规定执行。Article15Anindustrystandardtypicallydoesnotinvolvepatents.Patentsinvolvedinanindustrystandardshallbeindispensablepatentsfortheimplementationofthestandard,andtheirmanagementshallbegoverned,mutatismutandis,bytheapplicableprovisionsconcerningpatentmanagementdescribedinnationalstandards.第十六条行业标准确需采 用国际标准的，应当符合有关国 际组织的版权政策，获得国际标 准组织中国成员体同意。以国外 标准为基础起草行业标准的，应 当符合国外标准发布机构的版权 政策。Article16Ifitisreallynecessaryforanindustrystandardtoadoptaninternationalstandard,itshallcomplywiththecopyrightpolicyoftherelevantinternationalorganizationandobtaintheconsentoftheChinesemembersoftheInternationalStandardsOrganization.Thedraftingofanindustrystandardbasedonforeignstandardsshallcomplywiththecopyrightpoliciesoftheagencypublishingtheforeignstandards.第十七条 行业标准的编号 由行业标准的代号加“/T”、行 业标准发布的顺序号和行业标准 发布的年份号构成。“/'表示 推荐性标准，顺序号为自然数。Article17Thenumberofanindustrystandardconsistsofthecodeoftheindustrystandardplus7andthesequencenumberandyearnumberfortheissuanceoftheindustrystandard.'7T"indicatestherecommendedstandards,andthesequencenumberisanaturalnumber.第十八条行业标准由国务 院有关行政主管部门批准发布。 行业标准的发布实行公告制度。Article18AnindustrystandardshallbeissuedafterapprovalbytherelevantadministrativedepartmentsoftheStateCouncil.Theissuanceoftheindustrystandardshallbesubjecttotheannouncementsystem.第十九条国务院有关行政 主管部门应当自行业标准批准发 布之日起六十日内，且在该标准 实施日期前，通过全国标准信息 公共服务平台等方式向国务院标 准化行政主管部门提交备案材 料。备案材料应当包括行业标准 发布公告和批准发布的标准正式 文本。同时发布标准外文版的， 备案材料还应当包括行业标准外 文版发布公告和批准发布的外文 版正式文本。Article19TherelevantadministrativedepartmentoftheStateCouncilshall,within60daysfromthedateofapprovalandissuanceofanindustrystandard,andbeforetheimplementationdateofthestandard,submittherecordationmaterialstothestandardizationdepartmentoftheStateCouncilthroughthenationalpublicserviceplatformforstandardsinformation.Therecordationmaterialsshallincludetheannouncementoftheissuanceoftheindustrystandardandtheofficialtextofthestandardapprovedforissuance.Iftheforeign-languageversionofthestandardisissued,therecordationmaterialsshallalsoincludetheannouncementoftheforeign-languageversionoftheindustrystandardandtheofficialtextoftheforeign-languageversionapprovedforissuance.国务院有关行政主管部门依法推 动行业标准公开。鼓励通过全国 标准信息公共服务平台公开行业 标准文本，供公众查阅。TherelevantadministrativedepartmentsoftheStateCouncilpromotethedisclosureoftheindustrystandardaccordingtothelaw.Theissuanceofthetextoftheindustrystandardshallbeencouragedthroughthenationalpublicserviceplatformforstandardsinformation.鼓励行业标准制定部门建立涵盖 立项、起草、征求意见、审查、 批准发布等环节的信息平台，强 化标准制定信息公开和社会监 督。Thedepartmentresponsiblefordevelopingtheindustrystandardshallbeencouragedtoestablishaninformationplatformcoveringprojectinitiation,drafting,publiccommentsolicitation,review,approvalandissuance,andstrengtheninformationdisclosureandpublicsupervisionwhendevelopingstandards.第二十条行业标准发布 后，国务院有关行政主管部门可 以委托具有相关出版资质的单位 完成标准文本出版工作。Article20Aftertheissuanceofanindustrystandard,therelevantadministrativedepartmentsoftheStateCouncilmayauthorizeentitieswithrelevantpublishingqualificationstocompletethepublicationofthetextofthestandard.第二十一条行业标准的发 布与实施之间应当留出合理的过 渡期。Article 21 Anappropriatetransitionalperiodshallbeallowedbetweentheissuanceandimplementationofanindustrystandard.行业标准发布后实施前，可以选 择执行原行业标准或者新行业标 准。Aftertheissuanceoftheindustrystandardandbeforeitsimplementation,eithertheoriginalindustrystandardorthenewoneshallapply.新行业标准实施后，原行业标准 同时废止。Afterthenewindustrystandardcomesintoforce,theoriginaloneshallbeconcurrentlyrepealed.行业标准在相应的国家标准实施 后，应当由国务院有关行政主管 部门自行废止。第二十二条国务院有关行 政主管部门应当组织开展行业标 准的宣贯工作，并结合本部门法 定职责开展行业标准的推广实 施。Afterthecorrespondingnationalstandardcomesintoforce,theindustrystandardshallberepealedbytherelevantadministrativedepartmentsoftheStateCouncil.Article 22 TherelevantadministrativedepartmentsoftheStateCouncilshallorganizethepublicityandimplementationofindustrystandards,andcarryoutthewidespreadimplementationofindustrystandardsinlightoftheirstatutoryduties.第二十三条国务院有关行 政主管部门负责行业标准的解 释。行业标准的解释与标准文本 具有同等效力。解释发布后，国 务院有关行政主管部门应当自发 布之日起二十日内在部门门户网 站或者部门标准化工作网站公开 解释文本，并在全国标准信息公 共服务平台公开。Article 23 TherelevantadministrativedepartmentsoftheStateCouncilshallberesponsiblefortheinterpretationofindustrystandards.Theinterpretationofanindustrystandardandthestandardtextareequallyeffective.Aftertheissuanceoftheinterpretation,therelevantadministrativedepartmentoftheStateCouncilshall,within20daysfromthedateofissuance,publishthetextoftheinterpretationontheportalwebsiteorstandardizationwebsiteofthedepartment,andmakeitpubliconthenationalpublicserviceplatformforstandardsinformation.第二十四条行业标准的复 审周期一般不超过五年。有下列 情形之一的，应当及时复审：Article 24 Thereviewperiodofanindustrystandardisgenerallynomorethanfiveyears.Thereviewshallbeconductedinatimelymannerunderanyofthefollowingcircumstances:（一）法律、行政法规、部门规 章或者国家有关规定发生重大变 化的；(1) Thereareanymajorchangesinlaws,administrativeregulations,departmentalrules,orrelevantprovisionsofthestate;（二）相关国家标准、行业标准 发生重大变化的；(2) Majorchangeshavetakenplaceintherelevantnationalstandardsandindustrystandards;（三）关键技术、适用条件发生 重大变化的；(3) Majorchangeshavetakenplaceinkeytechnologiesandapplicableconditions;or（四）其他需要及时复审的情 形。(4) Othercircumstancesrequiringtimelyreview.国务院有关行政主管部门应当公 告复审结论°复审结论分为继续 有效、修订、废止三种情形。复 审结论为修订的，应当按照本办 法规定的行业标准制定程序执 行。复审结论为废止的，应当在 公告废止前公开征求意见。废止 公告应当在全国标准信息公共服 务平台公开。TherelevantadministrativedepartmentoftheStateCouncilshallannouncetheconclusionofthereview.Thereviewconclusionisdividedintothreecircumstances:remaininginforce,andbeingrevisedandrepealed.Ifthereviewconclusionisarevisedone,itshallbeimplementedinaccordancewiththeproceduresfordevelopingindustrystandardsstipulatedintheseMeasures.Ifthereviewconclusionisarepealedone,publiccommentsshallbesolicitedbeforeannouncingtherepeal.Therepealofanannouncementshallbepublishedonthenationalpublicserviceplatformforstandardsinformation.第二十五条国务院有关行 政主管部门应当建立行业标准实 施信息反馈和评估机制，根据反 馈意见和评估情况对行业标准进 行复审。Article 25 TherelevantadministrativedepartmentoftheStateCouncilshallestablishaninformationfeedbackandevaluationmechanismfortheimplementationofindustrystandards,andreviewindustrystandardsaccordingtothefeedbackandevaluation.第二十六条国务院有关行 政主管部门应当定期对其发布的 行业标准开展监督检查，及时纠 正行业标准不符合强制性国家标 准，与国家标准、其他行业标准 重复交叉或者不协调配套，超范 围制定以及编号编写不符合规定 等问题。Article 26 TherelevantadministrativedepartmentoftheStateCouncilshallregularlysuperviseandinspecttheindustrystandardsissuedbyitinanattempttopromptlycorrecttheproblemsthattheindustrystandardsdonotmeetthemandatorynationalstandardsoroverlapwithorarenotcompatiblewiththenationalstandardandotherindustrystandards,thestandardisdevelopedbeyondthescope,andthenumberingdoesnotmeettherequirements.第二十七条国务院标准化 行政主管部门定期组织对行业标 准开展监督抽查，通报结果。Article27ThestandardizationdepartmentoftheStateCouncilregularlyorganizessupervisionandspotchecksonindustrystandardsandreportstheresults.第二十八条行业标准与国 家标准、其他行业标准之间重复 交叉或者不协调配套的，国务院 标准化行政主管部门应当会同国 务院有关行政主管部门，提出整 合、修订或者废止行业标准的意 见，并由国务院有关行政主管部 门负责处理。国务院有关行政主 管部门未处理的，由国务院标准 化行政主管部门组织协商，协商 不成的，报请国务院标准化协调 机制解决。Article28Whereanindustrystandardoverlapsorisnotcompatiblewithanationalstandardoranyotherindustrystandard,thestandardizationdepartmentoftheStateCouncilshall,togetherwiththerelevantadministrativedepartmentsoftheStateCouncil,putforwardopinionsonintegrating,revising,orrepealingtheindustrystandard,andtherelevantadministrativedepartmentsoftheStateCouncilshallberesponsibleforhandlingthem.IftherelevantadministrativedepartmentoftheStateCouncilfailstohandleit,thestandardizationdepartmentoftheStateCouncilshallorganizeaconsultation,andiftheconsultationfails,itshallbesubmittedtothestandardizationcoordinationmechanismoftheStateCouncilforhandling.第二十九条国务院有关行 政主管部门违反本办法第三条第 三款、第六条第一款和第二款、 第九条规定的，以及行业标准制 定主体、编号、备案或者复审等 不符合本办法规定的，国务院标 准化行政主管部门要求其说明情 况，并限期改正。未按期改正 的，由国务院标准化行政主管部 门公告废止相关标准。Article29IftherelevantadministrativedepartmentoftheStateCouncilviolatestheprovisionsofparagraph3ofArticle3,paragraphs1and2ofArticle6,andArticle9oftheseMeasures,oriftheentityresponsiblefordevelopinganindustrystandardorthenumbering,filing,orreviewoftheindustrystandarddonotcomplywiththeprovisionsoftheseMeasures,thestandardizationdepartmentoftheStateCouncilshallrequireittoexplainthereasonsandtakecorrectiveactionwithinatimelimit.Ifitfailstodosoonschedule,thestandardizationdepartmentoftheStateCouncilshallannouncetherepealoftherelevantstandard.第三十条违反本办法第六
