1 Forthepurposesofpreventingandreducingworksafetyaccidents,strictlyholdingtheentitieswhereworksafetyaccidentsoccurandtherelevantliablepersonslegallyliableandcorrectlyapplyingtheadministrativepenaltyofafineforanaccident,theseProvisionsaredevelopedinaccordancewiththeAdministrativePunishmentLawofthePeople'sRepublicofChina,theWorkSafetyLawofthePeople'sRepublicofChina,theRegulationontheReporting,InvestigationandHandlingofWorkSafetyAccidents,andotherprovisions.Article 2 TheseProvisionsshallapplytotheadministrativepenaltiesoffinesimposedbyemergencymanagementdepartmentsandminesafetysupervisioninstitutionsonentitieswhereworksafetyaccidentsoccur(hereinafterreferredtoasuaccidententities)andtheirprimarypersonsincharge,otherpersonsincharge,worksafetymanagementpersonnelanddirectlyresponsiblepersonincharge,otherdirectlyliablepersons,andotherliablepersonsinaccordancewiththeWorkSafetyLawofthePeople'sRepublicofChinaandtheRegulationontheReporting,InvestigationandHandlingofWorkSafetyAccidents.Article 3 ForthepurposeoftheseProvisions,auaccidententitynmeansaproductionorbusinessentitythatisliablefortheoccurrenceofanaccident.安全事故，严格追究生产安全事 故发生单位及其有关责任人员的 法律责任，正确适用事故罚款的 行政处罚，依照中华人民共和 国行政处罚法中华人民共和 国安全生产法生产安全事故 报告和调查处理条例等规定， 制定本规定。第二条应急管理部门和矿 山安全监察机构对生产安全事故 发生单位（以下简称事故发生单 位）及其主要负责人、其他负责 人、安全生产管理人员以及直接 负责的主管人员、其他直接责任 人员等有关责任人员依照中华 人民共和国安全生产法和生 产安全事故报告和调查处理条 例实施罚款的行政处罚，适用 本规定。第三条本规定所称事故发 生单位是指对事故发生负有责任 的生产经营单位。本规定所称主要负责人是指有限 责任公司、股份有限公司的董事 长、总经理或者个人经营的投资 人，其他生产经营单位的厂长、 经理、矿长（含实际控制人）等 人员。ForthepurposeoftheseProvisions,a"primarypersoninchargemeansthechairmanoftheboardofdirectorsorgeneralmanagerofalimitedliabilitycompanyorajointstocklimitedcompanyortheinvestorofanindividualbusiness,orthefactorydirector,manager,orminemanager(includinganactualcontroller)ofanyotherproductionorbusinessentity,oranyotherperson.Article4ForthepurposeoftheseProvisions,theuannualincomeinthelastyearofanaccidententity'sprimarypersoninchargeoranyotherpersonincharge,worksafetymanagementpersonordirectlyresponsiblepersonincharge,oranyotherdirectlyliablepersonmeansthetotalannualincomeinthelastyearasdeterminedbythecompetentsuperiorauthorityoftheentityiftheentityisastate-ownedproductionorbusinessentity;ormeansthetotalannualincomeinthelastyearasassessedbythefinancialortaxationauthorityiftheentityisnotastate-ownedproductionorbusinessentity.Whereitisdifficulttodeterminearelevantperson,sannualincomeinthepreviousyearbecausetheproductionorbusinessentityprovidesfalsematerialsorthefinancialortaxationauthoritycannotconductassessmentorforanyotherreason,theannualincomeshallbedeterminedasfollows:(1) Theannualincomeoftheprimarypersoninchargeinthepreviousyearshallbecalculatedasnotlessthanfivetimesnormorethantentimesthepreviousyear'saveragewageofemployeesofurbanentitiesintheprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernment.第四条本规定所称事故发 生单位主要负责人、其他负责 人、安全生产管理人员以及直接 负责的主管人员、其他直接责任 人员的上一年年收入，属于国有 生产经营单位的，是指该单位上 级主管部门所确定的上一年年收 入总额；属于非国有生产经营单 位的，是指经财务、税务部门核 定的上一年年收入总额。生产经营单位提供虚假资料或者 由于财务、税务部门无法核定等 原因致使有关人员的上一年年收 入难以确定的，按照下列办法确 定：（一）主要负责人的上一年年收 入，按照本省、自治区、直辖市 上一年度城镇单位就业人员平均 工资的5倍以上10倍以下计算；（二）其他负责人、安全生产管 理人员以及直接负责的主管人 员、其他直接责任人员的上一年 年收入，按照本省、自治区、直 辖市上一年度城镇单位就业人员 平均工资的1倍以上5倍以下计(2) Theannualincomeofanyotherpersonincharge,aworksafetymanagementpersonoradirectlyresponsiblepersonincharge,oranyotherdirectlyliablepersoninthepreviousyearshallbecalculatedasnotlessthanonetimenormorethanfivetimesthepreviousyear'saveragewageofemployeesofurbanentitiesintheprovince,autonomousregion,or算。municipalitydirectlyundertheCentralGovernment.Article5ForthepurposeoftheRegulationontheReporting,InvestigationandHandlingofWorkSafetyAccidents,udelayinreporting,omissionofinformationinreporting,falsereporting,orconcealmentinreporting"shallbedeterminedaccordingtothefollowingcircumstances:(1) uDeIayinreporting11meansthatanaccidentfailstobereportedwithinaprescribedtimelimit.(2) uOmissionofinformationinreportingnmeansthatanaccidentthatshallbereportedorthecontentsuchastimeorplaceofoccurrence,category,numberofcasualties,ordirecteconomiclossesofanaccidentisomittedandnotreportedasaresultofnegligence.(3) Talsereporting"meansthatthetime,place,preliminarycause,nature,numberofcasualtiesornumberofpeopleaffected,ordirecteconomiclossesoftheaccidentorotherrelevantcontentisnotfaithfullyreportedonpurpose.(4) “Concealmentinreportingnmeansthatanaccidentthathasoccurredisconcealed,andnoreportismadetotheemergencymanagementdepartment,minesafetysupervisioninstitutionandrelevantdepartmentswithinaprescribedtimelimit,whichhavebeenverified.第五条生产安全事故报 告和调查处理条例所称的迟 报、漏报、谎报和瞒报，依照下 列情形认定：（一）报告事故的时间超过规定 时限的，属于迟报；（二）因过失对应当上报的事故 或者事故发生的时间、地点、类 别、伤亡人数、直接经济损失等 内容遗漏未报的，属于漏报；（三）故意不如实报告事故发生 的时间、地点、初步原因、性 质、伤亡人数和涉险人数、直接 经济损失等有关内容的，属于谎 报；（四）隐瞒已经发生的事故，超 过规定时限未向应急管理部门、 矿山安全监察机构和有关部门报 告，经查证属实的，属于瞒报。第六条对事故发生单位及Article 6 Theimpositionofadministrativepenaltiesoffinesonanaccidententityanditsrelevantliablepersonsshallbedecidedinaccordancewiththefollowingprovisions:(1) TheimpositionofadministrativepenaltiesoffinesonanentitywhereanespeciallyseriousaccidentoccursandonitsrelevantliablepersonsshallbedecidedbytheMinistryofEmergencyManagement.(2) Theimpositionofadministrativepenaltiesoffinesonanentitywhereaseriousaccidentoccursandonitsrelevantliablepersonsshallbedecidedbytheemergencymanagementdepartmentoftheprovincialpeople,sgovernment.(3) Theimpositionofadministrativepenaltiesoffinesonanentitywherearelativelyseriousaccidentoccursandonitsrelevantliablepersonsshallbedecidedbytheemergencymanagementdepartmentofthepeople'sgovernmentatthedistrictedcitylevel.(4) Theimpositionofadministrativepenaltiesoffinesonanentitywhereanordinaryaccidentoccursandonitsrelevantliablepersonsshallbedecidedbytheemergencymanagementdepartmentofthepeople'sgovernmentatthecountylevel.Anemergencymanagementdepartmentmaydesignatetheemergencymanagementdepartmentatthenextlowerleveltoimposeadministrativepenaltiesonanaccidententityanditsrelevantliablepersons.其有关责任人员处以罚款的行政 处罚，依照下列规定决定：（一）对发生特别重大事故的单 位及其有关责任人员罚款的行政 处罚，由应急管理部决定；（二）对发生重大事故的单位及 其有关责任人员罚款的行政处 罚，由省级人民政府应急管理部 门决定；（三）对发生较大事故的单位及 其有关责任人员罚款的行政处 罚，由设区的市级人民政府应急 管理部门决定；（四）对发生一般事故的单位及 其有关责任人员罚款的行政处 罚，由县级人民政府应急管理部 门决定。上级应急管理部门可以指定下一 级应急管理部门对事故发生单位 及其有关责任人员实施行政处 罚。第七条对煤矿事故发生单 位及其有关责任人员处以罚款的Article 7 Theimpositionofadministrativepenaltiesoffinesonacoalmineaccidententitybe行政处罚，依照下列规定执行:anditsrelevantliablepersonsshallgovernedbythefollowingprovisions:(1) TheimpositionofadministrativepenaltiesoffinesonacoalminewhereanespeciallyseriousaccidentoccursandonitsrelevantliablepersonsshallbedecidedbytheNationalMineSafetyAdministration.(2) Theimpositionofadministrativepenaltiesoffinesonacoalminewhereaserious,relativelyserious,orordinaryaccidentoccursandonitsrelevantliablepersonsshallbedecidedbytheprovincialbureauoftheNationalMineSafetyAdministration.Aminesafetysupervisioninstitutionmaydesignatetheminesafetysupervisioninstitutionatthenextlowerleveltoimposeadministrativepenaltiesonanaccidententityanditsrelevantliablepersons.Article8Where5foranaccidentbelowthelevelofespeciallyseriousaccident,theplaceofoccurrenceoftheaccidentandtheplacewheretheaccidententityislocatedarenotinthesameadministrativeregionatorabovethecountylevel,theemergencymanagementdepartmentorminesafetysupervisioninstitutionattheplaceofoccurrenceoftheaccidentshallimposeanadministrativepenaltyaccordingtopowerssetforthinArticle6or7oftheseProvisions.（一）对发生特别重大事故的煤 矿及其有关责任人员罚款的行政 处罚，由国家矿山安全监察局决 定；（二）对发生重大事故、较大事 故和一般事故的煤矿及其有关责 任人员罚款的行政处罚，由国家 矿山安全监察局省级局决定。上级矿山安全监察机构可以指定 下一级矿山安全监察机构对事故 发生单位及其有关责任人员实施 行政处罚。第八条特别重大事故以下 等级事故，事故发生地与事故发 生单位所在地不在同一个县级以 上行政区域的，由事故发生地的 应急管理部门或者矿山安全监察 机构依照本规定第六条或者第七 条规定的权限实施行政处耨。第九条应急管理部门和矿 山安全监察机构对事故发生单位 及其有关责任人员实施罚款的行 政处罚，依照中华人民共和国 行政处罚法安全生产违法行Article9EmergencymanagementdepartmentsandminesafetysupervisioninstitutionsshallimposetheadministrativepenaltiesoffinesonaccidententitiesandtheirrelevantliablepersonsaccordingtotheproceduresasprescribedintheAdministrativePunishmentLawofthePeople'sRepublicofChina,theMeasuresforAdministrativePenaltiesforIllegalActsConcerningWorkSafety,andotherprovisions.Article10Beforeimposingadministrativepenalties,emergencymanagementdepartmentsandminesafetysupervisioninstitutionsshallinformthepartiesoftheirlawfulrightstomakestatementsorargumentsandrequesthearings,amongothers.Anypartythatrefusestoacceptanadministrativepenaltyshallhavetherighttoapplyforadministrativereconsiderationandfileanadministrativelawsuitinaccordancewiththelaw.Article11WheretheprimarypersoninchargeofanaccidententitycommitsanyofthefollowingactsasprescribedinArticle110oftheWorkSafetyLawofthePeople'sRepublicofChinaorArticle35or36oftheRegulationontheReporting,InvestigationandHandlingofWorkSafetyAccidents,afineshallbeimposedinaccordancewiththefollowingprovisions:为行政处罚办法等规定的程序 执行。第十条应急管理部门和矿 山安全监察机构在作出行政处罚 前，应当告知当事人依法享有的 陈述、申辩、要求听证等权利； 当事人对行政处罚不服的，有权 依法申请行政复议或者提起行政 诉讼。第十一条事故发生单位主 要负责人有中华人民共和国安 全生产法第一百一十条、生 产安全事故报告和调查处理条 例第三十五条、第三十六条规 定的下列行为之一的，依照下列 规定处以罚款：（一）事故发生单位主要负责人 在事故发生后不立即组织事故抢 救，或者在事故调查处理期间擅 离职守，或者瞒报、谎报、迟报 事故，或者事故发生后逃匿的， 处上一年年收入60%至80%的罚 款；贻误事故抢救或者造成事故 扩大或者影响事故调查或者造成 重大社会影响的，处上一年年收 入80%至100%的罚款；(1) Wheretheprimarypersoninchargeoftheaccidententityfailstoorganizerescueimmediatelyaftertheaccidentoccurs,leaveshisorherpostwithoutpermissionduringtheinvestigationandhandlingoftheaccident,concealsinformationinthereportingof,falselyreports,ordelaysthereportingofanaccident,orescapesaftertheoccurrenceofanaccident,afineof60%to80%ofhisorherannualincomeinthepreviousyearshallbeimposed;andwheretherescueoftheaccidentisdelayed,theexpansionofaccidentiscausedortheaccidentinvestigationisaffected,oramajorsocialimpactiscaused,afineof80%to100%ofthepreviousyear'sannualincomeshallbeimposed.(2) Wheretheprimarypersoninchargeofanaccidententityomitsanyinformationinthereportingofanaccident,afineof40%to60%ofhisorherannualincomeinthepreviousyearshallbeimposed;andwheretherescueoftheaccidentisdelayed,theexpansionofaccidentiscausedortheaccidentinvestigationisaffected,oramajorsocialimpactiscaused,afineof60%to80%ofthepreviousyear'sannualincomeshallbeimposed.(3) Wheretheprimarypersoninchargeofanaccidententityforgesorintentionallydestroystheaccidentscene,transfersorconcealscapitalorproperty,destroystherelevantevidenceormaterials,refusestoacceptinvestigation,refusestoprovidetherelevantinformationormaterials,commitsperjuryintheaccidentinvestigation,orinstigatesanyotherpersontocommitperjury,afineof60%to80%ofthepreviousyear'sannualincomeshallbeimposed;andwheretherescueoftheaccidentisdelayed,theexpansionofaccidentiscausedortheaccidentinvestigationisaffected,oramajorsocialimpactiscaused,afineof80%to100%ofthepreviousyear'sannualincomeshallbeimposed.（二）事故发生单位主要负责人 漏报事故的，处上一年年收入40% 至60%的罚款；贻误事故抢救或 者造成事故扩大或者影响事故调 查或者造成重大社会影响的，处 上一年年收入60%至80%的罚 款；（三）事故发生单位主要负责人 伪造、故意破坏事故现场，或者 转移、隐匿资金、财产、销毁有 关证据、资料，或者拒绝接受调 查，或者拒绝提供有关情况和资 料，或者在事故调查中作伪证， 或者指使他人作伪证的，处上一 年年收入60%至80%的罚款；贻 误事故抢救或者造成事故扩大或 者影响事故调查或者造成重大社 会影响的，处上一年年收入80%至 100%的罚款。第十二条事故发生单位直 接负责的主管人员和其他直接责 任人员有生产安全事故报告和 调查处理条例第三十六条规定 的行为之一的，处上一年年收入 60%至80%的罚款；贻误事故抢救 或者造成事故扩大或者影响事故 调查或者造成重大社会影响的，Article12IfthedirectlyresponsiblepersoninchargeoranyotherdirectlyliablepersonoftheaccidententitycommitsanyoftheactsasprescribedinArticle36oftheRegulationontheReporting,InvestigationandHandlingofWorkSafetyAccidents,afineof60%to80%ofthepreviousyear'sannualincomeshallbeimposed;andwheretherescueoftheaccidentisdelayed,theexpansionofaccidentiscausedortheaccidentinvestigationisaffected,ora处上一年年收入80%至100%的罚majorsocialimpactiscaused,afineof80%to款。100%ofthepreviousyear'sannualincomeshallbeimposed.Article13Whereanaccidententitycommitsanyofthefollowingactsasprescribedinsubparagraphs(1)to(5)ofArticle36oftheRegulationontheReporting,InvestigationandHandlingofWorkSafetyAccidents,afineshallbeimposedinaccordancewiththefollowingprovisions:(1) Inthecaseofanordinaryaccident,afineofnotlessthan1millionyuannormorethan1.5millionyuanshallbeimposed.(2) Inthecaseofarelativelyseriousaccident,afineofnotlessthan1.5millionyuannormorethan2millionyuanshallbeimposed.(3) Inthecaseofaseriousaccident,afineofnotlessthan2millionyuannormorethan2.5millionyuanshallbeimposed.(4) Inthecaseofanespeciallyseriousaccident,afineofnotlessthan2.5millionyuannormorethan3millionyuanshallbeimposed.第十三条事故发生单位有 生产安全事故报告和调查处理 条例第三十六条第一项至第五 项规定的行为之一的，依照下列 规定处以罚款：（一）发生一般事故的，处100 万元以上150万元以下的罚款；（二）发生较大事故的，处150 万元以上200万元以下的罚款；（三）发生重大事故的，处200 万元以上250万元以下的罚款；（四）发生特别重大事故的，处 250万元以上300万元以下的罚 款。事故发生单位有生产安全事故 报告和调查处理条例第三十六 条第一项至第五项规定的行为之 一的，贻误事故抢救或者造成事 故扩大或者影响事故调查或者造 成重大社会影响的，依照下列规 定处以罚款：Whereanaccidententitycommitsanyofthefollowingactsasprescribedinsubparagraphs(1)toofArticle36oftheRegulationontheReporting,InvestigationandHandlingofWorkSafetyAccidents,andtherescueoftheaccidentisdelayed,theexpansionofaccidentiscausedortheaccidentinvestigationisaffected,oramajorsocialimpactiscaused,afineshallbeimposedaccordingtothefollowingprovisions:(1) Inthecaseofanordinaryaccident,afineofnotlessthan3millionyuannormorethan3.5millionyuanshallbeimposed.(2) Inthecaseofarelativelyseriousaccident,afineofnotlessthan3.5millionyuannormorethan4millionyuanshallbeimposed.(3) Inthecaseofaseriousaccident,afineofnotlessthan4millionyuannormorethan4.5millionyuanshallbeimposed.(4) Inthecaseofanespeciallyseriousaccident,afineofnotlessthan4.5millionyuannormorethan5millionyuanshallbeimposed.Article 14 Whereanaccidententityisliableforanordinaryaccident,afineshallbeimposedinaccordancewiththefollowingprovisions:(1) Iftheaccidenthascausedseriousinjuriestonotmorethanthreepersons(includingacuteindustrialpoisoning,hereandbelow)ordirecteconomiclossesofnotmorethan3millionyuan,afineofnotlessthan300,000yuannormorethan500,000yuanshallbeimposed.（一）发生一般事故的，处300 万元以上350万元以下的罚款；（二）发生较大事故的，处350 万元以上400万元以下的罚款；（三）发生重大事故的，处400 万元以上450万元以下的罚款；（四）发生特别重大事故的，处 450万元以上500万元以下的罚 款。第十四条事故发生单位对 一般事故负有责任的，依照下列 规定处以罚款：（一）造成3人以下重伤（包括 急性工业中毒，下同），或者300 万元以下直接经济损失的，处30 万元以上50万元以下的罚款；（二）造成1人死亡，或者3人 以上6人以下重伤，或者300万 元以上500万元以下直接经济损 失的，处50万元以上70万元以 下的罚款；(2) Iftheaccidenthascausedthedeathofonepersonorseriousinjuriesto
