Preparingthelistsofadministrativelicensingitemsinaccordancewiththelaw(3) Theresponsibilitiesforthepreparationoflistsshallbespecified.TheLeadingGroupOfficeoftheStateCouncilforAdministrativeApprovalSystemReformshallberesponsibleforarrangingforrelevantdepartmentsoftheStateCounciltopreparetheListofAdministrativeLicensingItemsDeterminedbyLaws,AdministrativeRegulations,andDecisionsoftheStateCounciLwhichshallbeissuedtothepublicafterbeing(二)工作目标。2022年底前,构建形成全国统筹、分级负责、事项统一、权责清晰的行政许可事项清单体系,编制并公布国家、省、市、县四级行政许可事项清单,将依法设定的行政许可事项全部纳入清单管理,清单之外一律不得违法实施行政许可。对清单内事项逐项编制完成行政许可实施规范,大幅提升行政许可标准化水平,“十四五”时期基本实现同一事项在不同地区和层级同要素管理、同标准办理。二、依法编制行政许可事项清单(三)明确清单编制责任。国务院审改办负责组织国务院有关部门编制法律、行政法规、国务院决定设定的行政许可事项清单,报国务院审定后向社会公布。县级以上地方人民政府牵头推进行政审批制度改革工作的机构(以下称审改牵头机构)负责组织梳理上级设定、本地区实施的行政许可事项和本地区地方性法规、省级政府规章设定的行政许可事项,编制本地区行政许可事项清单, 报同级人民政府审定后向社会公布,并抄送上一级审改牵 头机构。(四)统一清单编制要求。各级行政许可事项清单 应当逐项明确事项名称、主管部门、实施机关、设定和实 施依据等基本要素。各地区行政许可事项清单中上级设 定、本地区实施的事项及其基本要素,不得超出上级清单 的范围,确保事项同源、统一规范。省、市、县三级清单 应当于2022年底前编制完成。依托全国一体化政务服务平 台,建设全国行政许可管理系统,将国家、省、市、县级 行政许可事项清单全部纳入系统管理。examinedanddeterminedbytheStateCouncil.Theorganofalocalpeople'sgovernmentatorabovethecountylevelthattakestheleadinadvancingtheadministrativeapprovalsystemrefbn(hereinafterreferredtoasthetorganleadingtheapprovalsystemrcfbrm)shallberesponsiblefororganizingthereviewofadministrativelicensingitemsdeterminedbysuperiorauthoritiesandimplementedinitsregionandadministrativelicensingitemsdeterminedbythelocalregulationsandprovincialgovernmentrulesofitsregion,preparethelistofadministrativelicensingitemsofitsregion,submitthelisttothepeople'sgovernmentatthesamelevelforexaminationanddeterminationandthenreleasethelisttothepublic,andsendacopythereoftotheorganleadingtheapprovalsystemreformatthenexthigherlevel.(4) Therequirementsforthepreparationoflistsshallbeunified.Thelistofadministrativelicensingitemsateachlevelshallspecifyeachitem,competentauthority,implementingorgan,basisfordeterminationandimplementation,andotherbasicelements.Inthelistofadministrativelicensingitemsofeachregion,theitemsdeterminedbysuperiorauthoritiesandimplementedbytheregionandthebasicelementsthereofshallnotexceedthescopeofitemsinthelistofthesuperiorauthority,soastoensurethattheitemsarefromthesamesourceandareunifiedandstandardized.Thelistsattheprovincial,city,andcountylevelsshallbepreparedbeforetheendof2022.Byrelyingonthenationalintegratedgovernmentserviceplatform,anationaladministrativelicensingmanagementsystemshallbebuiltandallthelistsofadministrativelicensingitemsatthenational,provincial,city,andcountylevelsshallbeincludedinthesystemformanagement.(5) Dynamicadjustmentstolistsshallbemadeinatimelymanner.Ifanyadministrativelicensingitemistobeestablishedoradjustedbythedraftofanylaw,regulation,orrule,thedraftingdepartmentshallconductthoroughresearchanddemonstrationandgiveaspecialexplanationinthedraftingexplanation.Thejusticeadministrativedepartmentshallsolicittheopinionsoftheorganleadingtheapprovalsystemreformatthesamelevelindraftexamination.Priortotheofficialimplementationofadministrativelicensing,relevantdepartmentsshallfileapplicationsforadjustingthelistofadministrativelicensingitems,theorganleadingtheapprovalsystemreformshallmakeadjustmentsinatimelymanner,andtheadministrativelicensingimplementingorganshallmakegoodpreparationsforimplementation.Ifdynamicadjustmentsneedtobemadetothelistofadministrativelicensingitemsfordeepeningtheadministrativeapprovalsystemreform、theaforesaidproceduresshallapplymutatismutandis.Ifthelistofthesuperiorauthorityisadjusteddynamically»correspondingadjustmentsshallbemadetothelistofauthoritiesatlowerlevelsinatimelymanner.(6) Consistencywithitemsinthelistshallbeeffectivelymaintained.Theadministrativelicensingitemsinvolvedinthemarketaccessnegativelist,thebasiccatalogueofgovernmentsen,iceitems,the“InternetandRegulationvlist,thelistofitemsofinvestmentprojectssubjecttoapproval,andthelistofitemsofengineeringconstructionprojectssubjecttoapproval,amongothers,shallbestrictlyconsistentwithandwellalignedwiththelistofadministrativelicensingitems.Ifthelistof(五)及时动态调整清单。法律、法规、规章草案拟新设或者调整行政许可的,起草部门应当充分研究论证,并在起草说明中专门作出说明;司法行政部门在草案审查阶段,应当征求同级审改牵头机构意见。行政许可正式实施前,有关部门应当提出调整行政许可事项清单的申请,审改牵头机构应当及时进行调整,行政许可实施机关做好实施前准备。因深化行政审批制度改革需要动态调整行政许可事项清单的,参照上述程序办理。上级清单作出动态调整的,下级清单要及时相应调整。(六)做好有关清单衔接。市场准入负面清单、政务服务事项基本目录、“互联网+监管”事项清单、投资项目审批事项清单、工程建设项目审批事项清单等中涉及的行政许可事项,应当严格与行政许可事项清单保持一致并做好衔接。行政许可事项清单调整的,有关清单要适时作出相应调整。健全审改牵头机构与其他清单主管部门的沟通协调机制,协同做好清单内容对接匹配。三、严格依照清单实施行政许可(七)科学制定行政许可实施规范。对清单内的行 政许可事项要逐项制定实施规范,结合实施情况确定子 项、办理项,明确许可条件、申请材料、中介服务、审批 程序、审批时限、收费、许可证件、数量限制、年检年报 等内容,并向社会公布。法律、行政法规、国务院决定设 定的行政许可事项原则上由国务院有关部门制定实施规 范。对各地区实施规范存在差异、影响跨区域通办的事 项,国务院有关部门要研究提出解决方案,制定衔接办 法。地方性法规、省级政府规章设定的行政许可事项,由 省级、设区的市级人民政府有关部门制定实施规范。administrativelicensingitemsisadjusted,correspondingadjustmentsshallbemadetotherelevantlistsinduetime.Themechanismforcommunicationandcoordinationbetweentheorganleadingtheapprovalsystemreformandthedepartmentsinchargeofotherlistsshallbeimproved,andtheyshallcooperateineffectivelyensuringtheconsistencyofthecontentsinthelists.III.Implementingadministrativelicensinginstrictaccordancewiththelist(7) Thespecificationsfortheimplementationofadministrativelicensingitemsshallbedevelopedinascientificmanner.Thespecificationsfortheimplementationofadministrativelicensingitemsinthelistshallbedevelopeditembyitem,subitemsanditemsforhandlingshallbedeterminedinlightoftheimplementation,suchcontentsasthelicensingconditions,applicationmaterials,intermediaryservices,approvalprocedures,timelimitforapproval,charges,licensingcertificates,quantitylimit,annualinspectionandannualreportsshallbespecifiedandannouncedtothepublic.Inprinciple,thespecificationsfortheimplementationofadministrativelicensingitemsdeterminedbylaws,administrativeregulations,ordecisionsoftheStateCouncilshallbedevelopedbytherelevantdepartmentsoftheStateCouncil.Fortheitemswhicharesubjecttodifferentspecificationsforimplementationindifferentregionssothatcross-regionalhandlingisaffected,therelevantdepartmentsoftheStateCouncilshalloffersolutionsafterresearchandformulatecompatibilitymeasures.Fortheadministrativelicensingitemssetforthinlocalregulationsandprovincialgovernmentrules,therelevantdepartmentsofpeople'sgovernmentsofprovincesanddistrictedcitiesshalldevelopthespecificationsfortheimplementationofadministrativelicensingitems.(A)依法依规实施行政许可。行政许可实施机关 要依照行政许可实施规范制定办事指南,并向社会公布。 办事指南一经公布,必须严格遵照执行,不得随意增加许 可条件、申请材料、中介服务、审批环节、收费、数量限 制等,不得超时限办理行政许可,但可以作出有利于行政 相对人的合理优化调整。在严格执行办事指南的同时,各 地区、各部门要按照政务服务标准化、规范化、便利化要 求,通过推行告知承诺、集成服务、一网通办、跨省通办 等改革措施,更好满足企业和群众办事需求。(九)严肃清查整治变相许可。各地区、各部门要 严格落实清单之外一律不得违法实施行政许可的要求,大 力清理整治变相许可。在行政许可事项清单之外,有关行 政机关和其他具有管理公共事务职能的组织以备案、证(8) Administrativelicensingshallbeimplementedinaccordancewithlawsandregulations.Administrativelicensingimplementingorgansshalldeveloptheservicemanualsaccordingtothespecificationsfortheimplementationofadministrativelicensingitemsandmakethemavailabletothepublic.Onceservicemanualsarepublished,theymustbestrictlyfollowedandimplemented,nolicensingconditions,applicationmaterials,intermediaryservices,approvalprocesses,charges,andquantitylimit,amongothers»maybeaddedarbitrarily,administrativelicensingshallnotbehandledbeyondthetimelimit,butreasonableoptimizationandadjustmentswhichareconducivetotheadministrativecounterpartmaybemade.Whilestrictlyimplementingservicemanuals,allregionsanddepartmentsshall,accordingtotherequirementsforprovidingstandardized,well-regulated,andconvenientgovernmentservices,satisfytheservicerequirementsofenterprisesandthepeoplebysuchreformmeasuresaspromotingthenotificationandcommitment,integratedservices,accesstoservicesviaasinglewebsite,andhandlingaffairsacrossprovinces.(9) 1.icensingindisguiseshallbestrictlyreviewedandrectified.Allregionsanddepartmentsshallstrictlyimplementtherequirementthatnoadministrativelicensingshallbeillegallygrantedbeyondthelist,andlicensingindisguiseshallbevigorouslyreviewedandrectified.Forthemattersnotincludedinthelistofadministrativelicensingitems,iftherelevantadministrativeauthoritiesandotherorganizationswiththefunctionsofmanagingpublicaffairsrequire,inthenameofrecordation,certification,catalogue,plan,planning,designation,accreditation,andannualinspection,amongothers,thatadministrativecounterpartsmaynotengageincertainactivitiesuntiltheirapplicationsareapproved,suchrequirementsshallbedeterminedaslicensingindisguise,andcorrectiveactionshallbetakenthroughceasingtheimplementation,adjustingtheimplementationmethods,andimprovingthebasisfordetermination,amongothers.IV.Strengtheningexante,interim,andexpostregulationoftheentirechaininallfields(10) Regulatorjzprioritiesshallbespecifiedbyrelyingonthelist.Thelistofadministrativelicensingitemsistheimportantbasisforimprovingtheexante,interim,andexpostregulationoftheentirechaininallfields.Fortheitemsincludedinthelist,allregionsanddepartmentsshallfullyassesstheactualconditionsandpotentialrisks,scientificallyraterisks,specifythekeyregulatorylinks,andimplementpertinentanddifferentiatedregulatorypoliciestoenhancetheaccuracyandeffectivenessofregulation.Inparticular,keyfieldsthatdirectlyinvolvepublicsecurityandpublichealthandthosewithgreatpotentialrisksandhighsocialrisksshallbesubjecttokeyregulationinaccordancewiththeapplicablelawsandregulationsandthebottomlineofqualityandsafetyshallbefirmlyguarded.RegUIatOrymatterscorrespondingtotheadministrativelicensingitemsshallbeincludedinthedynamicmanagementsystemforregulatoryitemsofthe“Internetand明、目录、计划、规划、指定、认证、年检等名义,要求行政相对人经申请获批后方可从事特定活动的,应当认定为变相许可,要通过停止实施、调整实施方式、完善设定依据等予以纠正。四、加强事前事中事后全链条全领域监管(十)依托清单明确监管重点。行政许可事项清单是完善事前事中事后全链条全领域监管的重要基础。对列入清单的事项,各地区、各部门要充分评估实际情况和风险隐患,科学划分风险等级,明确监管重点环节,实施有针对性、差异化的监管政策,提升监管的精准性和有效性。其中,对直接涉及公共安全、公众健康,以及潜在风险大、社会风险高的重点领域,要依法依规重点监管,守牢质量和安全底线。与行政许可事项对应的监管事项,要纳入“互联网+监管”平台监管事项动态管理系统。Regulationplatform.(11) Theregulatorsforeachiteminthelistshallbespecified.Regulatorsshallbedeterminedinstrictaccordancewithlaws,regulations,andtheprovisionsonthedeterminationofmainfunctions,structure,andstaffing.Ifregulatorydutiesarenotspecifiedinlaws,regulations,andtheprovisionsonthedeterminationofmainfunctions,structure,andstaffing,regulatorsshallbedeterminedundertheprinciplethattwhoevergrantsapprovalshallberesponsibleforregulation,andwhoeverisinchargeshallberesponsibleforregulation*'.Intheregionswherethereformofrelativelycentralizedadministrativelicensingpoweriscarriedout,regulatorydutiesshallbedeterminedaccordingtothereformscheme.Withrespecttothemattersforwhichseveraldepartmentsjointlyassumeregulatoryduties,theindustrydepartmentshallconductcomprehensiveregulationtogetherwiththerelevantdepartments.Anydisputebetweentherelevantdepartmentsovertheregulatorshallbereportedtothepeople'sgovernmentatthesamelevelfordecision-making.(12)
