Guidingideology.GuidedbyXiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewEra,XiJinpingThoughtontheRuleofLawshallbethoroughlystudiedandimplemented;thespiritofthe20thCPCNationalCongressshallbefullyimplemented;thedecisivesignificanceofthetTwoEstablishments(establishmentofbothComradeXiJinping'scorepositionontheCPCCentralCommitteeandintheCPCasawholeandtheguidingroleofXiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewEra)''shallbedeeplyunderstood;thettFourConsciousnesses(maintainingpoliticalintegrity,thinkinginbig-pictureterms,followingtheleadershipcore,andkeepinginalignmentwiththecentralPartyleadership)5'shallbeenhanced,the“FourConfidences(confidenceinthepath,theory,system,andcultureofsocialismwithChinesecharacteristics)shallbebolstered,andthettTwoUpholds(resolutelyupholding提升行政执法质量三年行动计划(20232025年)行政执法是行政机关履行政府职能、管理经济社会事务的重要方式,行政执法质量直接关系法治政府建设成效。为深入贯彻落实法治政府建设实施纲要(20212025年),全面提升行政执法质量和效能,制定本计划。一、总体要求(一)指导思想。以习近平新时代中国特色社会主义思想为指导,深入学习贯彻习近平法治思想,全面贯彻落实党的二十大精神,深刻领悟“两个确立”的决定性意义,增强“四个意识"、坚定'四个自信”、做到“两个维护”,以提升行政执法质量和效能为目标,着力提高行政执法队伍能力素质,规范行政执法行为,完善行政执法体制机制,强化行政执法监督问责,全面推进严格规范公正文明执法,防止不作为乱作为,更好保护人民群众合法权益,维护公平竞争市场秩序,加快推进法治政府建设。GeneralSecretaryXiJinping'scorepositionontheCPCCentralCommitteeandintheCPCasawholeandresolutelyupholdingtheCPCCentralCommittee'sauthorityanditscentralizedandunifiedleadership)“shallbeachieved;andwiththeobjectiveofimprovingthequalityandefficiencyofadministrativelawenforcement,effortsshallbeconcentratedonimprovingthecapabilitiesandqualityofadministrativelawenforcementteams,regulatingadministrativelawenforcementacts,improvingtheadministrativelawenforcementsystemsandmechanisms,andenhancingadministrativelawenforcementsupen,isionandaccountabilitytocomprehensivelypromotestrict,procedure-based,impartial,andcivillawenforcement,preventnonfeasanceandmalfeasance,belterprotectthelegitimaterightsandinterestsofthepeople,maintainthemarketorderoffaircompetitionandacceleratethebuildingalaw-basedgovernment.(二)工作原则。坚持党的领导,把坚持和加强党的领导 贯穿于行政执法工作的全过程和各方面。坚持执法为民, 努力让人民群众在每一个执法行为中都能看到风清气正、 从每一项执法决定中都能感受到公平正义。坚持问题导 向,聚焦重点领域行政执法中存在的突出问题,查找根 源,切实解决。坚持注重实效,立足基层行政执法实际, 增强措施的针对性和实效性,稳步提升行政执法质量。坚 持统筹协调,着力增强系统性、整体性、协同性,推动行 政执法与政府管理其他各项工作协调发展。2. Workingprinciples.TheParty'sleadershipshallbeadheredtobeupheldandbestrengthenedthroughoutthewholeprocessandinallaspectsofadministrativelawenforcement.Lawenforcementforthegoodofthepeopleshallbeadheredto,andeffortsshallbemadetoenablethepeopletoseeintegrityineverylawenforcementactandfeelfairnessandjusticeineverylawenforcementdecision.Beingproblem-orientedshallbeadheredto,andfocusshallbeputonprominentproblemsinadministrativelawenforcementinkeyfieldsandtherootcausesthereofshallbefoundtoeffectivelysolvethem.Actualeffectsshallbealwayshighlighted,andbasedontheactualcircumstancesofgrassrootsadministrativelawenforcement,thepertinenceandactualeffectivenessofmeasuresshallbeenhanced,andthequalityofadministrativelawenforcementshallbesteadilyimproved.Overallplanningandcoordinationshallbeadheredto,andeffortsshallbeconcentratedonenhancingsystemicnature,integrityandcoordinationtoadvancethecoordinateddevelopmentofadministrativelawenforcementandallotherworkmanagedbythegovernment.3. Mainobjectives.Bytheendof2025,prominentproblemsinadministrativelawenforcementshallbeeffectivelyaddressed,theadministrativelawenforcementworkingsystemshallbefurtherimproved,thequalityofadministrativelawenforcementteamsshallbesignificantlyenhanced,theadministrativelawenforcementsupervisionmechanismandcapacitybuildingshallbeeffectivelyreinforced,theinformatizationanddigitalizationlevelofadministrativelawenforcementshallbefurtherenhanced,andthequalityandefficiencyofadministrativelawenforcementshallbesignificantlyimproved,theauthorityandcredibilityofadministrativelawenforcementshallbegreatlyenhanced,andthepeople'ssatisfactionwithadministrativelawenforcementshallbeimprovedsignificantly.II.KeyTasks1.Comprehensivelyimprovingthecapabilitiesandqualityofadministrativelawenforcementpersonnel(1) Concentratingeffortsonimprovingpoliticalcapabilities.TheadministrativelawenforcementauthoritiesatalllevelsshallgivetopprioritytotheenhancementoftheParty,spoliticalbuilding,effectivelyimplementXiJinpingThoughtontheRuleofLaw,firmlysupportthe“TwoEstablishments(三)主要目标。到2025年底,行政执法突出问题得到有效整治,行政执法工作体系进一步完善,行政执法队伍素质明显提升,行政执法监督机制和能力建设切实强化,行政执法信息化、数字化水平进一步提升,行政执法质量和效能显著提高,行政执法的权威性和公信力有力增强,人民群众对行政执法的满意度大幅上升。二、重点任务(一)全面提升行政执法人员能力素质1.着力提高政治能力。各级行政执法机关要把加强党的政治建设放在首位,切实践行习近平法治思想,坚定拥护“两个确立”、坚决做到“两个维护”,正确把握政治方向,严格遵守政治纪律,加强政治历练,积累政治经验,andresolutelyachievethe“TwoUpholds/'keeptothecorrectpoliticaldirection,strictlyabidebythepoliticaldisciplines,strengthenpoliticaltesting,andaccumulatepoliticalexperiencelocontinuouslyimprovethecapacityforpoliticaljudgment,thinking,andimplementation.TheyshallstrengthenthebuildingofPartyorganizationsofgrassrootsadministrativelawenforcemententities,andmaximizetheleadingroleofPartybuilding.Further,theyshallboostadministrativelawenforcementteamstobemorerevolutionary,standardized,specializedandprofessional,andcontinuouslyimprovetheabilities,qualityandcompetenceofeffectivelyconductingadministrativelawenforcementsoastoachievetheeffectiveunityofpolitical,legal,andsocialeffectsofadministrativelawenforcement.(2) Vigorouslyimprovingprofessionalcompetence.Astandardizedandinstitutionalizedtrainingmechanismforadministrativelawenforcementshallbeestablishedandimproved,classifiedandmulti-leveltrainingsshallbeconducted,anditshallbeensuredthateachadministrativelawenforcementofficerreceivenotlessthan60classhoursoftrainingsonlegalknowledge,businessknowledgeandadministrativelawenforcementskillsperyearonthebasisofcompletingpoliticaltheoryeducationandPartyspiriteducation.Inprinciple,therotationaltrainingsofallmembersofadministrativelawenforcementteamsofallregionsanddepartmentsshallbecompletedbeforeJune2024.Thestandardizationoflawenforcementactivitiesandprofessionalethiceducationshallbestrengthened.ThejudicialadministrativedepartmentoftheStateCouncilshallpromotetheconstructionofanationalstandardizationsystemforthe不断提高政治判断力、政治领悟力、政治执行力。加强基层行政执法单位党组织建设,充分发挥党建引领作用。推进行政执法队伍的革命化、正规化、专业化、职业化建设,持续提升做好行政执法工作的能力素养和本领,实现行政执法工作政治效果、法律效果和社会效果的有机统2.大力提升业务能力。建立健全行政执法标准化制度化培训机制,开展分类分级分层培训,在完成政治理论教育和党性教育学时的基础上,确保行政执法人员每人每年接受不少于60学时的公共法律知识、业务知识和行政执法技能培训,原则上于2024年6月前完成对本地区、本部门行政执法队伍的全员轮训。加强执法行为规范和职业道德教育。国务院司法行政部门要推进全国行政执法人员培训标准化体系建设。国务院有关部门要研究制定本系统行政执法人员的专门业务培训计划。上级业务部门要加强对下级业务部门培训工作的指导,乡镇、街道综合执法人员要参加上级有关业务部门组织的培训,对承担多个部门行政执法事项人员的培训,鼓励跨部门联合开展。培训工作务求实效,坚决避免各种形式主义,切实提升一线执法人员运用法治思维和法治方式开展执法、维护稳定、化解矛盾的能力。3.切实加强全方位管理。严格落实行政执法人员资格管理 和持证上岗制度,未取得行政执法证件的人员不得独立从 事行政执法工作。全面落实行政执法责任制,健全完善行 政执法人员年度考核制度。建立健全行政执法人员退出机 制,对不符合执法要求的行政执法人员要依法暂扣、收回 或者注销其行政执法证件。人民警察证件的管理使用按照 人民警察法的规定执行。按照国家有关规定对在行政执法 中做出突出贡献的集体和个人给予表彰奖励,推进示范创 建活动。trainingofadministrativelawenforcementpersonnel.RelevantdepartmentsoftheStateCouncilshallresearchanddevelopspecializedbusinesstrainingplansforadministrativelawenforcementpersonneloftheirrespectivesectors.Businessdepartmentsathigherlevelsshallstrengthentheguidanceonthetrainingsorganizedbybusinessdepartmentsathigherlevels,comprehensivelawenforcementpersonneloftowns,townshipsandsub-districtsshallparticipateintrainingsorganizedbyrelevantbusinessdepartmentsathigherlevels,andinter-departmentjointtrainingsofpersonnelresponsibleforadministrativelawenforcementmattersofmultipledepartmentsshallbeencouraged.Greateffortsshallbemadetoenabletrainingstodeliversolidresults,allkindsofformalismshallberesolutelyavoided,andfront-linelawenforcementpersonnel'scapabilitiesofemployinglaw-basedthinkingandapproachestolawenforcement,maintainingstability,andresolvingconflictsshallbeeffectivelyenhanced.(3) Effectivelystrengtheningall-roundmanagement.Therulesonqualificationmanagementandemploymentwithcertificatesforadministrativelawenforcementpersonnelshallbestrictlyimplemented,andthepersonnelwhohavenotobtainedanadministrativelawenforcementcertificatearenotallowedtoengageinadministrativelawenforcementworkindependently.Theadministrativelawenforcementresponsibilitysystemshallbecomprehensivelyimplemented,andtheannualassessmentrulesforadministrativelawenforcementpersonnelshallbeimproved.Thewithdrawalmechanismforadministrativelawenforcementpersonnelshallbeestablishedandimproved,andtheadministrativelawenforcementpersonnelwhodonotmeetthelawenforcementrequirementsshallhavetheiradministrativelawenforcementcertificatestemporarilywithheld,withdrawnorcanceledinaccordancewiththelaw.Themanagementanduseofcertificatesofthepeople'spoliceshallbegovernedbytheprovisionsofthePeople'sPoliceLaw.Thecollectivesandindividualsthathavemadeoutstandingcontributionsinadministrativelawenforcementshallbecommendedandrewardedinaccordancewithrelevantprovisionsissuedbythestate,anddemonstrationandbuildingcampaignsshallbepromoted.2. Comprehensivelypromotingstrict,standardized,fairandcivilizedlawenforcement(1) Vigorouslyaddressingtheprominentproblemsinadministrativelawenforcement.Focusshallbeputontheissueofnonfeasanceandmalfeasance,whichareofgreatconcerntothepeople,suchascampaign-stylelawenforcement,4kone-size-fits-al,lawenforcement,simplisticandrudelawenforcement,brutallawenforcement,excessivelawenforcement,mechanicallawenforcement,andprofit-seekinglawenforcement,andspecialrectificationandsupervisionactionsshallbeconducted.Therelevantdepartmentsofallregionsshallcompilealistofprominentproblemsinvariousadministrativelawenforcementfieldsofthelocalregionsbeforetheendof2023,organizeandconductspecialrectificationactionsingoodtimebasedonthelists,andsubmitthespecialrectificationactionstothejudicialadministrativedepartmentsatthesamelevelforstatisticalpurposes.ThespecialrectificationofprominentadministrativelawenforcementproblemsofthedepartmentsoftheStateCouncilthataresubjecttoverticalmanagementorthedualleadership(二)全面推进严格规范公正文明执法1.强力整治行政执法突出问题。聚焦人民群众反映强烈的运动式执法、“一刀切”执法、简单粗暴执法、野蛮执法、过度执法、机械执法、逐利执法等不作为乱作为问题,开展专项整治和监督行动。各地区有关部门要于2023年底前梳理形成本地区各行政执法领域的突出问题清单,并对照清单适时组织开展专项整治行动,专项整治情况报送本级司法行政部门汇总。实行垂直管理或者双重领导并以上级单位领导为主的国务院部门的行政执法突出问题专项整治情况,由垂直管理或者双重领导并以上级单位领导为主部门汇总后报送国务院司法行政部门。2024年底前,由国务院司法行政部门牵头,组织有关地方和部门对各地区专项整治情况开展专项监督,并将专项监督情况向国务院报告。dominatedbysuperiorauthoritiesshall,afterbeingsummarizedbythedepartmentssubjecttoverticalmanagementorthedualleadershipdominatedbysuperiorauthorities,besubmittedtoIhejudicialadministrativedepartmentoftheStateCouncil.Beforetheendof2024,thejudicialadministrativedepartmentoftheStateCouncilshalltaketheleadandorganizerelevantlocalitiesanddepartmentstoconductspecialsupen,isionofthespecialrectificationsconductedbyallregions,andreportthespecialSUPerViSiOnStotheStateCouncil.2.建立健全行政执法标准规范。全面落实行政裁量权基准 制度,加强行政裁量权基准的动态管理和备案审查。2023 年底前普遍建立行政裁量权基准制度。国务院司法行政部 门要会同有关部门围绕行政处罚、行政检查、行政强制等 执法种类,分批制定统一的行政执法文书基本格式标准, 研究制定行政执法装备配备标准及技术规范指引。3.完善行政执法工作机制。严格行政执法程序,全面落实 行政执法公示制度、执法全过程记录制度、重大执法决定 法制审核制度。依法健全以信用为基础的新型执法机制,(2) Establishingandimprovingadministrativelawenforcementstandardsandnorms.Theadministrativediscretionbenchmarksystemshallbecomprehensivelyimplemented,andthedynamicmanagementandrecordationreviewofadministrativediscretionbenchmarksshallbestrengthened.Theadministrativediscretionbenchmarksystemshallbegenerallyestablishedbeforetheendof2023.ThejudicialadministrativedepartmentoftheStateCouncilshall,inconjunctionwithrelevantdepartmentsandbycenteringonadministrativepenalties,administrativeinspections,administrativecompulsionandotherlawenforcementcategories,developunifiedbasicformatsforadministrativelawenforcementdocumentsinbatches,researchanddeveloptheallocationstandardsandtechnicalspecificationguidelinesforadministrativelawenforcementequipment.(3) Improvingtheworkingmechanismforadministrativelawenforcement.Strictadministrativelawenforcementproceduresshallbeimplemented,andtheadministrativelawenforcementpublicitysystem,theentirelawenforcementprocessrecording规范涉企行政检查,完善联合检查、“双随机、一公开” 监管、非现场执法等工作机制,推动监管信息共享互认, 避免多头执法、重复检查;对直接涉及公共安全和人民群 众生命健康等的特殊行业、重点领域,依法依规实行全覆 盖的重点监管。综合运用多种方式督促引导受处罚企业加 强合规管理、及时整改违法问题,防止以罚代管。探索建 立涉企行政执法案件经济影响评估制度,依法降低行政执 法对企业的负面影响。完善涉民营企业行政执法违法行为 投诉举报处理机制,依法保护民营企业和企业家权益。(三)健全完善行政执法工作体系system,andthelegalreviewsystemformajorlawenforcementdecisionsshallbefullyimplemented.Newcredit-basedlawenforcementmechanismsshallbeimprovedinaccordancewiththelaw;enterprise-relatedadministrativeinspectionsshallberegulated;theworkingmechanismsforjointinspections,theregulationOf“randomselectionofthoseforinspectionandrandomselectionofinspectorsaswellaspublicdisclosure/'andoff-sitelawenforcementshallbeimproved;thesharingandmutualrecognitionofregulationinformationshallbepromoted;andduplicatelawenforcementandrepeatedinspectionsshallbeavoided.Withrespecttospecialindustriesandkeyfieldsthatdirectlyinvolvepublicsecurityandpeople,slivesandhealth,keyregulationwithfullcoverageshallbeconductedinaccordancewiththelaw.Thepunishedenterprisesshallbesupervisedandguidedinstrengtheningcompliancemanagementandrectifyingtheirviolationsofregulationsinatimelymannerbycomprehensivelyadoptingavarietyofmethodstopreventreplacingmanagementwithpenalty.Theestablishmentoftheeconomicimpactassessmentsystemforadministrativelawenforcementcasesinvolvingenterprisesshallbeexploredtoreducethenegativeimpactsofadministrativelawenforcementonenterprisesinaccordancewiththelaw.Themechanismforhandlingcomplaintsandreportsab
