WeapprovetheWorkPlantoSupportBeijinginPursuingtheInitiativefortheNationalComprehensiveDemonstrationZOneforFurtherOpening-upoftheSerViCeSector.PleasediligentlyorganizetheimplementationoftheWorkPlan.国务院关于支持北京深化国家服务业扩大开放综合示范区建设工作方案的批复(国函(2023)130号)北京市人民政府、商务部:你们关于支持北京深化国家服务业扩大开放综合示范区建设的请示收悉。现批复如下:一、原则同意支持北京深化国家服务业扩大开放综合示范区建设工作方案(以下简称工作方案),请认真组织实施。II. InimplementingtheWorkPlan,youshallfollowtheguidanceofXiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewEra,comprehensivelyapplytheguidingprinciplesofthe20thCPCNationalCongress,andupholdtheunderlyingprincipleofpursuingprogresswhileensuringstability,asdirectedbythedecisionsandarrangementsoftheCPCCentralCommitteeandtheStateCouncil.Youshallfullyandfaithfullyapplythenewdevelopmentphilosophyonallfronts,fosteranewdevelopmentdynamic,promotehigh-qualitydevelopment,adoptaholisticapproachtoboththedomesticandinternationalsituations,andaligndevelopmentandsecurity.Leveragingtheadvantagesofourvastmarket,youshallenhancethequalityandleveloftradeandinvestmentcooperationintheservicesector,steadilyexpandopeningbasedonrules,regulations,management,standards,andotherinstitutions,andexplorealignmentwithinternationalhigh-standardeconomicandtraderules.Bydoingso,youshallcontributetohigh-levelopening-upandthecomprehensivelybuildingofamodemsocialistcountry.III. ThePeople'sGovernmentofBeijingMunicipalityshall,basedonthestrategicpositioningofthecapitalcity,servemajornationalstrategies,andorganizeanddirecttheimplementationoftheWorkPlan.Conditionaloncontrollablerisks,itshallensureprudentorganizationandboldexperimentation,pursuingtheInitiativefortheNationalComprehensiveDemonstrationZoneforFurtherOpening-upoftheSerViCeSector.Additionally,itshallgainmorereplicableandpronotableexperienceindevelopingasystem二、工作方案实施要以习近平新时代中国特色社会主义思想为指导,全面贯彻落实党的二十大精神,按照党中央、国务院决策部署,坚持稳中求进工作总基调,完整、准确、全面贯彻新发展理念,构建新发展格局,推动高质量发展,更好统筹国内国际两个大局,推动发展和安全深度融合,充分发挥我国超大市场优势,提升服务领域贸易投资合作质量和水平,稳步扩大规则、规制、管理、标准等制度型开放,开展对接国际高标准经贸规则先行先试,为推进高水平对外开放、全面建设社会主义现代化国家作出贡献。三、北京市人民政府要立足首都城市战略定位,服务国家重大战略,加强对工作方案实施的组织领导,在风险可控的前提下,精心组织,大胆实践,深化国家服务业扩大开放综合示范区建设,在努力构建高标准服务业开放制度体系、建设现代化产业体系等方面取得更多可复制可推广的经验,更好为全国服务业开放创新发展发挥引领作用。四、国务院有关部门要按照职责分工,积极支持北京 深化国家服务业扩大开放综合示范区建设。商务部要会同 有关部门加强指导和协调推进,组织开展督促和评估工 作,确保工作方案各项改革开放措施落实到位。五、需要暂时调整实施相关行政法规、国务院文件和 经国务院批准的部门规章的部分规定的,按规定程序办 理。国务院有关部门要根据工作方案相应调整本部门 制定的规章和规范性文件。工作方案实施中的重大问 题,北京市人民政府、商务部要及时向党中央、国务院请 示报告。附件:支持北京深化国家服务业扩大开放综合示范区建设工作方案国务院forhigh-levelopening-upoftheservicesectorandamodemindustrialsystem,amongothers.Bydoingso,itshallleadtheopen,innovativedevelopmentoftheservicesectornationwide.IV. RelevantdepartmentsoftheStateCouncilshall,withintheirpurview,supportBeijinginpursuingtheInitiativefortheNationalComprehensiveDemonstrationZoneforFurtherOpening-upoftheSen,iceSector.TheMinistryofCommerceshall,inconjunctionwithrelevantdepartments,provideguidanceandcoordination,andorganizesupervisionandassessments,ensuringtheeffectiveimplementationofallreformandopening-upmeasuresoutlinedintheWorkPlan.V. GuidingideologyGuidedbyXiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewEra,wewillcomprehensivelyapplytheguidingprinciplesofthe20thCPCNationalCongress,andupholdtheunderlyingprincipleofpursuingprogresswhileensuringstability.Wewillfullyandfaithfullyapplythenewdevelopmentphilosophyonallfronts,fosteranewdevelopmentdynamic,promotehigh-qualitydevelopment,adoptaholisticapproachtoboththedomesticandinternationalsituations,andaligndevelopmentandsecurity.Leveragingtheadvantagesofourvastmarket,basedonthe支持北京深化国家服务业扩大开放综合示范区建设工作方案为贯彻落实党中央、国务院关于支持北京深化国家服务业扩大开放综合示范区(以下简称综合示范区)建设的决策部署,促进服务业高水平开放、高质量发展,特制定本工作方案。一、总体要求(一)指导思想以习近平新时代中国特色社会主义思想为指导,全面贯彻落实党的二十大精神,坚持稳中求进工作总基调,完整、准确、全面贯彻新发展理念,构建新发展格局,推动高质量发展,更好统筹国内国际两个大局,推动发展和安全深度融合,充分发挥我国超大市场优势,立足首都城市战略定位,深化综合示范区建设,更好发挥对全国服务业开放创新发展的引领作用,提升服务领域贸易投资合作质量和水平,稳步扩大规则、规制、管理、标准等制度型开放,为推进高水平对外开放、全面建设社会主义现代化国家作出贡献。(二)基本原则strategicpositioningofthecapitalcity,wewillpursuetheDemonstrationZoneInitiative,betterguidetheopen,innovativedevelopmentoftheservicesectornationwide,enhancethequalityandleveloftradeandinvestmentcooperationintheservicesector,andsteadilyexpandopeningbasedonrules,regulations,management,standards,andotherinstitutions.Bydoingso,wewillcontributetohigh-levelopening-upandthecomprehensivelybuildingofamodemsocialistcountry.2. Basicprinciples坚持守正创新。坚持和加强党的全面领导,坚持社会主义 市场经济改革方向,坚持高水平对外开放。围绕综合示范 区建设目标任务,持续开展更大范围、更宽领域、更深层 次服务业开放探索,激发市场活力和社会创造力,促进现 代化建设成果更多更公平惠及全体人民,服务经济社会发 展大局。强化示范引领。聚焦制度创新,立足服务业开放创新发展 实际,精准对接国际高标准经贸规则,加强服务领域规则 建设,探索更多可复制可推广的经验,构建高标准服务业 开放制度体系,更好发挥对全国服务业开放创新发展的引 领作用。立足北京“四个中心”功能定位,加快要素合理 流动和高效集聚,构建京津冀协同发展的高水平对外开放Keepingtotherightpathandmakinginnovations:WewillupholdandstrengthentheoverallleadershipoftheParty,adheretothedirectionofreformtowardsasocialistmarketeconomy,andmaintainhigh-levelopening-up.InlinewiththegoalsandtasksoftheDemonstrationZoneInitiative,wewillconsistentlyexplorethebroader,moreextensive,anddeeperopening-upoftheservicesector.Thisisintendedtounleashmarketvitalityandsocialcreativity,promotethefairandwidespreadbenefitsofmodernizationforallpeople,andcontributetotheoveralldevelopmentoftheeconomyandsociety.Strengtheningdemonstrationandleadership:Withafocusoninstitutionalinnovationandinlinewiththeactualopen,innovativedevelopmentoftheservicesectorandinternationalhigh-standardeconomicandtraderules,wewilldeveloprules,explorereplicableandpromotableexperience,andestablishahigh-standardsystemforopeninguptheservicesector.Thiswillguidetheopen,innovativedevelopmentoftheservice平台,打造全国高质量发展的新动力源,推动形成优势互 补、高质量发展的区域经济布局。深化系统集成。服务现代化产业体系建设,坚持系统思维 和问题导向,统筹政策与服务、准入与准营、“边境上” 与“边境后”、贸易投资与人才智力引进,推进服务业全 产业链、全环节改革开放,优化产业发展整体生态。深化 电信、健康医疗、金融、文化教育、专业服务等优势产 业、重点行业改革开放,培育新兴业态,丰富应用场景, 拓展发展路径,构建优质高效的服务业新体系,塑造国际 合作和竞争新优势。加强风险防控。牢固树立总体国家安全观,统筹发展和安全,着力构建高效协同的服务业监管体系、保障产业安全sectornationwide.BasedonthefunctionalpositioningofBeijingasa"four-prongedcenter"(anationalpolitical,cultural,internationalexchange,andscienceandtechnologyinnovationcenter),wewillestablishahigh-levelopening-upplatformforthecoordinateddevelopmentofBeijing,Tianjin,andHebei.Thisaimstoensurethereasonableflowandefficientconcentrationofresources,creatinganationalsourceofimpetusforhigh-qualitydevelopment.Additionally,itwillshapearegionaleconomiclayoutcharacterizedbycomplementarystrengthsandhigh-qualitydevelopment.Integratingsystems:ToSerVethedevelopmentofamodemindustrialsystem,wewillemploysystematicthinkingandaproblem-orientedapproach.Thisinvolvescoordinatingpoliciesandservices,marketaccessandpermissionforoperations,activitiesaltheborderandthosebeyondtheborder,andtradeandinvestmentononesideandrecruitmentofskilledworkersontheother.Weaimtoreformandopenuptheentirechainandallaspectsoftheservicesector,optimizingtheoverallecosystemforindustrialdevelopment.Wewillcontinuetoreformandopenupadvantageousandkeyindustriessuchastelecommunications,healthcare,finance,culture,education,andprofessionalservices.Thisinvolvesfosteringemergingforms,enrichingapplicationscenarios,expandingdevelopmentpathways,andconstructingahigh-quality,efficientsystemfortheservicesector.Throughtheseefforts,weaimtogainadvantagesininternationalcooperationandcompetition.Preventingandcontrollingrisks:Wewillpursueaholisticapproachtonationalsecurity,balancingdevelopmentand的风险防控体系。坚持先立后破,制定完善重点产业开放 实施方案和监管措施,进一步完善文化、金融、生物、数 据流动等重点领域的风险评估预警机制及管控处置机制, 提升开放监管能力,增强风险防控能力,牢牢守住不发生 系统性区域性风险底线。二、主要任务(一)推进服务业重点领域深化改革扩大开放1.电信服务领域。研究建设国家新型互联网交换中心。在 北京取消信息服务业务(仅限应用商店,不含网络出版服 务)、互联网接入服务业务(仅限为用户提供互联网接入 服务)等增值电信业务外资股比限制,研究适时进一步扩 大增值电信业务开放。2.健康医疗服务领域。支持符合条件的外籍及港澳台医生在京开设诊所。探索对干细胞与基因领域医药研发企业外security.Ourfocusisonestablishinganefficient,collaborativeregulatorysystemforthesendeesectorandariskpreventionandcontrolsystemthatguaranteesindustrialsecurity.Followingtheprincipleofestablishingthenewbeforeabolishingtheold,wewilldevelopandimproveimplementationplansandregulatorymeasuresforopeningupkeyindustries.Wewillfurtherenhancemechanismsforassessing,warning,controlling,andaddressingrisksinkeyfieldssuchasculture,finance,biotechnology,anddataflow.Throughthesemeasures,wewillenhanceourcapabilitytoregulateopening-up,preventandcontrolrisks,andguardagainstsystemicregionalrisks.II.Maintasks1.Continuingthereformandopening-upofkeyfieldsintheservicesector.(1) Telecommunicationsservices.WewillresearchtheconstructionofnewnationalInternetexchangecenters.InBeijing,wewillremoveforeignstakerestrictionsonvalue-addedtelecommunicationsservices,suchasinformationservices(limitedtoappstores,excludingonlinepublishingservices)andInternetaccessservices(limitedtoInlemetaccessservicesforusers).Wewillalsoconsiderfurtheropeningupvalue-addedtelecommunicationsservicesinduetime.(2) Healthandmedicalservices.Wewillsupporteligibleforeign,HongKong,Macao,andTaiwandoctorsinestablishingclinicsinBeijing.Wewillexploremethodsofequityincentivesforforeign,HongKong,Macao,andTaiwanemployeesinpharmaceuticalR&Denterprisesinstemcellandgenefields.Wewillsupporteligiblemedicalinstitutionsinclinicaltrialsonstemcells,amongothers.Wewillsupportinternationalcooperationinresearchanddevelopmentofstemcellsandgenes.WewillfacilitatehumangeneticresourcemanagementservicesofHongKongandMacaoenterprisesinBeijing.Innovativemedicaldevices(excludinglargemedicalequipment)forwhichenterprisesregisteredinBeijinghaveobtainedmarketapprovalinChinamaybemarketedfordesignatedmedicalinstitutionsbasedonclinicalneeds.WewillsupporttheestablishmentofanexpeditedapprovalchannelinBeijingforurgentlyneededimportedmedicaldevices.Wewillpromotetheapplicationofreal-worlddatainresearchinthefieldofmedicaltechnology.Wewillestablishaninter-departmentalcoordinatedregulatorysystemthroughouttheprocessincutting-edgebiomedicinefields.Wewillacceleratetheriskassessmentandquarantineaccessforbovine-sourcedChinesemedicinalmaterials,suchasbezoar,fromcountries(regions)otherthanthosesubjecttobansformadcowdiseaseoutbreaks,soastoSerVethedevelopmentneedsofthetraditionalChinesemedicineandhealthindustry.InrelianceontheElectronicPrescriptionCenteroftheNationalUnifiedMedicalInsuranceInformationPlatform,prescriptionswillbecirculated.Wewillexploremodelsofjointdevelopmentandsharingofhealthandmedicaldata,andpursuethestandardizationandinter-hospitalopeningandexchangeofclinicalmedicaldata.Wewillcontinuetocarryoutthenationalcomprehensiveinnovationpilotprogramfortheconvalescentaidsindustry,promoteachievementsinthepilotprogramofcommunity-basedleasingofconvalescent籍及港澳台从业人员的股权激励方式。支持符合条件的医疗机构开展干细胞等临床试验。支持干细胞与基因研发国际合作。促进在京港澳企业人类遗传资源管理服务便利化。对在京注册企业在我国境内获得上市许可的创新药械(大型医用设备除外),在指定医疗机构根据临床需求“随批随进”。支持在京建立临床急需进口药械审批绿色通道。推动真实世界数据在医疗技术领域研究中的应用。建立生物医药前沿领域多部门全流程协同监管体系。加快无疯牛病疫情禁令国家(地区)牛黄等牛源性中药材风险评估和检疫准入,服务中医药健康产业发展需求。依托全国统一医保信息平台电子处方中心开展处方流转。探索健康医疗数据共建共享新模式,进一步加强临床医疗数据标准化和院际开放互通。深化康复辅助器具产业国家综合创新试点,推广康复辅助器具社区租赁试点成果,支持康复辅助器具研发运用对外合作,推动康复辅助器具产业发展。搭建中医药国际综合服务平台,建设中医药线上交易平台,支持企业开拓国际市场。以我国加入药品检查合作计划(PlC/S)等为契机,推动有条件的企业高质量参与共建“一带一路”等国际合作,助力创新药品“走出去”。3.金融服务领域。对境外金融机构、境外金融机构的投资 者、跨境金融服务提供者提交的要件完整且符合法定形式 的金融业务相关申请,金融管理部门按照内外一致原则, 在收到申请后120天内作出决定并及时通知申请人,如不 能如期作出决定,应立即通知申请人并争取在合理期限内 作出决定。探索支持保险资产管理公司在账户独立、风险 隔离的前提下,向境外发行合理规模的人民币计价的资产 管理产品。支持创业投资、股权投资机构与各类金融机构 开展市场化合作,依法依规为被投资企业提供融资服务。 在风险可控的前提下,探索建立不动产、股权等作为信托 Financialservices.Ifaforeignfinancialinstitution,aninvestorinaforeignfinancialinstitution,oracross-borderfinancialserviceprovidersubmitsacompleteandlegallyformattedapplicationrelatedtofinancialbusiness,thefinancialauthoritiesshall,undertheprincipleofnationaltreatment,makeadecisionwithin120daysofreceivingtheapplicationandpromptlynotifytheapplicant,orifadecisionisimpossiblewithintheperiod,immediatelyinformtheapplicantandmakeadecisionwithinareasonableperiod.WewillexplorewaysofsupportinginsuranceassetmanagementcompaniesinissuingreasonablysizedRMB-denominatedassetmanagementproductsoverseas,subjecttoindependentaccountsandisolatedrisks.Therewillbesupportformarket-orientedcooperationbetweenventurecapitalandequityinvestmentinstitutionsandvariousfinancialinstitutionstoprovidefinancingservicestoinvestedenterprisesinaccordancewithlawsandregulations.Subjecttocontrollablerisks,wewillexploretheestablishmentofaregistrationmechanismfortrustpropertysuchasrealestateandequities.(4) Culturalandeducationalservices.Wewillstudytheextensionoftaxpoliciesthatsupportculturalsystemreformandthedevelopmentofculturalenterprises.Wewill
