工业和信息化部关于印发无线电发射设备监督检查办法的通知(工信部无(2024)95号)相关省、自治区、直辖市工业和信息化主管部门,青海、宁夏无线电管理机构,国家无线电监测中心:现将无线电发射设备监督检查办法印发给你们,自无线电发射设备监督检查办法MeasuresfortheSupervisionandInspectionofRadioTransmittingEquipment制定抚关:工业和信息化部发文字号:工仅部无202495号公布日期:2024.05.20施行日期:2024.09.01效力0阶:部门规范性文件法规类别:无线电IssuingAuthority:Ministr)ofIndustrj'&InformationTechnologyDocumentNumberNo.952024oftheMinistryofIlus(r),andInformationTechnologyDateIssued:05-20-2024EffectiveDale:09-01-20241.evelofAuthorityDepamnenudRegulatoryDocumentsAreaof1.aw:RadioNoticebytheMinistryofIndustryandInformationTechnologyofIssuingtheMeasuresfortheSupervisionandInspectionofRadioTransmittingEquipment(No.952024oftheMinistryofIndustryandInformationTechnology)Thedepartmentsofindustryandinformationtechnologyofrelevantprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment;theradioregulatoryauthoritiesofQinghaiandNingxia;andtheStateRadioMonitoringCenter:TheMeasuresfortheSupervisionandInspectionofRadioTransmittingEquipmentareherebyissuedtoyouandshallcomeintoforceonSeptember1,2024.2024年9月1日起施行。MinistryofIndustryandInformationTechnology工业和信息化部May20.20242024年5月20日Annex:附件:MeasuresfortheSupervisionandInspectionofRadioTransmittingEquipment无线电发射设备监督检查办法ChapterIGeneralProvisions第一章总则Article1Forthepurposesofstrengtheningandregulatingthesupervisionandinspectionofradiotransmittingequipment,preventingandreducingharmfulinterferencefromthesource,maintainingtheorderofradiowavesintheair,andensuringthenormaloperationofvariousradioservices,theseMeasuresaredevelopedinaccordancewiththeAdministrative1.icensing1.awofthePeople'sRepublicofChina,theE-Commerce1.awofthePeople'sRepublicofChina,theRadioRegulationofthePeople'sRepublicofChina,theRegulationontheManagementofRadioTransmittingEquipment,andotherapplicablelaws,regulations,andrules.Article2TheseMeasuresshallapplytothesupervisionandinspectionoftheresearch,development,production,import,sales,andmaintenanceofradiotransmittingequipmentbytheradioregulatoryauthorityofthestateandradioregulatoryauthoritiesofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment(hereinaftercollectivelyreferredtoas"radioregulatoryauthorities").第一条为了加强和规范对无线电发射设备的监督检查,从源头上防止和臧少有害干扰,维护空中电波秩序,保证各项无线电业务的正常进行,根据中华人民共和国行政许可法中华人民共和国电子商务法中华人民共和国无线电管理条例无线电发射设备管理规定等法律、法规和规章,制定本办法。第二条国家无线电管理机构和省、自治区、直辖市无线电管理机构(以下统称无线电管理机构)对无线电发射设备研制、生产、进口、销售和维修环节实施监督检查,适用本办法。第三条国家无线电管理机构负责指导省、自治区、直辖市无线电管理机构开展无线电发射设备监督检查工作,并对各地开展的监督检查工作进行督查和考核评价。Article3Theradioregulatoryauthorityofthestateshallberesponsiblefordirectingradioregulatoryauthoritiesofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmenttoconductthesupervisionandinspectionofradiotransmittingequipment,andsupervise,assess,andevaluatethesupervisionandinspectionworkconductedinalllocalities.省、自治区、直辖市无线电管理机构依据职责或根据国家无线电管理机构要求,组织开展本行政区域内的无线电发射设备监督检查工作。Theradioregulatoryauthorityofaprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernmentshall,accordingtoitsdutiesorasrequiredbytheradioregulatoryauthorityofthestate,organizethesupervisionandinspectionofradiotransmittingequipmentwithinitsadministrativeregion.国家无线电监测中心和省、自治区、直辖市无线电监测站作为无线电管理技术机构,依据职责承担无线电发射设备监督检查的技术支撑工作。TheStateRadioMonitoringCenterandradiomonitoringstationsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentshall,asradioregulationtechnicalinstitutions,providetechnicalsupportforthesupervisionandinspectionofradiotransmittingequipmentaccordingtotheirduties.第四条无线电管理机构开展无线电发射设备监督检查,可以依据职责和工作需要,联合相关部门共同开展OArticle4Radioregulatoryauthoritiesmay,accordingtotheirdutiesandworkneeds,conductthesupervisionandinspectionofradiotransmittingequipmentjointlywithrelevantdepartments.第五条无线电发射设备监督检查工作应当遵循依法依规、权责清晰、分类实施、公平公正的原则。Article5Thesupervisionandinspectionofradiotransmittingequipmentshalladheretotheprinciplesofcompliancewithlawsandregulations,clearrightsandresponsibilities,classifiedimplementation,andfairnessandimpartiality.Article6Thesupervisionandinspectionofradiotransmittingequipmentaredividedintoroutineinspectionsandspecialinspections,androutineinspectionsshalltaketherandomselectionofbothinspectorsandinspectiontargetsandthepromptreleaseofresultsasthebasicmethodofroutineinspections.Theinspectionsoftheresearch,development,production,import,sale,andmaintenanceofradiotransmittingequipmentincludedintheannualinspectionplanareroutineinspections.Accordingtotherelevantworktaskarrangementsandrequirements,theinspectionsofspecificobjects,matters,orfieldsarespecialinspections.ChapterIlInspectionContentandRequirementsArticle7Radioregulatoryauthorities'inspectionsoftheresearchanddevelopment,production,andmaintenanceofradiotransmittingequipmentinclude:(1) whetherradiofrequenciesusedintheresearchanddevelopmentofradiotransmittingequipmentforsaleandusewithinChinacomplywiththeprovisionsofthestateontheallocationofradiofrequenciesandotherradioregulationprovisions;(2) whethermodelapprovalhasbeenobtainedfortheproductionofradiotransmittingequipment(excludingmicro-powershort-distanceradiotransmittingequipment)forsaleandusewithinChina,theindicationofthemodelapprovalcode,andwhethertheycomplywiththetechnicalindicatorsapprovedinthemodelapprovalcertificate;第六条无线电发射设备监督检查分为日常检查和专项检查,日常检查以“双陵机、一公开”为基本方式。对纳入年度检查计划的无线电发射设备研制、生产、进口、销售和维修环节的检查属于日常检查。根据相关工作任务部署和要求,针对特定对象、特定事项或特定领域开展的检查属于专项检查。第二章检查的内容和要求笫七条无线电管理机构对研制、生产和维修无线电发射设备的检查包括以下内容:(一)研制在国内销售、使用的无线电发射设备使用的无线电频率符合国家无线电频率划分规定及其他无线电管理有关规定的情况;(二)生产在国内销售、使用的无线电发射设备(除微功率短距离无线电发射设备外)取得型号核准的情况,标注型号核准代码的情况,符合型号核准证核定技术指标的情况;(3) whetherenterprisesthatproduceradio(三)生产在国内销售、使transmittingequipmentforsaleandusewithinChinahavethecorrespondingproductioncapacity,technicalstrength,andqualityassurancesystem;(4) whethertheproductionofmicro-powershortdistanceradiotransmittingequipmentforsaleandusewithinChinacomplieswiththeprovisionsofthestateonradioregulation;(5) whethertheradiotransmittingequipmentaftermaintenancecomplieswiththetechnicalindicatorsapprovedbythemodelapprovalcertificateoftheradiotransmittingequipment;and(6) whethermeasuresaretakentoeffectivelycurbtheemissionofradiowavesandavoidharmfulinterferencetoanyradiostationsetupandusedinaccordancewiththelawintheresearchanddevelopment,production,andmaintenanceofhigh-powerradiotransmittingequipment.SeeAnnex1forradioregulatoryauthorities'inspectionsoftheresearchanddevelopment,production,andmaintenanceofradiotransmittingequipment.Article8Radioregulatoryauthorities'inspectionsofimportedradiotransmittingequipmentinclude:用的无线电发射设备的企业具备相应的生产能力、技术力量、质量保证体系的情况;(四)生产在国内销售、便用的微功率短距离无线电发射设备符合国家无线电管理有关规定的情况;(五)维修之后的无线电发射设备,符合无线电发射设备型号核准证核定技术指标的情况;(六)研制、生产和维修大功率无线电发射设备的过程中,采取措施有效抑制电波发射,避免对依法设置、使用的无线电台(站)产生有害干扰的情况。无线电管理机构对研制、生产和维修无线电发射设备的检查内容参见附件K笫八条无线电管理机构对进口无线电发射设备的检查包括以下内容:(一)进口在国内销售、使用的无线电发射设备(除微功率短距离无线电发射设备外)取得型号核准的情况,(1) informationontheacquisitionofmodelapprovalfortheimportofradiotransmittingequipment(excludingmicro-powershort-distanceradiotransmittingequipment)forsaleandusewithinChina,theindicationofthemodelapprovalcode,标注型号核准代码的情况,在海关进行申报并办理通关手续的情况;andinformationondeclarationsmadeattheCustomsandthehandlingofcustomsclearanceformalities;and(二)进行体育比赛、科学实脸等活动,需要携带、寄递临时进关的,经无线电管理机构批准并凭批准文件办理通关手续的情况。(2) informationonthehandlingofcustomsclearanceformalitiesbasedontheapprovaldocumentsissuedbyradioregulatoryauthoritiesifitisnecessarytocarryorsendtemporarilyimportedradiotransmittingequipmentforsportscompetitions,scientificexperiments,andotheractivities.无线电管理机构对进口无线电发射设备的检查内容参见附件2。SeeAnnex2forthecontentsofinspectionsofimportedradiotransmissionequipmentconductedbyradioregulatoryauthorities.第九条无线电管理机构对销售无线电发射设备的检查依据无线电发射设备销售巡检工作制度开展,包括以下内容:Article9Theradioregulatoryauthorityshallinspectthesaleofradiotransmittingequipmentaccordingtotheworkrulesfortheroutineinspectionsofthesaleofradiotransmittingequipment,including:(一)销售的设备符合国家无线电管理有关规定的情况,销售应当取得型号核准而未取得型号核准的无线电发射设备的情况,违法违规销售“黑广播”、“伪基站”、无线电屏蔽器、干扰器、无人驾驶航空器无线电反制设备、无线电考试作弊设备等无线电发射设备的情况;(1) thecomplianceofequipmentsoldwiththeprovisionsofthestateonradioregulation,thesaleofradiotransmittingequipmentforwhichmodelapprovalshouldhavebeenobtained,thesaleofillegalradios,fakebasestations,radiojammers,interferencedevices,counter-unmannedaircraftsystems,radiocheatingdevicesinexams,andotherradiotransmittingequipmentinviolationofanylaworregulation;(二)销售伪造、冒用型号核准代码的无线电发射设备(2) thesaleofradiotransmittingequipmentwithforgedorcounterfeitmodelapprovalcodes;and的情况:(3)whoeversellsradiotransmittingequipmentrequiringmodelapprovalshallundergotheformalitiesforsalesrecordationwiththeradioregulatoryauthorityofaprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernment,indicatetheinformationonthemodelapprovalcodeasrequired,andindicatethenumberoftherecordationpartyorthecorrespondingtwo-dimensionalcodeatthephysicalbusinesspremisesorontheonlinesalesplatform.(三)销售应当取得型号核准的无线电发射设备,向省、自治区、直辖市无线电管理机构办理销售备案的情况,按照规定标注型号核准代码的情况,在实体经营场所或网络销售平台标明备案主体编号或所对应的二维码的情况。SeeAnnex3forthecontentsofinspectionsofsoldradiotransmissionequipmentconductedbyradioregulatoryauthorities.无线电管理机构对销售无线电发射设备的检查内容参见附件3。Article10Thesupervisionandinspectionofmodelapprovaltestinginstitutionsofradiotransmittingequipmentshallbeorganizedandcarriedoutbytheradioregulatoryauthorityofthestateandprovincialradioregulatoryauthoritiesundertakingmodelapprovaltestingtasks.Themaincontentsoftheinspectionshallincludethetestingtimelimitoftestinginstitutions,thequalityoftestingservices,thestandardizationoftestingreports,theaccuracyoftestingdata,andotherbusinesscapacities,fundperformanceandimplementation,andotherfunduseconditions.SeeAnnex4forthecontentsofinspectionsoftestinginstitutionsconductedbyradioregulatoryauthorities.第十条对无线电发射设备型号核准检测机构的监督检查,由国家无线电管理机构和承担型号核准测试任务的省级无线电管理机构组织开展,检查的主要内容是检测机构的检测时限、检测服务品质、检测报告规范性、检测数据准确性等业务能力,以及资金绩效和执行等资金使用情况。无线电管理机构对检测机构的检查内容参见附件4。Article11Radioregulatoryauthoritiesshallpromptlyconductspecialinspectionsofmattersinvolvingradiotransmissionequipment,suchasthoseassignedbyhigherauthorities,publicreports,第十一条无线电管理机构对涉及上级机关交力、群众举报、干扰投诉、无线电监测发现或者其他部门移送案件线索等涉及无线电发射设备事项应当及时开展专项检查,专项检查内容参见附件5。第三章检查的组织实施第十二条无线电管理机构应当制定年度无线电发射设备日常检查计划。检查计划应当包括检查的依据、事项、范围、方式、时间等内容。笫十三条无线电管理机构开展检查,应当由无线电管理机构的工作人员依据职责实施,无线电管理技术机构应当根据工作要求选派相关技术人员协助,需要开展技术检测的,可根据有关规定和程序委托第三方检测服务机构对相关技术参数实施检测,出具检测报告。其中,国家无线电管理机构组织的“双随机、一公开”检查工作,由承担型号核准测试任务的省级无线电管理机构通过购买服务方式提供检测服务。开展生产能力、技术力量、质量保证体系检查,由国家无线电管理机构根据有关规定和程序委托专业机构开展interferencecomplaints,radiomonitoringfindings,orcasecluestransferredbyotherdepartments.SeeAnnex5forthecontentsofspecialinspections.ChapterIIIOrganizationandImplementationofInspectionArticle12Theradioregulatoryauthorityshallmakeanannualplanfortheroutineinspectionofradiotransmittingequipment.Theinspectionplanshallincludethebasis,items,scope,methods,andtimeoftheinspection,andothercontent.Article13Inspectionconductedbytheradioregulatoryauthorityshallbecarriedoutbytheemployeesoftheradioregulatoryauthorityaccordingtoitsduties,andtheradioregulationtechnicalinstitutionshallassignrelevanttechnicalpersonneltoprovideassistanceaccordingtoworkrequirements.Ifitisnecessarytoconducttechnicaltesting,athird-partytestingserviceagencymaybeentrustedinaccordancewiththerelevantprovisionsandprocedurestotesttherelevanttechnicalparametersandissueatestingreport.Inparticular,withregardtotherandomselectionofbothinspectorsandinspectiontargetsandthepromptreleaseofresultsorganizedbytheradioregulatoryauthorityofthestate,testingservicesshallbeprovidedbytheprovincialradioregulatoryauthorityundertakingmodelapprovaltestingtasksthroughthepurchaseofservices.Theradioregulatoryauthorityofthestateshallentrustprofessionalinstitutionstoconductinspectionsofproductioncapacity,technicalstrength,andqualityassurancesystemsinaccordancewithrelevantprovisionsandprocedures.检查。Article14Theradioregulatoryauthorityshall,accordingtoinspectiontasks,carryouttheinspectionworkbysuchmethodsason-siteinspection,onlineinspection,ortechnicaltesting,focusonon-siteinspectionandtechnicaltestinginresearchanddevelopment,production,maintenance,andimportlinks,andmainlyadoptthecombinationofon-siteinspectionandonlineinspectioninthesaleslink.Inspectionsoftestinginstitutionsshallbeconductedinaccordancewiththerelevantrequirementsforthegovernmentpurchaseofservices.第十四条无线电管理机构应根据检查任务采用现场核查、线上检查或技术检测等方式开展检查工作,在研制、生产、维修、进口环节以现场核查和技术检测方式为主,在销售环节以现场核查和线上检查相结合的方式为主。对检测机构的检查按照政府购买服务有关要求进行。Article15Whereon-siteinspectionisconducted,atleasttwolawenforcementinspectorsshallbeassignedandtheyshallproducetheiradministrativelawenforcementcertificates.TheInspecteeshallbeinformedoftheinspectionpurpose,inspectioncontent,inspectionprocedures,andworkdisciplinerequirements.Theon-siteinspectionshallincludetheinspectionofrelevantmaterials.Attheendoftheon-siteinspection,inspectorsshalltruthfullyenteron-siteinspectionrecords,andtheinspecteeshallaffixhisorhersignatureorsealforconfirmation.Iftheinspecteerefusestoaffixhisorhersignatureorseal,inspectorsshallstatethereason,signthereport,andinviterelevantpersonneltosigntowitnessifnecessary.第十五条采取现场核查的,执法检查人员不得少于两人,并应当出示行政执法证件。应当向检查对象告知检查目的、检查内容、检查程序和工作纪律要求。现场核查内容应包括对相关材料的检查。现场核查结束时,检查人员应当如实填写现场核查记录,由检查对象签字或者重章确认。检查对象拒绝签字或者盖章的,检查人员应当注明原因并签名,必要时邀请相关人员签字见证。笫十六条采取线上检查的,检查人员应当全面、客观、完整地记录检查工作情况,应注意留存文字图片、视频影像等记录,包括线上检查过程中通过信息化Article16Whereonlineinspectionisconducted,inspectorsshallrecordtheinspectionworkinacomprehensive,objective,andcompletemanner,andpayattentiontokeepingrecordssuchastexts,pictures,andvideoimages,includingbutnotlimitedtotheinformation,electronicdata,anddocumentsandmaterialsaccessedthroughinformationsystemsinthecourseofonlineinspection.Therelevanttechnicalsupportworkmaybecarriedoutbyathird-partyinstitutionentrustedthroughthegovernmentprocurementofservicesasrequiredforthepracticalwork.系统获取的信息、电子数据、文件资料等。相关技术支撑工作可根据实际工作需要,通过政府购买服务方式委托第三方机构开展。Article17Theinspecteeshallcooperatewiththeinspectionwork,truthfullyanswerrelevantinquiries,providerelevantdocuments,previousinspectionresults,rectification(ifany),andotherrelevantmaterials,assignpersonstoeffectivelyassistintheinspectionwork,andprovideinspectorswithnecessarycooperationconditions.第十七条检查对象应当配合检查工作,如实回答相关询问,提供相关文件、前次检查结果及整改情况(如有)等其他有关资料,指派人员协助做好检查工作,并为检查人员提供必要的配合条件。Article18Theradioregulatoryauthorityshallrecordthewholeprocessofadministrativelawenforcement,includingtheinitiation,investigationandevidencecollection,examinationanddecisionmaking,sen/iceandexecutionintheformsofrecordssuchastextsandaudioandvideorecordings,soastomakethewholeprocessoflawenforcementtraceableandcarryoutretrospectivemanagement.Theradioregulatoryauthorityshalltakeadministrativelawenforcementinstrumentsasthebasicformofrecordstorecordthewholeprocessofinspectioninalegal,standardized,objective,comprehensive,timely,accurate,andconcisemanner.Withrespecttoon-sitelawenforcement,investigationandevidenceco
