中华人民共和国海事局关于印发招购检骏监督管理规定的通知(海船检(2024)33号)各直属海事局:为加强船舶检.验监督管理，提升都植检舱质量，我局研究制定了用船检验监督管理规定，现予印发，请遵照执行。中华人民共和国海事局关于印发船舶检验监督管理规定的通知NoticebytheMaritimeSafetyAdministrationofthePeople'sRepublicofChinaofIssuingtheProvisionsfortheSupervisionand/AdministrationofVesselInspection制定机关：中华人艮共和国海事局发文字号：海婚检(2024)33号公布日期：2024.03.29毡忏日期：2024.05.01效力位阶：都门规范性文件法规.美别：46IssuingAuthority：MaritimeSafetyAdministrationofthePeoplesRepublicofChinaDocumentNumberNo.332O24oftheMaritimeSafetyAdministrationofthePeople'sRepublicofChinaD<eIssued:03-29-2024ElYecliveDale054)1-20241.evelofu(horilyDqxirtnwnUlRCgUkUOryDgUmenlSAreaof1.aw:VesselsNoticebytheMaritimeSafetyAdministrationofthePeople'sRepublicofChinaofIssuingtheProvisionsfortheSupervisionandAdministrationofVesselInspection(No.332024oftheMaritimeSafetyAdministrationofthePeople'sRepublicofChina)AllmaritimesafetyadministrationsdirectlyundertheMinistryofTransport:Forthepurposesofstrengtheningthesupervisionandadministrationofvesselinspectionandimprovingthequalityofvesselinspection,theMaritimeSafetyAdministrationhasdevelopedtheProvisionsfortheSupervisionandAdministrationofVesselInspection,whichareherebyissuedforyourcomplianceandimplementation.MaritimeSafetyAdministrationofthePeople'sRepublicofChinaMarch29,2024ProvisionsfortheSupervisionandAdministrationofVesselInspectionChapterIGeneralProvisionsArticle1Forthepurposesofstrengtheningthesupervisionandadministrationofvesselinspectionandimprovingthequalityofvesselinspection,theseProvisionsaredevelopedinaccordancewiththeProvisionsontheAdministrationofVesselInspectionandtheProvisionsontheAdministrationofFisheryVesselInspection.Article2TheseProvisionsshallapplytothesupen/isionoverdomesticvesselinspectioninstitutionsandforeignvesselinspectioncompanies,aswellasthevesselinspectionactivitiescarriedoutbythem.中华人民共和国海事局2024年3月29日船舶检验监督管理规定第一章总则第一条为加强船舶检验监督管理工作，提升船舶检验质量，根据船舶检验管理规定渔业船舶检险管理规定制定本规定。第二条本规定适用于对国内船帕检验机构和外国验船公司及其开展的船舶检验活动的监督。Article3TheMaritimeSafetyAdministrationofthePeople'sRepublicofChina("ChinaMSA")shallberesponsiblefortheunifiedsupervisionandadministrationofthevesselinspectionwork.第三条中华人民共和国海事局（以下简称中国海事局）负责对船舶检验工作实施统一监督管理。Themaritimesafetyadministrationsatalllevelsshallcarryoutsupervisionandadministrationofvesselinspectionaccordingtotheirrespectivefunctionsandpowers.各级海事管理机构依据各自职责权限开展船勘检险监督管理工作。第四条船舶检险监督人员应具备相应专业知识并且不断进行知识更新。第二章国内船舶检验机构监督第五条国内船拈检验机构监督包括日常监督和年度监督检查。国内船舶检验机构的日常监督由船舶检验机构所在地直属海事局负责，所在地无直属海事局的，由负责船舶检验区域协调的直属海事局负责。国内船舶检验机构日常监督包括对投诉、举报、海事监管等涉及的船舶检验有关工作的监督，由直属海事局结合具体监督事项按有关规定实施。第六条国内船舶检验机构的年度监督检查由所在地直属海事局实施；所在地无直属海事局的，由负责船舶检验区域协调的直属海事局实施。Article4Vesselinspectorsandsupervisorsshallhavethecorrespondingprofessionalknowledgeandconstantlyupdatetheknowledge.ChapterIlSupervisionoverDomesticVesselInspectionInstitutionsArticle5Supervisionoverdomesticvesselinspectioninstitutionsincludesroutinesupervisionandannualsupervisionandinspection.TheroutinesupervisionoverdomesticvesselinspectioninstitutionsshallbeinthechargeofthemaritimesafetyadministrationsdirectlyundertheMinistryofTransportwherethevesselinspectioninstitutionsarelocated;andwherethereisnolocalmaritimesafetyadministrationdirectlyundertheMinistryofTransport,thelocalmaritimesafetyadministrationdirectlyundertheMinistryofTransportresponsibleforregionalcoordinationofvesselinspectionshallbeinthecharge.Theroutinesupervisionoverdomesticvesselinspectioninstitutionsincludesthesupervisionovervesselinspectionrelatedworkinvolvedincomplaints,tip-offs,maritimesupervisionandadministration,etc.,whichshallbeimplementedbythemaritimesafetyadministrationdirectlyundertheMinistryofTransportinaccordancewithrelevantprovisionsinconsiderationofthespecificsupervisionmatters.Article6TheannualsupervisionandinspectionbydomesticvesselinspectioninstitutionsshallbecarriedoutbythelocalmaritimesafetyadministrationsdirectlyundertheMinistryofTransport;andwherethereisnolocalmaritimesafetyadministrationdirectlyundertheMinistryofTransport,itshallbeimplementedbythemaritimesafetyadministrationdirectlyundertheMinistryofTransportresponsibleforregionalcoordinationofvesselinspection.原则上每年对各省、自治区、直辖市的船舶检跄机构进行一次年度监督检查。本年度开展或者拟开展船舶检险机构资质认可、熨核或者省级渔船检验机构业务范围核定的，当年可不开展年度监督检查。A类船舶检验机构的日常监督和年度监督检查由中国海事局组织实施。Inprinciple,thevesselinspectioninstitutionsofallprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshallbesubjecttoannualsupervisionandinspectioneveryyear.Wherequalificationrecognitionandreviewofvesselinspectioninspectionsorverificationofbusinessscopeofprovincialfishingvesselinspectioninstitutionsarecarriedoutorplannedtobecarriedoutinthecurrentyear,annualsupervisionandinspectionisnotrequiredinthecurrentyear.TheroutinesupervisionandannualsupervisionandinspectionofClassAvesselinspectioninstitutionsshallbeorganizedandimplementedbytheChinaMSA.第七条国内船舶检验机构的年度监督检查以检查组的方式开展，检查组一般由四至六人组成。直属海事局可以邀请行业内专家参与检查。Article7Theannualsupervisionandinspectionofdomesticvesselinspectioninstitutionsshallbecarriedoutintheformofinspectionteams,whicharegenerallycomposedoffourtosixpeople.ThemaritimesafetyadministrationdirectlyundertheMinistryofTransportmayinviteexpertsintheindustrytoparticipateininspections.笫八条检查组开展年度监督检查前应当制定检查计划，明确检查分工、活动安排、检查内容等。省级船舶检验主管部门应当派员参加监督检查。年度监督检查开始时应当召开沟通会议，沟通会议主要介绍检查计划和检查要求。Article8Aninspectionteamshalldevelopaninspectionplanbeforecarryingoutannualsupervisionandinspection,andspecifythedivisionofinspectionwork,arrangementsforactivities,inspectioncontent,etc.Provincialvesselinspectiondepartmentsshallappointpersonneltoparticipateinsupervisionandinspection.Atthebeginningofannualsupervisionandinspection,acommunicationmeetingshallbeheld,whichmainlyintroducestheinspectionplanandinspectionrequirements.第九条年度监督检查通过向都相检驶机构了解情况、抽查船舶检验技术档案、现场验证等方式开展。Article9Annualsupervisionandinspectionshallbecarriedoutbyobtaininginformationfromvesselinspectioninstitutions,randomcheckingoftechnicalfilesonvesselinspection,on-siteverificationandothermeans.Thecontentsofsupervisionandinspectioninclude:(1) Themaintenanceofqualificationconditionsofvesselinspectioninstitutions.(2) Theoperationofthequalitymanagementsystemormanagementsystem.监督检查的内容包括:（一）船舶检脸机构资质条件保持情况；（二）质量管理体系或管理制度运行情况；(3)Theimplementationoflaws,regulationsandnormativedocumentsonvesselinspection.（三）船舶检脸法律法规规章和规范性文件执行情况；(4)Theinspectionofnewlybuiltvesselsandaquaticfacilities.（四）新建船殖与水上设施检验情况；(5)Theinspectionofvesselsandaquaticfacilitiesinoperation.（五）营运船舶与水上设施检验情况；(6)Theinspectionofmarineproducts.（六）船用产品检验情况；（七）船运货物集装箱检验情况；(7) Theinspectionofshiploadcargocontainers.(8) Thequalitymanagementandcontrolofvessel(八)船舶检修检测质量maintenanceanddetection.管控情况；(9) Therectificationofproblemsfoundintheinspectionandsupervisionovervesselconstructionandoperation.(10) Theimplementationoftherelevantrequirementsbythecompetentdepartmentsathigherlevels.Article10Whendevelopinganinspectionplan,aninspectionteamshall,incomprehensiveconsiderationoftheinspectionworkofavesselinspectioninstitutioninthepreviousyear,determinethefocusofrandominspection,andthemaintenanceofqualificationconditionsshallbethecontentofcompulsoryinspection.Aninspectionteammayselectdrawingreview,constructioninspection,operationinspection,productinspection,containerinspectionandotherongoinginspectionactivitiestocarryouton-siteverification.Article 11 Afterthecompletionoftheannualsupervisionandinspection,aninspectionteamshallcommunicatewiththeinspectedentityandgivefeedback,focusingontheproblemsfoundintheinspection.Theproblemsfoundbydomesticvesselinspectioninstitutionsaredividedintoobservationitems,generalnon-conformanceitemsandseriousnon-conformanceitems.（九）船舶建造检验监督和营运检验监督发现的问题整改情况；<+）上级主管部门有关要求落实情况。笫十条检查组制定检查计划时，应综合考虑船舶检骏机构上一年度检验工作情况确定抽查重点，资质条件保持情况为必须检查内容。检查组可以选取图纸审查、建造检验、营运检跄、产品检验、集装箱检验等进行中的检验活动开展现场验证。第十一条年度监督检查完成后，检查组应当与被检查单位沟通并进行反馈，重点反馈检查发现的问题。对国内船舶检验机构检查发现的问题分为观察项、一般不符合项和严重不符合项。第十二条实施年度监督检查的直属海事局应当在检查结束后三个工作日内将观察项、一般不符合项、严重不符合项录入船舶检验管理信息系统，并将不符合项和有关管理意见建议以书面形式通报Article 12 ThemaritimesafetyadministrationdirectlyundertheMinistryofTransportimplementingtheannualsupervisionandinspectionshall,withinthreeworkingdaysaftertheendoftheinspection,entertheobsen/ationitems,generalnon-conformanceitems,andseriousnon-conformanceitemsinthevesselinspectionmanagementinformationsystem,andnotifytheprovincialvesselinspectiondepartmentsofthenon-conformanceitemsandrelevantmanagementopinionsandsuggestionsinwriting.Seriousnon-conformanceitems,ifany,shallalsobereportedtotheChinaMSA.Article 13 Thevesselinspectioninstitutionsshallanalyzeandcorrectthecausesofthenonconformanceitemsfoundintheinspection,andtakemeasurestopreventtherecurrenceofsimilarnonconformanceitems.Thecorrectionperiodforgeneralnon-conformanceitemsshallgenerallynotexceedonemonth,andthecorrectionperiodforseriousnonconformanceitemsshallgenerallynotexceedthreemonths.Afterthecompletionofthecorrection,thevesselinspectioninstitutionshallgivewrittenfeedbacktothemaritimesafetyadministrationdirectlyundertheMinistryofTransportimplementingtheannualsupervisionandinspection,andentertherelevantinformationandevidenceinthevesselinspectionmanagementinformationsystem,whichshallbeclosedaftertrackingandverificationbythemaritimesafetyadministrationdirectlyundertheMinistryofTransportimplementingtheannualsupervisionandinspection.Article 14 Whereavesselinspectioninstitutionfallsunderanyofthefollowingcircumstances,theChinaMSAmayorganizeadditionalinspections.省级船舶检验主管部门。存在严重不符合项的，还应当报告中国海事局。笫十三条船舶检验机构应当对检查发现的不符合项进行原因分析并纠正，采取措施防止类似不符合项再次发生。对于一般不符合项纠正期限一般不超过一个月，严重不符合项纠正期限一般不超过三个月。船舶检验机构纠正完成后应当向实施年度监督检查的直属海事局进行书面反馈，并将有关情况和证据录入拓舶检验管理信息系统，由实施年度监督检查的直属海事局跟踪验证后关闭。笫十四条船舶检验机构有下列情形之一的，中国海事局可以级级开展附加检查。（一）检验的笳舶发生重大及以上等级水上交通事故，涉及招舶检验责任的：(1) Aseriousandabovewatertrafficaccidentoccurstoavesselunderinspection,andtheliabilityforvesselinspectionisinvolved.(2) Intheroutinesupervisionorannualsupervisionandinspectionofvesselinspection,seriousviolationsoflawsandregulationsoruniversalproblemsarefound.(3) Non-conformanceitemsofthesamekindoccurrepeatedlyorareprevalentwithinacertainscope.(4) Itissubjecttoatip-offcomplain,andhasbeenconfirmedbypreliminaryinvestigationtohaveseriousinspectionbehaviorsinviolationofregulations.(5) OthercircumstancesunderwhichtheChinaMSAdeemsitnecessarytocarryoutadditionalinspections.ChapterIIIConstructionInspectionandSupervisionArticle15ThemaritimesafetyadministrationdirectlyundertheMinistryofTransportattheconstructionplaceshallberesponsiblefortheinspectionandsupervisionovervesselconstruction.Inspectionandsupervisionovertheconstructionoffishingvesselsandtheinspectionandsupervisionovertheconstructionofvesselsinprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralgovernmentwherenomaritimesafetyadministrationsdirectlyundertheMinistryofTransportaresetupshallbeimplementedintheformofon-siteverificationduringtheannualsupervisionandinspectionofvesselinspectioninstitutions.（二）在船舶检验日常监督或年度监督检查中发现严重违法违规情况或普遍性问题的；（三）同类不符合项重复多次出现或者在一定范围内普遍存在的；（四）被举报、投诉，经初步调查核实存在严重违规检验行为的；（五）中国海事局认为需要开展附加检查的其他情形。第三章建造检验监督笫十五条船舶建造检险监督由建造地直属海事局负贲。渔船建造检验监督以及未设置直属海事局的省、自治区、直辖市的船舶建造检跄监督，以对船射检舱机构开展年度监督检查时现场验证的方式实施。建造检验监督指直属海事局对本局辖区或指定区域内登记或拟登记为中国籍ThesupervisionoverconstructioninspectionreferstothesupervisionbythemaritimesafetyadministrationdirectlyundertheMinistryofTransportovertheinspectionoftheconstructionormajoralterationsofvesselsregisteredorintendedtoberegisteredasChinesevesselsinthejurisdictionordesignatedareaoftheadministration.船舶建造或重大改建检验的监督。第十六条船舶建造检验监督主要对以下内容进行抽查：Article16Randominspectionshallbemainlycarriedoutoverthefollowingitemsintheinspectionandsupervisionovervesselconstruction:(1)Theintegrityofvesselinspectionitems.（一）船舶检险项目的完整性；(2)Theimplementationofthetechnicalspecificationsforstatutoryvesselinspection.（二）船舶法定检验技术规范的执行情况；(3)Thecertificateholdingstatusofmarineproducts.（三）船用产品的持证情况；(4)Thepracticingofvesselinspectionpersonnel.（四）船舶检验人员执业情况；(5)Theconsistencyofvesselplans.（五）船图一致性情况:(6)Theinspectionofthevessel'smooringtestandsailingtest.（六）船舶系泊试验与航行试验的检险情况。Article17Theinspectionandsupervisionovervesselconstructionshallbecarriedoutbyatleasttwoinspectorsandsupervisors.Inprinciple,thevesselinspectioninstitutionshallappointpersonneltoparticipateintheinspectionandprovidecorrespondinginspectionmaterials.Theproportionofinspectionandsupervisionovervesselconstructionshallbeatleast10%ofthenumberofnewvesselscompletedinthejurisdictionorbenotlessthan30vesselsonanannualbasis.第十七条船舶建造检舱监督至少由2名检骁监督人员实施，原则上船舶检验机构应当派员参加并配合提供相应检验资料。建造船舶检验监督比例至少达到年度辖区新造船舶完工数量的10%或不少于30艘次。第十八条各直属海事局应当结合辖区船舶建造检验情况选定抽查船舶，并在开展船舶建造检验监督检查前至少十个工作日在船舶检险管理信息系统发起流程通知船舶检验机构。Article18AllmaritimesafetyadministrationsdirectlyundertheMinistryofTransportshallselectvesselsforrandominspectioninconsiderationofthevesselconstructioninspectionundertheirjurisdictions,andnotifythevesselinspectioninstitutionsoftheprocessinitiatedbythevesselinspectionmanagementinformationsystematleast10workingdaysbeforecarryingoutthesupervisionandinspectionofvesselconstructioninspection.第十九条下列船舶应作为建造检险监督抽查重点：Article19Thefollowingvesselsshallbethefocusofsupervisionandrandominspectionofconstructioninspection:(一)客船、危险品船、砂石船、易流态化固体散装货物运输格；(1) Passengervessels,dangerousgoodsvessels,sandandgravelvessels,andmovablesolidbulkcargovessels.<-)存在重大建造质量缺陷、非法改装改建、不按图施工等问题记录的船舶建造企业建造的船舶；(2) Vesselsconstructedbyvesselconstructionenterpriseswithmajorconstructionqualitydefects,illegalrefitsandalterations,andconstructionnotconductedaccordingtotheplansandotherproblemsrecorded.(三)三年内因船舶检验质量问题被中国海事局处理过的相舶检验机构检验的船舶：(3) VesselsinspectedbyvesselinspectioninstitutionsthathavebeenpunishedbytheChinaMSAforvesselinspectionqualityproblemswithinthreeyears.(四)三年内在事故调查中被认定存在检验责任的船舶检验机构检验的相舶。(4) Vesselsinspectedbyvesselinspectioninstitutionsthathavebeenidentifiedashavinginspectionliabilityintheaccidentinvestigationwithinthreeyears.第二十条各直属海Article20Afterthecompletionofsupervisionandinspection,allmaritimesafetyadministrationsdirectly事局监督检查完成后，应当出具建造检验监督检查报告，在三个工作日内将检查情况录入鼎舶检验管理信息系统，并通知船舶检舱机构。船舶检险机构有异议的，应当在五个工作日内回受，未在五个工作日内回复的视为无异议。各直属海事局对建造检验监督的检查意见包括：undertheMinistryofTransportshallissuesupervisionandinspectionreportsonconstructioninspection,entertheinspectioninformationinthevesselinspectionmanagementinformationsystemwithinthreeworkingdays,andnotifythevesselinspectioninstitutions.Avesselinspectioninstitutionhavinganyobjectionshallreplywithinfiveworkingdays,andwhereitfailstoreplywithinfiveworkingdays,itshallbedeemedhavingnoobjection.TheinspectionopinionsofthemaritimesafetyadministrationsdirectlyundertheMinistryofTransportonsupervisionoverconstructioninspectioninclude:（一）发证前纠正;(1) Correctionbeforeissuingacertificate.（二）停止检验;(2) Ceasingtheinspection.（三）通报船舶检脸机构的主管部门。(3) Notifyingthecompetentdepartmentofthevesselinspectioninstitution.第二十一条对没有
