(2024年5月16日中华人民共和国自然资源部令第13号公布经2024年5月9日自然资源部第2次部务会议审议通过自2024年7月1日起施行)第一条为了规范矿业权人勘查开采活动事中事后监管,促进矿业权人诚信自律,营造公平竞争的市场环境,根据中华人民共和国矿产资源法优化营商环境条例等法律、法规,制定本办法。矿业权人勘查开采信息管理办法MeasuresfortheAdministrationofMiningRightsOwners,ExplorationandExploitationInformation制定机关:4然充源部皮女字号:中华人民共和BlA找击忑都令M13号公布H嘉:2024.05.16艳行H期:2024.07.01致力仁除:部门规*法规臭别:尸区与炉山金北营商环境优化ISInngAuliiurily:MunMn,ofNalurulResourceiDocumentNumber:OrderNo13oftheMiniMQ'ofNuturalRcsorcciofthePeople'sRepublicofChinaDaleIssued:(>516-2024EfrcaivcDatc07-01-20241.evelofAiHlMirily:DepartnwnlalRulesAreaof1.aw:MiningArrasandMiningEnterprisesOptimizationofDoingBusinessMeasuresfortheAdministrationofMiningRights矿业权人勘查开采信息管理办Owners'ExplorationandExploitationInformation法(IssuedbyOrderNo.3ofNaturalResourcesofthePeople'sRepublicofChinaonMay16,2024,deliberatedandadoptedatthe2thexecutivemeetingoftheNaturalResourcesofthePeople'sRepublicofChinaonMay9,2024,andwillcomeintoforceonJuly1,2024)Article1Forthepurposesofstandardizingtheinterimandexpostregulationofexplorationandexploitationactivities,promotingtheintegrityandself-disciplineofminingrightsowners,andcreatingamarketenvironmentforfaircompetition,theseMeasuresaredevelopedinaccordancewiththeMineralResources1.awofthePeople'sRepublicofChina,theRegulationonOptimizingtheBusinessEnvironment,andotherlawsandregulations.Article2TheseMeasuresshallapplytoactivitiessuchasentering,publicity,verificationanduseofminingrightsowners'explorationandexploitationinformation.Article3Miningrightsowners'explorationandexploitationinformationshallbemanagedundertheprincipleofinclusivenessandprudence,andthelegitimaterightsandinterestsofminingrightsownersshallbeprotected.Article4TheMinistryofNaturalResourcesisresponsiblefortheadministrationofminingrightsowners*explorationandexploitationinformationacrossthecountry,andorganizetheconstructionofthenationalmanagementsystemforminingrightsowners'explorationandexploitationinformation.Thecompetentdepartmentsofnaturalresourcesofthelocalpeople'sgovernmentsatorabovethecountylevelareresponsiblefortheadministrationofminingrightsowners'explorationandexploitationinformationintheirrespectiveadministrativeregions.Article5Undertheprincipleof"whoproduces,whoentersinformation,"miningrightsowners'explorationandexploitationinformationshallbeenteredbyminingrightsownersandthecompetentdepartmentsofnaturalresourcesofthepeople'sgovernmentsatorabovethecountylevelinthenationalmanagementsystemforminingrightsowners'explorationandexploitationinformation,andbepublicizedtothepublicinaccordancewiththeprovisionsoftheseMeasures.笫二条矿业权人勘查开采信息填报、公示、核查、使用等活动,适用本办法。第三条矿业权人勘查开采信息管理应当坚持包容审慎的原则,保护矿业权人合法权益0笫四条自然资源部负责全国矿业权人勘查开采信息管理工作,组织建设全国矿业权人勘查开采信息管理系统。县级以上地方人民政府自然资源主管部门负责本行政区域内矿业权人勘查开采信息管理工作。笫五条矿业权人勘查开采信息按照“谁产生,谁填报”的原则,由矿业权人和县级以上人民政府自然资源主管部门在全国矿业权人勘查开采信息管理系统中负责填报,并依照本办法规定向社会公示。第六条下列信息由探矿Article 6 Thefollowinginformationisenteredbytheexplorationrightowner:(1) Thenameandaddressoftheentityundertakingtheexplorationwork.(2) Theamountoffundsinvestedinannualexploration,thenumberofmajorphysicalworkloadscompletedsuchasexplorationprojectsandsampleanalysis,andwhetherreportsonexplorationresultshavebeenprepared.(3) Thetypesandstagesofexploration,andwhethercomprehensiveexplorationevaluationofco-associatedmineralshasbeencarriedout.(4) Whethertheleftwellandcavernarefilledinatimelymannerafterthecompletionoftheexplorationoperation.(5) Paymentofrelevantfeesinaccordancewiththerelevantprovisionsoflawsandregulationsontheadministrationofmineralresources.(6) Theperformanceofobligationsforsubmittinggeologicaldata.(7) Theperformanceofotherexplorationobligationsprescribedbylawsandregulations.Article 7 Thefollowinginformationisenteredbytheexploitationrightowner:权人负责填报:(一)承担勘查工作的单位名称、地址等情况;(二)年度勘查投入资金数额、探矿工程、样品分析等主要实物工作量完成数量,以及是否编制勘查成果报告等情况;(三)勘查矿种、勘查阶段,以及是否对共伴生矿产进行综合勘查评价等情况;(四)勘查作业完毕后是否及时封填遗留并碉情况;(五)按照矿产资源管理法律法规等有关规定缴纳相关费用情况;(六)地质资料汇交义务履行情况;(±)法律法规规定的其他勘查义务履行情况。第七条下列信息由采矿权人负责填报:(一)矿山状态,实际开采利用矿种,以及是否编制矿山储(1) Thestatusofthemine,themineralspeciesactuallyexploitedandutilized,andwhethertheannualreportonminereservesisprepared,thebasicstatementofreservesstatisticsissubmitted,thecomprehensiveutilizationofmineralresources,theecologicalrestorationofthemineandotherbasicinformation.(2) Theminingrecoveryrate,mineralprocessingrecoveryrate,comprehensiveutilizationrate,amountoforeexploited,tailings,andutilizationofwasterockandassociatedminerals.(3) Paymentofrelevantfeesinaccordancewiththerelevantprovisionsoflawsandregulationsontheadministrationofmineralresources.(4) Theperformanceofobligationsforsubmittinggeologicaldata.(5) Theperformanceofotherexploitationobligationsprescribedbylawsandregulations.Article 8 Thecompetentdepartmentsofnaturalresourcesofthepeople'sgovernmentsatorabovethecountylevelareresponsibleforenteringthefollowinginformation:(1) Theinformationonregistrationofnewestablishment,renewal,alteration(transfer),retentionandcancellationofminingrights.量年度报告、报送储量统计基础表、综合利用矿产资源、开展矿山生态修复等基本情况;(二)矿山开采回采率、选矿回收率、综合利用率、矿石采出量,尾矿、废石以及共伴生矿产等利用情况;(三)按照矿产资源管理法律法规等有关规定缴纳相关费用情况;(四)地质资料汇交义务履行情况;(五)法律法规规定的其他开采义务履行情况。笫八条下列信息由县级以上人民政府自然资源主管部门负责填报:<-)矿业权新立、延续、变更(转让)、保留、注销等登记信息;(二)矿产资源勘查实施方案、开发利用方案、矿山地质环境保护与土地复垦方案审查(备案)情况以及阶段验收信息;(2) Thereview(recordation)ofmineralresourcesexplorationimplementationplans,developmentandutilizationplans,minegeologicalenvironmentprotectionandlandreclamationplansandstagedacceptanceinformation.(3) Thereviewandrecordationofmineralresourcesreserves.(4) Theinformationontheadministrativepenaltiesimposeduponminingrightsownersforviolatinglawsandregulationsontheadministrationofmineralresources.(5) Otherinformationrelatedtotheexplorationandexploitationstatusofminingrightsowners.Article 9 MiningrightsownersshallentertheexplorationandexploitationinformationforthepreviousyearbeforeMarch31ofeachyear;however,exceptunderthecircumstancethattheperiodfromthedateofestablishingtheminingrightsinthepreviousyeartothelatestenteringdatedoesnotexceedsixmonths.Thecompetentdepartmentsofnaturalresourcesofthepeople'sgovernmentsatorabovethecountylevelshallentertheexplorationandexploitationinformationwithin30daysfromthedateofinformationgeneration.Article 10 Miningrightsowners'explorationandexploitationinformationshallbeenteredandpublicizedinaccordancewiththeprovisionsofthelawsandadministrativeregulationsontheprotectionofstatesecrets,commercialsecrets,personalprivacyandpersonalinformation.(三)矿产资源储量评审备案情况;(四)矿业权人因违反矿产费源管理法律法规,受到行政处罚的信息:(五)其他有关矿业权人勘查开采状况的信息。第九条矿业权人应当于每年3月31日前填报上一年度的勘查开采信息;但是,上一年度设立的矿业权至最迟填报日不满六个月的除外。县级以上人民政府自然资源主管部门应当于勘查开采信息产生之日起三十日内填报。笫十条矿业权人勘查开采信息填报、公示,应当遵守有关保护国家秘密、商业秘密、个人除私、个人信息等法律、行政法规的规定。笫十一条省级以上人民政府自然资源主管部门可以按照“双随机、一公开”监管要求,随机抽取一定比例的勘查Article Thecompetentdepartmentsofnaturalresourcesofthepeople'sgovernmentsatorabovetheprovinciallevelmay,inaccordancewiththeregulatoryrequirementsof"dualrandomandpublicdisclosure,"randomlyselectacertainproportionofexplorationprojectsandmines,developverificationplansandorganizeverificationofthepublicityofminingrightsowners'explorationandexploitationinformation.Article 12 Thecompetentdepartmentsofnaturalresourcesofthepeople'sgovernmentsatorabovethecountylevelshallformaverificationteamtocarryouttheverificationofthepublicityinformationofminingrightsowners.Whereinspectorsandobjectsunderverificationhaveastake,theyshallbedisqualifiedinaccordancewiththelaw.Thecompetentdepartmentsofnaturalresourcesofthepeople'sgovernmentsatorabovethecountylevelmayauthorizeprofessionalinstitutionstocarryouttherelevantworkofon-siteverification.Article 13 Wherethecompetentdepartmentsofnaturalresourcesofthepeople'sgovernmentsatorabovethecountylevelfindintheverificationprocessthatminingrightsownershavenotenteredtheexplorationandexploitationinformationinaccordancewiththeprovisions,theyshallnotifytheminwritingandputforwardrectificationrequirements;andwhereminingrightsownersarefoundtohaveviolatedtheprovisionsoflawsandregulationsonadministrationofmineralresources,theyshallbeheldlegallyliableaccordingtothelaw.项目和矿山,制定核查方案并组织实施矿业权人勘查开采信息公示情况核查工作。笫十二条县级以上人民政府自然资源主管部门开展矿业权人公示信息核查应当组成核查组。核查人员与被核查对象存在利害关系的,应当依法回避。县级以上人民政府自然资源主管部门可以委托专业机构开展实地核查相关工作。第十三条县级以上人民政府自然资源主管部门在核查过程中发现矿业权人未按照规定填报勘查开采信息的,应当对其进行书面告知,并提出整改要求;发现矿业权人违反矿产资源管理法律法规规定的,应当依法追究法律责任。第十四条自然资源部负责其登记的海域油气矿业权的严重失信主体认定和异常名录管理工作。Article 14 TheMinistryofNaturalResourcesisresponsiblefortheidentificationofseriouslydishonestsubjectsandthemanagementofabnormallistsofoilandgasmineralrightsintheregisteredseaareas.Thecompetentdepartmentsofnaturalresourcesofthepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentareresponsiblefortheidentificationofseriouslydishonestsubjectsandthemanagementofabnormallistsfortheminingrightsregisteredwiththemandtheminingrightsregisteredwiththedepartmentsofnaturalresourcesintheirrespectiveadministrativeregions(excepttheoilandgasmineralrightsintheseaarea).Thecompetentdepartmentsofnaturalresourcesofthemunicipalandcountypeople'sgovernmentsareresponsiblefortheidentificationofseriouslydishonestsubjectsoftheirregisteredminingrightsandthemanagementoftheabnormallists.Article 15 Whereminingrightsownersviolatetherelevantprovisionsofthelawsandregulationsonadministrationofmineralresourcesandreceiverelativelysevereadministrativepenaltiesaccordingtothelaw,theyshallbeidentifiedasseriouslydishonestsubjectsinaccordancewiththeprovisionsoftheseMeasures.Forthepurposesoftheprecedingparagraph,relativelysevereadministrativepenaltiesinclude:(1) Imposingafineundertheprincipleofheavierpunishmentaccordingtothediscretionbenchmarkforadministrativepunishment.(2) Revokinganexplorationlicenseandexploitationlicense.省、自治区、直辖市人民政府自然资源主管部门负责其登记的矿业权以及本行政区域内自然资源部登记的矿业权(海域油气矿业权除外)的严重失信主体认定和异常名录管理工作。市、县人民政府自然资源主管部门负责其登记的矿业权的严重失信主体认定和异常名录管理工作。笫十五条矿业权人违反矿产资源管理法律法规等有关规定,依法受到较重行政处罚的,应当依照本办法规定将其认定为严重失信主体。前款所称较重行政处罚包括:(一)依照行政处罚裁量基准,按照从重处罚原则处以罚款的;(二)吊销勘查许可证、采矿许可证的;(三)一年内因同一矿业权受到两次及以上行政处罚的;(3) Receivingtwoormoreadministrativepenaltiesforthesameminingrightwithinoneyear.(4) Otherrelativelysevereadministrativepenaltiesprovidedforinlawsandregulations.Article16ThecircumstancesunderwhichrelativelysevereadministrativepenaltiesareimposeduponthosewhoviolatetherelevantprovisionssuchasthelawsandadministrationsonadministrationofmineralresourcesasprescribedinArticle15oftheseMeasuresaccordingtothelawinclude:(1) Obtaininganexplorationlicenseorexploitationlicensebycheating,briberyorotherinappropriatemeans,andreceivingrelativelysevereadministrativepenaltiesinaccordancewiththerelevantprovisionsoftheAdministrative1.icenses1.aw.(2) Conductingexplorationandexploitationofmineralresourcesbeyondtheregistrationperiodandscope,andreceivingrelativelysevereadministrativepenaltiesinaccordancewiththeprovisionsoftheMineralResources1.awandtherelevantadministrativeregulationsonadministrationofmineralresources.(四)法律法规规定的其他较重行政处罚。笫十六条本办法第十五条规定的违反矿产资源管理法律法规等有关规定,依法受到较重行政处罚的情形包括:(一)以欺骗、贿赂等不正当手段取得勘查许可证、采矿许可证,依照行政许可法有关规定受到较重行政处罚的:(二)超越登记的期限、范围勘查、开采矿产资源,依照矿产资源法及矿产资源管理有关行政法规规定受到较重行政处罚的;(三)未按照规定实施矿山地质环境治理恢复和土地复垦,或者矿山地质环境治理恢复和土地复垦未达到规范要求,依照土地管理法及土地复垦、矿山地质环境保护有关行政法规和部门规章规定受到较重行政处罚的;(3) Failingtoimplementthemininggeologicalenvironmentcontrolandrestorationandlandreclamationinaccordancewiththeprovisions,orfailingtoconductgeologicalenvironmentcontrolandrestorationandlandreclamationofminesaccordingtothestandardizedrequirements,andreceivingrelativelysevereadministrativepenaltiesinaccordancewiththe1.andAdministration1.awandtherelevantadministrativeregulationsanddepartmentalrulesonlandreclamationandprotectionofgeologicalenvironmentofmines.(4) Failingtosubmitgeologicaldatawithintheprescribedtimelimit,forginggeologicaldataorpracticingfraudintheprocessofsubmittinggeologicaldata,andreceivingrelativelysevereadministrativepenaltiesinaccordancewiththerelevantprovisionsoftheRegulationontheAdministrationofGeologicalData.(5) Failingtoconductrecordationoforreporttherelevantinformationinaccordancewiththeprovisions,orforgingthereportonmineralresourcesreservesandannualreportonminereserves,practicingfraud,andreceivingrelativelysevereadministrativepenaltiesinaccordancewiththeprovisionsoftherelevantadministrativeregulationsonadministrationofmineralresources.(6) Failingtomeettheminimumtargetof"threerates"fortherationaldevelopmentandutilizationofmineralresources;failingtocarryoutcomprehensiveexploitationandutilizationinaccordancewiththeprovisions,failingtotakeprotectivemeasuresagainstunusablemineralresources(includingco-associatedminerals),orexploitingmineralresourcesbydestructiveexploitationmethods,resultinginlossanddestructionofmineralresources,andreceivingrelativelysevereadministrativepenaltiesinaccordancewiththeprovisionsoftheMineralResources1.awandtherelevantlawsandadministrativeregulations.(四)未按照规定的期限汇交地质资料,伪造地质资料或者在地质资料汇交中弄虚作假,依照地质资料管理条例有关规定受到较重行政处罚的;(五)未按照规定备案、报告有关情况,或者伪造矿产资源储量报告、矿山储量年度报告,弄虚作假,依照矿产资源管理有关行政法规规定受到较重行政处罚的;(六)未达到矿产资源合理开发利用“三率”最低指标;未按照规定开展综合开采、综合利用,对尚不能利用的矿产资源(包括共伴生矿产)未采取保护性措施,或者采取破坏性的开采方法开采矿产资源,造成矿产资源损失破坏,依照矿产资源法及有关法律、行政法规规定受到较重行政处罚的;(七)未按照规定缴纳相关费用,依照矿产资源管理有关行政法规规定受到较重行政处罚的;(7) Failingtopayrelevantfeesinaccordancewiththeprovisions,andreceivingrelativelysevereadministrativepenaltiesinaccordancewiththeprovisionsoftherelevantadministrativeregulationsonadministrationofmineralresources.(8) Failingtoundergotheformalitiesforthederegistrationoftheexplorationlicenseorexploitationlicenseinaccordancewiththeprovisions,andreceivingrelativelysevereadministrativepenaltiesinaccordancewiththeprovisionsoftherelevantadministrativeregulationsonadministrationofmineralresources.(9) Othercircumstancesstipulatedbylawsandregulationsthatshallbeidentifiedasseriouslydishonestsubjects.Article17Adecisionbyacompetentdepartmentofnaturalresourcesofthepeople'sgovernmentatorabovethecountyleveltoidentifyminingrightsownersasseriouslydishonestsubjectsshallbemadeunderthefollowingprocedures:(1) Whereitisverifiedthatthecriteriaforidentificationofseriouslydishonestsubjectsaremet,thenoticeonidentificationofseriouslydishonestsubjectsshallbeservedontheparties,notifyingthemofthefacts,reasons,basis,administrativemeasuresforintendingtobeidentifiedasseriouslydishonestsubjects,aswellastherightsofthepartiestomakestatementsanddefendthemselvesaccordingtothelaw.(2) Within10workingdaysafterreceivingtherelevantnotificationdocuments,thepartieshavetherighttosubmitwrittenstatements,defenseopinionsandrelevantsupportingmaterialstotheidentificationdepartment.(八)未按照规定办理勘查许可证、采矿许可证注销登记手续,依照矿产资源管理有关行政法规规定受到较重行政处罚的;(九)法律法规规定其他应当认定为严重失信主体的情形。笫十七条县级以上人民政府自然资源主管部门将矿业权人认定为严重失信主体的决定,按照下列程序进行:(一)经杳证符合严重失信主体认定标准的,应当向当事人送达严重失信主体认定告知书,告知拟认定为严重失信主体的事实、理由、依据、管理措施,以及当事人依法享有的陈述、申辩等权利;(一)当事人在收到相关告知文书后十个工作日内,有权向认定部门提交书面陈述、申辩意见及相关证明材料;(三)当事人未在规定时间内陈述、申辩的,以及陈述、申辩时提出的事实、理由或者证据不成立的,县级以上人民政(3) Wherethepartiesfailtomakestatementsordefendthemselveswithintheprescribedtimelimit,andthefacts,reasonsorevidencepresentedduringthestatementordefensearenotestablished,thecompetentdepartm
