II Genera1.Ru1.esArtic1.e7Aconsignorsha1.1.accurate1.ydec1.arethecargoname,andcorrect1.yc1.assify,identify,pack,mark,and1.abe1.thecargo,andprovidetrue,comp1.ete,andva1.iddocumentsre1.atedtocargotransportbycivi1.aviation.航空货物运输活动的单位加强新技术、新设备应用,建设安全可靠、智慧先进、优质高效的现代化民用航空货物运输服务体系,并做好与其他运输方式的衔接,促进多式联运发展。Theconsignor'sagentengagedincargotransportbycivi1.aviationsha1.1.ho1.dtheconsignor's1.etterofauthorization,andsha1.1.begovernedbytheprovisionsoftheseProvisionsontheconsignor'sresponsibi1.ities.Artic1.e8Noentityorindividua1.mayconsign,acceptforcarriage,orcarryitemsprohibitedbythestatefromtransportbycivi1.aviation.Foritemsrestrictedbythestatefromtransportbycivi1.aviation,theconsignorsha1.1.providetrue,comp1.ete,andva1.idsupportingdocumentsinaccordancewiththeapp1.icab1.eprovisions.第六条有关行业协会应当加强行业自律,引导和促进会员依法开展民用航空货物运输活动,提高服务质量。第二章一般规定第七条托运人应当准确申报货物品名,正确地对货物进行分类、识别、包装、加标记、贴标签,提供真实完整有效的民用航空货物运输相关文件。托运人代理人从事民用航空货物运输活动的,应当持有托运人的授权书,并适用本规定有关托运人责任的规定。笫八条任何单位和个人不得托运、收运或者载运国家规定禁止通过民用航空运输的物品。国家规定限制通过民用航空运输的物品,托运人应当按照规定提供真实完整有效的证明文件。运箍动物和动物产品、野生动物及其制品的,应当依照国家法律法规的规定办理。托运人Thetransportofanima1.s,anima1.products,wi1.danima1.sandtheirproductssha1.1.begovernedbytheprovisionsof1.awsandregu1.ationsoftheCtataThornncinnnrChaI1.nmidro1.o0nt应当按照规定提供相关证明文件。承运人应当查险证明文件,对不符合规定的,不得承运。supportingdocumentsinaccordancewiththeapp1.icab1.eprovisions.Theconsignorsha1.1.examinethesupportingdocumentsandsha1.1.notcarryanyitemsthatfai1.tocomp1.ywiththeapp1.icab1.eprovisions.第九条托运人不得在货物或者货物包装内夹带禁止或者限制运输的物品、危险品等。第十条承运人或者其地面服务代理人发现托运人隐瞒夹带禁止或者限制运输的物品、危险品或者提供虚假证明文件的,不得收运、承运,并按照国家有关规定进行报告。Artic1.e9Acarriersha1.1.notcarryitemsordangerousgoods,amongothers,prohibitedorrestrictedfromtransportincargoorthepackagethereof.第十一条对于涉及抢险救灾、疫情防控等关系国计民生需要紧急运输的货物,境内承运人、地面服务代理人应当优先运输。Artic1.e10Whereacarrieroritsgroundserviceagentfindsthattheconsignorcarriesanyitemsordangerousgoodsprohibitedorrestrictedfromtransport,orprovidesfa1.sesupportingdocuments,thecarrieroritsgroundsen/iceagentsha1.1.notacceptforcarriageorcarrysuchitemsorgoodsandsha1.1.reportthematterinaccordancewithre1.evantprovisionsissuedbythestate.境内承运人、地面服务代理人应当制定急运货物运输保障预案,满足民航行政机关对关系国计民生物资紧急运输的统一组织协调要求。Artic1.e11Adomesticcarrierorgroundserviceagentsha1.1.prioritizethetransportofcargoconcerningnationa1.economyandthepeop1.e's1.ive1.ihoodthatneedstobetransportedurgent1.yduetoemergencyrescue,disasterre1.ief,epidemicpreventionandcontro1.,orothermatters.Adomesticcarrierorgroundserviceagentsha1.1.deve1.opcontingencyp1.ansforemergencycargotransportandsatisfytherequirementsofthecivi1.aviationadministrationforunifiedorganizationandcoordinationofemergencytransportofsupp1.iesconcerningnationa1.economyandthepeop1.e's1.ive1.ihood.第十二条承运人、地面服务代理人将其货物运输相关工作发包给具备安全生产条件或者相应资质的其他单位的,应当签订专门的安全生产管理协议或者在承包合同中约定各自的安仝去产管理Artic1.e12Whereacarrierorgroundserviceagentcontractsitscargotransport-re1.atedworktoanyotherentitywithspecificworksafetyconditionsorthecorrespondingqua1.ifications,theysha1.1.enterintoaspecia1.worksafetymanagementagreementorspecifyinthecontracttheirrespectiveworksafetymanacmntdtiocnnndrtI1.nifiaAcoordinationandmanagementoftheworksafetyperformanceofthecontractor,conductsafetyinspectionsonaregu1.arbasis,andprompt1.ysuperviseandurgetherectificationifanysafetyissuesarefound.Artic1.e13Anyentityorindividua1.engagedincargotransportbycivi1.aviationmayusee1.ectronicdocuments,e1.ectronicsignaturesorsea1.s,ore1.ectronicidentifiersasneeded.Are1.iab1.ee1.ectronicsignatureorsea1.orane1.ectronicidentifiermaybeusedasasea1.orsignatureonane1.ectronicdocument.Thecarrierandgroundserviceagentsha1.1.estab1.ishairwaybi1.1.ore1.ectronicdocumentmanagementru1.es,enhanceinformationsecrecyanddataprotection,andpreventdata1.eakageanddamage.Airwaybi1.1.sande1.ectronicdocumentssha1.1.beretainedfornot1.essthan24monthsaftertheendofthef1.ightcarryingthecargo.Noentityorindividua1.mayforge,fa1.se1.yuse,orstea1.anduseothers'e1.ectronicsignatureorsea1.ore1.ectronicidentifier,ortamperwithe1.ectronicdocumentsincargotransportbycivi1.aviation.Artic1.e14Airportmanagementinstitutionssha1.1.maximizetheircoordinationandmanagementro1.estocreateastab1.e,fair,andtransparentgroundsen/icemarketenvironment,andendeavortoprovidesufficientresourcesandfaci1.itiesforthedeve1.opmentofcargotransportbycivi1.aviation.Chapter III CarriersandGroundServiceAgents职责,并对承包单位的安全生产工作统一协调、管理,定期进行安全检查,发现安全问题的,应当及时督促整改。第十三条从事民用航空货物运输活动的单位和个人可以根据需要使用电子单证、电子签章或者电子标识。可靠的电子签章、电子标识可以用于电子单证上的签章。承运人、地面服务代理人应当建立航空货运单或者电子单证管理制度,加强信息保密和数据保护,防止数据信息泄露、损坏。航空货运单、电子单证应当在载运货物的飞行终止后,保存不少于24个月。任何单位和个人在民用航空货物运输中不得伪造、冒用、盗用他人的电子签章、电子标识或者篡改电子单证。第十四条机场管理机构应当充分发挥协调和管理作用,营造稳定、公平、透明的地面服务市场环境,努力为民用航空货物运输发展提供充分的资源保障和设施供绐。笫三章承运人及地面服务代理人笫十五条面向公众经营定期航班运揄的承运人(以下简称面向公众的承运人)应当制定并公布货物运输总条件,细化相关货物运输服务内容。Article 15 Acarrierprovidingschedu1.edf1.ighttransportservicestothepub1.ic("pub1.iccarrier")sha1.1.deve1.opandpub1.ishgenera1.conditionsforcargotransportandspecifyre1.evantcargotransportservices.Acarrier'sgenera1.conditionsforcargotransportsha1.1.notconf1.ictwiththere1.evantrequirementsof1.awsandregu1.ationsofthestateaswe1.1.astheru1.esgoverningcivi1.aviationadministration.Article 16 Thecarrierthatamendsitsgenera1.conditionsforcargotransportsha1.1.indicatetheeffectivedateoftheamendment.Anyamendmenttoacarrier'sgenera1.conditionsforcargotransportthatrestrictstherightsoftheconsignorortheconsigneeorincreasesitsob1.igationssha1.1.notapp1.ytothetransportofcargoacceptedforcarriagebythecarrierbeforetheamendment,exceptasotherwiseprescribedbythestateoragreeduponinthetransportcontract.Article 17 Thegenera1.conditionsforcargotransportsha1.1.at1.eastcover:(1) cargotransportinstructions;(2) transportcertificate;(3) whethertheserviceforthedec1.aredva1.ueofcargoisprovidedorthere1.evantrequirementsforprovidingsuchservice;(4) theproceduresforhand1.ingunde1.iverab1.ecargo;(5) thestandardsofcompensationforcargodamage,1.oss,orde1.ay,ortheapp1.icab1.eprovisionsofthestateorinternationa1.conventions;and(6) emai1.address,te1.ephonenumber,andotherchanne1.sforacceptingcomp1.aints.承运人的货物运揄总条件不得与国家法律法规以及涉及民航管理的规章相关要求相抵触。第十六条承运人修改货物运输总条件的,应当标明生效日期。修改后的货物运输总条件,不得将限制托运人、收货人权利或者增加其义务的修改内容,适用于修改前承运人已收运的货物运输,但是国家另有规定或者运输合同另有约定的除外。笫十七条货物运输总条件至少应当包括下列内容:(一)货物运输须知;(二)运输凭证;(三)是否提供货物声明价值服务或者办理货物声明价值的相关要求;(四)无法交付货物的处理办法;(五)货物损坏、丢失、延误的赔偿标准或者所适用的国家有关规定、国际公约;(六)受理投诉的电子邮件地址、电话等投诉受理渠道。前款所列事项变化较频繁的,可以单独制定相关规定,但应当视为货物运输总条件的一部分,并与货物运输总条件在Iftheitems1.istedintheprecedingparagraphchangefrequent1.y,separateregu1.ationsmaybedeve1.oped,providedthattheysha1.1.bedeemedasapartofthegenera1.conditionsforcargoIrjancnnrtandnh1.iehodnmminonth/atthae*amop1.aceasthegenera1.conditionsforcargotransport.Article 18 Acarriersha1.1.deve1.opanaircargoservicemanua1.andtakemeasurestomaintainitsapp1.icabi1.ityandeffectiveness.Thecarriersha1.1.providetheaircargoservicemanua1.tothegroundserviceagententrustedbyit.Thecontentofacarrier'saircargoservicemanua1.sha1.1.inc1.udeoperationa1.ru1.esforeachstageofhand1.inggenera1.cargoandvarioustypesofspecia1.cargo.Thecarriersha1.1.ensurethatthecargoishand1.edaccordingtotherequirementsofthemanua1.Article 19 Acarriersha1.1.setupstorageareasforgenera1.cargoandspecia1.cargoaccordingtothecharacteristicsandtransportvo1.umeofinboundandoutboundcargo.Acarriersha1.1.deve1.opandimprovetheru1.esforthecustodyofcargostorageareasandstrict1.yimp1.ementthehandoverprocedures.Cargoesintheseareassha1.1.bestackedreasonab1.y,organizedperiodica1.1.y,andproper1.yprotectedtoensuretheiraccuracyandintegrity.Article 20 Acarriersha1.1.estab1.ishandimp1.ementmanagementru1.esandbusinessprocessforon-sitetransshipmentand1.oadingandun1.oadingoperationstoensurethesafety,efficiency,andaccuracyoftransshipment,1.oadingandun1.oading,andotherprocesses.同一位置以显著方式予以公布。第十八条承运人应当制定航空货物运输手册,并采取措施保持手册的适用性和有效性。承运人应当向其委托的地面服务代理人提供航空货物运输手册。承运人航空货物运输手册内容应当包括普通货物和各类特种货物各作业环节的操作规定,承运人应当确保货物操作按照手册要求实施。第十九条承运人应当根据进出港货物特性和货物运抢量的需要,设置普通货物和特种货物存放区域。承运人应当建立健全货物存放区域保管制度,严格交接手续。区域内货物应当合理码放、定期整理,做好安全防护工作,确保区域内货物准确完整。第二十条承运人应当建立并落实场内转运、装卸作业的管理制度和业务流程,确保转运、装卸等环节的安全、高效和准确。第二十一条承运人应当根据特种货物运输需要,建立机长通知单制度,确保机长对在飞行途中需要额外关注的特种货物知情,并能够采取通风、供氧、应急处置等必要措施。Article 21 22 Whende1.iveringcargo,acarriersha1.1.requiretheconsigneetoproduceva1.ididentityinformation.Ifcargoisdamagedor1.ostandtheconsigneerequeststhecarriertoproducearecordofabnorma1.cargotransport,thecarriersha1.1.provideitinatime1.ymanner.Therecordofabnorma1.cargotransportsha1.1.inc1.udesuchinformationasthep1.aceanddateofissuance,airwaybi1.1.number,f1.ightnumber,f1.ightsegment,andcategoryofabnorma1.ity.Article 23 Whenhand1.ingunde1.iverab1.ecargo,thecarriersha1.1.notifytheconsignorortheconsigneeandeffective1.ykeeparecordofsuchnotification.Thecarriersha1.1.takeeffectivesafetymanagementmeasuresforunde1.iverab1.ecargoduringthecustodyperiodtopreventworksafetyaccidents.Article 24 Thecarriersha1.1.providecargotransportinformationtotheconsignorortheconsigneeinatime1.ymanner.Ifcargotransportisaffectedduetoreasonsattributab1.etothecarrier,thecarriersha1.1.immediate1.ynotifytheconsignor.Article 25 Adomesticcarriersha1.1.deve1.opru1.esforthemanagementofcontractedaircargosa1.esagentsandspecifythecontractconditionsandthemechanismforcontractterminationandexit.第二十二条承运人交付货物应当要求收货人出示有效身份信息。货物发生损坏或者丢失,收货人要求出具货物不正常运输记录的,承运人应当及时提供。货物不正常运输记录应当包括填开地点、填开日期、航空货运单号码、航班号、航段和货物不正常类别等内容。笫二十三条承运人处置无法交付货物,应当通知托运人或者收货人,并保存好通知记录。承运人对无法交付货物在保管期间应当采取有效安全管理措施,防止发生生产安全事故。第二十四条承运人应当及时向托运人或者收货人提供货物运输信息。由于承运人原因,货物运输受到影响的,承运人应当立即通知托运人。第二十五条境内承运人应当建立箔约航空货运销售代理人的管理制度,明确航空货运销售代理人的签约条件和解约退出机制。航空货运销售代理人应当向托运人、托运人代理人如实告知禁止或者限制通过民用航空运输的物品范围,不得隐瞒、漏报或者变造、伪造民用航空货物运输相关文件。Theaircargosa1.esagentsha1.1.truthfu1.1.yinformtheconsignorortheconsignor'sagentofthescopeofitemsprohibitedorrestrictedfromtransportbycivi1.aviation,andsha1.1.notconcea1.oromitinformation,ora1.terorforgedocumentsre1.atedtocargotransportbycivi1.aviation.Article 26 Acarriersha1.1.enterintogroundserviceandsa1.esagencyagreementswiththegroundserviceagentandaircargosa1.esagent,specifyingtheirrespectivemanagementdutiesandsafetymeasurestobetaken,andtakeeffectivemeasurestourgeitsgroundserviceagentandaircargosa1.esagenttocomp1.ywiththere1.evantrequirementsoftheseProvisions.Article 27 Agroundserviceagentsha1.1.useitsaircargoservicemanua1.providedorapprovedbythecarrier,inc1.udingoperationa1.regu1.ationsforeachstageofhand1.inggenera1.cargoandvarioustypesofspecia1.cargo,andensurethatthecargoishand1.edaccordingtotherequirementsofthemanua1.Article 28 Agroundserviceagentsha1.1.strengthentheco1.1.ectionofcargotransportsupportdata,strengthenthedeve1.opmentofinformationsystems,andprompt1.yprovidecargotransportsupportinformationtothecarrier.Article 29 Agroundserviceagententrustedbythecarriertoprovidegroundservicesforcargotransportbycivi1.aviationsha1.1.satisfytherequirementsforcarriersspecifiedinArtic1.es19through23oftheseProvisions.ChapterIVComp1.aintHand1.ingandInformationRepo
