不可抗力的确认Confirmationofforcemajeure21.1.1 不可抗力是指承包人和发包人在订立合同时不可预见，在工程施工过程中不可避免发生并不能克服的自然灾害和社会性突发事件，如地震、海啸、瘟疫、水灾、骚乱、暴动、战争和专用合同条款约定的其他情形。Forcemajeurereferstothenaturaldisastersandsocialemergenciesthatcannotbeovercomewhenthecontractorandthecontractorconcludethecontractandinevitablyoccurduringtheconstructionoftheproject,suchasearthquakes,tsunamis,plagues,floods,riots,riotszwarszandothercircumstancesstipulatedintheexclusivecontractterms.21.1.2 合同一方当事人遇到不可抗力事件，使其履行合同义务受到阻碍时，应立即通知合同另一方当事人和监理人，书面说明不可抗力和受阻碍的详细情况，并提供必要的证明。Whereapartytoacontractencountersaneventofforcemajeurethatpreventsitfromperformingitscontractualobligations,itshallimmediatelynotifytheotherpartyandthesupervisorofthecontract,givingdetailsoftheforcemajeureandtheobstructioninwriting,andprovidethenecessaryproof.
