ExtendedapplicationofAct.PARTIPRELIMINARYSection 1 -ShortTitle,ApplicationandCommencement(1) ThisActmaybecitedastheFoodAct1983andshallapplythroughoutMalaysia.(2) ThisActshallcomeintoforceonsuchdateastheMinistermaynotificationintheGazetteappointandtheMinistermayappointdifferentdatesforthecomingintoforceofthisActfordifferentStatesinMalaysiaorfordifferentprovisionsofthisAct.Section 2 -InterpretationInthisAct,unlessthecontextotherwiserequires-"advertisement"includesanyrepresentationbyanymeanswhatsoeverforthepurposesofpromotingdirectlyorindirectlythesaleorotherdisposalofanyfood;"analyst1'meansanyanalystappointedundersection3;"anima'includesanyquadrupedorbirdeitherdomesticatedorotherwise,fish,reptileorinsect;wholeorpartofwhichareusedforhumanconsumption;"appliance'1includesthewholeoranypartofanyutensil,machinery,instrument,apparatus,orarticleusedorintendedforuse,inorforthemaking,preparing,keeping,sellingorsupplyingofanyfood;"approvedlaboratory"meansanylaboratoryapprovedbytheMinister;"authorisedofficer"meansanymedicalofficerofhealthoranyhealthinspectoroftheMinistryofHealthorofanylocal,authority,oranysuitablyqualifiedperson,appointedbytheMinistertobeanauthorisedofficerundersection3;"Director"meanstheDirectorofHealthServicesoftheMinistryofHealth;"DirectorGeneral"meanstheDirectorGeneralofHealthoftheMinistryofHealth;"entertainment"includesanysocialorotherformofgathering,amusement,festival,exhibition,performance,game,competition,sportortrial,ofskill;"food"includeseveryarticlemanufactured,soldorrepresentedforuseasfoodordrinkforhumanconsumptionorwhichentersintoorisusedinthecomposition,preparation,preservation,ofanyfoodordrinkandincludesconfectionery,chewingsubstancesandanyingredientofsuchfood,drink,confectioneryorchewingsubstances;"import1'meanstobringorcausetobebroughtintoMalaysiabyland,waterorairforthepurposeofsalefromanyplaceoutsideMalaysiabutdoesnotincludethebringingintoMalaysiaofanyfoodwhichitisprovedisintendedtobetakenoutofMalaysiaonthesamevehicle,vessel,oraircraftonwhichsuchfoodwasbroughtintoMalaysiawithoutanytranshipmentorlanding;"importer"includesanypersonwho,whetherasowner,consignor,consignee,agentorbroker,isinpossessionof,orisotherwiseentitledtothecustodyorcontrol,oftheimportedfood;"label"includesanytag,brand,mark,pictorialorotherdescriptivematter,written,printed,stencilled,marked,painted,embossedorimpressedon,orattachedtoorincludedin,belongingto,oraccompanyinganyfood;"medicalexamination"includesphysical,microbiological,chemical,serological,andradiologicalexamination,andsuchexaminationmayincludethetakingofspecimenofanybodyfluid,tissueorwasteproductforexaminationoranalysis;',package,'includesanythinginwhichoranymeansbywhichfoodiswhollyorpartlycased,covered,enclosed,contained,placedorotherwisepackedinanywaywhatsoeverandincludesanybasket,pail,trayorreceptacleofanykindwhetheropenedorclosed;"premises1'includes-(a) anybuildingortentoranyotherstructure,permanentorotherwisetogetherwiththelandonwhichthebuilding,tentorotherstructureissituatedandanyadjoininglandusedinconnectiontherewithandanyvehicle,conveyance,vesseloraircraft;and(b) forthepurposesofsection4anystreet,openspaceorplaceofpublicresortorbicycleoranyvehicleusedfororinconnectionwiththepreparation,preservation,packaging,storage,conveyance,distributionorsaleofanyfood;,'preparation'*includesmanufacture,processingandanyformoftreatment;"sealincludesthedetention,inbulk,ofanyfood,asampleofwhichhasbeentakenforanalysis,pendingtheresultoftheanalysis;"sell"includesoffer,keep,exposeforsale,transmit,convey,deliverorprepareforsaleorexchange,disposeofforanyconsiderationwhatsoever,ortransmit,conveyordeliverinpursuanceofsuchsale,exchange,ordisposal;vegetablesubstance"meansanyplantorpartofaplant,andincludesthestem,root,bark,tuber,rhizome,leaf,stalk,inflorescene,bud,shoot,flowers,fruitandseed,oranextractthereof.PARTIIADMINISTRATIONANDENFORCEMENTSection3-AppointmentofAnalystsandAuthorisedOfficers(1) TheMinistermayappointsuchnumberofanalystsashemayconsidernecessaryforthepurposesofthisActandmaymakeregulationsconcerningtheirqualifications,conductandduties,andshallprepareorcausetobepreparedalistofappointedanalystsandreviseitasthecircumstancesmayrequire.(2) TheMinistermayappointsuchnumberofauthorisedofficersashemayconsidernecessaryforthepurposeofthisActandeveryauthorisedofficershallbeissuedwithaCertificateofAuthorisationwhichcertificateshallinanylegalproceedingsunderthisActbeadmissibleinevidenceandshallbeprimafacieevidenceofthefactssocertified.(3) TheMinistermay,inrelationtoanymatterwhichappearstohimtoaffectthegeneralinterestsoftheconsumer,authoriseanypublicofficertoprocureforanalysissamplesofanyfood,andthereuponthatofficershallhaveallthepowersofanauthorisedofficerunderthisAct,andthisActshallapplyasiftheofficerwasanauthorisedofficer.(4) TheanalystsandauthorisedofficersappointedunderthissectionshallbedeemedtobepublicservantswithinthemeaningofthePenalCode.Section4-PowerofAuthorisedOfficer(1) Anauthorisedofficermay,atanyhourreasonablefortheproperandbetterperformanceofhisduty-(a) enteranypremiseswherehebelievesanyfoodtowhichthisActappliesisprepared,preserved,packaged,stored,conveyed,distributedorsold,examineanysuchfoodandtakesamplesthereof,andexamineanythingthathebelievesisused,orcapableofbeingusedforsuchpreparation,preservation,packaging,storing,conveying,distributionorsale;(b) stop,searchordetainanyaircraft,shiporvehicleinwhichhebelievesonreasonablegroundsthatanyfoodtowhichthisActappliesisbeingconveyedandexamineanysuchfoodandtakesamplesthereofforthepurposesofthisAct;(c) openandexamineanypackagewhichhebelievescontainsanyfoodtowhichthisActapplies;(d) examineanybooks,documentsorotherrecordsfoundinanypremisesmentionedinparagraph(a)thathebelievescontainanyinformationrelevanttotheenforcementofthisActwithrespecttoanyfoodtowhichthisActappliesandmakecopiesthereofortakeextractstherefrom;(e) demandtheproductionoftheNationalRegistrationIdentityCard,theBusinessRegistrationCertificateoranyotherrelevantdocumentwhichtheauthorisedofficermayrequire;(f) seizeanddetainforsuchtimeasmaybenecessaryanyfoodbymeansoforinrelationtowhichhebelievesanyprovisionofthisActhasbeencontravened;or(g) mark,sealorotherwisesecure,weigh,countormeasureanyfoodorappliance,thepreparation,preservation,packaging,storage,conveyance,distributionorsaleofwhichisorappearstobecontrarytothisAct.(2) Anauthorisedofficeractingunderthissectionshall,ifsorequired,producehisCertificateofAuthorisation.(3) Anyowner,occupierorpersoninchargeofanypremisesenteredbyanyauthorisedofficerpursuanttoparagraph(a)ofsubsection(1),oranypersonfoundtherein,whodoesnotgivetotheauthorisedofficerallreasonableassistanceinhispowerorfurnishhimwithalltheinformationashemayreasonablyrequire,commitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearortofineortoboth.(4) Anypersonwhoobstructsorimpedesanyauthorisedofficerinthecourseofhisdutyorpreventsorattemptstopreventtheexecutionbytheauthorisedofficerofhisdutycommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearortofineortoboth.(5) AnauthorisedofficermayarrestwithoutwarrantanypersonwhomhehasreasontobelievetohavecommittedanoffenceunderthisActoranyregulationmadethereunderifthepersonfailstofurnishhisnameandaddressortherearereasonablegroundsforbelievingthathehasfurnishedafalsenameoraddressorthatheislikelytoabscond:ProvidedthatwhenanypersonhasbeenarrestedasaforesaidheshallthereafterbedealtwithasprovidedbytheCriminalProcedureCode.(6) Anypersonwhoknowinglymakesanyfalseormisleadingstatementeitherverballyorinwritingtoanyofficerengagedincarryingouthisdutycommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearortofineortoboth.(7) AnauthorisedofficershallreleaseanyfoodseizedbyhimwhenheissatisfiedthatalltheprovisionsoftheActwithrespecttoithavebeencomplied.(8) Whereanauthorisedofficerhasseizedanyfoodandtheownerorthepersoninwhosepossessionthefoodwasatthetimeofseizureconsentsinwritingtoitsdestruction,thefoodmaybedestroyedorotherwisedisposedofastheauthorisedofficermaydirectandiftheownerorthepersondoesnotconsenttothedestructionofthefood,theauthorisedofficermayapplytoacourtforthedestructionordisposalofthefoodandthecourtmaymakeanorderasitmaydeemfit,notwithstandingthattheownerorthepersonhasnotbeenconvictedofanyoffenceinconnectionwiththefood.(9) Whereanauthorisedofficerhasseizedanyfoodwhichisperishableinnatureandtheownerorthepersoninwhosepossessionthefoodwasatthetimeofseizuredoesnotconsentinwritingtoitsdestruction,theresponsibilityfortheproperstorageofsuchfoodsoastopreventitfromdeterioration,spoilage,damageortheft,pendingjudgementbythecourt,lieswiththeownerorsuchperson.(10) Whereanyfoodhasbeenseizedanddetainedunderparagraph(f)ofsubsection(1)andtheownerthereofhasbeenconvictedofanoffencethefoodmaybedestroyedorotherwisedisposedofasthecourtmaydirect.(11) Notwithstandinganyotherprovisionsofthissectionanauthorisedofficermaydestroyanyfoodwhereverfoundwhichisdeclayed,putrefiedorinjurioustohealthorfoodtheimportationofwhichisprohibitedorfoodwhichissurrenderedbytheownerfordestructiononpaymentbyhimofreasonablecharges.(12) Anypersonwhoremoves,altersorinterferesinanywaywithanyfoodseizedorsealedunderthisActwithouttheauthorityofanauthorisedofficercommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearorfineortoboth.(13) Anyfoodseizedmayattheoptionofanauthorisedofficerbekeptorstoredinthepremiseswhereitwasseizedormayatthedirectionofanauthorisedofficerberemovedtoanyotherproperplace.(14) Anauthorisedofficermaysubmitanyfoodseizedbyhimoranysamplefromitoranyothersampletakenbyhimtoanyapprovedlaboratoryforanalysisorexamination.(15) AnyauthorisedofficermayappearincourtandconductanyprosecutioninrespectofanyoffenceagainstthisAct.Section5-PowerToTakeSample(1) Onpaymentortendertoanypersonsellingfoodortohisagentorservant,ofthecurrentmarketvalueofthefood,anyauthorisedofficermayatanyplacedemandandselectandtakeorobtainsamplesofthefoodforthepurposeofanalysis.(2) Anauthorisedofficermayatanyplacedemandandselectandtakeorobtainsamplesforthepurposeofanalysiswithoutpaymentfromanymanufacturermakingfdforsaleorfromanyimporterofanyfoodorfromhisagentorservant.(3) Anysuchauthorisedofficermayrequirethepersonorhisagentorservanttoshowandpermittheinspectionofthepackageinwhichsuchfoodisatthetimekeptandtotaketherefromthesamplesdemanded.(4) Whereanyfoodiskeptforretailsaleinanunopenedpackage,nopersonshallberequiredbyanyauthorisedofficertoselllessthanthewholeofthecontentsofsuchpackage.(5) Anypersonwhorefusesorneglectstocomplywithanydemandorrequisitionmadebyanauthorisedofficerinpursuanceofthissectioncommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearortofineortoboth.Section6-ProcedureForTakingSample(1) Whereitisintendedtosubmitanysampleofanyfoodforanalysistheauthorizedofficerpurchasingorotherwiseprocuringthesampleshallinformthesellerorhisagentorservantsellingthefoodthatheintendstohavethesampleanalysedbyanyanalyst.(2) Theprocedurefortakinganddealingwiththesamplesshallbeasprescribedbyregulations.Section7-CertificateofAnalyst(1) Thecertificateoftheanalystshallbeintheformasprescribedbyregulations.(2) Whereanymethodofanalysishasbeenprescribedbyregulationsfortheanalysisofanyfood,theanalystshallfollow,andinhiscertificateofanalysisdeclarethathewasfollowed,theprescribedmethod.(3) Acopyoftheresultofanyanalysisofanyfoodprocuredbyauthorizedofficermaybeobtainedfromtheanalystbythepersonfromwhomthefoodsoanalysedwaspurchasedorobtainedonpaymentofsuchfeeasmaybeprescribed.(4) NocopyoftheresultofanyanalysismadeunderthisActoranyreproductionthereofshallbedisplayedorusedasanadvertisementandifanypersonsodisplaysorusessuchcopyorreproductionhecommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearortofineortoboth.Section8-PowerToCallForInformation(1) Ifanyauthorizedofficerisoftheopinionthatthereisreasonablegroundforsuspectingthatanypersonisinpossessionofanyfoodorothersubstanceofanyapplianceforthepurposeoforinconnectionwiththepreparation,preservation,packaging,storage,conveyance,distributionorsaleoffoodinbreachofanyoftheprovisionsofthisActoranyregulationsmadethereunderhemayrequiresuchpersontoproduceforhisinspectionanybook,documentsorotherrecordsoranyotherinformationrelatingtothereception,possession,purchase,saleordeliveryofsuchfoodorothersubstanceoranyappliance.(2) Anyauthorizedofficermentionedinsubsection(1)maymakeorcausetobemadecopiesoforextractsfromanysuchbook,documentsorrecords,oranyotherinformationandsuchcopiesorextractscertifiedassuchbysuchauthorizedofficershall,unlessthecontraryisproved,bedeemedtobetrueandcorrectcopiesorextracts.(3) Anypersonwhorefusesorneglectstocomplywithanyrequisitionmadeinpursuanceofthissectioncommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearortofineortoboth.(4) Anyauthorizedofficerwho-(a) doesnotmaintainthesecrecyofallmatterswhichcometohisknowledgeintheperformanceofhisofficialdutiesunderthissection;or(b) communicatesanysuchmattertoanypersonwhomsoeverforthepurposeofcarryingintoeffecttheprovisionsofthisAct,commitsanoffenceandisliableo
