Inordertoregulateexit/entryadministration,safeguardthesovereignty,securityandsocialorderofthePeople,sRepublicofChina,andpromoteforeignexchangesandopeningtotheoutsideworld,thisLawisherebyformulated.Article 2 ThisLawisapplicabletotheadministrationofexitandentryofChinesecitizens,entryandexitofforeigners,stayandresidenceofforeignersinChina,andtheexit/entryborderinspectionoftransportvehicles.Article 3 TheStateprotectsChinesecitizens,legitimaterightsandinterestsofexitingandenteringthecountry.ThelegitimaterightsandinterestsofforeignersinChinashallbeprotectedbylaws.ForeignersinChinashallabidebytheChineselaws,andshallnotendangerChina*snationalsecurity,harmpublicinterestsanddisruptsocialandpublicorder.Article 4 TheMinistryofPublicSecurityandtheMinistryofForeignAffairsshall,withinthescopeoftheirrespectiveresponsibilities,beresponsibleforadministeringe×itentryaffairs.EmbassiesandconsulatesofthePeople*sRepublicofChinaandotherinstitutionsstationedabroadentrustedbytheMinistryofForeignAffairs(hereinafterreferredtoas,thevisa-issuingauthoritiesabroad,)shallberesponsibleforissuanceofentryvisastoforeigners.Exit/entryborderinspectionauthoritiesshallberesponsibleforcarryingoutexit/entryborderinspection.Publicsecurityorgansunderlocalpeople*sgovernmentsatorabovethecountylevelandtheirexit/entryadministrationsshallberesponsiblefortheadministrationofthestayandresidenceOfforeigners.TheMinistryofPublicSecurityandtheMinistryofForeignAffairsmay,withinthescopeoftheirrespectiveresponsibilities,entrustexit/entryadministrationsofpublicsecurityorgansorforeignaffairsdepartmentsunderlocalpeople*sgovernmentsatorabovethecountyleveltoacceptforeigners*applicationsforentry,stayandresidenceinChina.Intheadministrationofexit/entryaffairs,theMinistryofPublicSecurityandtheMinistryofForeignAffairsshallstrengthencommunicationandcooperation,cooperatecloselywithrelevantdepartmentsundertheStateCouncil,andexercisefunctionsandpowersandbearliabilitieswithinthescopeoftheirrespectiveresponsibilitiesinaccordancewiththelaw.Article 5 TheStateshallestablishauniformexit/entryadministrationinformationplatformtoshareinformationamongrelevantadministrativedepartments.Article 6 TheStateshallestablishexit/entryborderinspectionauthoritiesattheportsopentoforeigncountries.Chinesecitizens,foreignersaswellastransportvehiclesshallexitorenterChinaviatheportsopentoforeigncountries,orviatheplacesapprovedbytheStateCouncilorbythedepartmentsauthorizedbytheStateCouncilunderspecialcircumstances.PersonnelandtransportvehiclesthatexitorenterChinashallbesubjecttoexit/entryborderinspection.Exit/entryborderinspectionauthoritiesshallberesponsibleforrelevantadministrationworkintherestrictedzonesofports.Onthebasisoftheneedforsafeguardingnationalsecurityandmaintainingtheorderofexit/entryadministration,exit/entryborderinspectionauthoritiesmayconductborderinspectiononthebelongingsofthepersonswhoexitorenterChina.Whennecessary,exit/entryborderinspectionauthoritiesmayconductborderinspectiononthegoodscarriedbytransportvehiclesthatexitorenterChina.Howeverexit/entryborderinspectionauthoritiesshallnotifytheCustomsofsuchinspections.Article 7 UponapprovalbytheStateCouncil,theMinistryofPublicSecurityandtheMinistryofForeignAffairsmay,onthebasisoftheneedforexit/entryadministration,setforthregulationsonthecollectionandkeepoffingerprintsandotherbiometricidentificationinformationofthepersonswhoexitorenterChina.WhereforeigngovernmentshavespecialregulationsonissuingvisastoChinesecitizensortheexit/entryadministrationofChinesecitizens,theChinesegovernmentmay,asthecircumstancesrequire,takecorrespondingandequivalentmeasures.Article 8 Departmentsandinstitutionsthatareresponsiblefortheexit/entryadministrationshalltakepracticalmeasures,constantlyimproveserviceandadministration,enforcelawsimpartially,provideconvenientandefficientserviceandensurethesecurityandconveyanceoftheexit/entryprocedures.ChapterIIExitandEntryofChineseCitizensArticle 9 ChinesecitizenswhoexitorenterChinashallrinaccordancewiththelaw,applyforpassportsorothertraveldocuments.Chinesecitizensboundforothercountriesorregionsshallobtainvisasorotherentrypermitsfromdestinationcountries,unlesstheChinesegovernmenthassignedvisaexemptionagreementswiththegovernmentsofthosecountries,orotherwisestipulatedbytheMinistryofPublicSecurityandtheMinistryofForeignAffairs.ChinesecitizenswhoexitorenterChinaasseamenorworkonforeignshipsshallapplyforseamen,scertificatesinaccordancewiththelaw.Article 10 ChinesecitizenswhotravelbetweentheMainlandandtheHongKongSpecialAdministrativeRegion,betweentheMainlandandtheMacaoSpecialAdministrativeRegion,andbetweentheMainlandandTaiwanRegion,shallapplyforexit/entrypermitsinaccordancewiththelaw,andabidebytherelevantprovisionsofthisLaw.ThespecificadministrativemeasuresshallbestipulatedbytheStateCouncil.Article 11 ChinesecitizenswhoexitorenterChinashallsubmittheirexit/entrydocumentssuchaspassportsorothertraveldocumentstotheexit/entryborderinspectionauthoritiesforexamination,gothroughtheprescribedformalities,andmayexitorenteruponexaminationandapproval.Forportsthatmeetrelevantconditions,exit/entryborderinspectionauthoritiesshallprovideconveniencesuchasspeciallanesfortheexitandentryofChinesecitizens.Article 12 Underanyofthefollowingcircumstances,ChinesecitizensarenotallowedtoexitChina:(1) Holdnovalidexit/entrydocuments,orrefuseorevadeborderinspection;(2) Aresentencedtocriminalpunishments,theexecutionofwhichhavenotbeencompleted,oraresuspectsordefendantsincriminalcases;(3) AreinvolvedinunsettledcivilcasesandnotallowedtoexitChinaupondecisionofthepeople*scourts;(4) Aresubjecttocriminalpunishmentforimpairingborderadministration,orarerepatriatedbyothercountriesorregionsduetoillegalexitfromChina,illegalresidenceorillegalemployment,andtheNo-Exit-from-Chinaperiodhasnotexpired;(5) Mayendangernationalsecurityorinterests,andarenotallowedtoexitChinaupondecisionbycompetentdepartmentsundertheStateCouncil;or(6) OthercircumstancesinwhichexitfromChinaisnotallowedinaccordancewithlawsoradministrativeregulations.Article13ChinesecitizensresidingabroadwhodesiretoreturntoChinaforpermanentresidenceshall,priortotheentry,fileapplicationswithChineseembassiesorconsulatesorotherinstitutionsstationedabroadentrustedbytheMinistryofForeignAffairs.TheymayalsofilesuchapplicationstotheoverseasChineseaffairsdepartmentsunderthelocalpeople/sgovernmentsatorabovethecountyleveloftheproposedplacesofpermanentresidenceontheirownorviatheirrelativesinChina.Article14Whenhandlingfinancialaffairsoraffairsinvolvingeducation,medicaltreatment,transportation,telecommunications,socialinsuranceorpropertyregistration,whereidentitycertificatesarerequired,Chinesecitizensresidingabroadmayprovidetheirpassportsforproofofidentity.ChapterIIIEntryandExitofForeignersSection1VisaArticle 15 InordertoenteringChina,foreignersshallapplytothevisa-issuingauthoritiesstationedabroadforavisa,exceptasotherwiseprovidedforinthisLaw.Article 16 Visasarecategorizedasdiplomaticvisa,courtesyvisa,officialvisaandordinaryvisa.DiplomaticorofficialvisasshallbeissuedtoforeignerswhoenterChinafordiplomaticorofficialreasons;andcourtesyvisasshallbeissuedtoforeignerswhoaregivencourtesyduetotheirspecialstatus.Thescopeandmeasuresforissuingdiplomatic,courtesyandofficialvisasshallbestipulatedbytheMinistryofForeignAffairs.AppropriatetypesofordinaryvisashallbeissuedtoforeignerswhoenterChinaduetonon-diplomaticorofficialreasonsincludingwork,study,familyvisit,travel,businessactivitiesandtalentintroduction.ThetypesofordinaryvisaandrelevantissuancemeasuresshallbestipulatedbytheStateCouncil.Article 17 Theregistereditemsofavisashallincludevisatype,name,sex,dateofbirth,numberofallowedentries,validityperiodofentryanddurationofstayoftheholder;dateandplaceofissuance,aswellaspassportnumberorotherinternationaltraveldocumentsnumber.Article 18 Foreignerswhoapplyforvisasshallsubmittheirpassportsorotherinternationaltraveldocuments,aswellasinformationofspecificapplicationmatters,tothevisa-issuingauthoritiesstationedabroad.Theyshallgothroughrelevantformalitiesandacceptinterviewsinaccordancewiththerequirementsofthevisa-issuingauthoritiesstationedabroad.Article 19 WhereforeignersapplyingforvisasneedtoprovidewritteninvitationsissuedbyentitiesorindividualswithinChina,theapplicantsshallprovidesuchinvitationsinaccordancewiththerequirementsofthevisa-issuingauthoritiesabroad.Entitiesorindividualsthatissuewritteninvitationsshallbeliableforthefidelityofthecontents.Article 20 ForeignerswhoneedtoenterChinaurgentlyforhumanitarianreasons,orareinvitedtoenterChinaforurgentbusinessorrushrepairwork,orhaveotherurgentneeds,andholdmaterialsthatprovethecompetentdepartments,approvaloftheirapplyingforvisasatport,mayapplyforportvisaswiththevisa-issuingauthoritiesentrustedbytheMinistryofPublicSecurityattheports(hereinafterreferredtoas,portvisaauthorities*)whichareapprovedtoissueportvisasbytheStateCouncil.TravelagenciesthatorganizeinboundtourisminaccordancewithrelevantStateregulationsmayapplyforgrouptouristvisasfromportvisaauthorities.Foreignerswhoapplytoportvisaauthoritiesforvisasshallsubmittheirpassportsorotherinternationaltraveldocuments,aswellasrelevantinformationofspecificapplicationmatters.Theyshallgothroughrelevantformalitiesinaccordancewiththerequirementsoftheportvisaauthorities,andenterChinaattheportswheretheyapplyforvisas.Visasissuedbyportvisaauthoritiesshallbesingleentryandthedurationofstayshallnotexceed30days.Article 21 Underanyofthefollowingcircumstances,visasshallnotbeissuedtoforeigners:(1) Wasdeported,orwasrepatriatedupondecision,andtheNo-Entry-into-Chinaperiodhasnotexpired;(2) Issufferingfromseriousmentaldisorders,infectioustuberculosisorotherinfectiousdiseasesthatmaySeverelyjeopardizethepublichealth;(3) MayendangerChina,snationalsecurityorinterests,ordisruptsocialandpublicorder;orengageinotherillegalorcriminalactivities;(4) ResorttofraudulentactsinvisaapplicationorcannotguaranteeexpectedexpendituresduringtheirstayinChina;(5) Failtosubmitrelevantinformationrequiredbythevisa-issuingauthorities;or(6) Othercircumstancesinwhichvisaauthoritiesconsideravisashouldnotbeissued.Thevisa-issuingauthoritiesarenotrequiredtogivereasonsforrefusingtheissuanceofavisa.Article 22 Underanyofthefollowingcircumstances,foreignersmaybeexemptfromapplyingforvisas:(1) SoexemptedbasedonthevisaexemptionagreementssignedbytheChinesegovernmentwiththegovernmentsofothercountries;(2) Holdvalidforeigners*residencepermits;(3) Holdconnectedpassengerticketsandareintransittoathirdcountryorregionbyaninternationalaircraft,shiportrainviaChina,willstayfornotmorethan24hoursinChinawithoutleavingtheportofentry,orwillstayinthespecificzonesapprovedbytheStateCouncilwithintheprescribedtimelimit;or(4) OthercircumstancesstipulatedbytheStateCouncilinwhichvisasmaybeexempted.Article 23 WhereforeignersunderanyofthefollowingcircumstancesneedtoenterChinatemporarily,theyshallapplytoexit/entryborderinspectionagenciesforgoingthroughtheformalitiesfortemporaryentry:(1) Foreignseamenandtheiraccompanyingfamilymembersdisembarkatcitieswheretheportsarelocated;(2) PersonsspecifiedinSubparagraph(3)ofArticle22ofthisLawneedtoleaveports;or(3) ForeignersneedtoenterChinatemporarilyduetoforcemajeureorforanyotherurgentreason.Thedurationofstayfortemporaryentryshallnotexceed15days.Forforeignerswhoapplyforgoingthroughtheformalitiesfortemporaryentry,exit/entryborderinspectionauthoritiesmayrequiresuchforeigners,thepersonsinchargeofthetransportvehiclesusedforsuchforeigners,entryortheagencieshandlingtheexit/entrybusinessfortransportvehiclestoprovidenecessaryguarantymeasures.Section2EntryandExitArticle 24 ForeignerswhoenterChinashallsubmittheirpassports,otherinternationaltraveldocuments,visasorotherentrypermitstotheexit/entryborderinspectionauthoritiesforexamination,gothroughtheprescribedformalities,andmayenteruponexaminationandapproval.Article 25 Underanyofthefollowingcircumstances,foreignersshallnotbeallowedtoenterChina:(1) Holdnovalide×itentrydocuments,orrefuseorevadeborderinspection;(2) AreinvolvedinanyofthecircumstancesspecifiedinSubparagraph(1)through(4)ofthefirstparagraphofArticle21ofthisLaw;(3) MayengageinactivitiesnotconformtothetypesofvisaafterenteringChina;or(4) Othercircumstancesinwhichentryisnotallowedinaccordancewithlawsoradministrativeregulations.Exit/entryborderinspectionauthoritiesarenotrequiredtogivereasonsfordenyinganentry.Article 26 Exit/entryborderinspectionauthoritiesshallorderforeignerswhoaredeniedentryinChinatoreturn,andshallforcethereturnofthosewhorefusetodoso.Whilewaitingforreturn,thoseforeignersshallnotleavetherestrictedzones.Article 27 ForeignerswhoexitChinashallsubmittheirexit/entrydocumentsincludingpassportsorotherinternationaltraveldocumentstotheexit/entryborderinspectionauthoritiesforexamination,gothroughprescribedformalities,andmayexituponexaminationandapproval.Article 28 Underanyofthefollowingcircumstances,foreignersshallnotbeallowedtoexitChina:(1) Aresentencedtocriminalpunishments,theexecutionofwhicharenotcompleted,orsuspectsordefendantsincriminalcases,exceptthosewhoaresentencedandtransferredunderrelevantagreementsbetweenChinaandforeigncountries;(2) AreinvolvedinunsettledcivilcasesandarenotallowedtoexitChinaupondecisionofthepeople*scourts;(3) AreinarrearsofpayingofflaborremunerationandthereforearenotallowedtoexitbydecisionoftherelevantdepartmentsundertheStateCouncilorofthepeople,sgovernmentsofprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernment;or(4) Othercircumstancesinwhichexitshallnotbeallowedinaccordancewithlawsoradministrativeregulations.ChapterIVStayandResidenceofForeignersSection1StayandResidenceArticle29Wherethedurationofstayspecifiedinavisaheldbyaforeignerdoesnotexceed180days,theholdermaystayinChinawithinthedurationspecifiedtherein.Wherethedurationofstayneedstobeextended,thevisaholdershallfileanapplicationwiththeexit/entryadministrationofpublicsecurityorganunderthelocalpeople*sgovernmentatorabovethecountylevelintheplaceofhisstaysevendayspriortoth
