251)(第251号)TheMeasuresoftheCustomsofthePeople,sRepublicofChinafortheCreditAdministrationofEnterprisesRegisteredandFiledwiththeCustoms,asdeliberatedandadoptedattheexecutivemeetingoftheGeneralAdministrationofCustomsonSeptember6j2021,areherebyissuedandshallcomeintoforceonNovember1,2021,uponwhichtheMeasuresoftheCustomsofthePeople'sRepublicofChinafortheAdministrationofEnterpriseCreditissuedbyOrderNo.237oftheGeneralAdministrationofCustomsonMarch3,2018,shallberepealed.Minister:NiYuefengSeptember13,2021MeasuresoftheCustomsofthePeople,sRepublicofChinafortheCreditAdministrationofEnterprisesRegisteredandFiledwiththeCustomsChapterIGeneralProvisionsArticle1ForthepurposesofestablishingthecreditadministrationrulesforenterprisesregisteredandfiledwiththeCustoms,advancingthebuildingofasocialcreditsystem,andpromotingtradesecurityandfacilitation,theseMeasuresaredevelopedinaccordancewiththeCustomsLawofthePeople'sRepublicofChina,theRegulationofthePeople'sRepublicofChinaonCustomsInspection,theInterimRegulationonEnterpriseInformationDisclosure,theRegulationonOptimizingtheBusinessEnvironmentandotherrelevantlawsandadministrativeregulations.Article2TheseMeasuresshallapplytothecollectionandpublicationofthecreditinformationofenterprisesregisteredandfiledwiththeCustoms(hereinafterreferredtoas“enterprises”)andthatofrelevantpersonnelofenterprisesandthecertification,determinationandadministrationofenterprises'creditstanding,amongothers.Article3TheCustomsshallconductcreditadministrationofenterprisesundertheprinciplesoffacilitatingtheenterprisesactingingoodfaithandcomplyingwithlawsandpunishingthoseactinginbadfaithorviolatinglaws,compliancewithlawsandregulations,andfairnessandopenness.中华人民共和国海关注册登记 和备案企业信用管理办法第一章总则第一条为了建立海关注 册登记和备案企业信用管理制 度,推进社会信用体系建设, 促进贸易安全与便利,根据 中华人民共和国海关法、 中华人民共和国海关稽查条 例、企业信息公示暂行条 例、优化营商环境条例 以及其他有关法律、行政法规 的规定,制定本办法。第二条海关注册登记和 备案企业(以下简称企业)以 及企业相关人员信用信息的采 集、公示,企业信用状况的认 证、认定及管理等适用本办 法。第三条海关按照诚信守 法便利、失信违法惩戒、依法 依规、公正公开原则,对企业 实施信用管理。第四条海关根据企业申 请,按照本办法规定的标准和 程序将企业认证为高级认证企Article4WheretheCustomshascertifiedanenterpriseasanadvancedcertifiedenterpriseuponitsrequestaccordingtothestandardsandproceduresspecifiedintheseMeasures,theenterpriseshallbesubjecttofacilitativeadministrationmeasures.WheretheCustomshas,basedonthecreditinformationcollected,determinedanenterprisethatviolatesanylaworregulationasadishonestenterpriseaccordingtothestandardsandproceduresspecifiedintheseMeasures,theenterpriseshallbesubjecttostrictadministrationmeasures.TheCustomsshallimplementroutineadministrationmeasuresforenterprisesotherthanadvancedcertifiedenterprisesanddishonestenterprises.Article5TheCustomsshallprovideenterpriseswithcreditcultivationservicestohelpthemenhancetheirawarenessofactingingoodfaithandabidingbythelawandimprovethelevelofbusinessoperationsingoodfaith.Article6TheCustomsshall,asrequiredforthebuildingofasocialcreditsystem,implementthemechanismofprovidingjointincentivestothosewhoactingoodfaithandtakingjointpunitiveactionsagainstthosewhoactinbadfaithinconjunctionwiththerelevantdepartmentsofthestatetopromoteinformationexchange,mutualrecognitionofsupervision,andmutualassistanceinlawenforcement.Article 7 TheCustomsshallestablishanenterprisecreditrepairmechanismforthecreditrepairofenterprisesinaccordancewiththelaw.业的,对其实施便利的管理措 施。海关根据采集的信用信息,按 照本办法规定的标准和程序将 违法违规企业认定为失信企业 的,对其实施严格的管理措 施。海关对高级认证企业和失信企 业之外的其他企业实施常规的 管理措施。第五条海关向企业提供 信用培育服务,帮助企业强化 诚信守法意识,提高诚信经营 水平。第六条海关根据社会信 用体系建设有关要求,与国家 有关部门实施守信联合激励和 失信联合惩戒,推进信息互 换、监管互认、执法互助。第七条海关建立企业信 用修复机制,依法对企业予以 信用修复。第八条中国海关依据有Article 8 ChinaCustomsshallimplementthemutualrecognitionofAuthorizedEconomicOperators(uAEOj,)betweenChinaCustomsandtheCustomsofothercountriesorregionsinaccordancewithrelevantinternationaltreatiesandagreementsandtheseMeasures,andprovidethecorrespondingfacilitationformutuallyrecognizedenterprises.Article 9 TheCustomsshallestablishanadministrationsystemforenterprisecredit,andimprovethelevelofenterprisecreditadministrationbytheCustomsbyinformationtechnologymeans.ChapterIlCollectionandPublicationofCreditInformationArticle 10 TheCustomsmaycollectthefollowinginformationwhichcanreflectthecreditstandingofenterprises:(1) Theinformationonregistrationorrecordationofenterprisesandthebasicinformationontherelevantpersonnelofenterprises.(2) Informationonorrelatedtotheimportandexportoperationsofenterprises.(3) Informationonadministrativelicensingforenterprises.(4) Informationonadministrativepunishmentandcriminalpunishmentimposedonenterprisesandtheirrelevantpersonnel.关国际条约、协定以及本办 法,开展与其他国家或者地区 海关的“经认证的经营者”(AEO)互认合作,并且给予 互认企业相关便利措施。第九条海关建立企业信 用管理系统,运用信息化手段 提升海关企业信用管理水平。第二章信用信息采集和公示第十条海关可以采集反 映企业信用状况的下列信息:(一)企业注册登记或者备案 信息以及企业相关人员基本信 息;(二)企业进出口以及与进出 口相关的经营信息;(三)企业行政许可信息;(四)企业及其相关人员行政 处罚和刑事处罚信息;(五)海关与国家有关部门实 施联合激励和联合惩戒信息;(5) InformationonthejointincentivesandjointpunitiveactionsimplementedbytheCustomsandtherelevantdepartmentsofthestate.(6) InformationonthemutualrecognitionofAEO.(六)AEO互认信息;(7) Otherrelevantinformationreflectingthecreditstandingofenterprises.Article 11 TheCustomsshallpublishthefollowingcreditinformationinatimelymanner,andmakepublicthewaysofinquiry.(1) TheinformationonregistrationorrecordationofanenterprisewiththeCustoms.(2) TheresultoftheCustoms*certificationordeterminationofanenterprise'screditstanding.(3) InformationontheadministrativelicensingofanenterprisebytheCustoms.(4) InformationontheadministrativepunishmentimposedbytheCustomsontheenterprise.(5) InformationonthejointincentivesandjointpunitiveactionsimplementedbytheCustomsandtherelevantdepartmentsofthestate.(6) Otherinformationthatshallbepublishedinaccordancewiththelaw.(七)其他反映企业信用状况 的相关信息。第十一条海关应当及时 公示下列信用信息,并公布查 询方式:(一)企业在海关注册登记或 者备案信息;(二)海关对企业信用状况的 认证或者认定结果;(三)海关对企业的行政许可 信息;(四)海关对企业的行政处罚 信息;(五)海关与国家有关部门实 施联合激励和联合惩戒信息;(六)其他依法应当公示的信 息。公示的信用信息涉及国家秘 密、国家安全、社会公共利 益、商业秘密或者个人隐私 的,应当依照法律、行政法规 的规定办理。Wherethecreditinformationpublishedinvolvesstatesecrets,nationalsecurity,publicinterests,tradesecretsorpersonalprivacy,itshallbehandledinaccordancewiththeprovisionsoflawsandadministrativeregulations.Article 12 Whereanaturalperson,legalpersonorunincorporatedorganizationdeemsthatthecreditinformationpublishedbytheCustomsisinaccurate,itmayfileanobjectionwiththeCustoms,andprovidetherelevantmaterialsorevidentiarymaterials.TheCustomsshallconductreviewwithin20daysafterreceivingtheobjectionapplication.Wherethegroundsforanobjectionfiledbyanynaturalperson,legalpersonorunincorporatedorganizationaretenable,theCustomsshalladopttheobjection.ChapterIIIStandardsandProceduresfortheCertificationofAdvancedCertifiedEnterprisesArticle 13 Thestandardsforthecertificationofadvancedcertifiedenterprisesaredividedintogeneralcriteriaandspecificcriteria.Generalcriteriaforadvancedcertifiedenterprisesshallincludeinternalcontrol,financialstatus,compliancewithlawsandregulations,andtradesecurity,amongothers.SpecificcriteriaforadvancedcertifiedenterprisesarethecertificationstandardsdevelopedbytheCustomsfordifferenttypesofcompaniesandbusinessscopes.Article 14 Advancedcertifiedenterprisesshallmeetbothgeneralcriteriaandcorrespondingspecificcriteria.第十二条自然人、法人 或者非法人组织认为海关公示 的信用信息不准确的,可以向 海关提出异议,并且提供相关 资料或者证明材料。海关应当自收到异议申请之日 起20日内进行复核。自然 人、法人或者非法人组织提出 异议的理由成立的,海关应当 采纳。第三章高级认证企业的认证 标准和程序第十三条高级认证企业 的认证标准分为通用标准和单 项标准。高级认证企业的通用标准包括 内部控制、财务状况、守法规 范以及贸易安全等内容。高级认证企业的单项标准是海 关针对不同企业类型和经营范 围制定的认证标准。第十四条高级认证企业 应当同时符合通用标准和相应 的单项标准。通用标准和单项标准由海关总GeneralcriteriaandspecificcriteriashallbedevelopedandissuedbytheGeneralAdministrationofCustomsseparately.Article 15 Whereanenterpriseappliesforthestatusofanadvancedcertifiedenterprise,itshallsubmittotheCustomsawrittenapplication,andsubmitrelevantmaterialsasrequiredbytheCustoms.Article 16 TheCustomsshall,accordingtogeneralcriteriaforadvancedcertifiedenterprisesandcorrespondingspecificcriteria,examinetheapplicationsandrelevantmaterialssubmittedbyenterprises,andvisitenterprisesforfieldcertification.Article 17 TheCustomsshall,within90daysofreceiptofanapplicationandrelevantmaterials,conductcertificationandmakeadecision.Underanyspecialcircumstance,thetimelimitfortheCustoms'certificationmaybeextendedby30days.Article 18 Foranenterprisethatmeetsthecriteriaforadvancedcertifiedenterprisesuponcertification,theCustomsshallmakeandissuetheCertificateofanAdvancedCertifiedEnterprise;andforanenterprisethatfailstomeetthecriteriaforadvancedcertifiedenterprises,theCustomsshallmakeandissueawrittendecisionthattheenterprisefailstopassthecertification.署另行制定并公布。第十五条企业申请成为 高级认证企业的,应当向海关 提交书面申请,并按照海关要 求提交相关资料。第十六条海关依据高级 认证企业通用标准和相应的单 项标准,对企业提交的申请和 有关资料进行审查,并赴企业 进行实地认证。第十七条海关应当自收 到申请及相关资料之日起90 日内进行认证并作出决定。特 殊情形下,海关的认证时限可 以延长30 Bo第十八条经认证,符合 高级认证企业标准的企业,海 关制发高级认证企业证书;不 符合高级认证企业标准的企 业,海关制发未通过认证决定 书。高级认证企业证书、未通过认 证决定书应当送达申请人,并 且自送达之日起生效。TheCertificateofanAdvancedCertifiedEnterpriseandthewrittendecisionthattheenterprisefailstopassthecertificationshallbeservedontheapplicant,andcomeintoforceonthedateofservice.Article 19 TheCustomsshallreviewanadvancedcertifiedenterpriseonceeveryfiveyears.Wherethecreditstatusoftheenterpriseisabnormal,theCustomsmayconductreviewatregularintervals.Where,uponreview,anenterprisenolongermeetsthecriteriaforadvancedcertifiedenterprises,theCustomsshallmakeandissueawrittendecisionthattheenterprisefailstopassthereview,andwithdrawtheCertificateofanAdvancedCertifiedEnterprise.Article 20 TheCustomsmayauthorizeasocialintermediarytoprovideprofessionalconclusionsonissuesconcerningthecertificationandreviewofadvancedcertifiedenterprises.Theprofessionalconclusionsonissuesconcerningthecertificationandreviewofadvancedcertifiedenterprisesprovidedbyasocialintermediaryauthorizedbyanenterprisemaybetakenasthereferencebasisforcustomscertificationandreview.Article 21 Whereanenterprisefallsunderanyofthefollowingcircumstances,itmaynotsubmitanapplicationforbeingcertifiedasanadvancedcertifiedenterprisewithinoneyear:(1) Itfailstopassthecertificationorreviewofadvancedcertifiedenterprises.(2) Itabandonstheimplementationofadministrationofadvancedcertifiedenterprises.第十九条海关对高级认 证企业每5年复核一次。企业 信用状况发生异常情况的,海 关可以不定期开展复核。经复核,不再符合高级认证企 业标准的,海关应当制发未通 过复核决定书,并收回高级认 证企业证书。第二十条海关可以委托 社会中介机构就高级认证企业 认证、复核相关问题出具专业 结论。企业委托社会中介机构就高级 认证企业认证、复核相关问题 出具的专业结论,可以作为海 关认证、复核的参考依据。第二十一条企业有下列 情形之一的,1年内不得提出 高级认证企业认证申请:(一)未通过高级认证企业认 证或者复核的;(二)放弃高级认证企业管理 的;(三)撤回高级认证企业认证(3) Itwithdrawsanapplicationforbeingcertifiedasanadvancedcertifiedenterprise.(4) Asanadvancedcertifiedenterprise,ithasitscreditratingdowngradedbytheCustoms.(5) Asadishonestenterprise,ithasitscreditratingupgradedbytheCustoms.ChapterIVStandardsandProceduresfortheDeterminationofDishonestEnterprisesandCreditRepairArticle22AnenterprisethatfallsunderanyofthefollowingcircumstancesshallbedeterminedbytheCustomsasadishonestenterprise:申请的;(四)高级认证企业被海关下调信用等级的;(五)失信企业被海关上调信用等级的。第四章失信企业的认定标准、程序和信用修复第二十二条企业有下列情形之一的,海关认定为失信企业:(一)被海关侦查走私犯罪公 安机构立案侦查并由司法机关 依法追究刑事责任的;(二)构成走私行为被海关行 政处罚的;(三)非报关企业1年内违反 海关的监管规定被海关行政处 罚的次数超过上年度报关单、 进出境备案清单、进出境运输 工具舱单等单证(以下简称 “相关单证”)总票数千分之 一且被海关行政处罚金额累计 超过100万元的;(1) Itisunderformalinvestigationbythepublicsecurityinstitutionofacustomsofficeresponsiblefortheinvestigationintosmugglingcrimesandisheldcriminallyliablebythejudicialauthorityinaccordancewiththelaw.(2) ItissubjecttoadministrativepunishmentbytheCustomsforcommittingsmuggling.(3) Asforanenterpriseotherthanacustomsbroker,thenumberofadministrativepunishmentsimposedbytheCustomsforviolationsofcustomssupervisionprovisionswithinoneyearexceeds1%oofthetotalnumberofcustomsdeclarationforms,importandexportrecordationlists,manifestsforinboundandoutboundmeansoftransportandotherrelevantdocuments(hereinafterreferredtoas“relevantdocuments”)ofthepreviousyear,andtheaccumulativeamountofadministrativefineimposedbytheCustomsexceeds1millionyuan.报关企业1年内违反海关的监 管规定被海关行政处罚的次数 超过上年度相关单证总票数万 分之五且被海关行政处罚金额 累计超过30万元的;Asforacustomsbroker,thenumberofadministrativepunishmentsimposedbytheCustomsforviolationsofcustomssupervisionprovisionswithinoneyearexceeds0.5ofthetotalnumberofrelevantdocumentsofthepreviousyear,andtheaccumulativeamountofadministrativefineimposedbytheCustomsexceeds300,000yuan.上年度相关单证票数无法计算 的,1年内因违反海关的监管 规定被海关行政处罚,非报关 企业处罚金额累计超过100万 元、报关企业处罚金额累计超 过30万元的;Wherethenumberofrelevantdocumentsinthepreviousyearcannotbecalculated,theenterpriseissubjecttoadministrativepunishmentbytheCustomsforviolatingcustomssupervisionprovisionswithinoneyear,andtheaccumulativeamountofadministrativefineimposedexceeds1millionyuaniftheenterpriseisnotacustomsbroker,ortheaccumulativeamountofadministrativefineimposedexceeds300,000yuaniftheenterpriseisacustomsbroker.(四)自缴纳期限届满之日起 超过3个月仍未缴纳税款的;(4) Itfailstopaytaxesoverthreemonthsaftertheexpirationofthepaymentperiod.(五)自缴纳期限届满之日起 超过6个月仍未缴纳罚款、没 收的违法所得和追缴的走私货 物、物品等值价款,并且超过 1万元的;(5) Itfailstopaythefineimposed,illegalproceedsconfiscatedortheamountequivalenttothevalueofsmuggledgoodsandarticlesrecovered,whichisworthmorethan10,000yuan,oversixmonthsaftertheexpirationofthepaymentperiod.(六)抗拒、阻碍海关工作人 员依法执行职务,被依法处罚 的;(6) Itresistsorobstructscustomsofficers'legalperformanceoftheirduties,andhasbeenlegallypunished.(七)向海关工作人员行贿, 被处以罚款或者被依法追究刑 事责任的;(7) Itisfinedorheldcriminallyliableinaccordancewiththelawforofferingbribestoacustomsofficer.(A)法律、行政法规、海关 规章规定的其他情形。(8) Othercircumstancesasprovidedforinlaws,administrativeregulationsandcustomsrules.第二十三条失信企业存 在下列情形的,海关依照法 律、行政法规等有关规定实施 联合惩戒,将其列入严重失信 主体名单:Article23Whereadishonestenterprisefallsunderanyofthefollowingcircumstances,theCustomsshalltakejointpunitiveactionsagainstitinaccordancelaws,administrativeregulationsandotherrelevantprovisions,andincludeitinthelistofseriouslydishonestparties:(一)违反进出口食品安全管 理规定、进出口化妆品监督管 理规定或者走私固体废物被依 法追究刑事责任的;(1) Itisheldcriminallyliableinaccordancewiththelawforviolatingtheprovisionsontheadministrationofsafetyofimportedandexportedfoodortheprovisionsonthesupervisionandadministrationofimportedandexportedcosmeticsorsmugglingsolidwastes.(二)非法进口固体废物被海
