1 ThisRegulationisformulatedtomaintaintheorderofroadtransportmarket,ensurethesafetyofroadtransport,protectthelegitimaterightsandinterestsofallpartiesinvolvedinroadtransportandpromotethehealthydevelopmentofroadtransport.Article 2 AnyoneengaginginroadtransportbusinessandotheroperationsrelatingtoroadtransportshallabidebythisRegulation.Theterm,roadtransportbusiness*asmentionedintheprecedingparagraphshallincludebusinessofroadpassengertransportandbusinessofroadfreighttransport.Theterm"otheroperationsrelatingtoroadtransport"shallincludethebusinessoperationsofstations(yard),businessoperationsofmotorvehiclemaintenance,andmotorvehicledrivertraining.Article 3 Theprincipleoflawfuloperation,honestyandgoodfaith,andfaircompetitionshallbeobservedbyallthoseengagingintheroadtransportbusinessandotheroperationsrelatingtoroadtransport.Article 4 Theroadtransportadministrationshallbeconsistentwiththeprincipleoffairness,impartiality,opennessandfacilitatingthepeople.第一章总 则第一条为了维护道路 运输市场秩序，保障道路运输 安全，保护道路运输有关各方 当事人的合法权益，促进道路 运输业的健康发展，制定本条 例。第二条从事道路运输 经营以及道路运输相关业务 的，应当遵守本条例。前款所称道路运输经营包括 道路旅客运输经营（以下简称 客运经营）和道路货物运输经 营（以下简称货运经营）；道 路运输相关业务包括站（场） 经营、机动车维修经营、机动 车驾驶员培训。第三条从事道路运输 经营以及道路运输相关业务， 应当依法经营，诚实信用，公 平竞争。第四条道路运输管理， 应当公平、公正、公开和便民。第五条国家鼓励发展 乡村道路运输，并采取必要的Article 5 ThestateshallencouragethedevelopmentofruralroadtransportandGhaIltknacaaaarvmGrtnnrmanytowns,townshipsandadministrativevillagesaspossibletohavebusessoastosatisfythelivingandproductionneedsofthefarmers.Article 6 TheStateencouragesroadtransportenterprisestoengageinlarge-scalebutintensivebusinessoperations.Noentityorindividualmayblockadeormonopolizetheroadtransportmarket.措施提高乡镇和行政村的通 班车率，满足广大农民的生活 和生产需要。第六条国家鼓励道路 运输企业实行规模化、集约化 经营。任何单位和个人不得封 锁或者垄断道路运输市场。第七条国务院交通运 输主管部门主管全国道路运 输管理工作。Article 7 ThetransportdepartmentoftheStateCouncilshalltakechargeofroadtransportadministrationnationwide.Thetransportdepartmentofthelocalpeople'sgovernmentatorabovethecountylevelshallberesponsibleforroadtransportadministrationwithinitsadministrativeregion.ChapterIlRoadTransportBusinessOperationSectionIPassengerTransportArticle8Anyonewhowishestoengageinthepassengertransportbusinessshall:县级以上地方人民政府交通运输主管部门负责本行政区域的道路运输管理工作。第二章道路运输经营第一节客运第八条申请从事客运经营的，应当具备下列条件：a.havevehiclesthatcanmeetthedemandofitsbusinessoperationsandthatarefoundtobequalifiedupontest;（一）有与其经营业务相适应并经检测合格的车辆；b.havedriversthatmeettherequirementsasdescribedinArticle9ofthisRegulation;and（二）有符合本条例第九条规定条件的驾驶人员；c.havesoundrulesandbylawsregardingsafeoperations.（三）有健全的安全生产管理制度。AnyonewhowishestoengageinroutePassenqertransportbusinessoperations申请从事班线客运经营的，还应当有明确的纬路和油占方案。第九条从事客运经营 的驾驶人员，应当符合下列条 件：（一）取得相应的机动车驾驶 证；（二）年龄不超过60周岁；（三）3年内无重大以上交通 责任事故记录；（四）经设区的市级人民政府 交通运输主管部门对有关客 运法律法规、机动车维修和旅 客急救基本知识考试合格。第十条申请从事客运 经营的，应当依法向市场监督 管理部门办理有关登记手续 后，按照下列规定提出申请并 提交符合本条例第八条规定 条件的相关材料：（一）从事县级行政区域内和 毗邻县行政区域间客运经营 的，向所在地县级人民政府交 通运输主管部门提出申请；（二）从事省除市口示且阮shallprovideaplanwithclearroutesandstops.Article9Adriverwhoisengagedinthepassengertransportbusinessoperationsshall:a. haveobtainedacorrespondingmotorvehicledrivingpermit;b. havenotattainedtheageof60years;c. havenorecordofserioustrafficaccidentswithintherecentthreeyears;andd. havepassedthebasicknowledgeexaminationofrelevantpassengertransportlawsandregulations,motorvehiclemaintenance,andfirstaidtopassengers,asheldbythetransportdepartmentofthepeople'sgovernmentatthedistrictedcitylevel.Article10Forbeingengagedinthepassengertransportbusiness,theapplicantshall,afterundergoingtherelevantregistrationformalitieswiththemarketregulatorydepartmentinaccordancewiththelaw,fileanapplicationaccordingtothefollowingprovisions,andsubmitthematerialsonitssatisfactionoftheconditionsprescribedinArticle8ofthisRegulation.a.Forbeingengagedinthepassengertransportbusinesswithintheadministrativeregionofacountyorequivalentoracrosstheadministrativeregionsofadjacentcountiesorequivalents,theapplicantshallfileanapplicationwiththetransportdepartmentofthepeople'sgovernmentofthecountyorequivalentwhereitislocated.h.FrhftimaarcIinthintAr-nrvincial.（除毗邻县行政区域间外）客 运经营的，向所在地设区的市 级人民政府交通运输主管部 门提出申请；（三）在直辖市申请从事客运 经营的，向所在地直辖市人民 政府确定的交通运输主管部 门提出申请。inter-city,orinter-county(excludingadministrativeregionsofadjacentcountiesorequivalents)passengertransportbusiness,theapplicantshallfileanapplicationwiththetransportdepartmentofthepeople'sgovernmentofthedistrictedcitywhereitislocated.依照前款规定收到申请的交 通运输主管部门，应当自受理 申请之日起20日内审查完 毕，作出许可或者不予许可的 决定。予以许可的，向申请人 颁发道路运输经营许可证，并 向申请人投入运输的车辆配 发车辆营运证；不予许可的， 应当书面通知申请人并说明 理由。c.ForbeingengagedinthepassengertransportbusinessinamunicipalitydirectlyundertheCentralGovernment,theapplicantshallfileanapplicationwiththetransportdepartmentdeterminedbythepeople'sgovernmentofthemunicipalitydirectlyundertheCentralGovernmentwhereitislocated.对从事省际和市际客运经营 的申请，收到申请的交通运输 主管部门依照本条第二款规 定颁发道路运输经营许可证 前，应当与运输线路目的地的 相应交通运输主管部门协商， 协商不成的，应当按程序报 省、自治区、直辖市人民政府 交通运输主管部门协商决定。Atransportdepartmentthatreceivesanapplicationinaccordancewiththeprecedingparagraphshall,within20daysofacceptingtheapplication,completetheexaminationandmakeadecisiontograntordenytheapplication.Iftheapplicationisgranted,thetransportdepartmentshallissuearoadtransportbusinesspermittotheapplicant,andallocatecommercialvehiclepermitstothevehiclestobeusedbytheapplicantfortransport;oriftheapplicationisdenied,thetransportdepartmentshallnotifytheapplicantinwriting,withanexplanationofthereasonsforthedenial.Atransportdepartmentthatreceivesanapplicationforbeingengagedintheinter-provincialorinter-citypassengertransportbusinessshall,beforeissuingaroadtransportbusinesspermitinaccordancewithparagraph2ofthisarticle,consultwiththecorrespondingtransportdepartmentofthedestinationofthetransportroute,andifsuchconsultationfails,reporttothetransportdepartmentofthnnnl0,QCCmmntnfthonrninro对从事设区的市内毗邻县客 运经营的申请，有关交通运输 主管部门应当进行协商，协商 不成的，报所在地市级人民政 府交通运输主管部门决定。第十一条取得道路运 输经营许可证的客运经营者， 需要增加客运班线的，应当依 照本条例第十条的规定办理 方人民政府交通运输主管部 门在审查客运申请时，应当考 虑客运市场的供求状况、普遍 服务和方便群众等因素。Article11Ifitisnecessaryforapassengertransportbusinessoperatorwhohasobtainedaroadtransportbusinesspermittoincreasepassengertransportbusinessoperationroutes,itshallgothroughtherelevantproceduresinaccordancewithArticle10ofthisRegulation.Article12Whentransportdepartmentofthelocalpeople'sgovernmentatorabovethecountylevelexaminesthepassengerbusinessoperationapplications,itshalltakeintoconsiderationthestatusofdemandandsupplyinthepassengertransportmarket,universalservices,facilitatingthepublic,andOtherfactors.同一线路有3个以上申请人 时，可以通过招标的形式作出 许可决定。第十三条县级以上地 方人民政府交通运输主管部 门应当定期公布客运市场供 求状况。第十四条客运班线的 经营期限为4年到8年。经营Whenthereare3ormoreapplicantsapplyingforoneroute,adecisionofapprovalmaybemadebywayofbidding.Article13Thetransportdepartmentsofthelocalpeople,sgovernmentatorabovethecountylevelshallregularlyannouncethestatusquoofdemandandsupplyinthepassengerbusinessoperationmarket.Article 14 Theroutepassengertransportbusinessoperationperiodshallbe4-8parcIfitQnoroQQpr/tnvinrlthprmtopassengertransportbusinessoperationperiodwhenitexpires,anewapplicationshallbefiled.期限届满需要延续客运班线 经营许可的，应当重新提出申 请。Article 15 Whenapassengertransportbusinessoperatorwishestoterminatethepassengertransportbusiness,itshallinformtheoriginalapprovalorganwithin30dayspriortothetermination.Article 16 Aroadpassengerbusinessoperatorshallprovidepassengerswithagoodenvironment,shallkeepthevehiclescleanandtidy,andshalltakenecessarymeasurestopreventtheoccurrenceofanyillegalactthatwouldtrespassthepassengers'personalorpropertysafety.Article 17 Apassengershallhaveavalidtickettotakeavehicle,observetheorder,bepoliteandclean,shallnotcarryanydangerousarticlesorotherprohibitivearticlesasprovidedforbythestate.第十五条客运经营者 需要终止客运经营的，应当在 终止前30日内告知原许可机 关。第十六条客运经营者 应当为旅客提供良好的乘车 环境，保持车辆清洁、卫生， 并采取必要的措施防止在运 输过程中发生侵害旅客人身、 财产安全的违法行为。第十七条旅客应当持 有效客票乘车，遵守乘车秩 序，讲究文明卫生，不得携带 国家规定的危险物品及其他 禁止携带的物品乘车。Article 18 Afteraroutepassengertransportbusinessoperatorhasacquiredaroadtransportbusinesspermit,itshallcontinuouslyprovidetransportservicestothegeneralpublic,shallnotsuspend,terminateortransfertheroutepassengertransportbusinesswithoutapproval.Article 19 Anyoneengagedincharteredpassengertransportbusiness,itshalloperateaccordingtothestipulatedplacesofdeparture,destinationsandroutes.Anyoneengagedintouristtransportbusinessshalloperatewithinthetouristareasaccordingtotheroutesfortourism.第十八条班线客运经 营者取得道路运输经营许可 证后，应当向公众连续提供运 输服务，不得擅自暂停、终止 或者转让班线运输。第十九条从事包车客 运的，应当按照约定的起始 地、目的地和线路运输。从事旅游客运的，应当在旅游 区域按照旅游线路运输。第二十条客运经营者Article 20 NopassengertransportbusinessCCaratCrmfnrrpnCaaCanCartntkitsvehicle,denyorextortanypassenger,changethetransportvehicleswithoutpermission.不得强迫旅客乘车，不得甩 客、敲诈旅客；不得擅自更换 运输车辆。第二节货 运Article 21 Anyone who wishes to engage in freight transport business shall:第二十一条申请从事 货运经营的，应当具备下列条 件：SectionllFreightTransport（一）有与其经营业务相适应 并经检测合格的车辆；（二）有符合本条例第二十二 条规定条件的驾驶人员；（三）有健全的安全生产管理 制度。a. havevehiclesthatcanmeetthedemandofitsbusinessoperationsandthatarefoundtobequalifiedupontest;b. havedriversthatmeettherequirementsasdescribedinArticle22ofthisRegulation;andc. havesoundrulesandbylawsregardingsafeoperations.Article 22 A driver who is engaged in freight transport business operations shall:（一）取得相应的机动车驾驶 证；（二）年龄不超过60周岁；（三）经设区的市级人民政府 交通运输主管部门对有关货 运法律法规、机动车维修和货 物装载保管基本知识考试合 格（使用总质量4500千克及 以下普通货运车辆的驾驶人 员除外）。第二十三条申请从事 危险货物运输经营的，还应当第二十二条从事货运经营的驾驶人员，应当符合下列条件：a. haveobtainedacorrespondingmotorvehicledrivingpermit;b. havenotattainedtheageof60years;c. havepassedthebasicknowledgeexaminationofrelevantfreighttransportlawsandregulations,motorvehiclemaintenance,andloadingandsafekeepingofgoods,asheldbythetransportdepartmentofthepeople'sgovernmentatthedistrictedcitylevel(excludingadriverwhousesageneralfreightvehiclewithatotalmassof4,500kgorless).Article23Apartfromtheabovementionedconditions,anyonewhoappliesforonnaninriinfminhttroncnnr+hicinccoperationsinvolvingdangerouscargoes具备下歹U条件:shall:a. have5ormorevehiclesandequipmentexclusivelydestinedtodangerouscargotransportthatcanmeetthedemandofitsbusinessoperationsandthatarefoundtobequalifiedupontest;b. havedrivers,managerialpersonnelforloadingandunloadinggoodsandtransportescortswhohavepassedtheexaminationheldbythetransportdepartmentatthedistrictedcitylevelandhaveobtainedcorrespondingpostlicense;c. equipthevehiclesexclusivelydestinedtodangerouscargotransportwithnecessarytelecommunicationtools;andd. havesoundrulesandbylawsregardingsafeoperations.Article24Forbeingengagedinthefreighttransportbusiness,theapplicantshall,afterundergoingtherelevantregistrationformalitieswiththemarketregulatorydepartmentinaccordancewiththelaw,fileanapplicationaccordingtothefollowingprovisions,andsubmitrespectivelythematerialsonitssatisfactionoftheconditionsprescribedinArticles21and23ofthisRegulation:a. Forbeingengagedinthefreighttransportbusinessotherthanthedangerousgoodstransportbusiness,theapplicantshallfileanapplicationwiththetransportdepartmentofthepeople,sgovernmentatthecountylevel.（一）有5辆以上经检测合格 的危险货物运输专用车辆、设 备；（二）有经所在地设区的市级 人民政府交通运输主管部门 考试合格，取得上岗资格证的 驾驶人员、装卸管理人员、押 运人员；（三）危险货物运输专用车辆 配有必要的通讯工具；（四）有健全的安全生产管理 制度。第二十四条申请从事 货运经营的，应当依法向市场 监督管理部门办理有关登记 手续后，按照下列规定提出申 请并分别提交符合本条例第 二十一条、第二十三条规定条 件的相关材料：（一）从事危险货物运输经营 以外的货运经营的，向县级人 民政府交通运输主管部门提 出申请；（二）从事危险货物运输经营 的，向设区的市级人民政府交 诵运输丰管胡门堤中G氤b. Forbeingengagedinthedangerousgoodstransportbusiness,theapplicantshallfileanapplicationwiththetransportdepartmentofthepeople'sgovernmentatthelevelofadistrictedcity.Atransportdepartmentthatreceivesanapplicationinaccordancewiththeprecedingparagraphshall,within20daysofacceptingtheapplication,completetheexaminationandmakeadecisiontograntordenytheapplication.Iftheapplicationisgranted,thetransportdepartmentshallissuearoadtransportbusinesspermittotheapplicant,andallocatecommercialvehiclepermitstothevehiclestobeusedbytheapplicantfortransport;oriftheapplicationisdenied,thetransportdepartmentshallnotifytheapplicantinwriting,withanexplanationofthereasonsforthedenial.Forthegeneralfreighttransportbusinessusinggeneralfreightvehicleswithagrossweightof4,500kgorless,anapplicationforaroadtransportbusinesspermitandcommercialvehiclepermitsinaccordancewiththeprovisionsofthisarticleisnotrequired.Article 25 Nofreighttransportbusinessoperatormaytransportanygoodsbannedbyanylaworadministrativeregulation.Withregardtothegoodsbannedfrombeingtransportedunlessthepertinentformalitiesasprovidedforinlaworadministrativeregulationhavebeenundergone,thefreighttransportbusinessoperatorshallcheckandverifythesaidformalities.依照前款规定收到申请的交 通运输主管部门，应当自受理 申请之日起20日内审查完 毕，作出许可或者不予许可的 决定。予以许可的，向申请人 颁发道路运输经营许可证，并 向申请人投入运输的车辆配 发车辆营运证；不予许可的， 应当书面通知申请人并说明 理由。使用总质量4500千克及以下 普通货运车辆从事普通货运 经营的，无需按照本条规定申 请取得道路运输经营许可证 及车辆营运证。第二十五条货运经营 者不得运输法律、行政法规禁 止运输的货物。法律、行政法规规定必须办理 有关手续后方可运输的货物， 货运经营者应当查验有关手 续。第二十六条国家鼓励 货运经营者实行封闭式运输， 保证环境卫生和货物运输安 全。Article 26 Thestateencouragesfreighttransportbusinessoperatorstoadoptthewayofclosedtransportsoastoensurethecleanenvironmentandsafefreighttransport.Afreighttransportbusinessoperatorshalltakenecessarymeasurestopreventthe
