规,制定本办法。公务员公开遴选办法(2021修订)MeasuresforthePublicSelectionofCivilServants(2021Revision)制定机关:中共中央组织部公布日期:2021.09.17施行日期:2021.09.17效力位阶:党内法规制度法规类别:公务员IssuingAuthority:OrganizationDepartmentof(heCentralCommitteeoftheCommunistPartyofChina(OrganizationDepartment,CCCPC)DateIssued:09-17-2021EffectiveDate:09-17-20211.evelofAuthority:SystemofPartyRegulationsAreaofLaw:CivilServantsMeasuresforthePublicSelectionofCivilServants(DevelopedbytheOrganizationDepartmentoftheCPCCentralCommitteeandtheMinistryofHumanResourcesandSocialSecurityonJanuary24,2013,andrevisedonAugust25,2021andissuedonSeptember17,2021bytheOrganizationDepartmentoftheCPCCentralCommittee)ChapterIGeneralProvisionsArticle1TheseMeasuresaredevelopedinaccordancewiththeCivilServantLawofthePeople'sRepublicofChina,theProvisionsontheTransferofPostsofCivilServants,andotherapplicablelawsandregulationsforthepurposesofoptimizingthestructureofcivilservantsinleadingauthorities,establishingandimprovingatrainingandselectionmechanismforcivilservantsfromtheprimarylevel,andregulatingthepublicselectionofcivilservants.Article2ForthepurposeoftheseMeasures,upublicselectionmeansthemerit-basedpublicselectionandappointmentofcivilservantsbyauthoritiesatorabovethecity(prefecture)levelfortheirinternalbodiesfromauthoritiesatlowerlevels.Publicselection,asoneofthewaysforcivilservantstobetransferredtoanotherpostatthesamelevel,shallhighlighttheneedsoftheworkandbesubjecttoanappropriatescale.Ifthepublicselectionofcivilservantsisrelatedtothepromotiontoordemotionfrompositionsofleadershipandranksortheinterchangeofpositionsofleadershipandranks,therelevantprovisionsshallapply.Article3ThepublicselectionofcivilservantsshallfollowtheprincipleofmanagementofofficialsbytheCommunistPartyofChina(CPC)5highlightpoliticalstandards,adheretobothmoralintegrityandcapabilitywithprioritygiventomoralintegrity,adheretomeritsregardlessoftheirorigins,adheretoprofessionaldedication,commensurationofpersonswiththeirpostsandofficialduties,andimpartiality,underscoreactualperformanceandpublicrecognition,andadheretothehandlingofaffairsaccordingtolawsandregulations.Article4Thepublicselectionofcivilservantsshallbeorganizedtotheextentofthespecifiedsizeofstaffingestablishmentsandthenumberofposts,andbeconditionaluponcorrespondingvacancies.第二条本办法所称公开遴选,是指市(地)级以上机关从下级机关公开择优选拔任用内设机构公务员。公开遴选是公务员转任方式之一,应当突出工作需要,保持适度规模。公开遴选中涉及领导职务和职级升降、领导职务和职级互相转任的,按照有关规定办理。第三条公开遴选坚持党管干部原则,突出政治标准,坚持德才兼备、以德为先、任人唯贤,坚持事业为上、人岗相适、人事相宜,坚持公道正派、注重实绩、群众公认,坚持依法依规办事。第四条公开遴选应当在规定的编制限额和职数内进行,并有相应的职位空缺。Article5Thepublicselectionofcivilservantsshallgenerallybeorganizedunderthefollowingprocedures:第五条公开遴选一般按照下列程序进行:(一)发布公告;(1) Issuanceofanannouncement.(二)报名与资格审查;(2) Registrationfortheexaminationandqualificationreview.(三)考试;(3) Examinations.(四)考察;(五)决定与任职。(4) Assessment.(5) Decisionandappointment.省级以上公务员主管部门可 以根据需要对上述程序进行 调整。Civilservicedepartmentsatorabovetheprovinciallevelmayadjusttheaboveproceduresasappropriate.第六条市(地)级以 上公务员主管部门按照管理 权限和职责分工负责公开遴 选工作的综合管理。公开遴 选机关按照公务员主管部门 的要求,负责公开遴选有关 工作。Article6Civilservicedepartmentsatorabovethecity(prefecture)levelshallberesponsibleforthecomprehensivemanagementofthepublicselectionofcivilservantsaccordingtotheiradministrativepowersandthedivisionoftheirduties.Publicselectionagenciesshallberesponsiblefortheworkrelatedtothepublicselectionofcivilservantsaccordingtotherequirementsofcivilservicedepartments.公开遴选有关专业性、技术 性、事务性工作,可以授权 或者委托考试机构以及其他 专业机构承担。Examinationinstitutionsandotherprofessionalinstitutionsmaybeauthorizedorengagedtoundertaketheprofessional,technical,orclericalworkinconnectionwiththepublicselection.第七条省级机关和市 (地)级机关公开遴选,原 则上面向本辖区内下级机关 (含相应层级中央机关直属Article7Aprovincialauthorityoranauthorityatthecityorprefecturelevelshall,inprinciple,organizepublicselectionamongcivilservantsofauthoritiesatlowerlevels(includingtheinstitutionsdirectlyunderthecentralauthoritiesatthecorrespondinglevel)withintheirrespectivejurisdictions.Whereaprovincialcivilservicedepartmentneedstoorganizepublicselectionoutsidetheprovince(autonomousregionormunicipalitydirectlyundertheCentralGovernment)becauseofservingandguaranteeingmajornationalstrategicdecisionsandarrangements,itshallcommunicatewiththecentralcivilservice机构)公务员进行。因服务 保障国家重大战略决策部署 等需要面向本省(自治区、 直辖市)以外进行的,省级 公务员主管部门应当事先与 中央公务员主管部门沟通。departmentinadvance.省级公务员主管部门应当对 本辖区内公开遴选工作进行 统筹,合理确定时间和频 次,一般应当集中开展。Chapter Il Application Plans and Announcement第二章申报计划与发布公 告Aprovincialcivilservicedepartmentshallmakeoverallplansfor,reasonablydeterminethetimingandfrequencyof,andgenerallyorganizeinacentralizedmanner,thepublicselectionofcivilservantswithinitsjurisdiction.第八条公开遴选机关 在进行公务员队伍结构和职 位分析的基础上,根据工作 需要,提出公开遴选职位及 其资格条件,拟定公开遴选 计划,报公务员主管部门审 批。第九条组织公开遴选 前,应当依据有关法律法规 和政策规定,制定实施方 案。第十条公开遴选应当 面向社会发布公告。公告应 当包括以下内容:Article8Onthebasisofanalyzingthestructureandpositionsoftheforceofcivilservants,asneededforwork,apublicselectionagencyshallproposepostssubjecttopublicselectionandtheirqualifications,drawupapublicselectionplan,andsubmitittothecivilservantdepartmentforapproval.Article 9 Beforeorganizingapublicselection,animplementationplanshallbedevelopedinaccordancewithrelevantlaws,regulations,andpolicies.Article 10 Thepublicselectionofcivilservantsshallbeannouncedtothepublic.Suchanannouncementshallinclude:(1) Public selection agencies, posts, quotas, post profiles, and qualifications to register for the examination.(一)公开遴选机关、职 位、名额、职位简介和报考 资格条件;(2) Scope of and procedures, methods, and relevant requirements for the public selection of civil servants.(二)公开遴选范围、程 序、方式和相关要求;(3) Methods for registration for the examination and relevant materials to be submitted.(三)报名方式和需要提交 的相关材料;(4) Subjects, time, and place of the examination.(四)考试科目、时间和地占.V¼9(五)其他相关事项。(5)Otherrelevantmatters.第三章报名与资格审查ChapterIIIRegistrationforExaminationsandQualificationReview第十一条公开遴选可 由公务员本人申请并按照干 部管理权限经组织审核同意 后报名,也可征得本人同意 后由组织推荐报名。Article 11 Acivilservantmayfileanapplicationandregisterfortheexaminationwiththeapprovaloftheorganizationuponreviewaccordingtoitspowertomanageofficialsormayberecommendedbytheorganizationwithhisorherconsent.公务员所在机关党委(党 组)或者公务员主管部门应 当切实履行把关责任,充分 考虑人选的政治素质、专业 素养、工作实绩和一贯表 现,对不符合报名资格条件 的,不得同意或者推荐报 名。Thepartycommittee(theleadingPartymembers,group)oftheauthoritywherethecivilservantservesorthecivilservicedepartmentshallpracticallyperformtheresponsibilityofcontrol,andfullyconsiderthepoliticalquality,professionalquality,actualperformance,andconsistentperformanceofthecandidate;andifthecivilservantfailstomeetthequalificationsforregistrationforexamination,itshallnotapproveorrecommendhisorherregistrationfortheexamination.第十二条报名参加公 开遴选的公务员,应当具备 下列资格条件:Article 12 Acivilservantwhoistoregisterforpublicselectionshallmeetthefollowingqualificationrequirements:(一)政治立场坚定、政治 素质过硬,增强“四个意 识,、坚定“四个自信”、 做到“两个维护”;(1) Heorshehasafirmpoliticalstanceandexcellentpoliticalqualityandhasraisedhisorherconsciousnessoftheneedtomaintainpoliticalintegrity,thinkinbig-pictureterms,followtheleadershipcore,keepinalignment,stayedconfidentinthepath,theory,system,andcultureofsocialismwithChinesecharacteristics,andupheldComradeXiJinping'scorepositionontheCPCCentralCommitteeandinthewholePartyandupheldtheCentralCommittee'sauthorityanditscentralized,unifiedleadership.(二)具有良好的业务素 质,品行端正,实绩突出, 群众公认;(2) Heorshehasgoodprofessionalquality,goodconduct,andoutstandingactualperformance,andisrecognizedbythepublic.(三)一般应当具有2年以 上基层工作经历;(3) Heorsheshallgenerallyhavemorethantwoyearsofprimary-levelworkexperience.(四)一般应当在本级机关 工作2年以上,年度考核没 有基本称职以下等次;(4) Heorsheshallgenerallyhaveworkedinauthoritiesatthesamelevelformorethantwoyearsandhasnotbeendeterminedtobe“basicallympetenoralowergradeintheannualassessment.(五)具有公开遴选职位要 求的工作能力和任职经历;(5) Heorsheshallhavetheprofessionalcompetenceandworkexperiencerequiredbythepostssubjecttopublicselection.(六)报名参加中央机关、省级机关公开遴选的一般应当具有大学本科以上文化程(6) Toregisterforpublicselectionorganizedbycentralorprovincialauthorities,heorsheshallgenerallyhaveabachelor'sdegreeorabove;orto度,报名参加市(地)级机 关公开遴选的一般应当具有 大学专科以上文化程度;registerforpublicselectionorganizedbyauthoritiesatthecityorprefecturelevel,heorsheshallgenerallyhaveacollegedegreeorabove.(七)具有正常履行职责的 身体条件和心理素质;(7) Heorshehasthephysicalconditionsandpsychologicalqualitytoperformhisorherdutiesnormally.(A)公务员主管部门规定 的其他资格条件;(8) Heorshemeetsotherqualificationsprescribedbythecivilservicedepartment.(九)法律法规规定的其他 条件。(9) Heorshemeetotherconditionsprescribedbylawsandregulations.前款第(三)、(四)、 (六)项所列条件,根据需 要,经省级以上公务员主管 部门批准,可以适当调整。Asneeded,theconditionslistedinsubparagraphs(3),(4),and(6)oftheprecedingparagraphmaybeappropriatelyadjustedwiththeapprovalofthecivilservicedepartmentsatorabovetheprovinciallevel.报考行政机关中行政处罚决 定审核、行政复议、行政裁 决、法律顾问等职位的,应 当取得法律职业资格。Thosewhoapplyforadministrativepunishmentdecisionreview,administrativereconsideration,administrativeadjudication,legalcounsel,andotherpositionsinadministrativeauthoritiesshallobtainlegalprofessionalqualifications.公务员主管部门和公开遴选 机关不得设置与职位要求无 关的报名资格条件。Civilservicedepartmentsandpublicselectionagenciesshallnotsetsuchrequirementsforqualificationtoregisterforexaminationsasarenotrelatedtojobrequirements.第十三条公务员有下 列情形之一的,不得参加公 开遴选:Article13Acivilservantfallingunderanyofthefollowingcircumstancesshallnotparticipateinthepublicselection:(一)被开除中国共产党党(1)HeorsheisexpelledfromtheCPC.籍的;(2)Heorsheislistedasadishonestpersonsubjecttojointpunishment.(二)被依法列为失信联合惩戒对象的;(3)Heorsheisunderexaminationandinvestigationbytheappropriateauthorityforsuspectedviolationsofdisciplineorlaw,forwhichnoconclusionhasbeenmadeyet.(三)涉嫌违纪违法正在接受有关专门机关审查调查尚未作出结论的;(4) Afterheorsheisgivenapartydisciplinaryactionoranorganizationaldisciplineorisadmonished,theperiodofsuchnegativeeffecthasnotyetexpiredortheexpirationoftheperiodofsuchnegativeeffecthasaffectedtherecruitment.(5) Inaccordancewiththeapplicableprovisions,heorshehasnotreachedtheminimumyearsofserviceintownorV川ageauthorities,poverty-strickenandremoteareas,anddirectionalentities,orthereareotherrestrictiveprovisionsontransferintoanotherauthorityatthesamelevel.(四)受到诫勉、组织处理或者党纪政务处分等影响期未满或者期满影响使用的;(五)按照有关规定,到乡镇机关、艰苦边远地区以及定向单位工作未满最低服务年限或者对转任有其他限制性规定的;(6)Heorsheisstillintheprobationaryperiodorhasbeenpromotedtoholdapositionofleadershipforlessthanoneyear.(六)尚在试用期或者提拔担任领导职务未满1年的;(7)Othercircumstancesprescribedbylawsandregulations.(七)法律法规规定的其他情形。Article14Anexaminationapplicantshallnotregisterforexaminationforanypositionthatfallsunderthecircumstancesspecifiedinparagraph1ofArticle74oftheCivilServantLawafterheholdsanoffice,norshallheorsheregistersforexaminationforthepositionofanemployerinwhichanypersoninaspousalrelationship,related第十四条报名人员不得报考任职后即构成公务员法第七十四条第一款所列情形的职位,也不得报考与本人有夫妻关系、直系血亲关系、三代以内旁系血亲关系以及近姻亲关系的人员担任 料应当真实、准确、完整。Article15Anexaminationapplicantshallsubmitrelevantmaterialsrequiredforregistrationforexaminationtothepublicselectionagency,andthesubmittedmaterialsshallbetrue,accurate,andcomplete.公开遴选机关按照职位资格 条件对报名人员提交的材料 进行审查,确定报名人员是 否具有报名资格。资格审查 贯穿公开遴选全过程。Thepublicselectionagencyshallreviewthematerialssubmittedbytheexaminationapplicantaccordingtothejobqualifications,todeterminewhethertheexaminationapplicantmeetsthequalificationstoregisterfortheexamination.Qualificationreviewsshallbeconductedthroughoutthewholeprocessofpublicselection.第四章考试第十六条考试一般采 取笔试和面试等方式进行。 考试内容根据不同职位类 别、不同层级机关公务员应 当具备的能力素质分别设 置,重点测查用习近平新时 代中国特色社会主义思想指 导分析和解决问题的能力。ChapterIVExaminationsArticle16Examinationsshallbegenerallyconductedinwrittenformandbyinterviews.Thecontentofexaminationsshallbedeterminedaccordingtotherequiredabilitiesandqualitiesofcivilservantsatdifferenttypesofpostsandlevels,focusingontheabilitytoanalyzeandresolveproblemsguidanceofXiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewEra.第十七条面试人选根 据笔试成绩由高到低的顺序 确定。Article 17 Candidatesforinterviewsshallbedeterminedindescendingorderofwrittenexaminationscores.第十八条面试应当组 成面试考官小组,其中公开 遴选机关以外的考官应当占Article 18 Aninterviewexaminergroupshallbeformedforinterviews,andinterviewersotherthanthestaffmembersofthepublicselectionagencyshallaccountforacertainproportion.Interviewersshallbeimpartialanddecent,familiarwiththebusinessrelatedtopostssubjecttopublicselection,andhaverelevantexperienceintheevaluationofofficials.一定比例。面试考官应当公 关根据职位需要,经公务员 主管部门同意,可以对报名 人员进行职位业务水平测 试、心理素质测评、体能测 评等。ChapterVAssessment第五章考察Article20Themethodofcompetitiveassessmentshallbeadoptedforpublicselection,andtheratioofthenumberofassessedpersonstothenumberofpersonsintendedtobeselectedshallgenerallynotbehigherthan2:1.Thecandidatesshallbedeterminedbasedontheirexaminationscores.第二十条公开遴选采 取差额考察的办法,考察人 数与计划遴选人数的比例一 般不高于2: Io考察对象根 据考试成绩等确定。第二H条公开遴选 机关对考察对象的德、能、 勤、绩、廉情况以及职位匹 配度等进行全面考察,突出 政治标准,深入考察政治忠 诚、政治定力、政治担当、 政治能力、政治自律等方面 情况,重点考察政治理论学 习情况、制度执行力、履职 能力、工作实绩和群众公认 程度,严把政治关、品行 关、能力关、作风关、廉洁 关,并据实形成书面考察材 料。Article21Apublicselectionagencyshallconductacomprehensiveassessmentofthemorality,capability,diligence,performance,andintegrityofcandidatesandthematchwithposts,highlightpoliticalstandards,thoroughlyexaminetheirpoliticalloyalty,politicaldetermination,politicalresponsibility,politicalcapabilities,politicalselfdiscipline,andotheraspects,focusontheirstudyofpoliticaltheories,implementationofrules,andabilitytoperformduties,actualperformanceandpublicrecognition,strictlycontroltheirpoliticalconsciousness,moralcharacterandbehavior,ability,workstyle,andintegrity,andcreatewrittenassessmentmaterialsbasedonfacts.Article22Inanassessment,thepublicselectionagencymayadoptmethodssuchasindividualconversations,democraticassessments,fieldvisits,andinterviewswiththecandidates,alsoconductspecialinvestigationsandextendedassessmentsasneeded,fullylistentotherelevantleadersoftheentitieswherecandidatesserve,thepublic,theorganization(personnel)department,thedisciplineinspectionandoversightauthority,andthePartyorganizationsoftheauthority,reviewtheirpersonnelfilesofofficials,inquireabouttheirsocialcreditrecords,andcheckpubliccomplaints,proposals,andreportsthatreflectspecificandverifiablecluestotheproblems.Whereacandidateneedstoreportorcheckrelatedpersonalmattersorbesubjecttoanauditofeconomicresponsibilities,relevantprovisionsshallapply.第二十二条考察可以 采取个别谈话、民主测评、 实地走访、同考察对象面谈 等方法,根据需要还可进行 专项调查、延伸考察等,充 分听取考察对象所在单位有 关领导、群众和组织(人 事)部门、
