共和国国务院令第508号公布 根据2019年3月2日国务 院关于修改部分行政法规的 决定修订)第一章总则第一条为了科学、有效 地组织实施全国污染源普查, 保障污染源普查数据的准确 性和及时性,根据中华人民 共和国统计法和中华人民 共和国环境保护法,制定本 条例。第二条污染源普查的Issuingauthority:StateCouncilDocumentNumber:OrderNo.709oftheStateCouncilofthePeople'sRepublicofChinaDateissued:03-02-2019Effectivedate:03-02-20191.evelofAuthority:AdministrativeRegulationsAreaofLaw:EnvironmentalProtectionRegulationonNationalGeneralSurveyofPollutionSources(PromulgatedbyOrderNo.508oftheStateCouncilofthePeople,sRepublicofChinaonOctober9,2007;andrevisedinaccordancewiththeDecisionoftheStateCounciltoAmendCertainAdministrativeRegulationsonMarch2,2019)ChapterIGeneralProvisionsArticle1Forthepurposeofcarryingoutthenationalgeneralsurveyofpollutionsourcesinascientificandefficientwayandensuringtheaccuracyandtimelinessoftheresultdata,thisRegulationisformulatedinaccordancewiththeStatisticsLawofthePeople'sRepublicofChinaandtheEnvironmentalProtectionLawofthePeople'sRepublicofChina.Article2Thetaskofthenationalgeneral任务是,掌握各类污染源的数 量、行业和地区分布情况,了 解主要污染物的产生、排放和 处理情况,建立健全重点污染 源档案、污染源信息数据库和 环境统计平台,为制定经济社 会发展和环境保护政策、规划 提供依据。第三条本条例所称污 染源,是指因生产、生活和其 他活动向环境排放污染物或 者对环境产生不良影响的场 所、设施、装置以及其他污染 发生源。surveyofpollutionsourcesshallbeknowingthenumberofpollutionsourcesandtheirdistributionindifferentindustriesandregions,knowingthegeneration,dischargeandtreatmentofmajorpollutants,establishingfilesforkeypollutionsources,apollutionsourceinformationdatabaseandanenvironmentalstatisticsplatform,toprovidebasisforformulatingpoliciesandplansforeconomicandsocialdevelopmentandenvironmentalprotection.第四条污染源普查按 照全国统一领导、部门分工协 作、地方分级负责、各方共同 参与的原则组织实施。Article3Theterm“pollutionsourcenasmentionedinthisRegulationreferstopremises,facilitiesandequipmentwhichdischargepollutantstoenvironmentintheprocessofproduction,livelihoodoranyotheractivityorhaveadverseimpactonenvironment,aswellasothersourcesgivingbirthtopollution.第五条污染源普查所 需经费,由中央和地方各级人 民政府共同负担,并列入相应 年度的财政预算,按时拨付, 确保足额到位。Article4Thenationalgeneralsurveyofpollutionsourcesshallbeimplementedunderunifiedleadership,withdepartmentscooperatingbasedondivisionoffunction,withlocalpeople'sgovernment'satdifferentlevelstakingdifferentresponsibilitiesandwiththeparticipationofallcircles.污染源普查经费应当统一管 理,专款专用,严格控制支出。Article5ExpensesnecessaryforthenationalgeneralsurveyofpollutionsourcesshallbepaidjointlybytheCentralGovernmentandthelocalpeople'sgovernmentsatvariouslevels,belistedintothefiscalbudgetofthecorrespondingyearandbeputinpositionintimeandinfullamount.Expensesforthenationalgeneralsurveyofpollutionsourcesshallbeunderunifiedmanagement,usedfordesignatedpurposeonlyandunderstrictcontrol.第六条全国污染源普Article 6 Thenationalgeneralsurveyofpollutionsourcesshallbeconductedonceevery10years,morespecifically,onDecember31stofthesurveyyear.Article 7 Newspapers,periodicals,broadcastingstations,TVstations,networkandothernewsmediashallreportandpublicizethegeneralsurveyinatimelymanner.ChapterIlObject,Scope,ContentandMethodArticle8Theobjectofthenationalgeneralsurveyofpollutionsourcesshallbeentitiesandself-employedhouseholdswhichhavepollutionsourceswithinthebordersofthePeople'sRepublicofChina.Article9Theobjectofthenationalgeneralsurveyofpollutionsourceshastheobligationtosubjectitselftotheinvestigationconductedbytheleadinggroupofficeofthenationalgeneralsurveyofpollutionsourcesanditsworkingpersonnel,reportthetruesituation,providetherelevantmaterialsandfillinthesurveyforminaccordancewiththerelevantrequirements.Noobjectmaydelaythereportofthedataneededbythegeneralsurvey,makefalsereports,hidethetruthinmakingreportsorrefusetoreport;orshuffle,refuseorimpedetheinvestigation;ortransfer,conceal,alterordestroyrawmaterialconsumptionrecords,productionrecords,pollutioncontrolfacilityoperationrecords,pollutantdischargemonitoringrecordsandothersourcematerialrelatedtothegenerationordischargeofpollutants.查每10年进行1次,标准时 点为普查年份的12月31 Bo第七条报刊、广播、电 视和互联网等新闻媒体,应当 及时开展污染源普查工作的 宣传报道。第二章污染源普查的对象、 范围、内容和方法第八条污染源普查的 对象是中华人民共和国境内 有污染源的单位和个体经营 户。第九条污染源普查对 象有义务接受污染源普查领 导小组办公室、普查人员依法 进行的调查,并如实反映情 况,提供有关资料,按照要求 填报污染源普查表。污染源普查对象不得迟报、虚 报、瞒报和拒报普查数据;不 得推诿、拒绝和阻挠调查;不 得转移、隐匿、篡改、毁弃原 材料消耗记录、生产记录、污 染物治理设施运行记录、污染 物排放监测记录以及其他与 污染物产生和排放有关的原 始资料。第十条污染源普查范 围包括:工业污染源,农业污Article 10 Thescopeofthegeneralsurveyofpollutionsourcesshallinclude:industrial染源,生活污染源,集中式污 染治理设施和其他产生、排放 污染物的设施。第十一条工业污染源 普查的主要内容包括:企业基 本登记信息,原材料消耗情 况,产品生产情况,产生污染 的设施情况,各类污染物产 生、治理、排放和综合利用情 况,各类污染防治设施建设、 排水情况,化肥、农药、饲料 和饲料添加剂以及农用薄膜 等农业投入品使用情况,秸秆 等种植业剩余物处理情况以 及养殖业污染物产生、治理情 况等。Article 11 Themaincontentsofthegeneralsurveyonindustrialpollutionsourcesshallinclude:enterprises'basicregistrationinformation,situationaboutrawmaterialconsumption,productionsituation,situationaboutthefacilitiesgivingrisetopollution,situationaboutthegeneration,control,dischargeandcomprehensiveutilizationofvariouskindsofpollutants,andsituationabouttheconstructionandoperationofvariouskindsofpollutionpreventionandcontrolfacilities.生活污染源普查的主要内容 包括:从事第三产业的单位的 基本情况和污染物的产生、排 放、治理情况,机动车污染物 排放情况,城镇生活能源结构 和能源消费量,生活用水量、 排水量以及污染物排放情况 等。Themaincontentsofthegeneralsurveyonagriculturalpollutionsourcesshallinclude:scaleofagriculturalproduction,situationaboutwateruseanddrainage,situationabouttheuseoffertilizer,pesticide,feedstuff,feedstuffadditives,agriculturalfilmandotherproductsinputinagriculture,situationaboutthedisposalofstrawandotherplantingresiduals,andsituationaboutthegenerationandtreatmentofpollutantsfromlivestockandpoultrybreedingindustry.Themaincontentsofthegeneralsurveyondomesticpollutionsourcesshallinclude:basicinformationaboutentitiesengaginginthetertiaryindustry,situationaboutthegeneration,dischargeandcontrolofpollutants,situationaboutthedischargeofpollutantsbyautomotivevehicles,situationabouturbandomesticenergystructureandconsumption,situationaboutdomesticwatersupplyvolumeanddisplacement,andsituationaboutdomesticpollutantdischarge,etc.Themaincontentsofthegeneralsurveyonfacilitiesforconcentratedtreatmentofpollutionshallinclude:basicsituationandoperationstatusofsuchfacilities,situationaboutthetreatmentanddisposalofpollutants,andsituationaboutthegeneration,disposalandutilizationofpercolate,sludge,burningresidueandwastegases,etc.Article 12 ThespecificscopeandcontentsofeachgeneralsurveyofpollutionsourcesshallbedeterminedaccordingtothegeneralsurveyplanapprovedbytheStateCouncil.Article 13 Thegeneralsurveyofpollutionsourcesshallbeconductedbywayofoverallstatisticalsurvey,andthemethodofsamplingsurveymaybetakenwhennecessary.Thegeneralsurveyofpollutionsourcesshallfollowthenationallyunifiedstandardsandtechnicalrequirements.ChapterIIIOrganizationandImplementationoftheGeneralSurveyofPollutionSourcesArticle 14 Theleadinggroupofthenationalgeneralsurveyofpollutionsourcesshalltakechargeofleadingandcoordinatingthenationalgeneralsurveywork.TheofficeoftheleadinggroupofthenationalgeneralsurveyofpollutionsourcesshallbeintheadministrativedepartmentofecologyandenvironmentoftheStateCouncil,andtakechargeofthedailyworkofthenationalgeneralsurveyofpollutionsources.集中式污染治理设施普查的 主要内容包括:设施基本情况 和运行状况,污染物的处理处 置情况,渗滤液、污泥、焚烧 残渣和废气的产生、处置以及 利用情况等。第十二条每次污染源 普查的具体范围和内容,由国 务院批准的普查方案确定。第十三条污染源普查 采用全面调查的方法,必要时 可以采用抽样调查的方法。污染源普查采用全国统一的 标准和技术要求。第三章污染源普查的组织 实施第十四条全国污染源 普查领导小组负责领导和协 调全国污染源普查工作。全国污染源普查领导小组办 公室设在国务院生态环境主 管部门,负责全国污染源普查 日常工作。第十五条县级以上地 方人民政府污染源普查领导 小组,按照全国污染源普查领 导小组的统一规定和要求,领 导和协调本行政区域的污染Article 15 Theleadinggroupsofthegeneralsurveyofpollutionsourcesofthelocalpeople'sgovernmentsatorabovethecountylevelshall,inaccordancewiththeunifiedprovisionsandrequirementsoftheleadinggroupofthenationalgeneralsurveyof源普查工作。县级以上地方人民政府污染 源普查领导小组办公室设在 同级生态环境主管部门,负责 本行政区域的污染源普查日 常工作。pollutionsources,leadandcoordinatethegeneralsurveyworkoftheirrespectiveadministrativeregions.Theleadinggroupofficeofthegeneralsurveyofpollutionsources(hereinafterreferredtoasleadinggroupoffice)underalocalpeople'sgovernmentatorabovethecountylevelshallbeintheadministrativedepartmentofecologyandenvironmentatthesamelevel,andshalltakechargeofthedailygeneralsurveyworkofthisadministrativeregion.乡(镇)人民政府、街道办事 处和村(居)民委员会应当广 泛动员和组织社会力量积极 参与并认真做好污染源普查 工作。第十六条县级以上人 民政府生态环境主管部门和 其他有关部门,按照职责分工 和污染源普查领导小组的统 一要求,做好污染源普查相关 工作。Thepeople,sgovernmentsofV川ages(towns),sub-districtofficesandvillagers,(neighborhood)committeesshallmobilizeandorganizesocialforcestoactivelyparticipateinandearnestlydoagoodjobinthegeneralsurveyofpollutionsources.第十七条全国污染源 普查方案由全国污染源普查 领导小组办公室拟订,经全国 污染源普查领导小组审核同 意,报国务院批准。Article 16 Theadministrativedepartmentofecologyandenvironmentandotherrelateddepartmentsofthepeople'sgovernmentatorabovethecountylevelshall,accordingtothedivisionofworkandtheunifiedrequirementsoftheleadinggroup,getallworkrelatedtothegeneralsurveyofpollutionsourceswelldone.Article 17 TheplanforthegeneralsurveyofpollutionsourcesshallbedraftedbytheleadinggroupofficeofthenationalgeneralsurveyofpollutionsourcesundertheStateCouncil(hereinafterreferredtoastheleadinggroupofficeundertheStateCouncil),andreportedtotheStateCouncilforapprovalafteritisexaminedandapprovedbytheleadinggroupofthenationalgeneralsurveyofpollutionsources.全国污染源普查方案应当包 括:普查的具体范围和内容、 普查的主要污染物、普查方Theplanshallinclude:thespecificscopeandcontentsofthegeneralsurvey,themajorpollutantstobeinspectedinthegeneralsurvey,theproceduresandmethodsforthegeneralsurvey,theorganizationandimplementationofthegeneralsurveyandtheappropriationbudget,etc.Whendraftingaplanforthenationalgeneralsurveyofpollutionsources,theopinionsfromtherelateddepartmentsandexpertsshallbefullyheard.Article 18 TheleadinggroupofficeundertheStateCouncilshalldrawoutthegeneralsurveytableinaccordancewiththeplanforthenationalgeneralsurveyofpollutionsources,andsubmitthetabletotheNationalBureauofStatisticsforappraisal.Theleadinggroupofficeunderthelocalpeople'sgovernmentofaprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentmayaddanattachedlistofthegeneralsurveyofpollutionsourcesforthisadministrativeregiontouse,andusethelistafteritisapprovedbytheleadinggroupofficeundertheStateCouncil.Article 19 Attheinitiationphaseofthegeneralsurvey,theleadinggroupofficeshallcheckallentities.Thedepartmentsinchargeofgovernmentbodyorganization,civilaffairs,marketregulationaswellasotherdepartmentswithfunctionsofexaminationandapprovalorregistrationunderthepeople'sgovernmentatorabovethecountylevelshallprovideentities'informationapprovedorregisteredbythemtotheleadinggroupofficeatthesamelevel,andassistthelatterintheworkofcheckingoverentities.法、普查的组织实施以及经费 预算等。拟订全国污染源普查方案,应 当充分听取有关部门和专家 的意见。第十八条全国污染源 普查领导小组办公室根据全 国污染源普查方案拟订污染 源普查表,报国家统计局审 定。省、自治区、直辖市人民政府 污染源普查领导小组办公室, 可以根据需要增设本行政区 域污染源普查附表,报全国污 染源普查领导小组办公室批 准后使用。第十九条在普查启动 阶段,污染源普查领导小组办 公室应当进行单位清查。县级以上人民政府机构编制、 民政、市场监督管理以及其他 具有设立审批、登记职能的部 ,应当向同级污染源普查领 导小组办公室提供其审批或 者登记的单位资料,并协助做 好单位清查工作。污染源普查领导小组办公室应当以本行政区域现有的基Theleadinggroupofficeshall,onthebasisoftheexistingdirectoryofentitiesofthisadministrativeregionandothersuchinformationprovidedbyrelateddepartments,checkandverifypollutionsourcesonebyoneinaccordancewiththespecificscopeofthegeneralsurveyasspecifiedinthenationalgeneralsurveyplanofpollutionsourcessoastoformadirectoryofentitiessubjecttothegeneralsurveyofpollutionsources.Article 20 Anyofthemidandlarge-scaleindustrialenterpriseslistedintothescopeofthegeneralsurveyofpollutionsourcesshallspecifyanagencytoberesponsibleforfillinginandreportingthegeneralsurveyform,whileotherentitiesshallspecifypersonneltoberesponsibleforsuchwork.Article 21 Theleadinggroupofficemay,inlightoftheactualneeds,hirepeopleorborrowworkersfromrelatedentitiestoengageinthegeneralsurveywork.本单位名录库为基础,按照全 国污染源普查方案确定的污 染源普查的具体范围,结合有 关部门提供的单位资料,对污 染源逐一核实清查,形成污染 源普查单位名录。Theleadinggroupofficeshallconcludealaborcontractwithanypersonithires,giveremunerationtohimandbuysocialinsuranceforhim.Aborrowedworkershallbepaidbytheentityhiringhim,andtheemployeebenefitsshallremainthesame.Article 22 Asurveyorshallsticktotheprincipleofbeingpracticalandrealistic,scrupulouslyabidebytheprofessionalethicsandhaveprofessionalknowledgeneededforexercisinghisduties.第二十条 列入污染源 普查范围的大、中型工业企 业,应当明确相关机构负责本 企业污染源普查表的填报工 作,其他单位应当指定人员负 责本单位污染源普查表的填 报工作。第二十一条污染源普 查领导小组办公室可以根据 工作需要,聘用或者从有关单 位借调人员从事污染源普查 工作。污染源普查领导小组办公室 应当与聘用人员依法签订劳 动合同,支付劳动报酬,并为 其办理社会保险。借调人员的 工资由原单位支付,其福利待 遇保持不变。第二十二条普查人员 应当坚持实事求是,恪守职业 道德,具有执行普查任务所需 要的专业知识。污染源普查领导小组办公室 应当对普查人员进行业务培 训,对考核合格的颁发全国统 一的普查员工作证。Theleadinggroupofficeshallprovidebusinesstrainingsforsurveyors,andissuethenationwideunifiedsurveyor'scardtosurveyorspassingtheexaminationandevaluation.Article 23 Surveyorsshallindependentlyexercisepowersofinvestigation,reporting,supervisionandinspectionaccordingtolaw,havetherighttolookuptherawmaterialconsumptionrecord,productionrecord,pollutioncontrolfacilityoperationrecord,pollutantdischargemonitoringrecordandothersourcematerialrelatedtothegenerationordischargeofpollutantsofanyobjectsubjecttothegeneralsurvey,andhavetherighttoaskanyobjecttocorrectthoseuntrueorincompetentcontentsinthegeneralsurveyformfilledinandreportedbyit.Article 24 Surveyorsshallstrictlyimplementthenationalgeneralsurveyplan,andmaynotforgeoralteranyrelateddata,norforceorinspiresurveyobjectstoprovidefalseinformationforthegeneralsurvey.Foranypollutionsourceinvestigationtask,thereshallbeatleasttwosurveyorsinvolved,whoshallproducetheirsurveyor'scardwhenexecutingthetask,otherwise,thesurveyobjecthastherighttorefusetheinvestigation.Article 25 Surveyorsshalldirectlyvisitsurveyobjectsandtellthemhowtofillinandreportthesurveyform.Afterfinishingfillinginthesurveyform,asurveyobjectshallaffixitssignatureorsealuponitandberesponsiblefortheauthenticityofalldocumentsaffixedwithitssignatureorsealandsubmittedforthegeneralsurveyofpollutionsources.第二十三条普查人员 依法独立行使调查、报告、监 督和检查的职权,有权查阅普 查对象的原材料消耗记录、生 产记录、污染物治理设施运行 记录、污染物排放监测记录以 及其他与污染物产生和排放 有关的原始资料,并有权要求 普查对象改正其填报的污染 源普查表中不真实、不完整的 内容。第二十四条普查人员 应当严格执行全国污染源普 查方案,不得伪造、篡改普查 资料,不得强令、授意普查对 象提供虚假普查资料。普查人员执行污染源调查任 务,不得少于2人,并应当出 示普查员工作证;未出示普查 员工作证的,普查对象可以拒 绝接受调查。第二十五条普查人员 应当依法直接访问普查对象, 指导普查对象填报污染源普 查表。污染源普查表填写完成 后,应当由普查对象签字或者 盖章确认。普查对象应当对其 签字或者盖章的普查资料的 真实性负责。污染源普查领导小组办公室 对其登记、录入的普查资料与 普查对象填报的普查资料的 一致性负责,并对其加工、整 理的普查资料的准确性负责。Theleadinggroupofficeshallberesponsiblefortheconsistencybetweenthesurveydocumentsregisteredorrecordedbyitandthesurveydocumentsfilledinandreportedbysurveyobjectsaswellastheaccuracyofthesurveydocumentsprocessedandsortedoutbyit.Theleadinggroupofficeshall,whenfindingoutanydoubtfulpointsintheprocessofregistering,recording,processingandsortingoutthesurveydocuments,checkthemupwiththerelatedsurveyobject,whichshallmaketruthfulexplanationsorcorrectthem.Article 26 Anypersoninchargeofalocalpeople'sgovernment,adepartmentoranentitymaynotillegallyalterthesurveydo
