政辖区内数据知识产权登记行 为,维护数据要素市场参与主 体合法权益,促进数据要素高 效流通使用,释放数据要素潜 能,支撑数字经济高质量发展, 根据中华人民共和国民法典 中华人民共和国网络安全 法中华人民共和国数据安 全法中华人民共和国个人 信息保护法中华人民共和 国反不正当竞争法北京市 数字经济促进条例北京市 知识产权保护条例中共中 央国务院关于构建数据基础 制度更好发挥数据要素作用的 意见知识产权强国建设纲 要(2021-2035年)等法律 法规和文件规定,制定本办法。第二条数据知识产权的 登记对象,是指数据持有者或 者数据处理者依据法律法规规 定或者合同约定收集,经过一 定规则或算法处理的、具有商 业价值及智力成果属性的处于 未公开状态的数据集合。Article2''Registrationofintellectualpropertyindata“meansdatasetswithcommercialvalueandtheattributesofintellectualachievementsandinanundisclosedstate,whicharecollectedbydataholdersordataprocessorsinaccordancewiththeprovisionsoflawsandregulationsorasagreeduponinthecontractsandprocessedaccordingtocertainrulesoralgorithms.Article3Theregistrationofintellectualpropertyindatashallfollowthelawofdatadevelopment,capturethebasicattributesofdataelements,followtheprinciplesofensuringlegality,compliance,voluntaryregistration,security,efficiency,facilitationofcirculation,openness,transparency,andgoodfaith,andensurethatnationalsecurity,commercialsecrets,andpersonalprivacyarenotinfringedupon.Article4TheBeijingMunicipalIntellectualPropertyOfficeshallmakeoverallplanningfortheadministrationoftheregistrationofintellectualpropertyindatawithintheadministrativeregionofthisMunicipality,buildacitywideunifiedregistrationplatformforintellectualpropertyindata,andcarryouttheworkontheregistrationofintellectualpropertyindatawithintheadministrativeregionofthisMunicipality.TheBeijingIntellectualPropertyProtectionCentershallspecificallyundertaketheregistrationofintellectualpropertyindata.Chapter II RegistrationContentArticle5Anapplicantshalltruthfullyfilloutanapplicationformforregistrationthroughtheregistrationbodydesignatedbythecompetentauthorityandprovidenecessarysupportingdocuments.Theapplicationformforregistrationassubmittedshallmainlycontain:(1) Thenameoftheregistrationtarget.Thenameshallbeintheformatofthenameofthedatasets.第三条数据知识产权登 记应当遵循数据发展规律,把 握数据要素基本属性,按照依 法合规、自愿登记、安全高效、 促进流通、公开透明、诚实信 用的原则,确保国家安全、商 业秘密和个人隐私不受侵犯。第四条北京市知识产权 局统筹本市行政区域内的数据 知识产权登记管理工作,建设 全市统一的数据知识产权登记 平台,开展本市行政区域内数 据知识产权登记工作。北京市 知识产权保护中心具体承办数 据知识产权登记工作。第二章登记内容第五条申请人应通过主 管部门指定的登记机构如实填 写登记申请表并提供必要的证 明文件。提交的登记申请表主 要包含以下内容:(一)登记对象名称。名称格 式为“数据集合名称“;(二)所属行业。按照国民经 济行业分类,说明数据所属行 业;(2) Theindustrytowhichitbelongs.TheindustrytowhichthedatabelongsshallbestatedaccordingtotheClassificationofIndustriesinNationalEconomy.(3) Applicationscenario.Theconditions,scope,andtargetstowhichthedataapplyshallbestated,andthemainproblemsthatthedataapplicationcansolveshallbeclearlyreported.(4) Thesourceofthedataandwhenthedatasetswerecreated.Thesourcesofdatashallbestatedandrelevantcertificationsobtainedinaccordancewiththelawshallbeprovided.(5) Structureandsize.Thestructure(namesandformatsofdatafields)andthesizeofthedata,andthenumberofrecords,amongothers,shallbestated.(6) Frequencyofupdates.Thefrequencyorperiodofupdatesofdataorpartofthedataandsomedataunitsshallbestated.(7) Algorithmrules.Abriefdescriptionaboutthebuildingofalgorithmmodelsandinformationduringthedataprocessingprocessshallbeprovided.Ifanypersonaldataorpublicdataisinvolved,thenecessaryanonymizationandde-identificationofthedata,amongothers,shallbestated,soastoensurethattheoriginaldatacannotberecoveredthroughreversiblemodelsoralgorithms.(8) Thepreservationornotarizationofthedata.(9) Sampledata;(10) Otherinformationtobedescribed,suchasthestatusoftheregistrationtarget.Chapter III RegistrationProcedures(三)应用场景。说明数据适 用的条件、范围、对象,清楚 反映数据应用所能解决的主要 问题;(四)数据来源及数据集合形 成时间。说明数据来源并提供 依法依规获取的相关证明;(五)结构规模。说明数据结 构(数据字段名称、格式)以 及数据规模、记录条数等;(六)更新频次。说明数据或 者部分数据、部分数据单元的 更新频率、更新期限;(七)算法规则。简要说明数 据处理过程中算法模型构建等 情况。涉及个人数据、公共数 据的,还应对数据进行必要的 匿名化、去标识化等情况进行 说明,确保不可通过可逆模型 或者算法还原出原始数据;(A)存证公证情况;(九)样例数据;(十)登记对象状态等其他需 要说明的情况。第三章登记程序第六条数据知识产权登 汨士体.臬指优根注篌注协搦Article6"Registrantsofintellectualpropertyindatameanspartiesthatholdorprocessdataaccordingtotheprovisionsoflawsandregulationsorasagreeduponincontracts,includingnaturalpersons,legalpersons,orunincorporatedorganizationsthatcollect,store,use,process,transmit,provideanddisclosedata.Aregistrantmayapplyforregistrationonitsownormayentrustanagencytohandletheregistrationofintellectualpropertyindata.Anagencyentrustedwithregistrationmattersshallsubmitapowerofattorney,complywiththerelevantprovisionsofthelaw,andshallnotprovidefalseinformationormaterials.Thosewhocooperateindataprocessingshalljointlyapplyforregistration.Whereanyotherpartyisentrustedwiththeprocessingofdata,theentrustingpartyorbothpartiesmayapplyforregistrationinaccordancewiththeagreement.Article7Registrationofintellectualpropertyindatashallbehandledonline.Toapplyfortheregistrationofintellectualpropertyindata,anapplicantshallfileanapplicationintheformofanelectronicdocumentthatcomplieswiththeapplicableprovisionsthroughtheregistrationplatformforintellectualpropertyindataasestablishedbytheregistrationbody.Theregistrationbodyshallservetherelevantdocumentsfortheregistrationofintellectualpropertyindatathroughtheregistrationplatform.定或者合同约定持有或者处理 数据的主体,包括进行数据收 集、存储、使用、加工、传输、 提供、公开等行为的自然人、 法人或者非法人组织。登记主体可自行申请登记,也 可以委托代理机构办理数据知 识产权登记。受委托办理登记 事宜的,应当提交授权委托书, 遵守有关法律规定,不得提供 虚假信息或材料。合作处理数据的,应当共同提 出申请。接受他人委托处理数 据的,可以根据协议由委托方 或双方共同提出申请。第七条数据知识产权登 记通过网上办理。申请数据知 识产权登记,申请人以符合规 定的电子文件形式通过登记机 构设立的数据知识产权登记平 台提出申请。登记机构通过登 记平台送达数据知识产权登记 相关文件。提交数据知识产权登记电子申 请文件或者材料的日期以登记 机构收到相关申请文件的时间 为准,登记机构未能正常接收 的,视为未提交。Thedateofsubmissionofelectronicapplicationdocumentsormaterialsfortheregistrationofintellectualpropertyindatashallbethetimewhentheregistrationbodyreceivestherelevantapplicationdocuments,andiftheregistrationbodyfailstoreceivethemproperly,theyshallbedeemednottohavebeensubmitted.Article8TheregistrationbodyshallconductaformalexaminationoftheapplicationmattersfortheregistrationofintellectualpropertyindatainaccordancewiththeprovisionsoftheseMeasures.WheretheapplicationmaterialsareincompleteordonotmeettherequirementsoftheseRules,theregistrationbodyshall,withinthreeworkingdaysofreceiptofthematerials,informtheapplicantatonetimeofallthenecessarysupplementsandcorrections,andtheapplicantshallmakethecorrectionsandsupplementswithintenworkingdays.Intheabsenceofaresponsemadewithinthespecifiedperiodwithoutjustification,theapplicationforregistrationshallbedeemedtohavebeenwithdrawn.Article9Noregistrationshallbegrantedunderanyofthefollowingcircumstances:(1) TheapplicantfailstocomplywiththescopeofapplicationandtheprinciplessetforthintheseMeasures.(2) TheapplicantfailstocomplywiththeprovisionsofArticles2and3oftheseMeasures.(3) Thedatahasnotbeenpreservedinaspecialpreservationrepositoryornotarizedbeforeregistration.(4) Thereisanunresolveddisputeovertheownershipofintellectualpropertyindata.(5) Theapplicantrepeatedlyregistersorreappliesforregistrationwithoutjustificationaftervoluntarilywithdrawingtheoriginalapplicationforregistration.第八条登记机构依据本 办法规定对数据知识产权登记 申请事项进行形式审查。申请 材料不齐全或者不符合本规则 要求的,登记机构应当在接到 材料三个工作日内,一次性告 知申请人需要补正的材料,申 请人应于十个工作日内予以补 正。无正当理由逾期不答复的, 视为撤回登记申请。第九条有下列情况之一 的,不予登记:(一)不符合本办法适用范围 及原则规定的;(二)不符合本办法第二条、 第三条规定的;(三)登记前未进行数据存证 或者公证的;(四)存在未解决的数据知识 产权权属诉讼纠纷的;(五)重复登记,或者登记申 请主动撤回后无正当理由再次 提出登记申请的;(六)申请人隐瞒事实或者弄 虚作假的;(6) Theapplicantconcealsfactsorcommitsfraud.(7) Othercircumstancesthatdonotcomplywiththeapplicableprovisionsofthelaw.Article 10 Aregistrationbodyshallpublishapublicnoticeontheregistrationplatformforaperiodoftenworkingdaysbeforeregistrationiftheregistrationrequirementsforintellectualpropertyindataaremetuponformalexamination.Thecontentofthepublicnoticeshallincludeinformationsuchastheapplicant,thenameoftheintellectualpropertyindata,applicationscenarios,datasources,andabriefdescriptionofalgorithmrules.Duringthepublicnoticeperiod,anyentityorindividualmayfileanobjectiontothecontentofthepublicnoticeofregistrationofintellectualpropertyindataandprovidethenecessaryevidentialmaterials.Article 11 Uponreceiptofanobjection,theregistrationbodyshallforwardthecontentoftheobjectiontotheapplicantwithinthreeworkingdays;theapplicantshallsubmitrelevantsupportingmaterialsthroughtheregistrationbodywithintenworkingdays.Uponreceiptofevidentialmaterialssubmittedbytheapplicantprovingthattheobjectionisnotsupported,theregistrationbodyshallforwardthemtotheopponentwithinthreeworkingdays;theopponentmaysubmitadditionalevidentialmaterialstotheregistrationbodywithinfiveworkingdaystoprovethattheobjectionissupported.Basedontheevidentialmaterialssubmittedbybothparties,theregistrationbodyshallpreparetheresultofhandlingtheobjectionandgivefeedbacktotheapplicantandtheopponent.(七)其他不符合相关法律规 定的情形。第十条 登记机构对经形 式审查符合数据知识产权登记 要求的,在登记平台进行登记 前公示,公示期为十个工作日。 公示内容包括申请人、数据知 识产权名称、应用场景、数据 来源、算法规则简要说明等信 息。公示期间,任何单位和个 人可对数据知识产权登记公示 内容提出异议并提供必要的证 据材料。第十一条 登记机构接到 异议后,应当在三个工作日内 将异议内容转送申请人;申请 人应于十个工作日内通过登记 机构提交相关证明材料。登记机构接到申请人提交的异 议不成立的证据材料后,应当 在三个工作日内转送异议人, 异议人可以在五个工作日内向 登记机构提交异议成立的补充 证据材料。登记机构根据双方 提交的证据材料形成异议处理 结果,并反馈申请人和异议人。第十二条 公示结束无异 议或者异议不成立的,登记机 构对登记申请依法予以核准,Article 12 Wherethereisnoobjectionattheendofthepublicnoticeoriftheobjectionisnotsupported,theregistrationbodyshallrtnnfirmthannlicatinnfnrroHictratinninaccordancewiththelawandissuearegistrationcertificateforintellectualpropertyindata.Aregistrationcertificateofintellectualpropertyindatashallbeissuedelectronicallyandshallbeannouncedontheregistrationplatform.Article 13 Theformatandstandardoftheregistrationcertificateforintellectualpropertyindatashallbeuniformlydevelopedbytheregistrationbody.Aregistrationcertificateforintellectualpropertyindataisacertificateforwhichtheregistrantholdsdatainaccordancewiththelaw,exercisesrightsoverthedata,andenjoystherightsandinterestssuchasprocessingandusingthedataandobtainingproceedsinaccordancewithlawsandregulations.Thedurationofaregistrationcertificateisvalidforthreeyearsfromonthedateoftheannouncementontheregistration.Withrespecttothepublicdatarelatingtoauthorizedoperationsorthedataofanenterpriseorindividualacquiredunderanagreement,ifthevalidityperiodoftherelevantagreementdoesnotexceedthreeyears,thevalidityperiodoftherelevantagreementshallbeuntilitsexpiration.签发数据知识产权登记证书。 数据知识产权登记证书采用电 子方式发放,并在登记平台上 公告。第十三条数据知识产权 登记证书样式、标准由登记机 构统一制定。数据知识产权登记证书是登记 主体依法持有数据并对数据行 使权利的凭证,享有依法依规 加工使用、获取收益等权益。登记证书的有效期为三年,自 登记公告之日起计算。涉及授权运营的公共数据及以 协议获取的企业、个人数据, 其协议期限不超过三年的,以 相关协议截止日期为有效期。第十四条登记证书有效 期满,需要继续使用证书的, 申请人应当在期满前一个月内 按照规定办理续展登记手续。 每次续展登记的有效期为三 年,自上一届有效期满次日起 计算。期满未办理续展手续的, 由登记机构注销登记并予以公 生_Article 14 Ifaregistrationcertificateexpiresanditisnecessarytocontinuetousethecertificate,theapplicantshallundergotheformalitiesforrenewaloftheregistrationinaccordancewiththeapplicableprovisionswithinonemonthbeforetheexpirationdateofthecertificate.Thedurationofeachrenewalperiodoftheregistrationshallbethreeyears,commencingfromthedayfollowinatheAxnirvoftheDreViOuSdurationoftheregistration.Whererenewalproceduresarenothandledupontheexpiry,
