2 TheoperationofdomesticwatertransportandancillarybusinessshallbesubjecttothisRegulation.Thetermudomesticwatertransportn(hereinafterreferredtoasuwatertransporf,)asmentionedinthisRegulationreferstothecommercialtransportofpassengersandcargosinnavigablewaters,wherethedepartureport,thecallingport,andthedestinationportareallwithinthejurisdictionofthePeople,sRepublicofChina.Thetermuancillarywatertransportbusiness”asmentionedinthisRegulationreferstothebusinessoperationsthataredirectlyprovidedforwatertransport,suchasvesselmanagement,vesselagency,agencyforwatertransportofpassengers,andagencyforwatertransportofcargos.Article 3 Thestateshallencourageandprotectfaircompetitionatthewatertransportmarketandprohibitmonopolyandunfaircompetition.第一条为了规范国内水路 运输经营行为,维护国内水路运 输市场秩序,保障国内水路运输 安全,促进国内水路运输业健康 发展,制定本条例。第二条经营国内水路运输 以及水路运输辅助业务,应当遵 守本条例。本条例所称国内水路运输(以下 简称水路运输),是指始发港、 挂靠港和目的港均在中华人民共 和国管辖的通航水域内的经营性 旅客运输和货物运输。本条例所称水路运输辅助业务, 是指直接为水路运输提供服务的 船舶管理、船舶代理、水路旅客 运输代理和水路货物运输代理等 经营活动。第三条国家鼓励和保护水 路运输市场的公平竞争,禁止垄 断和不正当竞争行为。国家运用经济、技术政策等措 施,支持和鼓励水路运输经营者 实行规模化、集约化经营,促进 水路运输行业结构调整;支持和 鼓励水路运输经营者采用先进适 用的水路运输设备和技术,保障Byadoptingsuchmeasuresaseconomicandtechnicalpolicies,thestateshallsupportandencouragewatertransportoperatorstorealizescaleandintensivebusinessoperationsandpromotethestructuraladjustmentofthewatertransportindustry;andsupportandencouragewatertransportoperatorstoadoptadvancedandapplicablewatertransportfacilitiesandtechnologiestoguaranteetransportsafety,promoteenergyconservation,andreducepollutantdischarge.Thestateshallprotectthelawfulrightsandinterestsofwatertransportoperators,passengers,andcargoowners.Article 4 ThetransportadministrativedepartmentoftheStateCouncilshallbeinchargeofthenationalwatertransportmanagement.Thetransportadministrativedepartmentunderthelocalpeople'sgovernmentatorabovethecountylevelshallbeinchargeofthewatertransportmanagementwithintheirrespectivejurisdiction.Thedepartmentorinstitutionresponsibleforwatertransportmanagementunderthelocalpeople'sgovernmentatorabovethecountylevel(hereinafterreferredtoas“departmentresponsibleforwatertransportmanageme)shallundertakethewatertransportmanagementassetforthinthisRegulation.Article 5 Toengageinwatertransportandancillarybusiness,anoperatorshallobservelawsandregulationsandprovideservicesingoodfaith.运输安全,促进节约能源,减少 污染物排放。国家保护水路运输经营者、旅客 和货主的合法权益。第四条 国务院交通运输主 管部门主管全国水路运输管理工 作。县级以上地方人民政府交通运输 主管部门主管本行政区域的水路 运输管理工作。县级以上地方人 民政府负责水路运输管理的部门 或者机构(以下统称负责水路运 输管理的部门)承担本条例规定 的水路运输管理工作。第五条经营水路运输及其 辅助业务,应当遵守法律、法 规,诚实守信。国务院交通运输主管部门和负责 水路运输管理的部门应当依法对 水路运输市场实施监督管理,对 水路运输及其辅助业务的违法经 营活动实施处罚,并建立经营者ThetransportadministrativedepartmentoftheStateCouncilandthedepartmentresponsibleforwatertransportmanagementshallconductsupervisionandadministrationonthewatertransportmarketaccordingtolaw,imposepenaltiesagainstanyillegalwatertransportoperationandanc川arybusiness,establishmanagementrulesforoperator'soperationsingoodfaith,andpubliclyannouncethesupervisionandinspectioncircumstancesinatimelymanner.ChapterIlWaterTransportOperatorsArticle6Toapplyforengaginginwatertransportbusiness,besidesthecircumstancesasprescribedinArticle7ofthisRegulation,anapplicantshallsatisfythefollowingconditions:(1) obtainsthelegalpersonstatusasanenterprise;(2) hasvesselsthatsatisfytheconditionsasprescribedinArticle13ofthisRegulation,andthetransportcapacityofitsownvesselsconformstotheprovisionsofthetransportadministrativedepartmentoftheStateCouncil;(3) hasspecificbusinessscope.Wheretheapplicantappliesforwatertransportbusinessofpassengerliners,itshallhavefeasiblerouteoperationplan;(4) hasthemanagementpersonnelofmaritimeandmechanicalaffairswhoareconsistentwiththeappliedbusinessscopeandthetransportcapacityofvessels;诚信管理制度,及时向社会公告 监督检查情况。第二章水路运输经营者第六条申请经营水路运输 业务,除本条例第七条规定的情 形外,申请人应当符合下列条 件:(一)取得企业法人资格;(二)有符合本条例第十三条规 定的船舶,并且自有船舶运力符 合国务院交通运输主管部门的规 定;(三)有明确的经营范围,其中 申请经营水路旅客班轮运输业务 的,还应当有可行的航线营运计 划;(四)有与其申请的经营范围和 船舶运力相适应的海务、机务管 理人员;(五)与其直接订立劳动合同的 高级船员占全部船员的比例符合 国务院交通运输主管部门的规 定;(5) thepercentageofseniorcrewwhodirectlyenterintolaborcontractswithitinthetotalcrewcomplieswiththeprovisionsofthetransportadministrativedepartmentoftheStateCouncil;(6) hassoundsafetymanagementrules;and(7) otherconditionsthatareprescribedinlawsandadministrativeregulations.Article7Anindividualmayapplyforengagingingeneralinland-watertransportbusinessofcargos.Anindividualwhoappliesforengagingingeneralinland-watertransportbusinessofcargosshallcomplywithArticle13ofthisRegulationandthetonnageofhisorhervesselmaynotexceedthatofaself-possessedvesselasprescribedbythetransportadministrativedepartmentoftheStateCouncil,andshallsatisfytheconditionsasprescribedinItems6and7ofArticle6ofthisRegulation.Article8TheoperationofwatertransportbusinessshallcomplywiththeprovisionsofthetransportadministrativedepartmentoftheStateCouncilandupontheapprovalofthetransportadministrativedepartmentsoftheStateCouncilorthedepartmentresponsibleforwatertransportmanagementunderthelocalpeople'sgovernmentatorabovethedistrictedcitylevel.Toapplyforengaginginwatertransportbusiness,anapplicantshallsubmittheapplicationformandtherelevantmaterialsprovingthatitsatisfiestheconditionsassetforthinArticle6or7ofthisRegulation.(六)有健全的安全管理制度;(七)法律、行政法规规定的其 他条件Q第七条 个人可以申请经营 内河普通货物运输业务。申请经营内河普通货物运输业务 的个人,应当有符合本条例第十 三条规定且船舶吨位不超过国务 院交通运输主管部门规定的自有 船舶,并应当符合本条例第六条 第六项、第七项规定的条件。第八条经营水路运输业 务,应当按照国务院交通运输主 管部门的规定,经国务院交通运 输主管部门或者设区的市级以上 地方人民政府负责水路运输管理 的部门批准。申请经营水路运输业务,应当向 前款规定的负责审批的部门提交 申请书和证明申请人符合本条例 第六条或者第七条规定条件的相 关材料。负责审批的部门应当自受理申请 之日起30个工作日内审查完毕,Thedepartmentresponsibleforexaminingandapprovingtheapplicationshall,within30workdaysofacceptingtheapplication,reviewtheapplicationanddecideonwhethertoapproveitornot.Wheretheapplicationisapproved,thedepartmentshallissueabusinesslicenseofwatertransportandanoperationcertificateforthevesseltheapplicantputsintooperation;andwheretheapplicationisnotapproved,thedepartmentshallnotifytheapplicantinwritingandstatereasons.Article9Thetransportadministrativedepartmentsatvariouslevelsshallconductwellthestatistics,investigation,andanalysisatthewatertransportmarket,anddisclosethesupplyanddemandoftransportcapacityatthewatertransportmarkettothepubliconaregularbasis.Article10Inordertoguaranteewatertransportsafetyandmaintainfaircompetitionorderatthewatertransportmarket,thetransportadministrativedepartmentoftheStateCouncilmay,inlightofthecircumstancesonthemonitoringofthewatertransportmarket,decidetosuspendnewlicensesoftransportcapacityinspecificroutesandwaterareasforthetransportofpassengerlinersandbulkliquidhazardouscargos.作出准予许可或者不予许可的决 定。予以许可的,发给水路运输 业务经营许可证件,并为申请人 投入运营的船舶配发船舶营运证 件;不予许可的,应当书面通知 申请人并说明理由。第九条各级交通运输主管 部门应当做好水路运输市场统计 和调查分析工作,定期向社会公 布水路运输市场运力供需状况。第十条为保障水路运输安 全,维护水路运输市场的公平竞 争秩序,国务院交通运输主管部 门可以根据水路运输市场监测情 况,决定在特定的旅客班轮运输 和散装液体危险货物运输航线、 水域暂停新增运力许可。采取前款规定的运力调控措施, 应当符合公开、公平、公正的原 则,在开始实施的60日前向社会 公告,说明采取措施的理由以及 采取措施的范围、期限等事项。Theadoptionofmeasuresforadjustingtransportcapacitiesasprescribedintheprecedingparagraphshallfollowtheprincipleofopenness,fairness,andimpartiality.Themeasuresshallbepubliclyannounced60daysbeforetheystarttobeimplemented,andmattersincludingreasonsforadoptingsuchmeasures,andthescopeandtimelimitoftheadoptedmeasuresshallbestated.Article 定,国务院另有规定的除外。Anyenterprise,othereconomicorganizationorindividualintheHongKongSpecialAdministrativeRegion,MacauSpecialAdministrativeRegion,andTaiwanRegionshallbegovernedbytheprovisionsoftheprecedingparagraph,unlessitisotherwiseprescribedbytheStateCouncil.第十二条依照本条例取得 许可的水路运输经营者终止经营 的,应当自终止经营之日起15个 工作日内向原许可机关办理注销 许可手续,交回水路运输业务经 营许可证件。Article 12 WhereawatertransportoperatorwhohasacquiredabusinesslicenseaccordingtothisRegulationterminatesitsbusinessoperations,itshall,within15workdaysoftermination,undergoformalitiesforcancelingthelicenseattheoriginallicense-issuingorganandreturnthelicenseofwatertransportbusiness.第十三条水路运输经营者 投入运营的船舶应当符合下列条 件:Article 13 Thevesselputintooperationbyawatertransportoperatorshallsatisfythefollowingconditions:(一)与经营者的经营范围相适 应;(1) isconsistentwiththeoperator'sbusinessscopeofoperations;(二)取得有效的船舶登记证书 和检验证书;(2) hasvalidvesselregistrationcertificateandinspectioncertificate;(三)符合国务院交通运输主管 部门关于船型技术标准和船龄的 要求;(3) satisfiestherequirementsofthetransportadministrativedepartmentoftheStateCouncilfortechnicalvesselstandardsandvesselage;and(4) otherconditionsasprescribedinlawsandadministrativeregulations.Article14Whereawatertransportoperatorhasnewvesselstoputintooperation,itshallreceivetheoperationcertificatesofvesselsfromthetransportadministrativedepartmentoftheStateCouncilorthedepartmentresponsibleforwatertransportmanagementunderthelocalpeople'sgovernmentatorabovethedistrictedcityleveluponthestrengthofthebusinesslicenseofwatertransport,thevesselregistrationcertificate,andtheinspectioncertificate.Thevesselengaginginwatertransportshallcarryitsoperationcertificate.Themaritimesafetyadministrationthatfindsinon-sitesupervisoryinspectionthatnovalidoperationcertificatecanbeprovidedforavesselengaginginwatertransportshallinformappropriatedepartmentofhandlingitaccordingtothelaw.(四)法律、行政法规规定的其 他条件Q第十四条水路运输经营者 新增船舶投入运营的,应当凭水 路运输业务经营许可证件、船舶 登记证书和检验证书向国务院交 通运输主管部门或者设区的市级 以上地方人民政府负责水路运输 管理的部门领取船舶营运证件。从事水路运输经营的船舶应当随 船携带船舶营运证件。海事管理机构在现场监督检查 时,发现从事水路运输的船舶不 能提供有效的船舶营运证件的, 应当通知有关主管部门依法处 理。第十五条国家根据保障运 输安全、保护水环境、节约能 源、提高航道和通航设施利用效 率的需求,制定并实施新的船型 技术标准时,对正在使用的不符 合新标准但符合原有标准且未达 到规定报废船龄的船舶,可以采 取资金补贴等措施,引导、鼓励 水路运输经营者进行更新、改 造;需要强制提前报废的,应当 对船舶所有人给予补偿。具体办 法由国务院交通运输主管部门会 同国务院财政部门制定。Article15Whenformulatingandimplementingnewtechnicalstandardsforvesselsaccordingtotherequirementsforsafeguardingtransportsafety,protectingwaterenvironment,savingenergy,andimprovingtheuseefficiencyofnavigationchannelsandfacilities,thestateshalladoptsuchmeasuresasfundallowancetothevesselsinusethatdonotcomplywiththenewstandards,butcomplywiththeoriginalstandardsanddonotreachtheprescribeddiscardingage,andguideandencouragewatertransportoperatorstoconductupgradeandtransformation;andwhereavesselneedstobeforciblydiscardedinadvance,itsownershallbecompensated.ThespecificmeasuresshallbeformulatedbythetransportadministrativedepartmentoftheStateCounciljointlywiththefinancialdepartmentoftheStateCouncil.第十六条水路运输经营者 不得使用外国籍船舶经营水路运 输业务。但是,在国内没有能够 满足所申请运输要求的中国籍船 舶,并且船舶停靠的港口或者水 域为对外开放的港口或者水域的 情况下,经国务院交通运输主管 部门许可,水路运输经营者可以 在国务院交通运输主管部门规定 的期限或者航次内,临时使用外 国籍船舶运输。Article16Nowatertransportoperatormayuseaforeignvesseltoengageinwatertransportbusiness.However,underthecircumstancewherethereisnoChinesevesselthatcansatisfytherequirementsfortheappliedtransport,andtheberthingportorwaterareasforthevesselisanopenportorwaterareas,thewatertransportoperatormay,upontheapprovalofthetransportadministrativedepartmentoftheStateCouncilandwithintheprescribedtimelimitandvoyagenumberasprescribedbythetransportadministrativedepartmentoftheStateCouncil,temporarilyuseaforeignvesselfortransport.在香港特别行政区、澳门特别行 政区、台湾地区进行船籍登记的 船舶,参照适用本条例关于外国 籍船舶的规定,国务院另有规定 的除外。AvesselwhosenationalityisregisteredintheHongKongSpecialAdministrativeRegion,MacauSpecialAdministrativeRegion,andTaiwanRegionshallbegovernedbytheprovisionsonforeignvesselsofthisRegulation,unlessitisotherwiseprescribedbytheStateCouncil.第三章水路运输经营活动ChapterIIIBusinessOperationsofWaterTransport第十七条水路运输经营者 应当在依法取得许可的经营范围 内从事水路运输经营。Article 17 Awatertransportoperatorshallengageinthebusinessoperationsofwatertransportwithinthebusinessscopeaslistedinthelicensethatislegallyobtained.第十八条水路运输经营者 应当使用符合本条例规定条件、 配备合格船员的船舶,并保证船 舶处于适航状态。Article 18 AwatertransportoperatorshallusevesselsthatsatisfytheconditionsasprescribedinthisRegulationandareequippedwitheligiblecrew,andguaranteethatsuchvesselsareseaworthy.Thewatertransportoperatorshallcarrypassengersorcargosaccordingtothedesignatedpassengerquotaorloadcapacityofavessel,andmaynotoverloadorusecargovesselstotransportpassengers.Article19Awatertransportoperatorshallprovidesafe,convenientandgood-qualityservicesforpassengersandcargoownersandguaranteethetransportsafetyofpassengersandcargosaccordingtothelaws,administrativeregulations,provisionsonthewatertransportofpassengersandcargos,andqualitystandardsofthetransportadministrativedepartmentoftheStateCouncil,andthestipulationsofthecontract.Thewatertransportoperatorofpassengersshallcoverthecarrier'sliabilityinsuranceforitspassengervesselsorobtainthecorrespondingfinancialguarantee.Article20Totransporthazardouscargos,awatertransportoperatorshallobservethelaws,administrativeregulations,andprovisionsofthetransportadministrativedepartmentoftheStateCouncilonthetransportofhazardouscargos,usethevesselswithlegally-obtainedcertificatesfortheloadingofhazardouscargos,carryandtransportsuchcargosaccordingtotheprescribedtechnicalspecificationsonsafetysoastoguaranteesafetransport.Article21Atransportoperatorofpassengerlinersshallsetsailwithin60daysofobtainingthelicensefortherouteoperationsofliners,andannouncesuchinformationasthevesselsin水路运输经营者应当按照船舶核定载客定额或者载重量载运旅客、货物,不得超载或者使用货船载运旅客。第十九条水路运输经营者应当依照法律、行政法规和国务院交通运输主管部门关于水路旅客、货物运输的规定、质量标准以及合同的约定,为旅客、货主提供安全、便捷、优质的服务,保证旅客、货物运输安全。水路旅客运输业务经营者应当为其客运船舶投保承运人责任保险或者取得相应的财务担保。第二十条水路运输经营者运输危险货物,应当遵守法律、行政法规以及国务院交通运输主管部门关于危险货物运输的规定,使用依法取得危险货物适装证书的船舶,按照规定的安全技术规范进行配载和运输,保证运输安全。第二十一条旅客班轮运输业务经营者应当自取得班轮航线经营许可之日起60日内开航,并在开航15日前公布所使用的船舶、班期、班次、运价等信息。use,schedule,voyagenumber,andfreightrate15daysbeforethevesselsse
