I GeneralProvisionsArticle1Forthepurposesofestablishingandimprovingtheadministrativediscretionbenchmarksystemforemergencymanagement,standardizingtheexerciseofadministrativediscretion,ensuringtheeffectiveimplementationoflawsandregulationsonemergencymanagement,andprotectingthelegitimaterightsandinterestsofcitizens,legalpersonsandotherorganizations,theseProvisionsaredevelopedinaccordancewiththeLawofthePeople'sRepublicofChinaonAdministrativePenalty,theAdministrativeLicensingLawofthePeople,sRepublicofChinaandotherlawsandregulationsandrelevantprovisions.Article2TheseProvisionsshallapplytothedevelopment,implementationandmanagementoftheadministrativediscretionbenchmarkoftheemergencymanagementdepartment.Thedevelopment,implementationandmanagementoftheadministrativediscretionbenchmarkoffirerescueinstitutions,minesafetysupervisioninstitutionsandseismicoperationinstitutionsshallbegovernedbytherelevantprovisionsoftheseProvisions.应急管理行政裁量权基准暂行 规定第一章总则第一条为了建立健全应 急管理行政裁量权基准制度, 规范行使行政裁量权,保障应 急管理法律法规有效实施,保 护公民、法人和其他组织的合 法权益,根据中华人民共和 国行政处罚法中华人民共 和国行政许可法等法律法规 和有关规定,制定本规定。第二条应急管理部门行 政裁量权基准的制定、实施和 管理,适用本规定。消防救援 机构、矿山安全监察机构、地 震工作机构行政裁量权基准的 制定、实施和管理,按照本规 定的相关规定执行。本规定所称应急管理行政裁量 权基准,是指结合工作实际, 针对行政处罚、行政许可、行 政征收征用、行政强制、行政 检查、行政确认、行政给付和 其他行政行为,按照裁量涉及 的不同事实和情节,对法律、ForthepurposeoftheseProvisions,administrativediscretionbenchmarkforemergencymanagementreferstothespecificlawenforcementmeasuresandstandardsannouncedtothepublicandimplementedinaspecificform,whichspecifyandquantifythelawenforcementauthority,marginofdiscretionandothercontentsinlaws,regulationsandruleswithprincipleprovisionsorcertainflexibility,onthebasisoftheadministrativepunishment,administrativelicense,administrativecollectionandrequisition,administrativecoercion,administrativeinspection,administrativeconfirmation,administrativepaymentandotheradministrativeactsinlightofthedifferentfactsandcircumstancesinvolvedinthediscretion,inconsiderationoftheworkreality.Article3Theadministrativediscretionbenchmarkforemergencymanagementshallcomplywiththeprovisionsoflaws,regulationsandrulesonadministrativelawenforcementmatters,conditions,procedures,typesandscope,effectivelyconductconnectionbetweenthegenerallawadjustingcommonadministrativeactsandthespecificregulationadjustingcertainspecificsocialrelationsorcontentsofcertainrespects,andensuretheunity,Systemizationandintegrityofthelegalsystem.Article4Forthedevelopmentoftheadministrativediscretionbenchmarkforemergencymanagement,theopinionsofcitizens,legalpersonsandotherorganizationsshallbeextensivelylistenedto,andtherighttoknowandtherighttoparticipateofadministrativecounterpartsandstakeholdersshallbeguaranteedinaccordancewiththelaw.法规、规章规定中的原则性规 定或者具有一定弹性的执法权 限、裁量幅度等内容进行细化 量化,以特定形式向社会公布 并施行的具体执法尺度和标 准O第三条应急管理行政裁 量权基准应当符合法律、法 规、规章有关行政执法事项、 条件、程序、种类、幅度的规 定,做好调整共同行政行为的 一般法与调整某种具体社会关 系或者某一方面内容的单行法 之间的衔接,确保法制的统一 性、系统性和完整性。第四条制定应急管理行 政裁量权基准应当广泛听取公 民、法人和其他组织的意见, 依法保障行政相对人、利害关 系人的知情权和参与权。第五条制定应急管理行 政裁量权基准应当综合考虑行 政职权的种类,以及行政执法 行为的事实、性质、情节、法 律要求和本地区经济社会发展 状况等因素,确属必要、适 当,并符合社会公序良俗和公 众合理期待。应当平等对待公 民、法人和其他组织,对类Article5Forthedevelopmentoftheadministrativediscretionbenchmarkforemergencymanagement,thetypesofadministrativepowers,aswellasthefacts,nature,circumstances,legalrequirementsandlocaleconomicandsocialdevelopmentsituation,andotherfactorsshallbecomprehensivelyconsidered,itisindeednecessaryandappropriate,andinlinewithsocialpublicorderandgoodcustomsandreasonableexpectationsofthepublic.Citizens,legalpersonsandotherorganizationsshallbetreatedequally,andtheresultsofhandlingmattersofthesameorsimilarcategory,natureandcircumstancesshallbebasicallyconsistent.Article6Emergencymanagementdepartmentsshallfirmlyestablishtheconceptoflawenforcementforthepeople,performtheirdutiesaccordingtothelaw,simplifyprocesses,specifyconditions,optimizeservices,improveadministrativeefficiency,andprovideconvenienceforcitizens,legalpersonsandotherorganizationstothegreatestextent.Chapter II DevelopmentResponsibilitiesandPowersArticle7TheadministrativepenaltydiscretionbenchmarkoftheemergencymanagementdepartmentshallbedevelopedbytheMinistryofEmergencyManagement,andtheNationalFireandRescueAdministration,theNationalMineSafetyAdministration,theChinaEarthquakeAdministrationshall,inaccordancewiththeirresponsibilities,respectivelydevelopadministrativepenaltydiscretionbenchmarkinthefieldoffirefighting,minesafety,andearthquake.别、性质、情节相同或者相近 事项的处理结果应当基本一 致Q第六条应急管理部门应 当牢固树立执法为民理念,依 法履行职责,简化流程、明确 条件、优化服务,提高行政效 能,最大程度为公民、法人和 其他组织提供便利。第二章制定职责和权限第七条应急管理部门行 政处罚裁量权基准由应急管理 部制定,国家消防救援局、国 家矿山安全监察局、中国地震 局按照职责分别制定消防、矿 山安全、地震领域行政处罚裁 量权基准。各省、自治区、直辖市和设区 的市级应急管理部门,各省、 自治区、直辖市消防救援机 构,国家矿山安全监察局各省 级局,各省、自治区、直辖市 地震局可以依照法律、法规、 规章以及上级行政机关制定的 行政处罚裁量权基准,制定本 行政区域(执法管辖区域)内 的行政处罚裁量权基准。Theemergencymanagementdepartmentsofallprovinces,autonomousregions,municipalitiesdirectlyundertheCentralGovernmentandatthedistrictedcitylevel,firerescueinstitutionsofallprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment,allprovincialbureausoftheNationalMineSafetyAdministration,andallearthquakebureausofallprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentmay,inaccordancewithlaws,regulationsandrules,aswellastheadministrativepenaltydiscretionbenchmarkdevelopedbyadministrativeauthoritiesathigherlevels,developtheadministrativepenaltydiscretionbenchmarkintheadministrativeregion(lawenforcementjurisdiction).Theemergencymanagementdepartmentatthecountylevelmay,withinthestatutoryscope,rationallyspecifyandquantifythestandards,conditions,types,extents,methods,andtimelimitsapplicabletotheadministrativepenaltydiscretionbenchmarkdevelopedbytheemergencymanagementdepartmentathigherlevels.Article 8 Theadministrativediscretionbenchmarkoftheemergencymanagementdepartmentforadministrativelicensing,administrativeexpropriation,administrativecoercion,administrativeinspection,administrativeconfirmation,administrativepaymentandotheradministrativeactsshallbedevelopedbytheemergencymanagementdepartmentresponsibleforimplementingtheadministrativeactortheemergencymanagementdepartmentoftheprovince(autonomousregion,ormunicipalitydirectlyundertheCentralgovernment)inaccordancewithlaws,regulations,rulesandrelevantprovisionsissuedbythepeople'sgovernmentatthecorrespondinglevel.县级应急管理部门可以在法定 范围内,对上级应急管理部门 制定的行政处罚裁量权基准适 用的标准、条件、种类、幅 度、方式、时限予以合理细化 量化。第八条应急管理部门行 政许可、行政征收征用、行政 强制、行政检查、行政确认、 行政给付以及其他行政行为的 行政裁量权基准,由负责实施 该行政行为的应急管理部门或 者省(自治区、直辖市)应急 管理部门按照法律、法规、规 章和本级人民政府有关规定制 定。第九条应急管理部门应 当采用适当形式在有关政府网 站或者行政服务大厅、本机关 办事机构等场所向社会公开应 急管理行政裁量权基准,接受 公民、法人和其他组织监督。Article 9 Theemergencymanagementdepartmentshall,inanappropriateform,disclosetheadministrativediscretionbenchmarkforemergencymanagementtothepubliconthewebsiteorattheadministrativeservicehalloftherelevantgovernment,theadministrativeofficeoftheauthorityandotherplaces,andacceptthesupervisionofcitizens,legalpersonsandotherorganizations.ChapterIIIScopeContentsandApplicableRulesArticle 10 Theprinciplesofpenaltiescommensuratewithcriminalactivitiesandcombiningpunishmentwithleniencyshallbeinsistedonforadministrativepenaltydiscretionbenchmarkforemergencymanagement,topreventexcessivelylightorseverepenaltiesandobviousunfairness.Theadministrativepenaltydiscretionbenchmarkforemergencymanagementshallincludeillegalacts,statutorybasis,discretionaryorder,applicableconditionsandspecificstandards,etc.Article 11 Wherelaws,regulations,andrulesstipulatethatapenaltytypemaybeselectedforthesameillegalact,theadministrativepenaltydiscretionbenchmarkforemergencymanagementshallclearlyselectthecircumstancesandapplicableconditionsofthepenaltytype.Whereitisstipulatedinlaws,regulationsandrulesthatthepenaltyrangemaybeselected,theadministrativepenaltydiscretionbenchmarkforemergencymanagementshalldeterminethespecificcircumstancesapplicabletodifferentlevelsofdiscretion.第三章范围内容和适用规则第十条应急管理行政处 罚裁量权基准应当坚持过罚相 当、宽严相济,避免畸轻畸 重、显失公平。应急管理行政处罚裁量权基准 应当包括违法行为、法定依 据、裁量阶次、适用条件和具 体标准等内容。第十一条法律、法规、 规章规定对同一种违法行为可 以选择处罚种类的,应急管理 行政处罚裁量权基准应当明确 选择处罚种类的情形和适用条 件。法律、法规、规章规定可以选 择处罚幅度的,应急管理行政 处罚裁量权基准应当确定适用 不同裁量阶次的具体情形。第十二条罚款数额的从 轻、一般、从重档次情形应当 明确具体,严格限定在法定幅 度内。Article 12 Thecircumstancesforlight,generalandseverepenaltyoffinesshallbeclearandspecificandstrictlylimitedwithinthelegalrange.Wherethefineisamultipleofacertainamount,itshallbereasonablydividedintonotlessthanthreeordersbetweenthehighestmultipleandthelowestmultiple;wherethehighestmultipleismorethantentimesthelowestmultiple,itshallbereasonablydividedintonotlessthanfiveorders;andwheretheamountoffinehasacertainrange,itshallbereasonablydividedintonotlessthanthreelevelsbetweenthemaximumamountandtheminimumamount.Article 13 Whenimplementingadministrativepenaltiesandcorrecting川egalacts,theemergencymanagementdepartmentshallinsistoncombinationofpunishmentandeducation,andmaximizetheroleofadministrativepenaltyeducationinguidingcitizens,legalpersonsandotherorganizationstoconsciouslyabidebythelaw.Whenimplementingadministrativepenalties,theemergencymanagementdepartmentshallorderthepartiestotakecorrectiveactionorcorrecttheillegalactswithinaprescribedtimelimit.Otherthanthoseshallberefundedorcompensatedaccordingtothelaw,theillegalgainsobtainedbyapartyshallbeconfiscated.Wherelawsoradministrativeregulationsprovidethatarticlesandillegalgainsshallbeconfiscatedbeforeotheradministrativepenaltiesareimposed,otheradministrativepenaltiesshallnotbedirectlyselectedforapplication.罚款为一定金额倍数的,应当 在最高倍数与最低倍数之间合 理划分不少于三个阶次;最高 倍数是最低倍数十倍以上的, 应当合理划分不少于五个阶 次;罚款数额有一定幅度的, 应当在最高额与最低额之间合 理划分不少于三个阶次。第十三条应急管理部门 实施行政处罚,纠正违法行 为,应当坚持处罚与教育相结 合,发挥行政处罚教育引导公 民、法人和其他组织自觉守法 的作用。应急管理部门实施行政处罚 时,应当责令当事人改正或者 限期改正违法行为。当事人有违法所得,除依法应 当退赔的外,应当予以没收。法律、行政法规规定应当先予 没收物品、没收违法所得,再 作其他行政处罚的,不得直接 选择适用其他行政处罚。第十四条不满十四周岁 的未成年人有违法行为的,不 予行政处罚,责令监护人加以 管教;已满十四周岁不满十八Article 14 Aminorundertheageof14thatcommitsanillegalactshallbeexemptedfromadministrativepenaltyandhisguardianshallbeorderedtodisciplinehim;andaminorabovetheageof14butundertheageof18thatcommitsanillegalactshallbegivenlighterormitigatedadministrativepenalty.Article 15 Whereamentalpatientorintellectualdisabledpersoncommitsanillegalactwhenheisunabletoidentifyorcontrolhisownbehavior,heshallnotbesubjecttoadministrativepunishment,buthisguardianshallbeorderedtokeephimunderstrictsupervisionandtreatment.Foranintermittentmentalpatientwhocommitsanillegalactatatimewhenheismentallynormal,administrativepenaltiesshallbeimposeduponhim.Amentalpatientormentallydeficientpersonthathasnotyetcompletelylostcapacityofidentifyingorcontrollinghisbehaviorandhascommittedanillegalactmaybegivenlighterormitigatedadministrativepenalty.Article 16 Aviolatorwhoseillegalactisminor,thathastakecorrectiveactioninatimelymanner,andthathascausednoharmfulconsequenceshallbeexemptedfromadministrativepenalty.Aviolatorthatviolateslawforthefirsttime,whoseharmfulconsequenceisminor,andthathastakencorrectiveactioninatimelymannermaybeexemptedfromadministrativepenalty.Inadditiontothelistofmattersthathavebeendevelopedinaccordancewiththeprovisionsthatpenaltyshallbeexemptedforminorviolations,inaccordancewiththeprovisionsofparagraph1ofthisarticle,ifadecisiononnotimposingpenaltyforrelevantillegalactsismade,itshallbemadebythepersonsinchargeoftheemergencymanagementdepartmentaftercollectivediscussion.周岁的未成年人有违法行为 的,应当从轻或者减轻行政处 罚。第十五条精神病人、智 力残疾人在不能辨认或者不能 控制自己行为时有违法行为 的,不予行政处罚,但应当责 令其监护人严加看管和治疗。 间歇性精神病人在精神正常时 有违法行为的,应当给予行政 处罚。尚未完全丧失辨认或者 控制自己行为能力的精神病 人、智力残疾人有违法行为 的,可以从轻或者减轻行政处 罚。第十六条 违法行为轻微 并及时改正,没有造成危害后 果的,不予行政处罚。初次违 法且危害后果轻微并及时改正 的,可以不予行政处罚。除已经按照规定制定轻微违法 不予处罚事项清单外,根据本 条第一款规定对有关违法行为 作出不予处罚决定的,应当经 应急管理部门负责人集体讨论 决定。当事人有证据足以证明没有主Whereapartyhassufficientevidencetoprovethatthereisnosubjectivefault,administrativepenaltyshallbeexempted,exceptasotherwiseprescribedbylawsandadministrativeregulations.观过错的,不予行政处罚。法律、行政法规另有规定的,从其规定。Whereapartyisexemptedfromadministrativepenaltyforillegalactinaccordancewiththelaw,theemergencymanagementdepartmentshalleducatetheparty.Article17Apartyfallingunderanyofthefollowingcircumstancesshallbegivenalighterormitigatedadministrativepenaltyinaccordancewithlaw:(1) Hehastakentheinitiativetoeliminateorlessentheharmfulconsequencesofhisillegalact.(2) Heiscoercedorcajoledbyothersintocommittinganillegalact.(3) Hehastakentheinitiativetoconfesshisillegalactsthathavenotbeenknowntotheemergencymanagementdepartmentandotheradministrativeauthorities.对当事人的违法行为依法不予行政处罚的,应急管理部门应当对当事人进行教育。第十七条当事人有下列情形之一的,应当依法从轻或者减轻行政处罚:(一)主动消除或者减轻违法行为或者事故危害后果的;(二)受他人胁迫或者诱骗实施违法行为的;(三)主动供述应急管理部门及其他行政机关尚未掌握的违法行为的;(4)Hehasmeritoriousperformanceincooperationwiththeemergencymanagementdepartmentininvestigatingintoandhandlingillegalactsorconductingaccidentinvestigationformeritoriousservice.(四)配合应急管理部门查处违法行为或者进行事故调查有立功表现的;(5)Hefallsunderothercircumstancesunderwhichalighterormitigatedadministrativepenaltyshallbegivenaccordingtothelaws,regulationsandrules.(五)法律、法规、规章规定其他应当从轻或者减轻行政处罚的。Article18Whereapartyfallsunderthecircumstanceforlighterpenalty,lighterandfewertypesofpenaltyorlowerlevelsofpenaltyshallbeimposedwithinthetypesandextentofpenaltytobeselectedaccordingtothelaw.第十八条当事人存在从轻处罚情节的,应当在依法可以选择的处罚种类和处罚幅度内,适用较轻、较少的处罚种类或者较低的处罚幅度。Wherethepartiesfallundercircumstancesformitigatedpenalty,thetypesorrangesofpenaltiesbelowtheminimumstatutoryadministrativepenaltiesshallbeapplied,includingcircumstancesunderwhichnotimposingadditionalpenaltywhenitisrequiredandanddeterminingtheamountoffinebelowthelegalminimumfinelimit.当事人存在减轻处罚情节的,应当适用法定行政处罚最低限度以下的处罚种类或者处罚幅度,包括应当并处时不并处、在法定最低罚款限值以下确定罚款数额等情形。Whereadecisiononmitigatingpenaltyismadeontheparties,thedecisionshallbemadeaftercollectivediscussionbythepersonsinchargeoftheemergencymanagementdepartmentArticle19Whereapartyfallsunderanyofthefollowingcircumstances,heavierpenaltyshallbeimposedaccordingtothelaw:(1) Apartyhasbeensubjecttocriminalpunishmentforthesameillegalactorhasbeensubjecttoadministrativepunishmentforthesameillegalactwithinoneyear.(2) Apartyrefuses,obstructsorthreatensbyviolentmeansadministrativelawenforc
