民用无人驾驶航空器生产管理若 干规定（2023年12月18日工业和信息 化部令第66号公布，自2024年1 月1日起施行）第一条为了规范民用无人 驾驶航空器生产活动，促进民用 无人驾驶航空器产业健康有序发 展，维护航空安全、公共安全、 国家安全，根据无人驾驶航空 器飞行管理暂行条例以及相关 法律、行政法规，制定本规定。第二条生产、组装、拼装 （以下统称生产）在中华人民共 和国境内销售、使用的民用无人 驾驶航空器，应当遵守本规定。民用无人驾驶航空器生产管理若干规定SeveralProvisionsontheAdministrationoftheManufactureofUnmannedCivilAircraft制定机关：工业和信息化部发文字号：工业和信息化部令第66号公布日期：2023.12.18施行日期：2024.01.01效力位阶：部门规章法规类别：航空运输IssuingAuthority:MinistryofIndustry&InformationTechnologyDocumentNumber:OrderNo.66oftheMinistryofIndustryandInformationTechnologyDateIssued:12-18-2023EffectiveDate:01-01-20241.evelofAuthority:DepartmentalRulesAreaofLaw:AirTransportSeveralProvisionsontheAdministrationoftheManufactureofUnmannedCivilAircraft(IssuedbyOrderNo.66oftheMinistryofIndustryandInformationTechnologyonDecember18,2023,andcomingintoforceonJanuary1,2024)Article1TheseProvisionsaredevelopedinaccordancewiththeInterimRegulationontheAdministrationoftheFlightofUnmannedAircraftandotherapplicablelawsandadministrativeregulationsforthepurposesofregulatingthemanufacturingactivitiesofunmannedcivilaircraft,promotingthesoundandorderlydevelopmentoftheunmannedcivilaircraftindustry,andprotectingaviationsafety,publicsafety,andnationalsecurity.Article2Themanufacture,assembly,andfabrication(hereinaftercollectivelyreferredtoas“manufacture")ofunmannedcivilaircraftforsaleorusewithintheterritoryofthePeople'sRepublicofChinashallcomplywiththeseProvisions.ForthepurposesoftheseProvisions,“unmannedcivilaircrafmeansacivilaircraftwithoutahumanpilotaboardbutwithanindependentpowertrain.Article3Anunmannedcivilaircraftmanufacturershallassignauniqueproductidentificationnumbertoeachunmannedcivilaircraftitmanufactures,exceptforflyingtoyswithanindependentpowertrain.Article4Auniqueproductidentificationnumbershallcontainthenamecodeoftheunmannedcivilaircraftmanufacturer,theproductmodelcode,andtheserialnumber.ThenamecodeoftheunmannedcivilaircraftmanufacturerandtheproductmodelcodeshallbepreparedbytheunmannedcivilaircraftmanufacturerandreportedtotheMinistryofIndustryandInformationTechnologyforexaminationandconfirmation.Theserialnumbershallbepreparedbytheunmannedcivilaircraftmanufactureronitsown.Article5Thecodingrulesofuniqueproductidentificationcodesshallcomplywiththemandatoryrequirementsoftherelevantnationalstandards.本规定所称民用无人驾驶航空 器，是指没有机载驾驶员、自备 动力系统的民用航空器。第三条民用无人驾驶航空 器生产者应当为其生产的民用无 人驾驶航空器设置唯一产品识别 码。自备动力系统的飞行玩具除 外。第四条 唯一产品识别码应 当包含民用无人驾驶航空器生产 者名称代码、产品型号代码和序 列号。民用无人驾驶航空器生产者名称 代码、产品型号代码，由民用无 人驾驶航空器生产者拟制，报工 业和信息化部审核确认。序列号由民用无人驾驶航空器生 产者自行编制。第五条唯一产品识别码的 编码规则应当符合有关国家标准 的强制性要求。不得重复、虚假设置唯一产品识 别码。Nouniqueproductidentificationnumbershallbeassignedrepeatedlyorfalsely.Article6AnunmannedcivilaircraftmanufacturershallfiletheuniqueproductidentificationcodeinformationwiththeMinistryofIndustryandInformationTechnologyforrecordationbeforetheunmannedcivilaircraftisputonthemarket.However,foranunmannedcivilaircraftthatisusedfortestflightsorthatisfabricatedorassembled,theuniqueproductidentificationcodeinformationshallbefiledwiththeMinistryofIndustryandInformationTechnologyforrecordationbeforeitsfirstflight.Article7Whereanunmannedcivilaircraftmanufacturerchangesanyuniqueproductidentificationcodeduetorepairormaintenance,themanufacturershallfilethechangeoftheuniqueproductidentificationcodewiththeMinistryofIndustryandInformationTechnologyforrecordationbeforetherelevantunmannedcivilaircraftfliesagain.Article8Anunmannedcivilaircraftmanufacturershallcomplywiththelawsandregulationsontheadministrationofradioandtherelevantprovisionsissuedbythestateontheadministrationofradio.Exceptformicropower,short-rangeradiotransmissionequipment,theradiotransmissionequipmentofunmannedcivilaircraftshallobtainmodelapprovalofradiotransmissionequipment.第六条民用无人驾驶航空 器生产者应当在民用无人驾驶航 空器投放市场前，将唯一产品识 别码信息报工业和信息化部备 案，但用于测试飞行以及组装、 拼装的民用无人驾驶航空器，应 当在首次飞行前将唯一产品识别 码信息报工业和信息化部备案。第七条因维修、维护等原 因，民用无人驾驶航空器生产者 变更唯一产品识别码的，应当在 民用无人驾驶航空器重新飞行前 将唯一产品识别码变更情况报工 业和信息化部备案。第八条生产民用无人驾驶 航空器应当遵守无线电管理法律 法规以及国家无线电管理有关规 定。除微功率短距离无线电发射 设备外，民用无人驾驶航空器无 线电发射设备应当依法取得无线 电发射设备型号核准。第九条民用无人驾驶航空 器装载的接入公用电信网的电信 设备应当依法取得电信设备进网 许可。Article9Anytelecommunicationsequipmentloadedonanunmannedcivilaircraftforaccesstothepublictelecommunicationsnetworkshallobtainanetworkaccesslicensefortelecommunicationsequipmentinaccordancewiththelaw.Article10Anunmannedcivilaircraft第十条民用无人驾驶航空器生产者不得在民用无人驾驶航 空器中设置恶意程序；发现民用 无人驾驶航空器存在网络或者数 据安全缺陷、漏洞等风险时，应 当立即采取补救措施，按照国家 有关规定及时告知使用人，并向 住所地的县级以上地方人民政府 工业和信息化主管部门或者省级 通信主管部门报告。manufacturershallnotinstallmalwareinitsunmannedcivilaircraft.Whenamanufacturerdiscoversanyrisksuchascybersecurityordatasecuritydefectandvulnerabilityarisingfromitsunmannedcivilaircraft,itshallimmediatelytakeremedialmeasures,promptlyinformusersinaccordancewiththeapplicableprovisionsissuedbythestate,andfileareportwiththedepartmentofindustryandinformationtechnologyofthepeople,sgovernmentatorabovethecountylevelortheprovincialcommunicationdepartmentatitsdomicile.国家鼓励民用无人驾驶航空器生 产者依法使用商用密码等技术手 空器生产者应当加强民用无人驾 驶航空器生产过程的数据管理和 安全防护。Article 11 Anunmannedcivilaircraftmanufacturershallstrengthendatamanagementandsecurityprotectioninthemanufacturingprocessofunmannedcivilaircraft.第十二条工业和信息化部 建立民用无人驾驶航空器产品信 息系统，与县级以上地方人民政 府工业和信息化主管部门、省级 通信主管部门，以及无人驾驶航 空器一体化综合监管服务平台等 共享民用无人驾驶航空器生产企 业信息以及唯一产品识别码等产 品信息OArticle 12 TheMinistryofIndustryandInformationTechnologyshallestablishaproductinformationsystemforunmannedcivilaircrafttoshareinformationonunmannedcivilaircraftmanufacturersandproductinformationsuchasuniqueproductidentificationcodeswiththedepartmentsofindustryandinformationtechnologyoflocalpeople'sgovernmentsatorabovethecountylevel,theprovincialcommunicationdepartments,andtheintegratedunmannedaircraftregulatoryserviceplatform.第十三条县级以上人民政 府工业和信息化主管部门、省级Article 13 Thedepartmentofindustryandinformationtechnologyofapeople's通信主管部门应当加强对民用无 人驾驶航空器生产活动的监督检 查；发现有违反本规定行为的， 依照无人驾驶航空器飞行管理 暂行条例以及相关法律、行政 法规予以处罚。第十四条县级以上人民政 府工业和信息化主管部门、省级 通信主管部门及其工作人员违反 本规定，在民用无人驾驶航空器 生产管理工作中滥用职权、玩忽 职守、徇私舞弊或者有其他违法 行为的，依法予以处分。第十五条本规定所称自备 动力系统的飞行玩具，是指最大 飞行真高不超过30米，最大起飞 重量小于0. 25千克，最大飞行水 平距离不超过100米，最大飞行 速度不超过18千米/小时，且无 线电发射设备符合微功率短距离 技术要求，不搭载拍摄和测控设 备，全程可以依靠人工操作进行 飞行的遥控玩具。第十六条模型航空器的生 产不适用本规定。governmentatorabovethecountyleveloraprovincialcommunicationdepartmentshallstrengthenthesupervisionandinspectionofthemanufacturingactivitiesofunmannedcivilaircraft;ifitfindsanyviolationoftheseProvisions,itshallimposeapenaltyontheviolatorinaccordancewiththeInterimRegulationontheAdministrationoftheFlightofUnmannedAircraftandtherelevantlawsandadministrativeregulations.Article 14 Thedepartmentofindustryandinformationtechnologyofapeople'sgovernmentatorabovethecountyleveloraprovincialcommunicationdepartmentoranyofitsemployeesthat,inviolationoftheseProvisions,abusespower,neglectsduties,engagesinmalpracticeforprivategain,orcommitsanyotherillegalactintheadministrationofthemanufactureofunmannedcivilaircraftshallbedisciplinedinaccordancewiththelaw.Article 15 ForthepurposeoftheseProvisions,uflyingtoywithanindependentpowertrainnmeansaremotecontroltoythatfliesatamaximumtruealtitudenotexceeding30meters,isnotmorethan0.25kginmaximumtakeoffweight,andfliesatamaximumhorizontalflightdistancenotexceeding100metersandatamaximumfightspeedof18km/h,hasradiotransmissionequipmentmeetingthetechnicalrequirementsformicropowerandshortrange,doesnotcarryfilmingandmeasuringandcontrolequipment,andmayflythroughmanualoperationsatanytimethroughouttheprocess.Article 16 TheseProvisionsshallnotapplytothemanufactureofmodelaircraft.Article 17 TheseProvisionsshallcomeinto第十七条本规定自2024年forceonJanuary1,2024.1月1日起施行。
