21日发布2018年6月1日实施）(IssuedbytheCivilAviationAdministrationofChinaonMarch21,2018andcameintoforceonJune1,2018)第一章总则Chapter I GeneralProvisions第一条为了规范使用民用无人 驾驶航空器（以下简称“无人驾驶航 空器”）从事经营性飞行活动，加强 市场监管，促进无人驾驶航空器产业 安全、有序、健康发展，依据民航 法及无人驾驶航空器管理的有关规 定，制定本办法。Article1Forthepurposesofregulatingtheuseofcivilunmannedaerialvehicles(uUAVn)tocarryoutoperationalflightactivities,strengtheningmarketsupervision,andpromotingthesafe,orderlyandsounddevelopmentoftheUAVindustry,theseMeasuresaredevelopedinaccordancewiththeCivilAviationLawandtherelevantprovisionsontheadministrationofUAV.Article2Thesemeasuresshallbeapplied第二条本办法适用于在中华人toaerialspraying（sprinkling）,民共和国境内（港澳台地区除外）使aerophotography,aerialphotography,show用最大空机重量为250克以上（含flightsandotheroperationalandUAVpilotstrainingactivitiescarriedoutwithintheterritoryofthePeople'sRepublicofChina(excludingHongKong,MacaoandTaiwan)withUAVsofmaximumemptyweightof250gramsormore.Thesemeasuresshallnotbeappliedtothepassenger-andcargocarryingoperationalflightactivitiescarriedoutwithUAVs.Article3AnoperationpermitshallbeobtainedforcarryingouttheoperationalflightactivitiessetoutinArticle2oftheseMeasureswithUAVs,andnooperationalflightactivitiesshallbecarriedoutwithoutanoperationpermit.Article4TheCivilAviationAdministrationofChina(uCAACn)shallimplementunifiedsupervisionandadministrationoftheoperationpermitsofUAVs.TheCAACregionaladministrationsshallberesponsiblefortheissuance,supervisionandadministrationofoperationpermitsofUAVswithintheirjurisdictions.Chapter II ConditionsandProceduresfortheApplicationforPermitsArticle 5 AnapplicantforanoperationpermitofUAVsshallmeetthefollowingbasicconditions:250克）的无人驾驶航空器开展航空 喷洒（撒）、航空摄影、空中拍照、 表演飞行等作业类和无人机驾驶员培 训类的经营活动。无人驾驶航空器开 展载客类和载货类经营性飞行活动不 适用本办法。第三条使用无人驾驶航空器开 展本办法第二条所列的经营性飞行活 动应当取得经营许可证，未取得经营 许可证的，不得开展经营性飞行活 动。第四条中国民用航空局（以下 简称民航局）对无人驾驶航空器经营 许可证实施统一监督管理。中国民用 航空地区管理局（以下简称民航地区 管理局）负责实施辖区内的无人驾驶 航空器经营许可证颁发及监管管理工 作。第二章许可证申请条件及程序第五条取得无人驾驶航空器经 营许可证，应当具备下列基本条件：（一）从事经营活动的主体应当为企 业法人，法定代表人为中国籍公民；(1) Theentityengaginginbusinessactivitiesshallbeanenterpriselegalperson,andthelegalrepresentativeshallbeaChinesecitizen.(2) TheenterpriseshallhaveoneUAVataminimum,andundergotheformalitiesofrealnameregistrationintheureal-nameregistrationinformationsystemoftheCAACforcivilUAVs.w(3) Theenterprisehasthetrainingabilityrecognizedbythecompetentdepartmentoftheindustryoraninstitutionauthorizedthereby(thisparagraphshallonlybeappliedtotrainingactivities).(4) Ithaspurchasedthird-partygroundliabilityinsuranceforUAVs.Article 6 Underoneofthefollowingcircumstances,noapplicationforanoperationpermitofUAVsshallbeaccepted:(1) Anapplicantre-filesanapplicationwithinoneyear,aftertheapplicationisrejectedforprovisionoffalsematerials.(2) Anapplicantre-filesanapplicationwithinthreeyear,aftertheoperationpermitobtainedbysuchimpropermeansasfraudandbriberyisrevoked.(3) Anenterpriseisincludedintheublacklisofcreditmanagementinthecivilaviationindustryduetoseriouslydishonestacts.(4) Othercircumstancesunderwhichapplicationsshallnotbeacceptedasprescribedinlawsandregulations.（二）企业应至少拥有一架无人驾驶 航空器，且以该企业名称在中国民用 航空局”民用无人驾驶航空器实名登 记信息系统”中完成实名登记；（三）具有行业主管部门或经其授权 机构认可的培训能力（此款仅适用从 事培训类经营活动）；（四）投保无人驾驶航空器地面第三 人责任险。第六条具有下列情形之一的， 不予受理无人驾驶航空器经营许可证 申请：（一）申请人提供虚假材料被驳回, 一年内再次申请的；（二）申请人以欺骗、贿赂等不正当 手段取得经营许可证后被撤销，三年 内再次申请的；（三）因严重失信行为被列入民航行 业信用管理”黑名单”的企业；（四）法律、法规规定不予受理的其 他情形。第七条 申请人应当通过”民用Article 7 Anapplicantshallapplyforan无人驾驶航空器经营许可证管理系统 ”（https： / / u a s . g a . c a a c . gov. c n ）在线 申请无人驾驶航空器经营许可证，申 请人须在线填报以下信息，并确保申 请材料及信息真实、合法、有效：operationpermitofUAVsonlinethroughtheuUAVsOperationPermitManagementSystem(hppts).Anapplicantmustenterthefollowinginformationonlineandensurethattheapplicationmaterialsandinformationareauthentic,legalandvalid:(1) thebasicinformationoftheenterpriselegalperson;(2) thereal-nameregistrationnumbersoftheUAVs;(3) thecertificationnumberoftheUAVdrivertraininginstitution(thisparagraphisonlyappliedtotrainingbusinessactivities);（一）企业法人基本信息;（二）无人驾驶航空器实名登记号;（三）无人机驾驶员培训机构认证编号（此款仅适用于培训类经营活动）；（四）投保地面第三人责任险承诺;(4) theguaranteeforpurchasingthird-partygroundliabilityinsurance;and（五）企业拟开展的无人驾驶航空器 经营项目。(5) theUAVbusinessprojectstobecarriedoutbytheenterprise.第八条民航地区管理局应当自 申请人在线成功提交申请材料之日起 二十日内作出是否准予许可的决定。 准予许可的，申请人可在线获取电子 经营许可证，不予许可的，申请人可 在线查询原因。Article8TheCAACregionaladministrationshall,within20daysofthedatewhenanapplicantsuccessfullysubmitstheapplicationmaterialsonline,makeadecisionofwhetherornottograntpermit.Whereapermitisgranted,theapplicantmayobtaintheelectronicoperationpermitonline.Whereapermitisnotgranted,theapplicantmayinquireaboutthereasonsonline.第九条无人驾驶航空器经营许 可证所载事项需变更的，许可证持有 人应当通过系统提出变更申请。Article 9 WherethemattersspecifiedintheoperationpermitofUAVsneedtobechanged,thepermitholdershallfileanapplicationforchangethroughthesystem.第十条 民航地区管理局应当自 申请人在线成功提交变更申请之日起 二十日内作出是否准予变更的决定。 准予变更的，申请人可在线获取变更 后的电子经营许可证，不予变更的， 申请人可在线查询原因。Article 10 TheCAACregionaladministrationshall,within20daysofthedatewhenanapplicantsuccessfullyfilesanapplicationforchangeonline,makeadecisionofwhetherornottoapprovechange.Wherechangeisapproved,theapplicantmayobtainthechangedelectronicoperationpermitonline.Wherethechangeisnotapproved,theapplicantmayinquireaboutthereasonsonline.第三章监督管理ChapterIIISupervisionandAdministration第十一条许可证持有人开展经 营性飞行活动，应当遵守国家法律法 规和无人驾驶航空器管理有关规定的 要求，遵守空中运行秩序，确保安 全。Article 11 ApermitholdercarryingoutoperationalflightactivitiesshallsatisfytherequirementsofthelawsandregulationsofthestateandtherelevantprovisionsontheadministrationofUAVs,andfollowtheairoperationordertoensuresafety.第十二条许可证持有人应持续 符合取得经营许可证所需符合的条 件。Article 12 Apermitholdershallcontinuouslymeettheconditionsrequiredforobtaininganoperationpermit.第十三条许可证持有人开展飞 行活动，应当采取有效的环境保护措 施。Article 13 Tocarryoutflightactivities,apermitholdershalltakeeffectiveenvironmentalprotectionmeasures.第十四条许可证持有人应在许 可证列明的经营范围内开展经营活 动。Article 14 Apermitholdershallcarryoutbusinessactivitieswithinthebusinessscopespecifiedinthepermit.第十五条许可证持有人应在飞 行活动结束后72小时内，通过系统Article 15 Apermitholdershall,within72hoursafterthecompletionoftheflightactivity,submittherelevantoperationinformationthroughthesystem.报送相关作业信息。Article16Underoneofthefollowingcircumstances,theCAACregionaladministrationshallrevoketheenterprise'soperationpermitaccordingtothelaw:第十六条有下列情形之一的，民航地区管理局依法撤销企业经营许可证：(1)Apermitisissuedtoanapplicantthatdoesnotmeettheconditionsofpermit.（一）向不具备许可条件的申请人颁发许可证的；(2)Othercircumstancesunderwhichanoperationpermitmayberevokedaccordingtothelaw.（二）依法可以撤销经营许可证的其他情形。Article17Whereapermitholderfallsunderoneofthefollowingcircumstances,theCAACregionaladministrationshallundergotheformalitiesofrevokingtheoperationpermitaccordingtothelaw:(1) Itslegalpersonqualificationisterminatedduetobankruptcy,dissolutionandotherreasons.(2) Itsoperationpermitisrevokedaccordingtothelaw.(3) Theholderoftheoperationpermitappliesforcancellationonitsown.(4) Othercircumstancesunderwhichitshallbecanceledasprescribedbylawsandregulations.Article18NooperationpermitofUAVsshallbealtered,lent,soldortransferred.第十七条许可证持有人有下列情形之一的，民航地区管理局应当依法办理经营许可证的注销手续：（一）因破产、解散等原因被终止法人资格的；（二）经营许可证依法被撤销的;（三）经营许可证持有人自行申请注销的；（四）法律、法规规定的应当注销的其他情形。第十八条无人驾驶航空器经营许可证不得涂改、出借、买卖或转让。Article19ApermitholdershallprinttheoperationpermitofUAVsonlineandplaceitataconspicuouspositioninthecompany'sdomicileorbusinesspremise.第十九条许可证持有人应当在线打印无人驾驶航空器经营许可证，并置于公司住所或者营业场所的醒目位置。Article20AnoperationpermitofUAVsshallbevalidforalongtimewithoutbeingrevoked,annulledorcanceledaccordingtothelaw.第二十条无人驾驶航空器经营许可证在未被依法吊销、撤销、注销等情况下，长期有效。Explanationofterms术语解释Aerialspraying(sprinkling)meanstheflightactivitiesofusingspecialequipmenttosprayingorspreadingliquidorsoliddrymaterialstothegroundtargetsintheairinaccordancewithspecialtechnicalrequirementswithUAVsascarryingtools.航空喷洒（撒）以无人驾驶航空器作为搭载工具，使用专业设备将液体或固体干物料按特定技术要求从空中向地面目标喷雾或撒播的飞行活动。Aerophotographymeanstheflightactivitiesofusingspecialequipmenttoobtaintheearth'sreflection,radiation,scatteringelectromagneticwaveswithUAVsascarryingtools.AerialphotographymeanstheflightactivitiesofusingprofessionalequipmenttoobtainaerialimagedatawithUAVsascarryingtools.ShowflightsmeanstheflightactivitiesofUAVscarriedoutforthepurposesofdemonstratingtheperformanceofUAVsandflightskills,popularizingaviationknowledgeandmeetingaudiences'viewingneeds.航空摄影以无人驾驶航空器作为搭载工具，使用专业设备获取地球地表反射、辐射以及散射电磁波信息的飞行活动。空中拍照以无人驾驶航空器作为搭载工具，使用专业设备获取空中影像资料的飞行活动。表演飞行以展示无人驾驶航空器性能、飞行技艺，普及航空知识和满足观众观赏为目的开展的无人驾驶航空器飞行活动。驾驶员培训训练机构通过培训驾驶技 术及运行要求，以培养符合资质要求 的无人机驾驶员为目的而开展的无人
