4、atedinaccordancewithCivilAviationLawofthePeople,sRepublicofChina,theAdministrativePermissionLawofthePeoplesRepublicofChinaandAirworthinessManagementRuleforCivilAircraftofthePeoplesRepublicofChina.Itisforthepurposeofstandardizingtheadministrationandsupervisionofcivilaircraftmaintenanceorganizationand

5、toensurethecontinuingairworthinessandflightsafetyofcivilaircrafts.145.2 ScopeofApplicationThisregulationappliestocertification,supervisionandadministrationofmaintenanceorganization(hereinafterreferredtoasMO)thathasobtainedtheCivilAircraftMaintenanceOrganizationCertificate(hereinafterreferredtoasMOC)

6、.第一章总则第145.1条目的和依据为了规范民用航空器维修许可证的颁发和管理，保障民用航空器持续适航和飞行安全，根据中华人民共和国民用航空法、中华人民共和国行政许可法和中华人民共和国民用航空器适航管理条例等法律、行政法规，制定本规则。第145.2条适用范围本规则适用于为取得民用航空器维修许可证的单位（以下简称维修单位）的合格审定及监督管理。TheaforementionedMOincludestheindependentMOandtheoperatorsMO.TheindependentMOmayincludethedomesticMOandtheforeignMO.前款所称维修单位，包括独立

7、的维修单位和航空器运营人的维修单位；独立的维修单位包括国内维修单位和国外维修单位。145.3AdministrativeDepartment第145.3条管理机构TheCivilAviationAdministrationofChina(hereinafterreferredtoastheCAAC)is中国民用航空局（以下简称民航局）统一负责维修许可证管理，并负责国外维修单位的合 格审定和监督管理。中国民用航空地区管理局(以 下简称民航地区管理局)受民 航局委托，负责主要办公地点 和维修设施在本辖区内的航空 器运营人的维修单位、国内维 修单位的合格审定和监督管 理。Chapter IlAdmi

8、nistration CertificateApplication, Issuance andof Maintenance Organization第二章维修许可证的申请、 颁发和管理145.4 Applicant第145.4条申请条件An applicant for a MOC shall meet the following维修许可证申请人应当具备下conditions:列条件:(a) The applicant is a legal entity established pursuant to the law, and has basic conditions such as maint

9、enance facilities, technicians, and quality management systems for the maintenance rating(s)item(s) being applied.(a)申请人为依法设立的法人 单位，具备进行所申请项目维 修工作的维修设施、技术人 员、质量管理系统等基本条 件；(b) The maintenance rating(s)item(s) that a foreign applicant applies for CAAC approval shall be in support of maintenance being

10、performed to China registered civil aircraft or components thereof.(b)国外维修单位申请人申请 的项目应当适用于具有中国登 记的民用航空器或者其部件。145.5 Application Materials第145.5条申请材料responsiblefortheunifiedadministrationoftheMOC,aswellasthecertification,supervisionandadministrationofforeignMO.TheRegionalAdministrationofCAAC(hereinaft

11、erreferredasCAACRA)entrustedbytheCAAC,isresponsibleforthecertification,supervisionandadministrationofthedomesticMOandoperatorsMOwhosemainofficesandmaintenancefacilitiesarelocatedwithinitsjurisdiction.To apply for a MOC, the applicant shall submit the following documents in accordance with the format

12、 and manner prescribed by the CAAC, and be responsible for the authenticity of the documents.申请维修许可证，申请人应当 按照民航局规定的格式和方法 提交下列材料，并对材料的真 实性负责：(a) Application Letter.(a)申请书;(b) Training Program Manual (hereinafter referred to as the TPM) in accordance with 145.27 of this regulation and Maintenance Orga

13、nization Manual (hereinafter referred to as the MOM) developed in accordance with the 145.28.(b)按本规则第145. 27条编写的培训大纲和第145. 28条编 写的维修管理手册；(c) Compliance statement to this regulation, including relevant supporting documents.(c)对本规则的符合性说明, 包括有关支持资料；(d) The foreign applicant shall submit a Letter of Int

14、ent (hereinafter referred to as the LOI) from the Chinese customer requesting related maintenance services.(d)国外维修单位申请人初次 申请的还应当提交中国用户的 送修意向书。The domestic applicant shall submit application documents in Chinese, and the foreign applicant may submit application documents in Chinese or in English.国内维修

15、单位应当使用中文提 交申请资料。国外维修单位的 申请材料可以使用中文或者英 文。145.6 Acceptance and Audit第145.6条受理和审查局方收到申请人的申请材料 后，应当在5个工作日内作出 是否受理的答复，并以书面形 式通知申请人。申请人未能提 交齐全的材料或者申请书格式 不符合要求，需要申请人补正 申请材料的，局方应当当场或Oncetheapplicationdocumentsarereceived,theauthoritywillnotifytheapplicantinwritingwithin5workingdayswhethertheapplicationisacc

16、epted.Incasetheapplicationdocumentsareunacceptable,theauthoritywillnotifytheapplicantallthedocumentsrequiredtosupplementorcorrectonthespotorwithinthe5workingdaysatonetime.者在该5个工作日内一次性告知申请人需要补正的全部内容。局方在受理申请后，以书面或 者会面的形式与申请人协商确 定对申请人进行现场审查的日 期。145.7 Approval第145.7条批准Afteracceptingtheapplication,theaut

17、horitywillconsultwiththeapplicantinwritingorinpersontodeterminethedateofon-siteaudit.对于符合要求并交纳了规定审 查费用的申请，局方应当在受 理申请之日起20个工作日内向 申请人颁发维修许可证，依法 进行检验的时间不计入前述期 限。20个工作日内不能颁发 的，经本行政机关负责人批 准，可以延长10个工作日，并 应当将延长期限的理由告知申 请人。145.8 Recognition第145.8条认可情形The CAAC may recognize the MO and its maintenance capabil

18、ities in the following circumstances:在下列情形下，民航局可以对 维修单位及其维修能力进行认 可： The CAAC validates the MO approved by Civil Aviation Department of Hong Kong (HKCAD) and Civil Aviation Authority of Macao (AACM) pursuant to the cooperation arrangement between the CAAC, HKCAD and AACM.(a)根据民航局与香港民航 处、澳门民航局签订的合作安 排

19、，认可香港民航处、澳门民 航局批准的维修单位；(b) The CAAC recognizes the MO approved by(b)根据民航局与其他国家或Forapplicationsthatmeettherequirementsandhavepaidtheauditfees,theauthoritywillissueaMOCtotheapplicantwithin20workingdaysfromthedateofacceptingtheapplication,however,timeforvalidationpursuanttothelawisnotincludedintheafore

20、mentionedperiod.IftheMOCcannotbeissuedwithin20workingdays,theissuancecanbeextendedfor10workingdayswiththeapprovalofthepersoninchargeoftheadministrations,buttheapplicantwillbeinformedofthereasonforsuchextension.thecivilaviationauthoritiesofothercountriesorregionspursuanttotheagreementssignedbytheCAAC

21、andthecountryorregion.者地区签订的协议，认可其他 国家或者地区民航当局批准的 维修单位。145.9 MaintenanceOrganizationCertificate第145.9条维修许可证TheMOCconsistsoftheMaintenanceOrganizationCertificatepageandtheLimitationofMaintenanceItemsnpage.ThenameandaddressoftheMOtogetherwiththeapprovedMaintenanceRatingsarespecifiedontheMaintenanceOrg

22、anizationCertificate*page,whereasthelimitedapprovedMaintenanceItemsarespecifiedonthenLimitationofMaintenanceItemspage.维修许可证由维修许可证 页和许可维修项目页构 成。维修许可证页应当载 明单位名称、地址及维修项目 类别；许可维修项目页标 明具体维修项目及维修工作类 别。维修许可证不得转让、转借、altered.出租或者涂改。TheMOCshallnotbetransferable,lent,leasedor维修许可证应当明显展示在维 修单位的主要办公地点。第145.10条维修

23、许可证的有效性维修许可证自颁发之日起3年 内有效。维修单位可以申请延 续有效期，但是应当在有效期 届满前至少6个月向局方提出 延续维修许可证有效期的书面 申请，并提交申请书等民航局 规定的申请材料。申请的受 理、审查、批准程序与初次申 请相同。每次延续的有效期限 最长为3年。超过有效期后的 再次申请视为初次申请。TheMOCshallbeprominentlydisplayedatthemainofficeoftheMO.145.10 ValidityofMaintenanceOrganizationCertificateTheMOCisvalidfor3yearsfromthedateofi

24、ssuance.TheMOcanapplyfortherenewalofthevalidityperiod,butitshallsubmitawrittenapplicationtotheAuthorityforsuchrenewalatleast6monthsbeforetheexpiration,andsubmittheapplicationdocumentsstipulatedbytheAuthority.Theapplicationacceptance,auditandapprovalprocessesarethesameasthoseoftheinitialapplication.E

25、achrenewalshallbevalidforamaximumperiodof3years.Theapplicationaftertheexpirationdatewillbedeemedastheinitialapplication.If the MO no longer has the conditions for safe production, the Authority will revoke its MOC.维修单位不再具备安全生产条 件的，局方撤销其维修许可。In case of any of the following circumstances, the Authorit

26、y will conduct the cancellation process of the MOC:有下列情况之一的，局方应当 办理维修许可证的注销手续：(a) The maintenance permit is revoked in accordance with the law, or the MOC is revoked in accordance with the law.(a)维修许可依法被撤销，或 者维修许可证依法被吊销的；(b) The MO is terminated in accordance with law.(b)维修单位依法终止的;(c) Other circumst

27、ances regulated by laws or administrative regulations where administrative licenses shall be revoked.(c)法律、行政法规规定的应 当注销行政许可的其他情形。145.11 Application for Change第145.11条变更申请和 办理TheMOshallsubmitawrittenapplicationtotheauthoritytochangetheMOCatleast60daysinadvancewhenitsname,address,ormaintenancerating(s

28、)item(s)arechanged.Theprocessofacceptance,auditandapprovalprocessesarethesameastheinitialapplication.维修单位在名称、地址、维修 类别发生变化时，应当至少提 前60日向局方提出变更维修许 可证的书面申请Q申请的受 理、审查、批准程序与初次申 请相同。维修单位在厂房设施、人员、 组织机构、维修能力和管理要 求等情况发生较大变化时，应 当提前通知局方，并按照局方 要求及时修改本规则第145. 28 条要求的维修单位手册。TheMOshallreporttotheauthorityinadvancew

29、henthereisanymajorchangetothefacility,personnel,organization,scopeofworkormanagementrequirements,etc.,andmodifytheMOMasrequestedinthe145.28ofthisregulationintime.145.12 Rights of Maintenance Organization第145.12条维修单位的 权利TheMOisgrantedthefollowingrightsafterobtainingtheMOC:维修单位在获得维修许可证后 具有下列权利：(a) Pur

30、suanttothemaintenancecontract/agreement,performingthemaintenanceofthecivilaircraftoraircraftcomponentswithintheapprovedscopeofworkasspecifiedintheMOC;(a)在维修许可证限定的维修 范围内按照维修合同或者协 议，进行民用航空器或者其部 件的维修工作。(b) Mayprovidesupportinthecaseofemergencyorsimpleaftermarketserviceatlocationsotherthanthosespecified

31、intheMOC.Exceptingtheaforementionedcircumstances,theMOmayperformmaintenanceworkwithintheapprovedscopeofworkonone-timeorshort-termbasisatlocationsotherthanthosespecifiedintheMOConlywhentheprocedurespecifyinghowtocomplywiththerequirementsasprescribedinchapterIVofthisregulationhasbeenaddressedintheMOM,

32、anditsobtainedAuthorityapproval.(b)在维修许可证限定的地点 以外进行应急情况支援和简单 的售后服务工作。除上述情况 外，在维修许可证限定的地点 以外一次性或者短期从事批准 范围内的维修工作项目时，应 当在其维修单位手册中说明其 确保符合本规则第四章要求的 程序，并在获得局方的批准后 方可进行。(c)维修单位可以授权维修放 行人员对按照相应技术文件的 要求完成的某项完整维修工作 签发维修放行证明文件。145.13 Obligation of Maintenance Organization第145.13条维修单位的 义务(c) TheMOmayauthorize

33、certifyingstafftoissuemaintenancereleasecertificateforthemaintenanceworkcompletedaccordingtotherelevantAirworthinessRequirements.维修单位应当保持本单位持续 符合本规则的要求并按照管理 手册规范管理，及时发现并改 正其存在的缺陷和不足。TheMOshallatalltimeskeeptheorganizationincompliancewiththerequirementsofthisregulationandcarryoutmanagementinaccordanc

34、ewiththeapprovedMOMbytakingappropriatecorrectiveactionstorectifyanydefectsanddeficienciesifany.维修单位应当对民用航空器或 者其部件所进行的维修工作满 足相应技术文件的要求负责。 在送修人提出的维修要求不能 保证满足相应技术文件的要求 时，维修单位应当告知送修人 实际情况，并不得签发维修放 行证明文件。TheMOmustensurethatthemaintenanceofcivilaircraftoraircraftcomponentsareperformeduptothelevelrequiredb

35、ythecorrespondingAirworthinessRequirements.WhenthemaintenancerequestedbythejobsendercannotmeettherequirementofcorrespondingAirworthinessRequirements,theMOshallinformtheujobsendernoftheactualsituation,andshallnotissueamaintenancereleasecertificate.维修单位使用本规则第145. 14 条所述的不具有维修许可证的 外委单位的，应当对外委的维 修工作满足相应

36、技术文件的要 求承担全部责任。TheMOwhichusessubcontractorswithouttheMOCasprescribedin145.14jshalltakefullresponsibilityforensuringthatthesubcontractedmaintenanceworkmeetstherequirementsofcorrespondingAirworthinessRequirements.维修单位应当如实向局方报告 以下信息：TheMOshalltruthfullyreportthefollowinginformationtothe:(a)按年度报告本单位按照本

37、规则对民用航空器或者其部件 实施维修的情况；(a) Annualreportontheorganizationsmaintenanceofaircraftoraircraftcomponentsinaccordancewiththisregulation.(b)本规则第145. 32条规定 的缺陷和不适航状况报告；(b) Defectsorun-airworthyconditionsdescriptedin145.32ofthisregulation.(c)局方要求的与维修质量和 民用航空器事件调查有关的其 他信息。(c) Otherinformationrelatedtomaintenanc

38、equalityandinvestigationofaircraftincidentsrequestedbytheAuthority.维修单位应当配合局方审查、 监督和调查。TheMOshallcooperatewiththereview,supervisionandinvestigation.145.14Subcontract第145.14条外委Exceptformajorpartofthemaintenance,finaltestandreleasingofmaintenance,theMOmaysubcontractsomehighlyspecializedprocessesorsub-

39、componentmaintenanceinthescopeoftheworklimitedinitsMOCtotheorganizationwhichmeetsCAACrequirements.除主要维修工作、最终测试及 放行工作外，维修单位可以对 维修许可证限定范围内维修工 作中个别专业性较强的工作环 节或者子部件修理等部分维修 工作选择符合局方要求的外委 维修单位进行维修Q维修单位选择外委维修的，应 当建立质量系统控制下的评估 制度。145.15 Equivalent Means of Compliance第145.15条等效安全情况TheMOwhichusesthesubcontrac

40、tors,shallestablishanevaluationprocedureunderthecontrolofitsqualitysystem.维修规模较小或者在其他特殊 情况下，维修单位在保证所维 修的民用航空器或者其部件具 有同等安全性的前提下，可以 就本规则的某些条款向局方提 出如下等效的符合性方法：(a)规模较小的维修单位或者 仅从事特种作业或者航线维修 工作的维修单位，其责任经 理、质量经理和生产经理可以 由一人兼任；其维修管理手册 和工作程序手册可以合并为一 册。(b)对于有多个维修地点的维 修单位，如果能表明建立了有 效的统一管理和手册体系，可IfthesizeoftheMO

41、issmallorinotherspecialcircumstances,andonthepremiseofensuringthesamesafetyofthecivilaircraftoritscomponentstobemaintained,theMOmayproposethefollowingequivalentcompliancemeanstotheregardingcertainprovisionsofthisregulation:(a) ForthesmallsizeMOortheMOthatonlyprovidesspecializedoperationorlinemainten

42、ancework,itsAccountableManager,QualityManagerandProductionManagermaybethesameperson;itsMOMandWorkProcedureManual(WPM)maybecombined.(b) FortheMOwithmultiplemaintenancelocations,ifitcanestablishaneffectiveunifiedmanagementandmanualsystem,asingleMOC以颁发一个维修许可证并注明 每一地点的维修能力。(c) canbeissuedwiththemaintena

43、ncecapabilityofeachlocationspecifiedontheMOC.(d) 1.inemaintenanceatlocationsotherthanthebaseorsub-baseofaircraftoperatorsMOmaynotbelimited,itcanbeself-managedthroughits,managementsystem.(d)局方认为可以接受的其他 等效的符合性方法。(e) AnyotherequivalentmeansofcomplianceacceptedbytheAuthority.第三章维修类别ChapterIIIMaintenance

44、Categories145.16 Classification of Maintenance Function第145.16条维修工作类别本规则所指的维修工作分为如 下类别：(a)检测，指不分解民用航空 器部件，而根据相应技术文件 的要求，通过离位的试验和功 能测试来确定航空器部件的可 用性。(b)修理，指根据相应技术文 件的要求，通过各种手段使偏 离可用状态的民用航空器或者 其部件恢复到可用状态。(c)改装，指根据相应技术文 件的要求对民用航空器或者其 部件实施的各类设计更改。此 处所指的改装不包括对改装方Maintenancefunctionsofthisregulation,arecla

45、ssifiedasfollows:(a) ,lnspectionTest,:VerifyingserviceabilityofremovedcivilaircraftcomponentswithoutdisassemblingbyexaminationandfunctionalcheckinaccordancewiththestandardsspecifiedinAirworthinessRequirements.(b) Repair:Therestorationofthecivilaircraftoraircraftcomponenttoanairworthyconditioninaccor

46、dancewiththestandardsspecifiedintheappropriateairworthinessrequirementsafterithasbeendamagedorsubjectedtowear.(c) Modification:ThevariousdesignchangesperformedoncivilaircraftorcomponentsaccordingtotherequirementsofcorrespondingAirworthinessRequirements.Modifications案中涉及设计更改方面内容的 批准。herebydonotinclud

47、eapprovalofcontentsinvolvedindesignchanges.(d)翻修，指根据相应技术文 件的要求，通过对民用航空器 或者其部件进行分解、清洗、 检查、必要的修理或者换件、 重新组装和测试来恢复民用航 空器或者其部件的使用寿命或 者适航性状态。(d) Overhaul*:Therestorationofthecivilaircraftoraircraftcomponent,bydisassembling,cleaning,inspecting,performingthenecessaryrepairsorreplacements,reassemblingandtestinginaccordancewiththestandardsspecifiedincorrespondingAirworthinessRequirements,toitsserviceablelifeorairworthyconditions.(e)航线维修，指根据相应技 术文件的要求对航线运行中的 民用航空器进行的例行检查和 故障、缺陷的处理。下列一般 勤务工作不视为航线维修：(e) ,Linemaintenance:Routineinspections,therectificationofmalfunctionsanddefectsenco
