3、hallcomeintoforceonMay1,2024.1.iQiangPremieroftheStateCouncilofthePeoplesRepublicofChina2024年1月24日January24,2024煤矿安全生产条例第一章总 则第一条 为了加强煤矿安全 生产工作，防止和减少煤矿生产 安全事故，保障人民群众生命财 产安全，制定本条例。第二条在中华人民共和国 领域和中华人民共和国管辖的其 他海域内的煤矿安全生产，适用 本条例。第三条 煤矿安全生产工作 坚持中国共产党的领导。煤矿安全生产工作应当以人为 本，坚持人民至上、生命至上， 把保护人民生命安全摆在首位， 贯彻安全发展理

4、念，坚持安全第 一、预防为主、综合治理的方 针，从源头上防范化解重大安全 风险。煤矿安全生产工作实行管行业必 须管安全、管业务必须管安全、 管生产经营必须管安全，按照国 家监察、地方监管、企业负责， 强化和落实安全生产责任。RegulationonWorkSafetyinCoalMinesChapterIGeneralProvisionsArticle 1 ThisRegulationisenactedforthepurposesofstrengtheningworksafetyincoalmines,preventingandreducingminingaccidents,andensuri

5、ngthesafetyofpeopleslivesandproperty.Article 2 ThisRegulationappliestoworksafetyincoalmineswithintheterritoryofthePeoplesRepublicofChinaandotherseaareasunderthejurisdictionofthePeoplesRepublicofChina.Article3Forworksafetyincoalmines,theleadershipoftheCommunistPartyofChinashallbeupheld.Worksafetyinco

6、alminesshallbepeople-oriented.People,slivesandhealthshallbeputfirst,andtoppriorityshallbegiventotheprotectionofpeopleslives.Thephilosophyofsafedevelopmentshallbeimplemented,andthepolicyofputtingsafetyfirstwithafocusonpreventionandcomprehensivemanagementshallbeadoptedinanattempttoguardagainstanddefus

7、emajorsafetyrisksatsource.Forworksafetyincoalmines,whoeverregulatestheindustryorisresponsibleforbusinessorproductionshallbechargedwithsafety.Undertheprincipleofnationaloversight,localregulation,andenterpriseaccountability,theresponsibilityforworksafetyshallbespecifiedandfulfilled.Article4Acoalmining

8、enterpriseshallfulfillitsresponsibilityforworksafety,strengthenworksafetymanagement,andestablishandimproveandimplementaworksafetyresponsibilitysystemandworksafetyrulesandregulationsforallemployees.Theenterpriseshallincreaseeffortstoguaranteetheinputoffunds,materials,technology,andpersonnelinworksafe

9、ty,improveworksafetyconditions,strengthenthestandardizationandinformatizationofworksafety,constructadualpreventionmechanismconsistingofgradedmanagementandcontrolofsafetyrisksandexaminationandcontrolofpotentialrisks,improvetheriskpreventionandresolutionmechanism,andraiseworksafetylevels,soastoensurew

10、orksafety.Theprincipalinchargeofacoalminingenterprise(includingtheactualcontrollers),thesamebelow)istheprimarypersonresponsiblefortheworksafetyoftheenterprise,andhasoverallresponsibilityfortheworksafetyoftheenterprise.Otherprincipalsinchargeareresponsibleforworksafetywithinthescopeoftheirduties.Arti

11、cle5Thepeople,sgovernmentatorabovethecountylevelshallstrengthenitsleadershipoverworksafetyincoalmines,establishandimproveaworkcoordinationmechanism,supportandsuperviseallrelevantdepartmentsinperformingtheirdutiesofworksafetyincoalminesaccordingtothelaw,andsolvemajorproblemsinworksafetyincoalminesina

12、timelyandcoordinatedmanner.第四条 煤矿企业应当履行 安全生产主体责任，加强安全生 产管理，建立健全并落实全员安 全生产责任制和安全生产规章制 度，加大对安全生产资金、物 资、技术、人员的投入保障力 度，改善安全生产条件，加强安 全生产标准化、信息化建设，构 建安全风险分级管控和隐患排查 治理双重预防机制，健全风险防 范化解机制，提高安全生产水 平，确保安全生产。煤矿企业主要负责人（含实际控 制人，下同）是本企业安全生产 第一责任人，对本企业安全生产 工作全面负责。其他负责人对职 责范围内的安全生产工作负责。第五条 县级以上人民政府 应当加强对煤矿安全生产工作的 领导

13、，建立健全工作协调机制， 支持、督促各有关部门依法履行 煤矿安全生产工作职责，及时协 调、解决煤矿安全生产工作中的 重大问题Q第六条县级以上人民政府 负有煤矿安全生产监督管理职责 的部门对煤矿安全生产实施监督 管理，其他有关部门按照职责分Article6Thedepartmentofthepeoplesgovernmentatorabovethecountylevelresponsibleforthesupervisionandadministrationofworksafetyincoalminesshallsuperviseandadministerworksafetyincoalmine

14、s,andotherrelevantdepartmentsshallperformtheirdutiesrelatedtoworksafetyincoalminesaccordingtothedivisionofresponsibilities.Article7Thestateimplementsanoversightsystemforthesafetyofcoalmines.Thenationaladministrationforminesafetyanditslocalofficesareresponsiblefortheoversightofthesafetyofcoalmines,an

15、dsuperviseandinspectthesupervisionandadministrationofworksafetyincoalminesoflocalpeoplesgovernmentsaccordingtothelaw.Thenationaladministrationforminesafetyanditslocalofficesperformtheirdutiesofoversightofminesafetyaccordingtothelaw,andarenotsubjecttointerferencebyanyentityorindividual.Article8Thesta

16、teimplementsasystemofaccountabilityforcoalminingaccidents.EntitiesandpersonsresponsibleforcoalminingaccidentsareheldlegallyliableinaccordancewiththeprovisionsofthisRegulationandrelevantlawsandregulations.Thenationaladministrationforminesafetyanditslocalofficesorganizeorparticipateintheinvestigationa

17、ndhandlingofcoalminingaccidentsaccordingtothelaw.工依法履行煤矿安全生产相关职 责。第七条国家实行煤矿安全 监察制度。国家矿山安全监察机 构及其设在地方的矿山安全监察 机构负责煤矿安全监察工作，依 法对地方人民政府煤矿安全生产 监督管理工作进行监督检查。国家矿山安全监察机构及其设在 地方的矿山安全监察机构依法履 行煤矿安全监察职责，不受任何 单位和个人的干涉。第八条国家实行煤矿生产 安全事故责任追究制度。对煤矿 生产安全事故责任单位和责任人 员，依照本条例和有关法律法规 的规定追究法律责任。国家矿山安全监察机构及其设在 地方的矿山安全监察机构依法

18、组 织或者参与煤矿生产安全事故调 查处理。第九条县级以上人民政府 负有煤矿安全生产监督管理职责 的部门、国家矿山安全监察机构 及其设在地方的矿山安全监察机 构应当建立举报制度，公开举报Article9Thedepartmentofthepeoplesgovernmentatorabovethecountylevelresponsibleforthesupervisionandadministrationofworksafetyincoalminesandthenationaladministrationforminesafetyanditslocalofficesshallestablisha

19、violationreportingsystem,makepubliconlinereportingplatformssuchasreportingtelephonenumbers,mailboxes,oremailaddresses,andacceptreportsonworksafetyincoalminesanddealwiththeminatimelymanneraccordingtothelaw.Whereareportneedstobeinvestigatedandhandledbyotherrelevantdepartments,theyshalltransfertherepor

20、ttootherrelevantdepartmentsforhandling.Anyentityorindividualisentitledtoreportanaccidenthazardoraviolationrelatingtoworksafetytothedepartmentsandagenciesspecifiedintheprecedingparagraph.Ifthereportedmattersareverified,rewardsaregrantedaccordingtothelawsandregulations.Article 10 Employeesofcoalmining

21、enterprisesarelegallyentitledtosafeguardsforworksafetyaccordingtothelaw,andperformworksafetyobligationsaccordingtothelaw.Article 11 Thenationaladministrationforminesafetyshall,inaccordancewiththerequirementsofensuringworksafetyincoalmines,andundertheguidanceoftheemergencymanagementauthorityoftheStat

22、eCouncil,formulatenationalstandardsorindustrystandardsforworksafetyincoalminesinatimelymanneraccordingtothelaw,andberesponsibleforproposingaprojectonmandatorynationalstandardsforworksafetyincoalminesandfororganizingthedraftingof,solicitingcommentson,andconductingtechnicalreviewofsuchstandards.电话、信箱或

23、者电子邮件地址等 网络举报平台，受理有关煤矿安 全生产的举报并依法及时处理； 对需要由其他有关部门进行调查 处理的，转交其他有关部门处 理Q任何单位和个人对事故隐患或者 安全生产违法行为，有权向前款 规定的部门和机构举报。举报事 项经核查属实的，依法依规给予 奖励。第十条煤矿企业从业人员 有依法获得安全生产保障的权 利，并应当依法履行安全生产方 面的义务。第十一条国家矿山安全监 察机构应当按照保障煤矿安全生 产的要求，在国务院应急管理部 门的指导下，依法及时拟订煤矿 安全生产国家标准或者行业标 准，并负责煤矿安全生产强制性 国家标准的项目提出、组织起 草、征求意见、技术审查。第十二条国家鼓励和

24、支持 煤矿安全生产科学技术研究和煤 矿安全生产先进技术、工艺的推Article 12 Thestateencouragesandsupportsscientificandtechnologicalresearchonworksafetyincoalminesandthewidespreadapplicationofadvancedtechnologiesandprocessesforworksafetyincoalminestoimprovetheintelligentminingofcoalmines,facilitatethescientificmanagementofworksafety

25、incoalmines,andenhanceworksafety.广应用，提升煤矿智能化开采水 平，推进煤矿安全生产的科学管 理，提高安全生产水平ChapterIlWorkSafetyResponsibilityofCoal第二章MiningEnterprises任煤矿企业的安全生产责Article 13 Acoalminingenterpriseshallabidebylawsandregulationsonworksafetyandcoalminesafetyrules,andimplementnationalorindustrystandardsforensuringworksafety

26、.Article 14 Theownerofacoalmineconstruction,reconstruction,orexpansionproject(collectively,ucoalmineconstructionprojecf,)shallauthorizeadesignofficewiththequalificationofadesignenterpriseforconstructionprojectstodesignsafetyfacilities.第十三条煤矿企业应当遵 守有关安全生产的法律法规以及 煤矿安全规程，执行保障安全生 产的国家标准或者行业标准。第十四条新建、改建、

27、扩 建煤矿工程项目（以下统称煤矿 建设项目）的建设单位应当委托 具有建设工程设计企业资质的设 计单位进行安全设施设计。安全设施设计应当包括煤矿水、 火、瓦斯、冲击地压、煤尘、顶 板等主要灾害的防治措施，符合 国家标准或者行业标准的要求， 并报省、自治区、直辖市人民政 府负有煤矿安全生产监督管理职 责的部门审查。安全设施设计需 要作重大变更的，应当报原审查 部门重新审查，不得先施工后报 批、边施工边修改。Thedesignofthesafetyfacilitiesshallincludepreventionandcontrolmeasuresformajordisasterscausedbyco

28、alminewater,fire,gas,rockburst,coaldustandroof,complywiththerequirementsofnationalstandardsorindustrystandards,andbesubmittedtothedepartmentresponsibleforthesupervisionandadministrationofworksafetyincoalminesofthepeoplesgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGov

29、ernmentforexamination.Ifamajorchangeneedstobemadeinthedesignofasafetyfacility,itshallbereportedtotheoriginalexaminationdepartmentforreexamination.Itisnotallowedtocommencetheconstructionbeforesubmissionforapprovalortomodifythedesignduringconstruction.Article15Theownerofacoalmineconstructionprojectsha

30、llconductunifiedandcoordinatedmanagementoftheentitiesinvolvedinthedesign,construction,andsupervisionofthecoalmineconstructionproject,andtakeoverallresponsibilityforthesafetymanagementofthecoalmineconstructionproject.第十五条煤矿建设项目的建设单位应当对参与煤矿建设项目的设计、施工、监理等单位进行统一协调管理，对煤矿建设项目安全管理负总责。Theconstructioncontrac

31、torshallcarryoutconstructionaccordingtotheapproveddesignofsafetyfacilities,andshallnotchangethedesigncontentswithoutauthorization.施工单位应当按照批准的安全设施设计施工，不得擅自变更设计内容。Article16Beforeacoalmineconstructionprojectiscompletedandputintoproductionoruse,theownershallorganizeanacceptancetestforsafetyfacilitiesand

32、beresponsiblefortheresultsoftheacceptancetest;itmaybeputintoproductionoruseonlyafterpassingthetest.第十六条煤矿建设项目竣工投入生产或者使用前，应当由建设单位负责组织对安全设施进行验收，并对验收结果负责；经验收合格后，方可投入生产和使用。Article17AcoalminingenterprisethatengagesinproductionshallobtainaworksafetypermitinaccordancewiththeRegulationonWorkSafetyPermits.Th

33、osewhohavenoworksafetypermitarenotallowedtoengageinproduction.第十七条煤矿企业进行生产，应当依照安全生产许可证条例的规定取得安全生产许可证。未取得安全生产许可证的，不得生产QArticle18Theprincipalinchargeofacoalminingenterpriseshallassumethefollowingresponsibilitiesfortheworksafetyoftheenterprise:第十八条煤矿企业主要负责人对本企业安全生产工作负有下列职责：(1)Establishingandimplementin

34、garesponsibilitysystemfortheworksafetyofallemployees,andstrengtheningthestandardizationofworksafety;（一）建立健全并落实全员安全生产责任制，加强安全生产标准化建设；(2) Organizingtheformulationand（二）组织制定并实施安全生产规章制度和作业规程、操作规 程；implementationofrulesandregulations,operationrules,andoperatingproceduresforworksafety;（三）组织制定并实施安全生产 教育和培训

35、计划；(3) Organizingtheformulationandimplementationofprogramsofeducationandtrainingrelevanttoworksafety;（四）保证安全生产投入的有效 实施；(4) Ensuringtheeffectiveimplementationofworksafetyinvestment;（五）组织建立并落实安全风险 分级管控和隐患排查治理双重预 防工作机制，督促、检查安全生 产工作，及时消除事故隐患；(5) Organizingtheestablishmentandimplementationofadualpreventi

36、onmechanismfortheclassifiedcontrolofsafetyrisksandtheidentificationandgovernanceofaccidenthazards,andsupervisingandinspectingworksafetytoeliminateanaccidenthazardinatimelymanner;（六）组织制定并实施生产安全 事故应急救援预案；(6) Organizingtheformulationandimplementationofemergencyrescueplansforworksafetyaccidents;and（七）及时

37、、如实报告煤矿生产 安全事故。(7) Timelyandtruthfullyreportingcoalminingaccidents.第十九条煤矿企业应当设 置安全生产管理机构并配备专职 安全生产管理人员。安全生产管 理机构和安全生产管理人员负有 下列安全生产职责：Article19Acoalminingenterpriseshallsetupaworksafetymanagementdepartmentthatisstaffedwithfull-timeworksafetymanagementpersonnel.Theworksafetymanagementdepartmentandfull

38、-timeworksafetymanagementpersonnelshallassumethefollowingresponsibilitiesforworksafety:（一）组织或者参与拟订安全生 产规章制度、作业规程、操作规 程和生产安全事故应急救援预(1) Organizingorparticipatingintheformulationofrulesandregulations,operationrules,andoperatingproceduresforworksafetyandemergencyrescueplansforworksafety案;accidents;(2) O

39、rganizingorparticipatingineducationandtrainingrelevanttoworksafety,andtruthfullyrecordingtheeducationandtraining;(3) Organizingthepublicityandeducationaboutlawsandregulationsonworksafety;(4) Organizingtheassessmentofsafetyriskidentification,andsupervisingtheimplementationofthemeasurestocontrolmajors

40、afetyrisks;(5) Stoppingandcorrectingactsofprovidingdirectionsinviolationofrules,forciblyorderingriskyoperations,andviolatingoperatingprocedures.Whenanemergencythreateningsafetyisfound,thedepartmentandtherelevantpersonnelmayrequiretheimmediatecessationofoperationsindangerousareasandtheevacuationofrel

41、evantoperators;(6) Checkingthestatusofworksafety,screeninghiddenrisksofanaccidentinatimelymanner,conductingstatisticalanalysisontheinvestigationandtreatmentofthehiddenrisks,andprovidingrecommendationsforimprovingtheworksafetymanagement;(7) Organizingorparticipatinginemergencyrescuedrills;and（二）组织或者参

42、与安全生产教 育和培训，如实记录安全生产教 育和培训情况；（三）组织开展安全生产法律法 规宣传教育；（四）组织开展安全风险辨识评 估，督促落实重大安全风险管控 措施；（五）制止和纠正违章指挥、强 令冒险作业、违反规程的行为， 发现威胁安全的紧急情况时，有 权要求立即停止危险区域内的作 业，撤出作业人员；（六）检查安全生产状况，及时 排查事故隐患，对事故隐患排查 治理情况进行统计分析，提出改 进安全生产管理的建议；（七）组织或者参与应急救援演 练；（A）督促落实安全生产整改措 施。(8) Supervisingtheimplementationofworksafetyrectificationm

43、easures.煤矿企业应当配备主要技术负责 人，建立健全并落实技术管理体 系OAcoalminingenterpriseshallbestaffedwithachieftechnicalofficer,andestablishandimproveandimplementatechnicalmanagementsystem.第二十条煤矿企业从业人 员负有下列安全生产职责：Article 20 Employeesofacoalminingenterpriseshallassumethefollowingresponsibilitiesforworksafety:（一）遵守煤矿企业安全生产规 章制

44、度和作业规程、操作规程， 严格落实岗位安全责任；(1) Abidingbytherulesandregulations,operationrules,andoperatingproceduresforworksafetyofthecoalminingenterprise,andstrictlyimplementingjobresponsibilitiesforsafety;（二）参加安全生产教育和培 训，掌握本职工作所需的安全生 产知识，提高安全生产技能，增 强事故预防和应急处理能力；(2) Participatingineducationandtrainingrelevanttoworksa

45、fety,masteringknowledgeaboutworksafetyrequiredbytheirownwork,improvingworksafetyskills,andenhancingaccidentpreventionandemergencyresponsecapabilities;and（三）及时报告发现的事故隐患 或者其他不安全因素。(3) Promptlyreportingaccidenthazardsorotherunsafefactorsfound.对违章指挥和强令冒险作业的行 为，煤矿企业从业人员有权拒绝 并向县级以上地方人民政府负有 煤矿安全生产监督管理职责的部

46、门、所在地矿山安全监察机构报 告。Employeesofcoalminingenterprisesareentitledtorefuseillegalcommandorforcedriskyoperationsandreportsuchactstothedepartmentofthelocalpeoplesgovernmentatorabovethecountylevelresponsibleforthesupervisionandadministrationofworksafetyincoalminesandthelocaladministrationforminesafety.煤矿企业不得

48、平和能 力。riskyoperations.Article 21 Theprincipalinchargeandworksafetymanagementpersonnelofacoalminingenterpriseshallpasstheevaluationofknowledgeaboutworksafetyandmanagementcapabilities,andcontinuouslymaintainthecorrespondinglevelandability.煤矿企业从业人员经安全生产教 育和培训合格，方可上岗作业。 煤矿企业特种作业人员应当按照 国家有关规定经专门的安全技术 培训和考核合格，并取得相应资 格。Theworksafetymanagementpersonnelofacoalminingenterprisemaygoondutyonlyafterreceivingeducationandtrainingrelevanttoworksafety.Thespecialoperationpersonnelofacoalminingenterpriseshall,inaccordancewiththerelevantprovisionsofth
