4、nsportofDangerousCargobyCivilAviationChapter I GeneralPrinciplesArticle1Forthepurposesofstrengtheningtheadministrationofthetransportofdangerouscargobycivilaviation,regulatingthetransportofdangerouscargobyair,andguaranteeingthesafetyoftransportbycivilaviation,theseProvisionsaredevelopedaccordingtothe

5、CivilAviationLawofthePeoplesRepublicofChina,theWorkSafetyLawofthePeoplesRepublicofChina,theCounterterrorismLawofthePeoplesRepublicofChina,theRegulationontheSafetyManagementofHazardousChemicalsandotherlawsandadministrativeregulations.Article2TheseProvisionsshallapplytocarriers,airportmanagementinstit

6、utions,groundserviceagents,dangerouscargotraininginstitutions,institutionscarryingoutcivilaviationsafetyinspectionandotherentitiesandindividualscarryingoutactivitiesrelatedtothetransportofdangerouscargobycivilaviationintheterritoryofthePeoplesRepublicofChina.TheseProvisionsshallapplytoforeigncarrier

7、sorcarriersfromHongKong,MacaoandTaiwanthatcarryoutactivitiesspecifiedintheprecedingparagraphandwhoseoneoftheplacesofdeparture,stopoverordestinationofflightisintheterritoryofthePeople,sRepublicofChina(excludingHongKong,MacaoandTaiwan).民用航空危险品运输管理规定第一章总则第一条为了加强民用航 空危险品运输管理，规范危险 品航空运输活动，保障民用航 空运输安全，根据中

8、华人民 共和国民用航空法中华人 民共和国安全生产法中华 人民共和国反恐怖主义法 危险化学品安全管理条例 等法律、行政法规，制定本规 定。第二条中华人民共和国 境内的承运人、机场管理机 构、地面服务代理人、危险品 培训机构、从事民航安全检查 工作的机构以及其他单位和个 人从事民用航空危险品运输有 关活动的，适用本规定。外国承运人、港澳台地区承运 人从事前款规定的活动，其航 班始发地点、经停地点或者目 的地点之一在中华人民共和国 境内（不含港澳台，下同） 的，适用本规定。第三条中国民用航空局 （以下简称民航局）负责对民 用航空危险品运输活动实施统 一监督管理。Article3TheCivilAvi

9、ationAdministrationofChina(uCAACn)shallberesponsiblefortheunifiedsupervisionandadministrationofthetransportofdangerouscargobycivilaviation.TheCAACregionaladministrationsshallberesponsibleforimplementingsupervisionandadministrationofthetransportofdangerouscargobycivilaviationwithintheirrespectivejuri

10、sdictions.TheCAACandCAACregionaladministrationsarecollectivelyreferredtoasCAACadministrations.Article4EntitiesandindividualscarryingoutactivitiesrelatedtothetransportofdangerouscargobycivilaviationshallsatisfytherequirementsofAnnex18SafeTransportofDangerousCargobyAirandTechnicalInstructionstotheConv

11、entiononInternationalCivilAviation,unlessotherwiseprescribedbylaws,regulationsandrules.Article5Therelevantindustryassociationshallstrengthenindustrialself-regulation,promoteintegrityconstruction,urgememberstocarryoutpublictransportofdangerouscargobyairinaccordancewiththelaw,andimprovetheservicequali

12、ty.Chapter II TransportRestrictionsArticle6Anyentityorindividualshallnotcarryinbaggageorconsign,receiveortransportbycargoormaildangerouscargowhichareprohibitedtobetransportedbyairunderanycircumstanceasstipulatedintheTechnicalInstructions.中国民用航空地区管理局（以 下简称民航地区管理局）负责 对本辖区内的民用航空危险品 运输活动实施监督管理。民航局和民航地区管

13、理局统称 为民航行政机关。第四条从事民用航空危 险品运输有关活动的单位和个 人应当遵守国际民用航空公 约附件18危险物品的安全 航空运输及技术细则的 要求；法律、法规、规章另有 规定的，还应当遵守其规定。第五条有关行业协会应 当加强行业自律，推进诚信建 设，促进会员依法开展公共航 空危险品运输活动，提升服务 质量。第二章运输限制第六条任何单位和个人 不得在行李中携带或者通过货 物、邮件托运、收运、载运 技术细则中规定的在任何 情况下禁止航空运输的危险 品。第七条除运输安全水平Article7Unlessthesafetyleveloftransportsatisfiestherequireme

14、ntsandisapprovedorexemptedbytheCAACadministrationinaccordancewiththeTechnicalInstructions,noentityorindividualshallcarryinbaggageorconsign,receiveortransportthefollowingdangerouscargobycargoormail:符合要求并获得民航行政机关按技术细则给予批准或者豁免外，任何单位和个人不得在行李中携带或者通过货物、邮件托运、收运、载运下列危险品:(1) Anydangerouscargoprohibitedtobetr

15、ansportedbyairundernormalcircumstancesasstipulatedintheTechnicalInstructions.(2) Anyinfectedlivinganimal.Article8Theconsignment,receiptandtransportofamailcontainingdangerouscargoshallsatisfytherequirementsofrelevantpostallawsandregulations,theseProvisionsandtheTechnicalInstructions.Article9Articleso

16、rsubstancesfallingunderthefollowingcircumstancesarenotsubjecttorestrictionsonthetransportofdangerouscargobyairinaccordancewiththeprovisionsoftheTechnicalInstructions:(1) Anyarticleorsubstancethathasbeenclassifiedasdangerouscargobutneedstobeuploadedontoacivilaircraftpursuanttotheairworthinessrequirem

17、entsandoperationrulesorduetoanyotherspecialreasonlistedintheTechnicalInstructions.(2) AnyspecificarticleorsubstancecarriedbypassengersoraircrewmemberswithinthescopeprescribedbytheTechnicalInstructions.（一）技术细则中规定禁止在正常情况下航空运输的危险品；（二）受到感染的活体动物。第八条托运、收运、载运含有危险品的邮件，应当符合相关邮政法律法规、本规定及技术细则的要求。第九条符合下列情况的物品或者

18、物质，按照技术细则的规定不受危险品航空运输的限制：（一）已分类为危险品的物品或者物质，根据有关适航要求和运行规定，或者因技术细则列明的其他特殊原因需要装在民用航空器上时；（二）旅客或者机组成员携带的技术细则规定范围内的特定物品或者物质。运输前款第一项所述物品或者 物质的替换物，或者被替换下 来的所述物品或者物质，除 技术细则准许外，应当遵 守本规定。Thetransportofsubstitutesforthearticlesorsubstancesmentionedinitem(1)oftheprecedingparagraph,orthereplacedarticlesorsubstanc

19、es,shallcomplywiththeseProvisions,unlesspermittedbytheTechnicalInstructions.第三章运输许可ChapterIIITransportLicensing第一节一般规定Section1Generalprovisions第十条承运人从事危险 品货物、含有危险品的邮件 （以下简称危险品货物、邮 件）航空运输，应当取得危险 品航空运输许可。Article 10 Totransportdangerouscargoormailscontainingdangerouscargo(hereinafterreferredtoas,*dange

20、rouscargoandmailsn)byair,acarriershallobtainapermitfortransportofdangerouscargobyair.第十一条境内承运人申 请取得危险品航空运输许可 的，应当具备下列条件：Article 11 Toapplyforapermitfortransportofdangerouscargobyair,adomesticcarriershallmeetthefollowingconditions:（一）持有公共航空运输企业 经营许可证；(1) Ithasabusinesspermitforapublicairtransportente

21、rprise.（二）危险品航空运输手册符 合本规定的要求；(2) ItsmanualfortransportofdangerouscargobyairsatisfiestherequirementsoftheseProvisions.（三）危险品培训大纲符合本 规定的要求；(3) ItsdangerouscargotrainingoutlinesatisfiestherequirementsoftheseProvisions.（四）按照危险品航空运输手 册建立了危险品航空运输管理 和操作程序、应急方案；(4) Ithas,accordingtoitsmanualforthetransporto

22、fdangerouscargobyair,developedtheproceduresandemergencyresponseplansforthemanagementandoperationofthetransportofdangerouscargobyair.（五）危险品航空运输从业人 员按照危险品培训大纲完成培 训并考核合格；(5) Practitionersoftransportofdangerouscargobyairhavebeentrainedaccordingtothedangerouscargotrainingoutlineandpassedtheassessment.（六）

23、货物、邮件航空运输安 全记录良好。(6) Ithasgoodsafetyrecordsfortransportofcargoandmailsbyair.第十二条港澳台地区承 运人、外国承运人申请取得危 险品航空运输许可的，应当具 备下列条件：Article 12 AcarrierinHongKong,MacaoandTaiwanoraforeigncarrierapplyingforapermitforthetransportofdangerouscargobyairshallmeetthefollowingconditions:（一）持有所在地区或者所在 国民航主管部门颁发的危险品 航空运输

24、许可或者等效文件；(1)Itholdsapermitforthetransportofdangerouscargobyairissuedbythecivilaviationauthorityoftheregionorcountrywhereitislocated,oradocumentofequivalenteffect.（二）持有所在地区或者所在 国民航主管部门审查或者批准 的危险品航空运输手册或者等 效文件；(4) Ithasamanualforthetransportofdangerouscargobyairexaminedorapprovedbythecivilaviationauth

25、orityoftheregionorcountrywhereitislocated,oradocumentofequivalenteffect.（三）持有所在地区或者所在 国民航主管部门审查或者批准 的危险品培训大纲或者等效文 件；(5) Ithasadangerouscargotrainingoutlineexaminedorapprovedbythecivilaviationauthorityoftheregionorcountrywhereitislocated,oradocumentofequivalenteffect.（四）货物、邮件航空运输安 全记录良好。(4)Ithasgoods

26、afetyrecordsfortransportofcargoandmailsbyair.第十三条民航地区管理 局作出的危险品航空运输许 可，应当包含下列内容：Article13ApermitforthetransportofdangerouscargobyairgrantedbyaCAACregionaladministrationshallspecifythefollowingcontents:（一）承运人按照本规定和 技术细则开展危险品货 物、邮件航空运输活动的经营 范围；(2) The categories (items) of dangerous approved to be tra

27、nsported.(3) The validity period of the permit.(4) The necessary restrictions.Section 2 Licensing procedurescargo （二）批准运输的危险品类（项）别；（三）许可的有效期；（四）必要的限制条件。第二节许可程序Article 14 To apply for a permit for the transport of dangerous cargo by air, a domestic carrier shall submit the following materials to the

28、CAAC regional administration where the main operating base airport is located as specified in the operating permit of its public air transport enterprise, and ensure that they are authentic, integral and effective:(1) An application form.(2) A manual for the transport of dangerous cargo by air.第十四条境

29、内承运人申 请危险品航空运输许可的，应 当向其公共航空运输企业经营 许可证载明的主运营基地机场 所在地民航地区管理局提交下 列材料，并确保其真实、完 整、有效：（一）申请书;（二）危险品航空运输手册;(3) A dangerous cargo training outline.（三）危险品培训大纲。Article 15 A carrier in Hong Kong, Macao and Taiwan or a foreign carrier applying for a permit for the transport of dangerous cargo by air shall submi

30、t the following materials to the CAAC第十五条港澳台地区承 运人、外国承运人申请危险品 航空运输许可的，应当向民航 局指定管辖的民航地区管理局(1)ThescopeofbusinessforacarriertotransportdangerouscargoandmailsbyairinaccordancewiththeseProvisionsandtheTechnicalInstructions.提交下列材料，并确保其真 实、完整、有效：regionaladministrationwhosejurisdictionhasbeendesignatedbythe

31、CAAC,andensurethattheyareauthentic,integralandeffective:（一）申请书;(1) Anapplicationform.（二）承运人所在地区或者所 在国民航主管部门颁发的危险 品航空运输许可或者等效文 件；(2) Apermitforthetransportofdangerouscargobyairissuedbythecivilaviationauthorityoftheregionorcountrywherethecarrierislocated,oradocumentofequivalenteffect.（三）承运人所在地区或者所 在国民

32、航主管部门对承运人危 险品航空运输手册或者等效文 件的审查或者批准的证明材 料；(3) Thecertificationmaterialsforexaminationorapprovalofthecarriersmanualforthetransportofdangerouscargobyairoradocumentofequivalenteffectbythecivilaviationauthorityoftheregionorcountrywherethecarrierislocated.（四）承运人所在地区或者所 在国民航主管部门对承运人危 险品培训大纲或者等效文件的 审查或者批准的证明

33、材料。(4) Thecertificationmaterialsforexaminationorapprovalofthecarriersdangerouscargotrainingoutlineoradocumentofequivalenteffectbythecivilaviationauthorityoftheregionorcountrywherethecarrierislocated.前款规定的申请材料应当使用 中文或者英文。使用译本的， 申请人应当承诺保证译本和原 件的一致性和等同有效性。第十六条经审查，境内 承运人符合本规定第十一条、 港澳台地区及外国承运人符合 本规定第十二条要

34、求的，由民 航地区管理局为其颁发危险品 航空运输许可。TheapplicationmaterialsspecifiedintheprecedingparagraphshallbeinChineseorEnglish.Whereatranslationisused,theapplicantshallundertaketoensuretheconsistencyandequivalentvalidityofthetranslationandtheoriginal.Article16Where,uponexamination,adomesticcarriersatisfiestherequireme

35、ntsofArticle11oftheseProvisions,andacarrierinHongKong,MacaoandTaiwanoraforeigncarriersatisfiestherequirementsofArticle12oftheseProvisions,theCAACregionaladministrationshallissueapermitforthetransportofdangerouscargobyairtoit.经审查不符合要求的，由民航 地区管理局书面作出不予许可 决定，说明理由，并告知申请 人享有依法申请行政复议或者 提起行政诉讼的权利。第十七条民航地区管

36、理 局应当自受理申请之日起20个 工作日内作出是否准予许可的 决定。20个工作日内不能作出 决定的，经民航地区管理局负 责人批准，可以延长10个工作 日，并应当将延长期限的理由 告知申请人。Where,uponexamination,therequirementsarenotsatisfied,theCAACregionaladministrationshallmakeawrittendecisiononnotgrantingapermit,explainthereasons,andnotifytheapplicantoftherighttoapplyforadministrativereco

37、nsiderationorinstitutinganadministrativeactionaccordingtothelaw.Article17TheCAACregionaladministrationshallmakeadecisiononwhethertograntapermitwithin20workingdaysfromthedateofacceptinganapplication.Whereadecisionisunabletobemadewithin20workingdays,withapprovalofthepersoninchargeoftheCAACregionaladmi

38、nistration,10workingdaysmaybeextendedandtheapplicantshallbenotifiedofthereasonsfortheextension.民航地区管理局作出行政许可 决定，需要进行检验、检测、 鉴定和组织专家评审的，所需 时间不计入前款所述期限。WheretheCAACregionaladministrationneedstoconductinspection,testing,appraisalandorganizeexpertreviewformakinganadministrativelicensingdecision,thetimere

39、quiredshallnotbeincludedintheperiodmentionedintheprecedingparagraph.第三节许可管理Section3Permitmanagement第十八条危险品航空运 输许可的有效期最长不超过24 个月。Article18Themaximumvalidityperiodofapermitforthetransportofdangerouscargobyairshallbe24months.有下列情形之一的，作出行政 许可决定的民航地区管理局应 当依法办理危险品航空运输许 可注销手续：Underanyofthefollowingcircumst

40、ances,theCAACregionaladministrationhavingmadetheadministrativelicensingdecisionshallundergotheformalitiesforcancellationofthepermitforthetransportofdangerouscargobyairinaccordancewiththelaw:(1) Thelicensedcarrierappliesforcancellationinwriting.（一）被许可承运人书面申请 办理注销手续的；（二）许可依法被撤销、撤 回、吊销的；(3) The permit

41、is not renewed upon expiry.（三）许可有效期届满未延续 的；(4) Other circumstances set forth in laws and regulations.（四）法律、法规规定的其他 情形。Article 19 Where a carrier requests to change the permitted matters, it shall apply to the CAAC regional administration and undergo the formalities in accordance with the relevant pr

42、ovisions of this Chapter on permit.第十九条承运人要求变 更许可事项的，应当向民航地 区管理局提出申请，按照本章 有关许可的规定办理。Article 20 To apply for renewing the validity period of a permit, a carrier shall file an application with the CAAC regional administration 30 days prior to the expiry of the permit. Where, upon examination, a carrie

43、r meets the licensing conditions of these Provisions, the CAAC regional administration shall make a decision on approving or disapproving renewal before the expiry of a permit; and where no decision is made within the prescribed time limit by the CAAC regional administration, it shall be deemed an a

44、pproval.第二十条承运人申请许 可有效期延续的，应当在许可 有效期届满30日前向民航地区 管理局提出申请。经审查，承 运人满足本规定许可条件的， 民航地区管理局应当在许可有 效期届满前作出是否准予延续 的决定；民航地区管理局逾期 未作出决定的，视为准予延 续。Chapter IV Management of Transport Manuals第四章运输手册管理Article 21 Domestic carriers and ground service第二十一条境内承运(2) Thepermitiscanceled,withdrawnorrevokedaccordingtothelaw.

45、人、地面服务代理人应当制定 符合本规定要求的危险品航空 运输手册，并采取措施保持手 册的实用性和有效性。agentsshalldevelopmanualsforthetransportofdangerouscargobyairinaccordancewiththerequirementsoftheseProvisions,andtakemeasurestomaintainthepracticalityandeffectivenessofthemanuals.境内承运人应当在完成运行合 格审定前向主运营基地机场所 在地民航地区管理局备案危险 品航空运输手册。手册内容发 生变化的，境内承运人应当及

46、 时进行更新备案。AdomesticcarriershallundergotherecordationformalitiesforthemanualforthetransportofdangerouscargobyairwiththeCAACregionaladministrationwheretheairportatthemainoperationbaseislocatedbeforecompletingtheexaminationofoperationqualification.Intheeventofanychangeinthecontentofthemanual,adomesticca

47、rriershallundergotheupdatingrecordationformalitiesinatimelymanner.第二十二条境内承运 人、地面服务代理人的危险品 航空运输手册应当至少包括下 列适用的内容：Article22Amanualforthetransportofdangerouscargobyairofadomesticcarrierandagroundserviceagentshall,ataminimum,includethefollowingapplicablecontents:（一）危险品航空运输的总政 策；(1) Thegeneralpoliciesfort

48、hetransportofdangerouscargobyair.（二）危险品航空运输管理和 监督机构及其职责；(2) Theinstitutionsfortheadministrationandsupervisionoverthetransportofdangerouscargobyairandtheirduties.（三）开展自查及对其代理人 进行检查的要求；(3) Therequirementsforconductingselfinspectionsandinspectionsofitsagents.（四）人员的培训要求及对危 险品培训机构的要求；(4) Therequirementsforpersonneltraininganddangerouscargotraininginstitutions.（五）旅客、机组成员携带危(5) Therestrictionsonpassengersandcrewmemberscarrying
