6、的决定第四次修订）第一章总则ChapterIGeneralProvisionsArticle 1 ThisRegulationisformulatedwithaviewtostrengtheningthemanagementofcommercialperformances,promotingthedevelopmentofculturalindustry,boostingthesocialistartcause,cateringtotheculturalneedsofthepeopleandpromotingthesocialistspiritualcivilization.Article 2

7、 ThecommercialperformancesasmentionedinthisRegulationrefertotheliveartperformancesgearedtowardsthegeneralpublicforcommercialpurposes.Article 3 Thecommercialperformancesshalladheretothedirectionofservingthepeopleandthesocialism,giveprioritytothesocialbenefits,harmonizethesocialandeconomicbenefitsande

8、nrichtheculturallifeofthepeople.Article 4 Thestateencouragestheexcellentprogramsthatunifytheculturalandartisticperformancegroups,creationofperformersaswellasthespiritsandartisticqualityofperformances,reflectthegoodnationalculturaltraditionandarepopularamongthepeople,andencouragestheperformancesthata

9、regratuitouslyorpreferentiallyofferedtoruralareas,industrialandminingenterprises,aswellasthechildren.Article 5 ThecultureadministrativedepartmentoftheStaleCouncilshallberesponsibleforthesupe,isionandmanagementofthecommercialperformancesthroughoutthecountry.Thepublicsecuritydepartmentandtheindustryan

10、d第一条为了加强对营业性演出的管理，促进文化产业的发展，繁荣社会主义文艺事业，满足人民群众文化生活的需要，促进社会主义精神文明建设，制定本条例。第二条本条例所称营业性演出，是指以营利为目的为公众举办的现场文艺表演活动。第三条营业性演出必须坚持为人民服务、为社会主义服务的方向，把社会效益放在首位、实现社会效益和经济效益的统一，丰富人民群众的文化生活。第四条国家鼓励文艺表演团体、演员创作和演出思想性艺术性统一、体现民族优秀文化传统、受人民群众欢迎的优秀节目，鼓励到农村、工矿企业演出和为少年儿童提供免费或者优惠的演出。第五条国务院文化主管部门主管全国营业性演出的监督管理工作。国务院公安部门、工商行政

13、hecountylevelshall,accordingtotheirrespectivefunctions,beresponsibleforthesupervisionandmanagementofcommercialperformances.第二章营业性演出经营主体的设立ChapterIIEstablishmentofBusinessSubjectofCommercialPerformances第六条文艺表演团体申请从事营业性演出活动， 应当有与其业务相适应的专职演员和器材设备，并向县级 人民政府文化主管部门提出申请；演出经纪机构申请从事 营业性演出经营活动，应当有3名以上专职演出经纪人员

14、 和与其业务相适应的资金，并向省、自治区、直辖市人民 政府文化主管部门提出申请。文化主管部门应当自受理申 请之日起20 H内作出决定。批准的，颁发营业性演出许可 证；不批准的，应当书面通知申请人并说明理由。Article6Aculturalandartisticperformanceorganizationthatappliesforengagingincommercialperformanceactivitiesshallhavefull-timeperformersandequipmentsuitableforitsbusiness,andfileanapplicationwiththec

15、ompetentcultureadministrativedepartmentatthecountylevel;andaperformancebrokerageinstitutionthatappliesforengagingincommercialperformancebrokerageshallhavethreeormorefull-timeperformancebrokersandfundssuitableforitsbusiness,andfileanapplicationwiththecultureadministrativedepartmentofthepeoplesgovernm

16、entoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment.Thecultureadministrativedepartmentshallmakeadecisionwithin20daysofacceptingtheapplication.Iftheapplicationisapproved,acommercialperformancepermitshallbeissuedtotheapplicant;oriftheapplicationisdisapproved,theapplicantsh

17、allbenotifiedinwritingofthedecisionwithanexplanationofthereasonsforthedisapproval.第七条设立演出场所经营单位，应当依法到工商行政管理部门办理注册登记，领取营业执照，并依照有关 消防、卫生管理等法律、行政法规的规定办理审批手续。Article7Whenestablishingabusinessentityofcommercialperformanceplace,theapplicantshallgothroughtheregistrationformalitiesintheindustryandcommercead

18、ministrativedepartment,getabusinesslicense,andgothroughtheexaminationandapprovalformalitiesinaccordancewiththerelevantlawsandadministrativeregulationsonfireprotection,sanitation,etc.演出场所经营单位应当自领取营业执照之日起20日内向所在地县级人民政府文化主管部门备案。Thebusinessentityofcommercialperformanceplaceshall,within20daysafteritobtai

21、gistrationintheindustryandcommerceadministrativedepartment.Whereabusinessentityofcommercialperformanceplaceintendstochangeitsname,domicile,legalrepresentativeormajorperson-in-charge,itshallgothroughthefonalitiesformodifyingtheregistrationintheindustryandcommerceadministrativedepartmentandshall,oncea

22、gain,gothroughthearchivalfilingformalitiesintheoriginalarchivalfilingorgan.Article9Theself-employedperformersengagedincommercialperformances(hereinafterreferredtoastheselfemployedperformers)andtheself-employedperformancebrokersengagedintheactivitiessuchasintermediaryandagencyforcommercialperformance

23、s(hereinafterreferredtoastheself-employedperformancebrokers)shalleachgothroughtheregistrationformalitiesintheindustryandcommerceadministrativedepartmenttogetabusinesslicense.Aself-employedperformerorself-employedperformancebrokershall,within20daysafteritobtainsabusinesslicense,gothroughthearchivalfi

24、lingformalitiesinthelocalcultureadministrativedepartmentofthepeoplesgovernmentatthecountylevel.Article 10 AforeigninvestormaylegallyformaperformancebrokerageinstitutionoranentityoperatingperformanceplaceswithinChina,andmaynotformanyculturalandartisticperformanceorganization.Aforeign-fundedperformanc

25、ebrokerageinstitutionthatappliesforengagingincommercialperformancebrokerageactivitiesoraforeign-fundedentityoperatingperformanceplacesthatappliesforengaginginperformanceplaceoperationactivitiesshallfileanapplicationwiththecultureadministrativedepartmentoftheStateCouncil.Theculture向原备案机关重新备案。第九条以从事营业

26、性演出为职业的个体演员（以下简称个体演员）和以从事营业性演出的居间、代理活动为职业的个体演出经纪人（以下简称个体演出经纪人），应当依法到工商行政管理部门办理注册登记，领取营业执照。个体演员、个体演出经纪人应当自领取营业执照之日起20日内向所在地县级人民政府文化主管部门备案。第十条外国投资者可以依法在中国境内设立演出经纪机构、演出场所经营单位；不得设立文艺表演团体。外商投资的演出经纪机构申请从事营业性演出经营活动、外商投资的演出场所经营单位申请从事演出场所经营活动，应当向国务院文化主管部门提出申请。国务院文化主管部门应当自收到申请之日起20日内作出决定.批准的,颁发营业性演出许可证；不批准的，应

27、当书面通知申请人并说明理由。第一条 香港特别行政区、澳门特别行政区的投 资者可以在内地投资设立演出经纪机构、演出场所经营单 位以及由内地方控股的文艺表演团体；香港特别行政区、 澳门特别行政区的演出经纪机构可以在内地设立分支机 构。台湾地区的投资者可以在大陆投资设立演出经纪机构、演 出场所经营单位，不得设立文艺表演团体。依照本条规定设立的演出经纪机构、文艺表演团体申请从 事营业性演出经营活动，依照本条规定设立的演出场所经 营单位申请从事演出场所经营活动，应当向省、自治区、 直辖市人民政府文化主管部门提出申请。省、自治区、直 辖市人民政府文化主管部门应当自收到申请之日起20日内 作出决定。批准的，

29、ereasonsforthedisapproval.Article 11 TheinvestorsfromtheHongKongSpecialAdministrativeRegionortheMacaoSpecialAdministrativeRegionmayinvestinorformaperformancebrokerageinstitution,anentityoperatingperformanceplaces,oraculturalandartisticperformanceorganizationofwhichthecontrollingsharesareheldbythemai

30、nlandparlyinthemainland;theperformancebrokerageinstitutionsoftheHongKongSpecialAdministrativeRegionortheMacaoSpecialAdministrativeRegionmaysetupbranchesinthemainland.AninvestorfromTaiwanRegionmayformaperformancebrokerageinstitutionoranentityoperatingperformanceplacesinthemainland,butshallnotformacul

31、turalandartisticperformanceorganization.Aperformancebrokerageinstitutionoraculturalandartisticperformanceorganizationformedundertheprovisionsofthisarticlethatappliesforengagingincommercialperibnancebrokerageactivities,oranentityoperatingperformanceplacesformedundertheprovisionsofthisarticlethatappli

32、esforengaginginperformanceplaceoperationactivitiesshallfileanapplicationwiththecultureadministrativedepartmentofthepeoplesgovernmentoftheprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernment.Thecultureadministrativedepartmentofthepeoplesgovernmentoftheprovince,autonomousregion,or

33、municipalitydirectlyundertheCentralGovernmentshallmakeadecisionwithin20daysofreceiptofIheapplication.Iftheapplicationisapproved,acommercialperformancepermitshallbeissued;oriftheapplicationisdisapproved,theapplicantshallbenotifiedinwritingofthedecisionwithanexplanationofthereasonsforthedisapproval.Th

34、eformationofaperformancebrokerageinstitutionoranentityoperatingperformanceplacesundertheprovisionsofthisarticleshallalsocomplywiththeprovisionsofotherlawsandregulationsofChina.ChapterIIINormsonCommercialPerformancesArticle12Aculturalandartisticperformancegrouporselfemployedperformermaystagecommercia

35、lperformancesindependently,andmayparticipateinanycooperativecommercialperformances.Thecooperativecommercialperformancesshallbearrangedbyaperformancebrokerageinstitution,butabusinessentityofperformanceplacemaystagecooperativecommercialperformancesatitsownperformanceplace.Aperformancebrokerageinstitut

36、ionmaybeengagedintheactivitiessuchasintermediary,agencyandbrokerageforcommercialperformances;aself-employedperformancebrokermayonlyactasamiddlemanoragentforcommercial依照本条规定设立演出经纪机构、演出场所经营单位的，还应当遵守我国其他法律、法规的规定。第三章营业性演出规范第十二条文艺表演团体、个体演员可以自行举办营业性演出，也可以参加营业性组台演出。营业性组台演出应当由演出经纪机构举办；但是，演出场所经营单位可以在本单位经营的场所

37、内举办营业性组台演出。演出经纪机构可以从事营业性演出的居间、代理、行纪活动；个体演出经纪人只能从事营业性演出的居间、代理活动。performances.Article13Whenhostingcommercialperformances,theapplicantshallfileanapplicationwiththecultureadministrativedepartmentofthepeoplesgovernmentatthecountyleveloftheplacewheretheperformancesarehosted.Thecultureadministrativedepartm

38、entofthepeoplesgovernmentatthecountylevelshallmakeadecisionwithin3daysafteritacceptstheapplication.IftheapplicationmeetstherequirementsasprescribedinArticle26ofthisRegulation,itshallgranttheapplicantanapprovaldocument;iftheapplicationdoesnot,itshallmakeadecisionofdisapprovalandshallnotifytheapplican

39、tinwritingandmakeanexplanation.Article14Withtheexceptionsofperformancebrokerageinstitutions,anyotherentityorindividualshallnothostcommercialperformancesparticipatedinbyforeignorHongKongorMacaoculturalandartisticperformancegroupsorindividuals.However,whenaculturalandartisticperformancegrouphostscomme

40、rcialperformancesbyitself,itmayinviteforeign,HongKongandMacaoculturalandartisticperformancegroupsandindividualstoparticipateinthecommercialperformances.Whenhostingcommercialperformanceswithparticipantsofforeign,HongKongandMacaoculturalandartisticperformancegroupsandindividuals,thehostingpartyshallme

41、etthefollowingrequirements:第十三条举办营业性演出，应当向演出所在地县级人民政府文化主管部门提出申请。县级人民政府文化主管部门应当自受理申请之日起3日内作出决定。对符合本条例第二十五条规定的，发给批准文件；对不符合本条例第二十五条规定的，不予批准，书面通知申请人并说明理由。第十四条除演出经纪机构外，其他任何单位或者个人不得举办外国的或者香港特别行政区、澳门特别行政区、台湾地区的文艺表演团体、个人参加的营业性演出。但是，文艺表演团体自行举办营业性演出，可以邀请外国的或者香港特别行政区、澳门特别行政区、台湾地区的文艺表演团体、个人参加。举办外国的或者香港特别行政区、澳门特

42、别行政区、台湾地区的文艺表演团体、个人参加的营业性演出，应当符合下列条件：(1) Havingthefundthatcanmeettherelevantneedsofthecommercialperformances;(2) Having2-yearormoreexperienceofhostingcommercialperformances;and(3) HavingnorecordofviolatingthisRegulationwithin2yearspriortotheto-be-hostedcommercialperformances.Article 15 Tohostcommerc

43、ialperformancesinwhichforeignculturalandartisticperformancegroupsorindividualsparticipate,thehostingentityshallfileanapplicationwiththeculturaladministrativedepartmentsofthepeoplesgovernmentoftheprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernmentwheretheperformancesarelocated.W

44、ithregardtothecommercialperformanceswithparticipantsofHongKongandMacaoculturalandartisticperformancegroupsandindividuals,thehostingentityshallfileanapplicationwiththecultureadministrativedepartmentofthepeoplesgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentofth

45、eplacewherethecommercialperformancesarehosted.WithregardtothecommercialperformanceswithparticipantsofTaiwanculturalandartisticperformancegroupsandindividuals,thehostingentityshallfileanapplicationwiththecultureadministrativedepartmentoftheStateCounciljointlywiththeexaminationandapprovalorganasdesign

46、atedbytherelevantdepartmentsoftheStaleCouncil.（一）有与其举办的营业性演出相适应的资金；（二）有2年以上举办营业性演出的经历；（三）举办营业性演出前2年内无违反本条例规定的记录。第十五条举办外国的文艺表演团体、个人参加的营业性演出，演出举办单位应当向演出所在地省、自治区、直辖市人民政府文化主管部门提出申请。举办香港特别行政区、澳门特别行政区的文艺表演团体、个人参加的营业性演出，演出举办单位应当向演出所在地省、自治区、直辖市人民政府文化主管部门提出申请；举办台湾地区的文艺表演团体、个人参加的营业性演出，演出举办单位应当向国务院文化主管部门会同国务院有

47、关部门规定的审批机关提出申请。Thecultureadministrativedepartmentof(heStateCouncilorthecultureadministrativedepartmentofthepeoplesgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentshallmakeadecisionafteritacceptsanapplication.IftheapplicationmeetstherequirementsasspecifiedinArti

48、cle26ofthisRegulation,itshallgranttheapplicantanapprovaldocument;ifitdoesnot,itshalldisapproveitandshallnotifytheapplicantinwritingandmakeanexplanation.Article 16 Theapplicationmaterialsforhostingcommercialperformancesshallincludethefollowingitems:(1) Thenameoftheperformance,hostingentityandparticip

49、antsofculturalandartisticperformancegroupandactorsoftheperformances;(2) Thedate,placeandtotalnumberofperformances;and(3) Theprogramsandtherelevantvisualandaudiomaterials;Whenapplyingforhostingcooperativecommercialperformances,theapplicantshall,inadditiontosubmittingtheabove-mentionedmaterials,submittheperformerswrittenlettersaboutth
