4、rbanwatersupplyundertaking,andensuringthewatersupplyforeverj,daylife,productionactivitiesandvariousconstructions.城市供水条例（1994年7月19日中华人民共和国国务院令第158号发布根据2018年3月19日国务院关于修改和废止部分行政法规的决定第一次修订根据2020年3月27日国务院关修改和废止部分行政法规的决定第二次修订）第一章总则第一条为了加强城市供水管理，发展城市供水事业，保障城市生活、生产用水和其他各项建设用水，制定本条例。supply”meansurbanpublicwa

6、rthepurposeofthisRegulation,uwatersupplyfromselfconstructedfacililies“meansthesupplyofwaterbyurbanwaterusersfortheirowneverydaylife,productionactivitiesandvariousconstructionsthroughtheirself-constructedwatersupplypipelinesandtheauxiliaryfacilitiesthereof.Article 3 Entitiesandindividualsengagedinurb

7、anwatersupplyanduseofwatersuppliedtourbanareasmustobservethisRegulation.Article 4 Urbanwatersupplyshallfollowtheprinciplesof44Combiningtheexploitationofwatersourceswithplannedwateruseandwaterconservation.”Article 5 Thepeoplesgovernmentsatorabovethecountylevelshallincorporatetheurbanwatersupplyundert

8、akingintotheirplansforeconomicandsocialdevelopment.Article 6 Thestatewillimplementthepoliciesthatareconducivetothedevelopmentofurbanwatersupply,encouragescientificandtechnologicalresearchonurbanwater和自建设施供水。本条例所称城市公共供水，是指城市自来水供水企业以公共供水管道及其附属设施向单位和居民的生活、生产和其他各项建设提供用水。本条例所称自建设施供水，是指城市的用水单位以其自行建设的供水管道及

9、其附属设施主要向本单位的生活、生产和其他各项建设提供用水。第三条从事城市供水工作和使用城市供水，必须遵守本条例。第四条城市供水工作实行开发水源和计划用水、节约用水相结合的原则。第五条县级以上人民政府应当将发展城市供水事业纳入国民经济和社会发展计划。第六条国家实行有利于城市供水事业发展的政策，鼓励城市供水科学技术研究，推广先进技术，提高城市供水的现代化水平。supply,promoteadvancedtechnologies,andenhancethemodernizationofurbanwatersupply.Article 7 Theadministrativedepartmentofur

10、banconstructionoftheStateCouncilshallbeinchargeofurbanwatersupplyacrossthecountry.Theadministrativedepartmentsofurbanconstructionofthepeoplesgovernmentsofprovincesandautonomousregionsshallbeinchargeofurbanwatersupplywithintheirrespectiveadministrativeregions.Theadministrativedepartmentofurbanwalersu

11、pplydeterminedbythepeoplesgovernmentofacityatorabovethecountylevel(hereinafterreferredtoasadministrativedepartmentofurbanwatersupply)shallbeinchargeofurbanwatersupplywithinitsadministrativeregions.Article 8 Entitiesandindividualsthathavemadeoutstandingachievementsinurbanwatersupplyshallberewarded.Ch

12、apterIIWaterSourcesforUrbanWaterSupplyArticle9Thepeoplesgovernmentofacityatorabovethecountylevelshallorganizetheadministrativedepartmentofurbanplanning,wateradministrativedepartment,administrativedepartmentofurbanwatersupply,administrativedepartmentofgeologyandmineralresourcesandotherappropriateadmi

13、nistrationstojointlyprepareawatersourcedevelopmentandutilizationplanforurbanwatersupply第七条国务院城市建设行政主管部门主管全国城市供水工作。省、自治区人民政府城市建设行政主管部门主管本行政区域内的城市供水工作。县级以上城市人民政府确定的城市供水行政主管部门（以下简称城市供水行政主管部门）主管本行政区域内的城市供水工作。第八条对在城市供水工作中作出显著成绩的单位和个人，给予奖励。第二章城市供水水源第九条县级以上城市人民政府应当组织城市规划行政主管部门、水行政主管部门、城市供水行政主管部门和地质矿产行政主管部门

15、nandthelong-termwatersupplyanddemandplan.ArticleIlAwatersourcedevelopmentandutilizationplanforurbanwatersupplyshallbepreparedaccordingtolocalcircumstances,andtheuseofsurfacewaterandgroundwatershallbereasonablyarranged.Article12Inthepreparationofawatersourcedevelopmentandutilizationplanforurbanwaters

16、upply,priorityshallbegiventoensuringurbandomesticwater,withdueregardtooverallarrangementsfortheuseofwalerforindustrialactivitiesandothervariousconstructions.Article13Theenvironmentalprotectiondepartmentofalocalpeoplesgovernmentatorabovethecountylevelshall,inconjunctionwiththeadministrativedepartment

17、ofurbanwatersupply,waleradministrativedepartment,healthadministrativedepartmentandotherappropriatedepartments,jointlydelimitthedrinkingwatersourceprotectionareas,andmakeanannouncementthereonafterapprovalbythepeoplesgovernmentatthesamelevel.Thedelimitationofdrinkingwalersourceprotectionareasacrosspro

18、vinces,cities,andcountiesshallbejointlydeterminedthroughconsultation第十条编制城市供水水源开发利用规划，应当从城市发展的需要出发，并与水资源统筹规划和水长期供求计划相协调。第H一条编制城市供水水源开发利用规划，应当根据当地情况，合理安排利用地表水和地下水。第十二条编制城市供水水源开发利用规划，应当优先保证城市生活用水，统筹兼顾工业用水和其他各项建设用水。第十三条县级以上地方人民政府环境保护部门应当会同城市供水行政主管部门、水行政主管部门和卫生行政主管部门等共同划定饮用水水源保护区，经本级人民政府批准后公布；划定跨省、市、县的饮

20、Theconstructionofurbanwatersupplyprojectsshallbecarriedoutinaccordancewiththeurbanwatersupplydevelopmentplananditsannualconstructionplan.Article 16 Designandconstructionentitieswithcorrespondingqualificationcertificatesshallbeentrustedwiththedesignorconstructionofurbanwatersupplyprojects,inwhichrele

21、vanttechnicalstandardsandspecificationsofthestateshallbecompliedwith.Itisprohibitedtoundertakethedesignorconstructionofurbanwatersupplyprojectswithoutalicenseorbeyondthebusinessscopespecifiedinthequalificationcertificate.Article 17 Uponcompletionofanurbanwatersupplyproject,afinalinspectionshallbeorg

22、anizedinaccordancewiththeprovisionsofthestate;thosethathavenotundergoneafinalinspectionorfaillopassthefinalinspectionshallnotbeputintouse.第十四条在饮用水水源保护区内，禁止一切污染水质的活动。第三章城市供水工程建设第十五条城市供水工程的建设，应当按照城市供水发展规划及其年度建设计划进行。第十六条城市供水工程的设计、施工，应当委托持有相应资质证书的设计、施工单位承担，并遵守国家有关技术标准和规范。禁止无证或者超越资质证书规定的经营范围承担城市供水工程的设计、施

23、工任务。第十七条城市供水工程竣工后，应当按照国家规定组织验收；未经验收或者验收不合格的，不得投入使用。Article 18 Wherethevolumeofwateruseneedstoincrease第十八条城市新建、扩建、改建工程项目需要增foranewconstruction,expansion,orreconstructionprojectinanurbanarea,thetotalprojectestimateshallincludetheinvestmentintheconstructionofthewatersupplyproject;wherethevolumeofwaters

24、uppliedtoanurbanareaneedstoincrease,theinvestmentintheconstructionofthewatersupplyprojectshallbetransferredtotheadministrativedepartmentofurbanwatersupply,andthelattershallorganizetheconstructionoftheurbanpublicwatersupplyprojectinanunifiedmanner.ChapterIVUrbanWaterSupplyBusinessArticle 19 Awateruti

25、lityoranenterprisesupplyingwaterexternallythroughaself-constructedfacilityinanurbanareamayonlyconductbusinessactivitiesonceitisregisteredwithanadministrationforindustryandcommerce.Article 20 Awaterutilityoranenterprisesupplyingwaterexternallythroughaself-constructedfacilityinanurbanareashallestablis

26、handimproveitswaterqualitytestingsystemtoensurethatthewaterqualityoftheurbanwateritsuppliesmeetsthehygienestandardsfordrinkingwaterasprescribedbythestate.Article 21 Anurbanwaterutilityoranenterprisesupplyingwaterexternallythroughaselfconstructedfacilityinanurbanareashallsetuppressuretappingpointsfor

27、itswatersupplynetworkaccordingtotherelevantprovisionsissuedbythestate,andeffectivelyconductmonitoringofwaterpressuresoastoensurethatthepressureofitswatersupplypipenetwork加用水的，其工程项目总概算应当包括供水工程建设投资；需要增加城市公共供水量的，应当将其供水工程建设投资交付城市供水行政主管部门，由其统一组织城市公共供水工程建设。第四章城市供水经营第十九条城市自来水供水企业和自建设施对外供水的企业，经工商行政管理机关登记注册后

28、，方可从事经营活动。第二十条城市自来水供水企业和自建设施对外供水的企业，应当建立、健全水质检测制度，确保城市供水的水质符合国家规定的饮用水卫生标准。第二He一条城市自来水供水企业和自建设施对外供水的企业，应当按照国家有关规定设置管网测压点，做好水压监测工作，确保供水管网的压力符合国家规定的标准。meetsthestandardsprescribedbythestate.禁止在城市公共供水管道上直接装泵抽水。Itisprohibitedtopumpwateroutofanurbanpublicwatersupplypipelinebyinstallinganypumpdirectlyonsuch

29、pipeline.第二十二条 城市自来水供水企业和自建设施对外 供水的企业应当保持不间断供水。由于工程施工、设备维 修等原因确需停止供水的，应当经城市供水行政主管部门 批准并提前24小时通知用水单位和个人；因发生灾害或者 紧急事故，不能提前通知的，应当在抢修的同时通知用水 单位和个人，尽快恢复正常供水，并报告城市供水行政主 管部门。Article 22 Anurbanwaterutilityoranenterprisesupplyingwalerexternallythroughaself-constructedfacilityinanurbanareashallmaintainuninter

30、ruptedwatersupply.Wherethewatersupplyhastobesuspendedduetosuchreasonsastheconstructionofabuildingprojectandthemaintenanceofequipment,itshallnotifytheentitiesandindividualsusingitswatersupply24hoursinadvance,subjecttoapprovalbytheadministrativedepartmentofurbanwatersupply.Whereitisunabletonotifywater

31、usersinadvanceduetoadisasteroranemergency,itshallnotifytheentitiesandindividualsusingitswatersupplywhilemakingarepair,restorenormalwatersupplyassoonaspossibleandreporttotheadministrativedepartmentofurbanwatersupply.第二十三条 城市自来水供水企业和自建设施对外 供水的企业应当实行职工持证上岗制度。具体办法由国务 院城市建设行政主管部门会同人事部门等制定。第二十四条用水单位和个人应当按

32、照规定的计量标准和水价标准按时缴纳水费。Article 23 Anurbanwalerutilityoranenterprisesupplyingwaterexternallythroughaself-constructedfacilityinanurbanareashallimplementthesystemofrequiringemployeestoholdqualificationcertificates.ThespecificmeasuresshallbeformulatedbytheadministrativedepartmentofurbanconstructionoftheSta

33、teCouncilinconjunctionwithitspersonneldepartment.Article 24 EntitiesandindividualsusingsuppliedwatershallpayIheirwalerbillsontimeaccordingtotheprescribedArticle 25 Itisprohibitedtomisappropriateortransfertourbanpublicwatersupply.Article 26 Thepriceofurbanwatersupplyshallbesetundertheprinciplesofmain

34、tainingmeagreprofitsindomesticwateruseandreasonablepricesfortheuseofwaterinproductionandbusinessoperations.Themethodsforsettingwatersupplypricesinanurbanareashallbeformulatedbythepeoplesgovernmentoftherelevantprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernment.ChapterVMaintenan

35、ceofUrbanWaterSupplyFacilitiesArticle 27 Anurbanwaterutilityoranenterprisesupplyingwaterexternallythroughaselfconstructedfacilityinanurbanareashallconducttheregularinspectionsandmaintenanceofthedesignatedreservoirs,waterdiversionchannels,waterintakes,pumpstations,wells,watertransportation(distributi

36、on)pipenetwork,generalwatermetersofhouseholds,waterpurification(distribution)factories,publicwaterstationsandotherfacilities,whichareunderitsmanagementforurbanwatersupply,andshallensuretheirsafeoperation.Article 28 Theoutdoorpipelinesandtheirauxiliarj,facilities第二十五条禁止盗用或者转供城市公共供水。第二十六条城市供水价格应当按照生活用

37、水保本微利、生产和经营用水合理计价的原则制定。城市供水价格制定办法，由省、自治区、直辖市人民政府规定。第五章城市供水设施维护第二十七条城市自来水供水企业和自建设施供水的企业对其管理的城市供水的专用水库、引水渠道、取水口、泵站、井群、输（配）水管网、进户总水表、净（配）水厂、公用水站等设施，应当定期检查维修，确保安全运行。第二十八条用水单位自行建设的与城市公共供水constructedbyanentityusingsuppliedwaterwhichare管道连接的户外管道及其附属设施，必须经城市自来水供水企业验收合格并交其统一管理后，方可使用。第二十九条在规定的城市公共供水管道及其附属 设施的

38、地面和地下的安全保护范围内，禁止挖坑取土或者 修建建筑物、构筑物等危害供水设施安全的活动。第三十条因工程建设确需改装、拆除或者迁移城 市公共供水设施的，建设单位应当报经县级以上人民政府 城市规划行政主管部门和城市供水行政主管部门批准，并 采取相应的补救措施。第三H一条涉及城市公共供水设施的建设工程开 工前，建设单位或者施工单位应当向城市自来水供水企业 查明地下供水管网情况。施工影响城市公共供水设施安全 的，建设单位或者施工单位应当与城市自来水供水企业商 定相应的保护措施，由施工单位负责实施。intendedforconnectiontourbanpublicwatersupplypipelin

40、iggingholesforcollectionofsoilorconstructingbuildingsorstructures,whichendangerthesafetyofwatersupplyfacilities.Article3()Whereanyurbanpublicwatersupplyfacilityhastobemodified,dismantledorrelocatedduetotheconstructionofaproject,theconstructionemployershallreporttotheadministrativedepartmentofurbanpl

41、anningandtheadministrativedepartmentofurbanwatersupplyofthepeoplesgovernmentatorabovethecountylevelforapproval,andlakecorrespondingremedialmeasures.Article31Beforecommencingtheconstructionofaconstructionprojectinvolvinganyurbanpublicwatersupplyfacility,theconstructionownerorconstructioncontractorsha

42、llascertaintheinformationabouttheundergroundwatersupplypipelinenetworkwiththerelevanturbanwalerutility.Wheresuchconstructionmayaffectthesafetyofanyurbanpublicwatersupplyfacility,theconstructionownerorconstructioncontractorshalladoptcorrespondingprotectionmeasuresthroughconsultationwiththerelevanturb

43、anwaterutility,andtheconstructionownershallberesponsiblefortheimplementationofthemeasures.Article32Itisprohibitedtoconnectthewatersupplypipesystemofself-constructedfacilitiestotheurbanpublicwatersupplypipenetworkwithoutauthorization.Whereitisnecessarytoconnectunderexceptionalcircumstances,theconsent

44、oftheurbanwaterutilitymustbeobtained,andnecessaryprotectivemeasuresshallbetakenatthepipeconnections.Aproduceroruseroftoxicorhazardoussubstancesshallbeprohibitedfromdirectlyconnectingitsproduction-usewaterpipesystemtotheurbanpublicwatersupplypipenetwork.ChapterVIPenaltiesArticle33Whereanurbanwateruti

45、lityoranenterprisesupplyingwalerexternallythroughaself-constructedfacilityinanurbanareacommitsanyofthefollowingconducts,theadministrativedepartmentofurbanwatersupplyshallorderittotakecorrectiveactionsandmayimposeafineonit;shallreporttothepeoplesgovernmentatorabovethecountylevelforapproval,andorderit

46、tosuspendbusinessoperationsforanoverhaulifthecircumstancesareserious,andthedirectlyliableexecutiveinchargeandotherdirectlyliablepersonsshallbegivendisciplinaryactionsbytheiremployerorthesuperiorcompetentdepartmentthereof:(1) Failingtomeetthestandardsprescribedbythestateregardingthewaterqualityorwate

47、rpressureofthewater第三十二条禁止擅自将自建设施供水管网系统与城市公共供水管网系统连接；因特殊情况确需连接的，必须经城市自来水供水企业同意，并在管道连接处采取必要的防护措施。禁止产生或者使用有毒有害物质的单位将其生产用水管网系统与城市公共供水管网系统直接连接。第六章罚则第三十三条城市自来水供水企业或者自建设施对外供水的企业有下列行为之一的，由城市供水行政主管部门责令改正，可以处以罚款；情节严重的，报经县级以上人民政府批准，可以责令停业整顿；对负有直接责任的主管人员和其他直接责任人员，其所在单位或者上级机关可以给予行政处分：（一）供水水质、水压不符合国家规定标准的;suppli

48、ed;(2) SuspendingwatersupplywithoutauthorizationorfailingtoperformtheobligationOfissuinganoticeofsuspensionofwatersupply;or(3) Failingtomaintainitswatersupplyfacilityasrequiredorfailingtomakearepairinatimelymannerafteritswatersupplyfacilitybreaksdown.Article34WhoevercommitsanyofthefollowingconductsasinviolationofthisRegulationshallbeorderedbytheadministrativedepartmentofurbanwatersupplytoceasetheviolationoflawandmaybefined;andthedirectlyliableexecutiveinchargeandotherdirectlyliablepersonsmaybegivendisciplinarj,actionsbytheiremployerorthesuperiorcompetentdepartmentthereof:(1) Designingorc
