11、eop1.esBankofChinaJu1.y2,20242024年7月2日深圳市创业担保贷款管理办法第一章总则第一条为进一步促进和规范创业担保贷款工作，加大对初创企业和小微企业的融资支持力度，促进创业带动就业，根据财政部关于印发普惠金融发展专项资金管理办法的通知（财金（2023）75号）、关于印发广东省人力资源和社会保障厅广东省财政厅广东省地方金融监督管理局中国人民银行广州分行关于创业担保贷款担保基金和贴息资金管理办法（修订稿）的通知（黑人社规（2022）25号）、深圳市人民政府关于印发深圳市进一步稳定和促进就业若干政策措施的通知（深府规（2020）5号）有关规定，结合我市实际，制定本办法。

16、oymentthroughbusinessstartups.第二条本办法所称创业担保贷款，是指以符合规定条件的创业者个人或者小徽企业为借款人，由创业担保贷款担保基金或政府性融资担保机构提供担保，由经办银行发放，由创业担保贷款贴息资金给予贴息，用于支持个人创业或小微企业吸纳就业的贷款业务。创业担保贷款免收借款人担保费。Artic1.e2ForthepurposesoftheseMeasures,guaranteed1.oansforbusinessstartupsmeansthe1.oanbusinessinwhichborrowersarequa1.ifiedindividua1.entrep

18、sstartupsbyindividua1.sorcreationofjobsbymicroandsma1.1.enterprises.Theborrowersguaranteefeesha1.1.beexemptedforguaranteed1.oansforbusinessstartups.笫三条本办法所称创业担保贷款担保基金（以下简称担保基金），是指由市级财政出资设立，用于为创业担保贷款提供担保的专项资金。担保基金由市公共就业服务机构负责运营管理（以下简称运营管理机构）。Artic1.e3ForthepurposesoftheseMeasures,guaranteefundsofguar

20、称贴息资金），是指纳入市级财政年度预算安排，用于创业担保贷款贴息的资金。ForthepurposesoftheseMeasures,interestsubsidyfundsforguaranteed1.oansforbusinessstartups(interestsubsidyfunds)meansfundsinc1.udedinannua1.municipa1.fisca1.budgetarrangementsandusedasinterestsubsidiesforguaranteed1.oansforbusinessstartups.失业保险基金不得用于担保基金和贴息资金支出。Theu

21、nemp1.oymentinsurancefundsha1.1.notbeusedfortheexpenditureofguaranteefundsandinterestsubsidyfunds.第四条本办法所称政府性融资担保机构（以下简Artic1.e4ForthepurposesoftheseMeasures,governmentfinancingguaranteeinstitutions(guaranteeinstitutions)meansfinancingguarantee称担保机构），是指依法设立，由市政府及其授权机构出资并实际控股，以服务小微企业或“三农”主体为主要经营目标，纳入

24、度、贷款利率、服务评价等因素，通过公开遴选等方式择优选取，为符合条件的个人或小微企业发放创业担保贷款的本市辖区内根行业金融机构。ForthepurposesoftheseMeasures,hand1.ingbankmeansabankingfinancia1.institutionthatgrantsguaranteed1.oansforbusinessstartupstoe1.igib1.eindividua1.sormicroandsma1.1.enterprisesdeterminedthroughopense1.ectionorothermethodsincomprehensiveco

25、nsiderationof1.oanconvenience,1.oaninterestrate,serviceeva1.uation,andotherfactors.笫五条建立创业担保贷款工作联席会议机制（以下简称联席会议），由市人力资源保障部门牵头会同市财政部门、市地方金融管理部门、人艮银行深圳市分行共同研究创业担保贷款担保基金存放、贷款规模调整等重大事项。第二章借款人对象范围Artic1.e5Ajointconferencemechanismforguaranteed1.oansforbusinessstartups(jointconference)sha1.1.beestab1.ishe

27、sinessstartupsandtheadjustmentofthesizeof1.oans.Chapter II ScopeofBorrowersArtic1.e6Scopeofindividua1.borrowers:第六条个人借款人的范围：(1) Registeredunemp1.oyedpersons,personswithdifficu1.tiesinseekingemp1.oyment(inc1.udingthedisab1.ed),veterans,personsre1.easeduponcomp1.etionofsentence,graduatesfromco1.1.eges

28、anduniversities,graduatesfromvocationa1.schoo1.sandtechnicianschoo1.s,emp1.oyeesandunemp1.oyedpersonsofenterprisesthatreduceexcessproductioncapacity,peop1.ereturningtotheirhometowntostartbusinesses,on1.inebusinesses,peop1.e1.iftedoutofpoverty,farmersandresidentsfromHongKong1Macao,andTaiwan(keysuppor

29、trecipients)mayapp1.yforpersona1.guaranteed1.oansforbusinessstartups(persona1.1.oans)iftheyfai1.toraisesufficientfundstostarttheirownbusinessesandmeetthefo1.1.owingconditions.Keysupportsha1.1.begiventowomenamongthem.（一）登记失业人员、就业困难人员（含残疾人）、退役军人、刑满释放人员、高校毕业生、职业院校毕业生、技工院校毕业生、化解过剌产能企业职工和失业人员、返乡创业人员、网络商户

30、、脱贫人口、农民及港澳台居民（以下简称重点扶持对象）自主创业自筹资金不足，并符合以下条件的，可以申请个人创业担保贷款（以下简称个人贷款）。对其中的妇女，给予重点支持。(2) Whensubmittinga1.oanapp1.ication,awomansha1.1.notexceed55yearso1.dandamansha1.1.notexceed60yearso1.d.(3) Heorshehasundergonestatutoryregistrationforma1.ities(inc1.udingmicroandsma1.1.enterprises,individua1.industr

31、ia1.andcommercia1.househo1.ds,socia1.organizations,farmersprofessiona1.cooperatives,fami1.yfarms,andothertypes,hereandbe1.ow)withintheadministrativeregionofShenzhen(inc1.udingtheShenzhen-ShanweiSpecia1.CooperationZone,hereandbe1.ow).(4) Heorshehasaspecificoperatingproject.1.提交贷款申请时女性不超过55周岁、男性不超过60周

32、岁；2.已在深圳市行政区域内（含深汕特别合作区，下同）办理法定登记注册手续（包括小微企业、个体工商户、社会组织、农民专业合作社、家庭农场等类型，下同）；3.有具体经营项目;4.在提交贷款申请时，除助学货款、扶贫贷款、住房贷款、购车贷款、10万元以下小额消费贷款（含信用卡消费）以外，本人及其配偶应(5) Atthetimeofsubmittinga1.oanapp1.ication,theapp1.icantandhisorherspousesha1.1.havenoother1.oansexceptforstudent1.oans,povertya1.1.eviation1.oans,hous

33、ing1.oans,auto1.oans,andsma1.1.consumer1.oansofnotmorethan100,000yuan没有其他贷款。(inc1.udingcreditcardconsumption).（二）其他人员自主创业自筹资金不足申请创业担保贷款的，除符合本条第（一）项规定的条件外，其所创办的创业主体登记注册时间须在3年内。2.Ifanyotherpersonhasinsufficientse1.f-raisedfundstostarthisorherownbusinessandapp1.iesforaguaranteed1.oanforbusinessstartups

34、,heorshesha1.1.meettheconditionsspecifiedinsubparagraph1ofthisartic1.e,andtheentrepreneuria1.entityformedbythepersonsha1.1.beregisteredwithinthreeyears.笫七条符合以下条件的小微企业借款人，可以申请小微企业创业担保贷款（以下简称小微企业贷款）：Artic1.e7Amicroorsma1.1.enterpriseborrowermeetingthefo1.1.owingconditionsmayapp1.yforaguaranteed1.oanfo

35、rthebusinessstartupofamicroorsma1.1.enterprise(1.oanforamicroorsma1.1.enterprise):（一）在深圳市行政区域内登记注册的小微企业。1. Amicroorsma1.1.enterpriseregisteredwithintheadministrativeregionofShenzhen.（二）当年（提出申请之日前12个月内）新招用重点扶持对象达到企业现有在职职工人数10%（超过100人的企业达到5%）,并与其签订1年以上劳动合同。2. Amicroorsma1.1.enterprisewhosenew1.yrecrui

36、tedemp1.oyeesinthecurrentyear(within12monthsbeforethedateofapp1.ication)accountfor10%oftheexistingincumbentemp1.oyeesoftheenterprise(5%forenterprisesemp1.oyingmorethan100peop1.e)andenterinto1.aborcontractsofoneyearormoretherewith.（三）无拖欠职工工资、欠缴社会保险费等严重违法违规信用记录。3. Theenterprisehasnocreditrecordofanyse

37、riousvio1.ationof1.aworregu1.ationsuchasoverduewagesofemp1.oyeesandfai1.uretopaysocia1.insurancepremiums.第三章贷款额度、利率和期限ChapterIII1.oanAmount,InterestRate,andTerm第八条符合本办法第六条规定条件的个人借款Artic1.e8Themaximumamountofpersona1.1.oansforanindividua1.borrowermeetingtheconditionsspecifiedinArtic1.e6oftheseMeasure

38、ssha1.1.be300,000yuan.Ifanindividua1.borrowerhascreatedjobsforfiveormorepeop1.e(inc1.udingfivepersons,exc1.udingtheborrowerhimse1.forherse1.f)within12monthsbeforethedateofapp1.ication,themaximumamountofpersona1.1.oanssha1.1.beraisedto600,000yuan.Ifaborrowerwhomeetstheconditionsofpersona1.guaranteed1

39、.oansforbusinessstartupsstartsapartnership,theamountof1.oansmaybeappropriate1.yincreasedaccordingtothenumberofpartnershipentrepreneurs,withthemaximumnotexceeding110%ofthesumofthemaximumamountofqua1.ifiedpersona1.guaranteed1.oansforbusinessstartupsandnotexceedingthemaximumamountofguaranteed1.oansforb

40、usinessstartupsformicroandsma1.1.enterprises.Foramicroorsma1.1.enterpriseborrowermeetingtheconditionsspecifiedinArtic1.e7oftheseMeasures,themaximum1.oanamountsha1.1.befourmi1.1.ionyuan;andifsuchaborrowerhascreatedjobsforfiveormorepeop1.e(inc1.udingfivepeop1.e,exc1.udingthe1.ega1.representative)withi

41、n12monthsbeforethedateofapp1.ication,themaximum1.oanamountsha1.1.befivemi1.1.ionyuan.The1.oanamountsha1.1.bereasonab1.ydeterminedbythehand1.ingbankbasedontheenterprisesoperatingstatus,repaymentabi1.ity,andtheactua1.numberofemp1.oyees,amongothers.人，个人贷款额度最高30万元：其在提出申请之日前12个月内带动5人以上就业（含5人，不含借款人本人），个人贷

42、款额度提高至最高60万元。对符合个人创业担保贷款条件的借款人合伙创业的，可根据合伙创业人数适当提高贷款额度，最高不超过符合条件的个人创业担保贷款额度上限之和的110%,且不超过小微企业贷款额度上限。符合本办法第七条规定条件的小微企业借款人，贷款额度最高400万元；其在提出申请之日前12个月内带动5人以上就业（含5人，不含法定代表人本人）的，贷款额度最高500万元。贷款额度由经办银行根据企业经营状况、还款能力以及实际招用人数等合理确定。笫九条创业担保贷款利率不超过1.PR+50BPS（1.PR为1年期贷款市场报价利率），实际贷款利率由经办银行根据借款人的经营状况、信用情况等与借款人协商确定。贷款

43、利率应当在贷款合同中载明，各经办银行Artic1.e9Theinterestrateforguaranteed1.oansforbusinessstartupssha1.1.notexceed1.PR+50BPs(1.PRistheone-year1.oanprimerate)andtheactua1.1.oaninterestratesha1.1.bedeterminedthroughnegotiationbetweenthehand1.ingbankandtheborroweraccordingtotheborrowersoperatingstatus,creditstatus,andot

44、hercircumstances.The1.oaninterestratesha1.1.bespecifiedinthe1.oancontract,andnohand1.ingbankmay,indisguise,raisetheactua1.interestrateofguaranteed1.oansforbusinessstartupsorincreaseunreasonab1.echargesonthe1.oaninanyform.不得以任何形式变相提高创业担保贷款实际利率或额外增加贷款不合理收费。E1.igib1.eborrowersofguaranteed1.oansforbusin

45、essstartupsmayapp1.yforafisca1.interestsubsidyat50%oftheactua1.1.oaninterestrate.符合条件的创业担保贷款借款人，可以申请贷款实际利率50%的财政贴息。Artic1.e10Aborrowersha1.1.notenjoybothpersona1.1.oansandmicroandsma1.1.enterprise1.oanswithinthesame1.oanperiod.Themaximumtermofeachpersona1.1.oansha1.1.notexceedthreeyears,andthemaximu

46、mtermofeach1.oanforamicroorsma1.1.enterprisesha1.1.notexceedtwoyears.Aborrowerthatisactiveinmakingrepayments,hasstrongcapacitytopromoteemp1.oyment,astab1.esca1.eofemp1.oyment,andgoodbusinessstartupprojectsandsatisfiestherequirementsspecifiedinparagraph1ofArtic1.e6orArtic1.e7oftheseMeasuresmaycontinu

47、etoapp1.yforaguaranteed1.oanforbusinessstartupsandinterestsubsidiesfornotmorethanthreetimesintota1.afterithasrepaidthe1.oanonschedu1.eaccordingtotheapp1.icab1.eprovisions.第十条借款人在同一贷款期限不能同时享受个人贷款和小微企业贷款。个人贷款每次贷款期限最长不超过3年，小微企业贷款每次贷款期限最长不超过2年。还款积极、带动就业能力强、用工规模稳定、创业项目好且符合本办法第六条第（一）款或第七条规定的借款人，按规定按期还款后，可

48、以继续申请创业担保贷款和贴息，累计次数不得超过3次。创业担保贷款期限届满前，借款人确需继续使用资金或因暂时资金紧张预计不能按期还款，但信用记录和还款意愿良好、无积欠贷款利息及罚息且创业项目经营正常的，可以向经办银行申请贷款展期。贷款展期只能申请1次，展期期限不超过1年，展期期间不予贴息，可以继续提供担保。Where,beforetheexpirationofthetermofaguaranteed1.oanforbusinessstartups,aborrowerindeedneedstocontinueusingfundsorisexpectedtofai1.torepaythe1.oanonschedu1.eduetothetemporaryshortageoffunds,buthasgoodcreditrecordsandrepaymentintention,hasnooutstanding1.oaninterestandpena1.tyinterest,andthestartupprojectoperatesnorma1.1.y,theborrowermayapp1.ytothehand1.ingbankforanextensionofthe1.oan.Theapp1.icantmayon1.yapp1.yforanextensionofa1.oanonce,an
