7、YSection 1 -ShortTitle,ApplicationandCommencement(1) ThisActmaybecitedastheFoodAct1983andshallapplythroughoutMalaysia.(2) ThisActshallcomeintoforceonsuchdateastheMinistermaynotificationintheGazetteappointandtheMinistermayappointdifferentdatesforthecomingintoforceofthisActfordifferentStatesinMalaysia

8、orfordifferentprovisionsofthisAct.Section 2 -InterpretationInthisAct,unlessthecontextotherwiserequires-advertisementincludesanyrepresentationbyanymeanswhatsoeverforthepurposesofpromotingdirectlyorindirectlythesaleorotherdisposalofanyfood;analyst1meansanyanalystappointedundersection3;animaincludesany

9、quadrupedorbirdeitherdomesticatedorotherwise,fish,reptileorinsect;wholeorpartofwhichareusedforhumanconsumption;appliance1includesthewholeoranypartofanyutensil,machinery,instrument,apparatus,orarticleusedorintendedforuse,inorforthemaking,preparing,keeping,sellingorsupplyingofanyfood;approvedlaborator

14、rwiseentitledtothecustodyorcontrol,oftheimportedfood;labelincludesanytag,brand,mark,pictorialorotherdescriptivematter,written,printed,stencilled,marked,painted,embossedorimpressedon,orattachedtoorincludedin,belongingto,oraccompanyinganyfood;medicalexaminationincludesphysical,microbiological,chemical

15、,serological,andradiologicalexamination,andsuchexaminationmayincludethetakingofspecimenofanybodyfluid,tissueorwasteproductforexaminationoranalysis;,package,includesanythinginwhichoranymeansbywhichfoodiswhollyorpartlycased,covered,enclosed,contained,placedorotherwisepackedinanywaywhatsoeverandinclude

16、sanybasket,pail,trayorreceptacleofanykindwhetheropenedorclosed;premises1includes-(a) anybuildingortentoranyotherstructure,permanentorotherwisetogetherwiththelandonwhichthebuilding,tentorotherstructureissituatedandanyadjoininglandusedinconnectiontherewithandanyvehicle,conveyance,vesseloraircraft;and(

17、b) forthepurposesofsection4anystreet,openspaceorplaceofpublicresortorbicycleoranyvehicleusedfororinconnectionwiththepreparation,preservation,packaging,storage,conveyance,distributionorsaleofanyfood;,preparation*includesmanufacture,processingandanyformoftreatment;sealincludesthedetention,inbulk,ofany

18、food,asampleofwhichhasbeentakenforanalysis,pendingtheresultoftheanalysis;sellincludesoffer,keep,exposeforsale,transmit,convey,deliverorprepareforsaleorexchange,disposeofforanyconsiderationwhatsoever,ortransmit,conveyordeliverinpursuanceofsuchsale,exchange,ordisposal;vegetablesubstancemeansanyplantor

19、partofaplant,andincludesthestem,root,bark,tuber,rhizome,leaf,stalk,inflorescene,bud,shoot,flowers,fruitandseed,oranextractthereof.PARTIIADMINISTRATIONANDENFORCEMENTSection3-AppointmentofAnalystsandAuthorisedOfficers(1) TheMinistermayappointsuchnumberofanalystsashemayconsidernecessaryforthepurposesof

20、thisActandmaymakeregulationsconcerningtheirqualifications,conductandduties,andshallprepareorcausetobepreparedalistofappointedanalystsandreviseitasthecircumstancesmayrequire.(2) TheMinistermayappointsuchnumberofauthorisedofficersashemayconsidernecessaryforthepurposeofthisActandeveryauthorisedofficers

21、hallbeissuedwithaCertificateofAuthorisationwhichcertificateshallinanylegalproceedingsunderthisActbeadmissibleinevidenceandshallbeprimafacieevidenceofthefactssocertified.(3) TheMinistermay,inrelationtoanymatterwhichappearstohimtoaffectthegeneralinterestsoftheconsumer,authoriseanypublicofficertoprocur

22、eforanalysissamplesofanyfood,andthereuponthatofficershallhaveallthepowersofanauthorisedofficerunderthisAct,andthisActshallapplyasiftheofficerwasanauthorisedofficer.(4) TheanalystsandauthorisedofficersappointedunderthissectionshallbedeemedtobepublicservantswithinthemeaningofthePenalCode.Section4-Powe

23、rofAuthorisedOfficer(1) Anauthorisedofficermay,atanyhourreasonablefortheproperandbetterperformanceofhisduty-(a) enteranypremiseswherehebelievesanyfoodtowhichthisActappliesisprepared,preserved,packaged,stored,conveyed,distributedorsold,examineanysuchfoodandtakesamplesthereof,andexamineanythingthatheb

24、elievesisused,orcapableofbeingusedforsuchpreparation,preservation,packaging,storing,conveying,distributionorsale;(b) stop,searchordetainanyaircraft,shiporvehicleinwhichhebelievesonreasonablegroundsthatanyfoodtowhichthisActappliesisbeingconveyedandexamineanysuchfoodandtakesamplesthereofforthepurposes

25、ofthisAct;(c) openandexamineanypackagewhichhebelievescontainsanyfoodtowhichthisActapplies;(d) examineanybooks,documentsorotherrecordsfoundinanypremisesmentionedinparagraph(a)thathebelievescontainanyinformationrelevanttotheenforcementofthisActwithrespecttoanyfoodtowhichthisActappliesandmakecopiesther

26、eofortakeextractstherefrom;(e) demandtheproductionoftheNationalRegistrationIdentityCard,theBusinessRegistrationCertificateoranyotherrelevantdocumentwhichtheauthorisedofficermayrequire;(f) seizeanddetainforsuchtimeasmaybenecessaryanyfoodbymeansoforinrelationtowhichhebelievesanyprovisionofthisActhasbe

27、encontravened;or(g) mark,sealorotherwisesecure,weigh,countormeasureanyfoodorappliance,thepreparation,preservation,packaging,storage,conveyance,distributionorsaleofwhichisorappearstobecontrarytothisAct.(2) Anauthorisedofficeractingunderthissectionshall,ifsorequired,producehisCertificateofAuthorisatio

28、n.(3) Anyowner,occupierorpersoninchargeofanypremisesenteredbyanyauthorisedofficerpursuanttoparagraph(a)ofsubsection(1),oranypersonfoundtherein,whodoesnotgivetotheauthorisedofficerallreasonableassistanceinhispowerorfurnishhimwithalltheinformationashemayreasonablyrequire,commitsanoffenceandisliableonc

29、onvictiontoimprisonmentforatermnotexceedingoneyearortofineortoboth.(4) Anypersonwhoobstructsorimpedesanyauthorisedofficerinthecourseofhisdutyorpreventsorattemptstopreventtheexecutionbytheauthorisedofficerofhisdutycommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearortofin

30、eortoboth.(5) AnauthorisedofficermayarrestwithoutwarrantanypersonwhomhehasreasontobelievetohavecommittedanoffenceunderthisActoranyregulationmadethereunderifthepersonfailstofurnishhisnameandaddressortherearereasonablegroundsforbelievingthathehasfurnishedafalsenameoraddressorthatheislikelytoabscond:Pr

31、ovidedthatwhenanypersonhasbeenarrestedasaforesaidheshallthereafterbedealtwithasprovidedbytheCriminalProcedureCode.(6) Anypersonwhoknowinglymakesanyfalseormisleadingstatementeitherverballyorinwritingtoanyofficerengagedincarryingouthisdutycommitsanoffenceandisliableonconvictiontoimprisonmentforatermno

32、texceedingoneyearortofineortoboth.(7) AnauthorisedofficershallreleaseanyfoodseizedbyhimwhenheissatisfiedthatalltheprovisionsoftheActwithrespecttoithavebeencomplied.(8) Whereanauthorisedofficerhasseizedanyfoodandtheownerorthepersoninwhosepossessionthefoodwasatthetimeofseizureconsentsinwritingtoitsdes

33、truction,thefoodmaybedestroyedorotherwisedisposedofastheauthorisedofficermaydirectandiftheownerorthepersondoesnotconsenttothedestructionofthefood,theauthorisedofficermayapplytoacourtforthedestructionordisposalofthefoodandthecourtmaymakeanorderasitmaydeemfit,notwithstandingthattheownerorthepersonhasn

34、otbeenconvictedofanyoffenceinconnectionwiththefood.(9) Whereanauthorisedofficerhasseizedanyfoodwhichisperishableinnatureandtheownerorthepersoninwhosepossessionthefoodwasatthetimeofseizuredoesnotconsentinwritingtoitsdestruction,theresponsibilityfortheproperstorageofsuchfoodsoastopreventitfromdeterior

35、ation,spoilage,damageortheft,pendingjudgementbythecourt,lieswiththeownerorsuchperson.(10) Whereanyfoodhasbeenseizedanddetainedunderparagraph(f)ofsubsection(1)andtheownerthereofhasbeenconvictedofanoffencethefoodmaybedestroyedorotherwisedisposedofasthecourtmaydirect.(11) Notwithstandinganyotherprovisi

36、onsofthissectionanauthorisedofficermaydestroyanyfoodwhereverfoundwhichisdeclayed,putrefiedorinjurioustohealthorfoodtheimportationofwhichisprohibitedorfoodwhichissurrenderedbytheownerfordestructiononpaymentbyhimofreasonablecharges.(12) Anypersonwhoremoves,altersorinterferesinanywaywithanyfoodseizedor

37、sealedunderthisActwithouttheauthorityofanauthorisedofficercommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearorfineortoboth.(13) Anyfoodseizedmayattheoptionofanauthorisedofficerbekeptorstoredinthepremiseswhereitwasseizedormayatthedirectionofanauthorisedofficerberemovedto

38、anyotherproperplace.(14) Anauthorisedofficermaysubmitanyfoodseizedbyhimoranysamplefromitoranyothersampletakenbyhimtoanyapprovedlaboratoryforanalysisorexamination.(15) AnyauthorisedofficermayappearincourtandconductanyprosecutioninrespectofanyoffenceagainstthisAct.Section5-PowerToTakeSample(1) Onpayme

39、ntortendertoanypersonsellingfoodortohisagentorservant,ofthecurrentmarketvalueofthefood,anyauthorisedofficermayatanyplacedemandandselectandtakeorobtainsamplesofthefoodforthepurposeofanalysis.(2) Anauthorisedofficermayatanyplacedemandandselectandtakeorobtainsamplesforthepurposeofanalysiswithoutpayment

40、fromanymanufacturermakingfdforsaleorfromanyimporterofanyfoodorfromhisagentorservant.(3) Anysuchauthorisedofficermayrequirethepersonorhisagentorservanttoshowandpermittheinspectionofthepackageinwhichsuchfoodisatthetimekeptandtotaketherefromthesamplesdemanded.(4) Whereanyfoodiskeptforretailsaleinanunop

41、enedpackage,nopersonshallberequiredbyanyauthorisedofficertoselllessthanthewholeofthecontentsofsuchpackage.(5) Anypersonwhorefusesorneglectstocomplywithanydemandorrequisitionmadebyanauthorisedofficerinpursuanceofthissectioncommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneye

42、arortofineortoboth.Section6-ProcedureForTakingSample(1) Whereitisintendedtosubmitanysampleofanyfoodforanalysistheauthorizedofficerpurchasingorotherwiseprocuringthesampleshallinformthesellerorhisagentorservantsellingthefoodthatheintendstohavethesampleanalysedbyanyanalyst.(2) Theprocedurefortakingandd

43、ealingwiththesamplesshallbeasprescribedbyregulations.Section7-CertificateofAnalyst(1) Thecertificateoftheanalystshallbeintheformasprescribedbyregulations.(2) Whereanymethodofanalysishasbeenprescribedbyregulationsfortheanalysisofanyfood,theanalystshallfollow,andinhiscertificateofanalysisdeclarethathe

44、wasfollowed,theprescribedmethod.(3) Acopyoftheresultofanyanalysisofanyfoodprocuredbyauthorizedofficermaybeobtainedfromtheanalystbythepersonfromwhomthefoodsoanalysedwaspurchasedorobtainedonpaymentofsuchfeeasmaybeprescribed.(4) NocopyoftheresultofanyanalysismadeunderthisActoranyreproductionthereofshal

45、lbedisplayedorusedasanadvertisementandifanypersonsodisplaysorusessuchcopyorreproductionhecommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearortofineortoboth.Section8-PowerToCallForInformation(1) Ifanyauthorizedofficerisoftheopinionthatthereisreasonablegroundforsuspecting

46、thatanypersonisinpossessionofanyfoodorothersubstanceofanyapplianceforthepurposeoforinconnectionwiththepreparation,preservation,packaging,storage,conveyance,distributionorsaleoffoodinbreachofanyoftheprovisionsofthisActoranyregulationsmadethereunderhemayrequiresuchpersontoproduceforhisinspectionanyboo

47、k,documentsorotherrecordsoranyotherinformationrelatingtothereception,possession,purchase,saleordeliveryofsuchfoodorothersubstanceoranyappliance.(2) Anyauthorizedofficermentionedinsubsection(1)maymakeorcausetobemadecopiesoforextractsfromanysuchbook,documentsorrecords,oranyotherinformationandsuchcopie

48、sorextractscertifiedassuchbysuchauthorizedofficershall,unlessthecontraryisproved,bedeemedtobetrueandcorrectcopiesorextracts.(3) Anypersonwhorefusesorneglectstocomplywithanyrequisitionmadeinpursuanceofthissectioncommitsanoffenceandisliableonconvictiontoimprisonmentforatermnotexceedingoneyearortofineortoboth.(4) Anyauthorizedofficerwho-(a) doesnotmaintainthesecrecyofallmatterswhichcometohisknowledgeintheperformanceofhisofficialdutiesunderthissection;or(b) communicatesanysuchmattertoanypersonwhomsoeverforthepurposeofcarryingintoeffecttheprovisionsofthisAct,commitsanoffenceandisliableo
