6、tion,nuclearradiationorradioactivecontamination:c) wilfulactorwilfulnegligenceoftheInsuredorofhisrepresentatives;d) cessationofworkwhethertotalorpartial.Inanyaction,suitorotherproceedingwheretheInsurersallegethatbyreasonoftheprovisionsofExclusiona)aboveanyloss,destruction,damageorliabilityisnotcover

7、edbythisinsurancetheburdenofprovingthatsuchloss,destruction,damageorliabilityiscoveredshallbeupontheInsured.PeriOdofverTheliabilityoftheinsurersshallcommence,notwithstandinganydatetothecontraryspecifiedintheSchedule,directlyuponcommencementofworkoraftertheunloadingoftheitemsenteredintheScheduleatthe

ThedueobservanceandfulfilmentofthetermsofthisPolicyinsofarastheyrelatetoanythingtobedoneorcompliedwithbytheInsuredandthetruthofthestatementsandanswersinthequestionnaireandproposalmadebytheInsuredshal

11、lbeaconditionprecedenttoanyliabilityoftheInsurers.2. TheScheduleandtheSection(s)shallbedeemedtobeincorporatedinandformpartofthisPolicyandtheexpressionthisPolicywhereverusedinthiscontractshallbereadasincludingtheScheduleandtheSection(s).Anywordorexpressiontowhichaspecificmeaninghasbeenattachedinanypa

12、rtofthisPolicyoroftheScheduleoroftheSection(s)shallbearsuchmeaningwhereveritmayappear.3. TheInsuredshallathisownexpensetakeallreasonableprecautionsandcomplywithallreasonablerecommendationsoftheInsurerstopreventloss,damageorliabilityandcomplywithstatutoryrequirementsandmanufacturersrecommendations.4.

13、 a)RepresentativesoftheInsurersshallatanyreasonabletimehavetherighttoinspectandexaminetheriskandtheInsuredshallprovidetherepresentativesoftheInsurerswithalldetailsandinformationnecessaryfortheassessmentoftherisk.b)TheInsuredshallimmediatelynotifytheInsurersbytelegramandinwritingofanymaterialchangein

14、theriskandcauseathisownexpensesuchadditionalprecautionstobetakenascircumstancesmayrequire,andthescopeofcoverand/orpremiumshall,ifnecessary,beadjustedaccordingly.NomaterialalterationshallbemadeoradmittedbytheInsuredwherebytheriskisincreased,unlessthecontinuanceoftheinsuranceisnfirmedinwritingbytheins

15、urers.5.IntheeventofanyoccurrencewhichmightgiverisetoaclaimunderthisPolicy,theInsuredshalla) immediatelynotifytheInsurersbytelephoneortelegramaswellasinwriting,givinganindicationastothenatureandextentoflossordamage:b) takeallstepswithinhispowertominimizetheextentofthelossordamage;c) preservetheparts

16、affectedandmakethemavailableforinspectionbyarepresentativeorsurveyoroftheinsurers;d) furnishallsuchinformationanddocumentaryevidenceastheInsurersmayrequire;e)informthepoliceauthoritiesincaseoflossordamageduetotheftorburglary.m4Alalliance-SegurosTheInsurersshallnotinanycasebeliableforloss,damageorlia

17、bilityofwhichnonoticehasbeenreceivedbytheInsurerswithin14daysofitsoccurrence.UponnotificationbeinggiventotheInsurersunderthiscondition,theInsuredmaycarryouttherepairsorreplacementofanyminordamage;inallothercasesarepresentativeoftheInsurersshallhavetheopportunityofinspectingthetossordamagebeforeanyre

18、pairsoralterationsareeffected.IfarepresentativeoftheInsurersdoesnotcarryouttheinspectionwithinaperiodoftimewhichcouldbeconsideredadequateunderthecircumstances,theInsuredisentitledtoproceedwiththerepairsorreplacement.TheliabilityoftheInsurersunderthisPolicyinrespectofanyitemsustainingdamageshallcease

19、ifsaiditemisnotrepairedproperlywithoutdelay.6. TheInsuredshallattheexpenseoftheInsurersdoandconcurindoingandpermittobedoneallsuchactsandthingsasmaybenecessaryorrequiredbytheInsurersintheinterestofanyrightsorremedies,orofobtainingrelieforindemnityfromparties(otherthanthoseinsuredunderthisPolicy)towhi

20、chtheinsurersareorwouldbecomeentitledorwhichisorwouldbesubrogatedtothemupontheirpayingforormakinggoodanylossordamageunderthisPolicy,whethersuchactsandthingsareorbecomenecessaryorrequiredbeforeoraftertheInsuredsindemnificationbytheInsurers.7. IfanydifferencearisesastotheamounttobepaidunderthisPolicy(

21、liabilitybeingotherwiseadmitted),suchdifferenceshallbereferredtothedecisionofanarbitratortobeappointedinwritingbythepartiesindifferenceor,iftheycannotagreeuponasinglearbitrator,tothedecisionoftwoarbitrators,onetobeappointedinwritingbyeachofthepartieswithinonecalendarmonthafterhavingbeenrequiredinwri

22、tingsotodobyeitheroftheparties,or,incasethearbitratorsdonotagree,ofanumpiretobeappointedinwritingbythearbitratorsbeforethelatterenteruponthereference.Theumpireshallsitwiththearbitratorsandpresideattheirmeetings.ThemakingofanawardshallbeaconditionprecedenttoanyrightofactionagainsttheInsurers.8. Ifacl

23、aimisinanyrespectfraudulent,orifanyfalsedeclarationismadeorusedinsupportthereof,orifanyfraudulentmeansordevicesareusedbytheInsuredoranyoneactingonhisbehalftoobtainanybenefitunderthisPolicy,orifaclaimismadeandrejectedandnoactionorsuitiscommencedwithinthreemonthsaftersuchrejectionor,inthecaseofarbitra

24、tiontakingplaceasprovidedherein,withinthreemonthsafterthearbitratororarbitratorsorumpirehavemadetheiraward,allbenefitunderthisPolicyshallbeforfeited.9. IfatthetimeanyclaimarisesunderthePolicythereisanyotherinsurancecoveringthesameloss,damageorliability,theInsurersshallnotbeliabletopayorcontributemor

25、ethantheirrateableproportionofanyclaimforsuchloss,damageorliability.Section1-MaterialdamageTheInsurersherebyagreewiththeInsuredthatifatanytimeduringtheperiodofcovertheitemsoranypartthereofenteredintheScheduleshallsufferanyunforeseenandsuddenphysicallossordamagefromanycause,otherthanthosespecifically

26、excluded,inamannernecessitatingrepairorreplacement,theInsurerswillindemnifytheInsuredinrespectofsuchlossordamageashereinafterprovidedbypaymentincash,replacementorrepair(attheirownoption)uptoanamountnotexceedinginrespectofeachoftheitemsspecifiedintheSchedulethesumsetoppositetheretoandnotexceedinginan

27、yoneeventthelimitofindemnitywhereapplicableandnotexceedinginallthetotalsumexpressedintheScheduleasinsuredhereby.SpecialexclusionstoSection1TheInsurerswillalsoreimbursetheInsuredforthecostofclearanceofdebrisfollowinguponanyeventgivingrisetoaclaimunderthisPolicyprovidedaseparatesumthereforhasbeenenter

28、edintheSchedule.TheInsurersshallnot,however,beliablefora) thedeductiblestatedintheScheduletobebornebytheInsuredinanyoneoccurrence;b) consequentiallossofanykindordescriptionwhatsoeverincludingpenalties,lossesduetodelay,lackofperformance,lossofcontract:c) lossordamageduetofaultydesign;d) thecostofrepl

29、acement,repairorrectificationofdefectivematerialand/orworkmanship,butthisexclusionshallbelimitedtotheitemsimmediatelyaffectedandshallnotbedeemedtoexcludelossofordamagetocorrectlyexecuteditemsresultingfromanaccidentduetosuchdefectivematerialand/orworkmanship：e) wearandtear,corrosion,oxidation,deterio

30、rationduetolackofuseandnormalatmosphericconditions:f) lossordamagetoconstructionplant,equipmentandconstructionmachineryduetoelectricalormechanicalbreakdown,failure,breakageorderangement,freezingofcoolantorotherfluid,defectivelubricationorlackofoilorcoolant,butifasaconsequenceofsuchbreakdownorderange

31、mentanaccidentoccurscausingexternaldamage,suchconsequentialdamageshallbeindemnifiable:g) lossofordamagetovehicleslicensedforgeneralroaduseorwaterbornevesselsoraircraft:h) lossofordamagetofiles,drawings,accounts,bills,currency,stamps,deeds,evidencesofdebt,notes,securities,cheques;i) lossordamagedisco

32、veredonlyatthetimeoftakinganinventory.(ILOBAILIANCE-segurosProvisionsapplyingMemo1-SumsinsuredtoSection1ItisarequirementofthisinsurancethatthesumsinsuredstatedintheScheduleshallnotbelessthanforitem1:thefullvalueofthecontractworksatthecompletionoftheconstruction,inclusiveofallmaterials,wages,freight,

33、customsduties,dues,andmaterialsoritemssuppliedbythePrincipal：foritems2and3:thereplacementvalueofconstructionplant,equipmentandmachinery;whichshallmeanthecostofreplacementoftheinsureditemsbynewitemsofthesamekindandcapacity:andtheinsuredundertakestoincreaseordecreasetheamountsofinsuranceintheeventofan

34、ymaterialfluctuationinwagesorpricesprovidedalwaysthatsuchincreaseordecreaseshalltakeeffectonlyafterthesamehasbeenrecordedinthePolicybytheInsurers.If,intheeventoflossordamage,itisfoundthatthesumsinsuredarelessthantheamountsrequiredtobeinsured,thentheamountreverablebytheInsuredunderthisPolicyshallbere

35、ducedinsuchproportionasthesumsinsuredbeartotheamountsrequiredtobeinsured.Everyobjectandcostitemissubjecttothisconditionseparately.Memo2-BasisoflosssettlementIntheeventofanylossordamagethebasisofanysettlementunderthisPolicyshallbea)inthecaseofdamagewhichcanberepaired-thestofrepairsnecessarytorestoret

36、heitemstotheirconditionimmediatelybeforetheoccurrenceofthedamagelesssalvage,orb)inthecaseofatotalloss-theactualvalueoftheitemsimmediatelybeforetheoccurrenceofthelosslesssalvage,however,onlytotheextentthestsclaimedhadtobebornebytheInsuredandtotheextenttheyareincludedinthesumsinsuredandprovidedalwayst

37、hattheprovisionsandconditionshavebeencompliedwith.Theinsurerswillmakepaymentsonlyafterbeingsatisfiedbyproductionofthenecessarybillsanddocumentsthattherepairshavebeeneffectedorreplacementhastakenplace,asthecasemaybe.Alldamagewhichcanberepairedshallberepaired,butifthecostofrepairinganydamageequalsorex

38、ceedsthevalueoftheitemsimmediatelybeforetheoccurrenceofthedamage,thesettlementshallbemadeonthebasisprovidedforinb)above.ThecostofanyprovisionalrepairswillbebornebytheInsurersifsuchrepairsconstitutepartofthefinalrepairsanddonotincreasethetotalrepairexpenses.Thecostofanyalterations,additionsand/orimpr

39、ovementsshallnotberecoverableunderthisPolicy.Memo3-ExtensionofverExtrachargesforovertime,nightwork,workonpublicholidays,expressfreightarecoveredbythisinsuranceonlyifpreviouslyandspeciallyagreeduponinwriting.Section2-ThirdpartyliabilityTheInsurerswillindemnifytheInsureduptobutnotexceedingtheamountssp

40、ecifiedintheScheduleagainstsuchsumswhichtheInsuredshallbecomelegallyliabletopayasdamagesconsequentupona)accidentalbodilyinjurytoorillnessofthirdparties(whetherfatalornot).b)accidentallossofordamagetopropertybelongingtothirdpartiesoccurringindirectnnectionwiththenstructionorerectionoftheitemsinsuredu

41、nderSection1andhappeningonorintheimmediatevicinityofthesiteduringtheperiodofcover.Inrespectofaclaimforcompensationtowhichtheindemnityprovidedhereinapplies,theInsurerswillinadditionindemnifytheInsuredagainsta) allcostsandexpensesoflitigationrecoveredbyanyclaimantfromtheInsured,andb) allcostsandexpens

42、esincurredwiththewrittennsentoftheInsurers,providedalwaysthattheliabilityoftheInsurersunderthisSectionshallnotexceedthelimitsofindemnitystatedintheSchedule.SpecialexclusionstoSection2TheInsurerswillnotindemnifytheInsuredinrespectof1. thedeductiblestatedintheScheduletobebornebytheInsuredinanyoneoccur
