4、ityontheFireFightingand上海市社会消防组织管理规定(PromulgatedbyDecreeNo.2ofShanghaiMunicipalPeoplesGovernmentonFebruary20,2023andtobeeffectiveasofMay1,2023)（2023年2月20日上海市人民政府令第2号公布自2023年5月1日起施行）ChapterIGeneralProvisionsArticle 1 (PurposesandBasis)第一章总则第一条（目的和依据）为了加强本市社会消防组织的建 设和管理，提高预防、扑救火灾 和应急救援能力，保护人身、财 产安全，维护

5、公共安全，根据 中华人民共和国消防法上 海市消防条例等法律、法规， 结合本市实际，制定本规定。WithaviewtostrengtheningtheconstructionandadministrationofthesocialfirefightingandpreventionorganizationsinthisMunicipality,raisingtheabilityoffireprevention,firefightingandemergencyresponseandrescue,protectingpersonalandpropertysafety,andmaintainingpub

6、licsecurity,theseProvisionsareformulatedaccordingtotheFireFightingandPreventionLawofthePeoplesRepublicofChina,theRegulationsofShanghaiMunicipalityonFireFightingandPreventionandotherrelevantlaws,rulesandregulations,andinthelightoftheactualcircumstancesofthisMunicipality.第二条（定义）Article 2 (Definitions)

7、本规定所称社会消防组织，是指 除国家综合性消防救援队以外的 其他承担火灾预防、扑救和应急 救援工作的消防组织，包括基层 消防安全组织、专职消防队和志 愿消防队。ThetermusocialfirefightingandpreventionOrganizationsnasmentionedintheseProvisionsreferstothefirefightingandpreventionorganizationsthatundertakefireprevention,firefightingandemergencyresponseandrescueincludingthegrass-roo

8、tsfiresafetyorganizations,professionalfirefightingteamsandvoluntaryfirefightingteamsotherthanthenationalintegratedfireandrescuebrigades.基层消防安全组织是指乡镇人民 政府、街道办事处建立的具体承 担辖区内消防安全管理职责的消 防工作队伍。Thegrass-rootsfiresafetyorganizationsrefertothefirefightingandpreventionteamsestablishedbytown/townshippeople,sgo

9、vernmentsandsub-districtofficestoundertaketheresponsibilitiesoffiresafetyadministrationwithintheirrespectivejurisdictions.专职消防队包括政府专职消防队 和单位专职消防队。政府专职消 防队是指各级人民政府建立的主 要承担火灾扑救和应急救援工作 的消防组织。单位专职消防队是 指由企业、事业单位建立的主要 承担本单位火灾扑救和应急救援 工作的消防组织。Theprofessionalfirefightingteamincludesthegovernmentprofessionalf

10、irefightingteamandtheunitprofessionalfirefightingteam.Thegovernmentprofessionalfirefightingteamreferstothefirefightingorganizationestablishedbythepeoplesgovernmentsatalllevels,whichprofessionallyundertakesthefirefightingandemergencyresponseandrescuework.Theunitprofessionalfirefightingteamreferstothe

11、firefightingorganizationestablishedbyenterprisesandpublicinstitutions,whichprofessionallyundertakesthefirefightingandemergencyresponseandrescueworkoftheunit.志愿消防队包括微型消防站和其 他志愿消防组织。微型消防站是 指由机关、团体、企业、事业等 单位和居（村）民委员会建立的 承担火灾预防、初起火灾扑救等 群众性自防自救工作的消防组 织。其他志愿消防组织是指为社 会和他人无偿提供消防志愿服务 的组织。Thevoluntaryfirefigh

12、tingteamincludestheminifirestationsandothervolunteerfirefightingorganizations.Themini-firestationreferstoafirefightingorganizationestablishedbygovernmentorgans,socialgroups,enterprises,publicinstitutionsandneighborhood(V川agers)committeestoundertakemassself-preventionandself-rescueworksuchasfirepreve

13、ntionandinitialfirefighting.Othervoluntaryfirefightingorganizationsrefertotheorganizationsthatprovidevoluntaryfirefightingandpreventionservicesforthesocietyandothersfreeofcharge.第三条（适用范围）Article 3 (ApplicationScope)本市行政区域内社会消防组织的 组织建设、训练与执勤、管理与 保障等，适用本规定。TheseProvisionsshallapplytotheorganizationand

14、construction,traininganddutyexecution,administrationandsupplyguaranteeofsocialfirefightingandpreventionorganizationswithintheadministrativeareaofthisMunicipality.第四条（基本原贝DArticle 4 (BasicPrinciples)本市社会消防组织的建设和管理 工作，遵循政府主导、社会参 与、联勤联防、自防自救的原 则。Theconstructionandadministrationofsocialfirefightingandpr

15、eventionorganizationsinthisMunicipalityshallfollowtheprinciplesofgovernmentleading,socialparticipation,jointexecutionandjointprevention,andselfpreventionandself-rescue.第五条（规划与建设）Article 5 (PlanningandConstruction)市、区人民政府应当将社会消防 组织建设纳入消防工作专项规 划，明确建设目标任务，加强社 会消防组织的人员队伍、基础设 施和消防装备建设。Themunicipalanddist

16、rictpeoplesgovernmentsshallincorporatetheconstructionofsocialfirefightingandpreventionorganizationsintothespecialplanningoffirefightingandpreventionwork,clarifytheconstructionobjectivesandtasks,andstrengthentheconstructionofpersonnelteam,infrastructureandfirefightingequipmentofsocialfirefightingandp

17、reventionorganizations.第六条（部门职责）Article 6 (ResponsibilitiesofDepartments)市、区消防救援机构对本行政区 域内社会消防组织的建设和管理 实施指导和监督。Themunicipalanddistrictfirefightingandrescueorgansshallguideandsupervisetheconstructionandadministrationofsocialfirefightingandpreventionorganizationswithintheirrespectiveadministrativearea

18、s.发展改革、财政、应急管理、规划资源、住房城乡建设管理、房Thedevelopment&reform,finance,emergencymanagement,planningandresources,housingandurban-ruraldevelopment,housing屋管理、人力资源社会保障、公 安、交通、民政等部门按照各自 职责，做好社会消防组织建设和 管理相关工作。administration,humanresourcesandsocialsecurity,publicsecurity,transportation,civilaffairsandotherdepartment

19、sshall,accordingtotheirownrespectivefunctionsandduties,doagoodjobintheconstructionandadministrationofsocialfirefightingandpreventionorganizations.第七条（经费保障）Article 7 (FundingGuarantee)基层消防安全组织和政府专职消 防队所需经费，纳入同级财政预 算，并由财政部门结合具体情况 统筹安排。Thefundsrequiredbygrass-rootsfiresafetyorganizationsandgovernmentpr

20、ofessionalfirefightingteamsshallbeincludedinthefinancialbudgetatthesamelevel,andthefinancialdepartmentshallmakeoverallarrangementsinlightofspecificcircumstances.The funds required by the unit professional firefighting team and the voluntary firefighting team shall be guaranteed by the establisher un

21、it.Units and individuals shall be encouraged to donate to the construction of social fire fighting and prevention organizations.Chapter Il Organizational ConstructionArticle 8 (Requirements for Construction of Grass-roots Fire Safety Organizations)单位专职消防队、志愿消防队所 需经费，由组建单位保障。鼓励单位和个人捐助社会消防组 织建设。第二章组织建

22、设第八条 （基层消防安全组 织建设要求）乡镇人民政府、街道办事处应当 按照国家和本市有关规定，建立 基层消防安全组织，明确工作机 构和专门人员具体承担消防安全 管理职责，并配备办公场所和消 防安全检查、宣传所需装备。Thetown/townshippeople,sgovernmentsandsub-districtofficesshall,accordingtotherelevantprovisionsoftheStateandthisMunicipality,establishgrass-rootsfiresafetyorganizations,clarifytheworkingorgans

23、andspecializedpersonneltoundertakethespecificfunctionanddutyoffiresafetyadministration,andprovidethemwithofficesandequipmentrequiredforfiresafetyinspectionandpublicity.Article 9 (FunctionsandDutiesofGrass-rootsFireSafetyOrganizations)Thegrass-rootsfiresafetyorganizationsshallcarryoutthefollowingwork

24、undertheleadershipoftown/townshippeoplesgovernmentsandsubdistrictoffices,andtheprofessionalguidanceofdistrictfirefightingandrescueorgans:1. implementingtheresponsibilitysystemforfirefightingandsafety,formulatingtheannualfirefightingandpreventionplan,regularlyanalyzingandjudgingthefirefightingandsafe

25、tysituation,anddeployingandpromotingthespecialtreatmentoffirefightingandsafety;2. guidingtheprofessionalfirefightingteamofthetown/townshippeoplesgovernmenttocarryoutfirefightingandsafetywork;3. guidingtheneighborhood(villagers)committeestocarryoutmassfirefightingandpreventionwork;4. organizingandcar

26、ryingoutfirepreventionandsafetyinspectionandpatrol,incorporatingitintothegridmanagement,andurgingtherectificationoffirehazards;5. organizingfirefightingandpreventionpublicityandeducation,andfiredrills;第九条（基层消防安全组 织工作职责）基层消防安全组织在乡镇人民政 府、街道办事处的领导和区消防 救援机构的专业指导下，开展下 列工作：（一）落实消防安全责任制，制 定年度消防工作计划，定期分析 研判

27、消防安全形势，部署推进消 防安全专项治理；（二）指导乡镇政府专职消防队 开展消防安全工作；（三）指导居（村）民委员会开 展群众性消防工作；（四）组织开展防火安全检查、 巡查，纳入网格化管理，督促火 灾隐患的整改；（五）组织开展消防宣传教育和 消防演练；（六）协助开展火灾现场保护和 善后处理；6. assistinginthefiresceneprotectionanditsaftercare;and（七）国家和本市规定的其他工 作。（政府专职消防队7. otherworkstipulatedbytheStateandthisMunicipality.Article 10 (Establishm

28、entofGovernment第十条ProfessionalFirefightingTeam)的建立)市、区人民政府依照国家有关规 定和消防规划，建立政府专职消 防队。Themunicipalanddistrictpeoplesgovernmentsshall,accordingtotherelevantprovisionsoftheStateandthefirefightingandpreventionplanning,establishgovernmentprofessionalfirefightingteams.乡镇人民政府应当根据经济社会 发展和消防工作的需要，建立政 府专职消防队。有

29、下列情形之一 的乡镇，应当建立政府专职消防 队：Thetowntowshippeoplesgovernmentsshall,accordingtotheneedsofeconomicandsocialdevelopmentandfirefightingandpreventionwork,establishgovernmentprofessionalfirefightingteams.Inanyofthefollowingcircumstances,thetown/townshipshallestablishagovernmentprofessionalfirefightingteam:（一）建

30、成区面积超过5平方公 里或者居住人口 5万人以上，且 国家综合性消防救援队或者市、 区政府专职消防队到达辖区边缘 距离较远的；1. Thebuilt-upareaismorethanfivesquarekilometersortheresidentpopulationismorethan50,000,andthenationalintegratedfireandrescuebrigadeortheprofessionalfirefightingteamofthemunicipalordistrictpeople,sgovernmentisfartherawayfromtheedgeofthej

31、urisdiction;（二）易燃易爆危险品生产、经 营单位和劳动密集型企业集中 的；2. Theproductionandbusinessunitsofinflammableandexplosivedangerousgoodsandlabor-intensiveenterprisesareconcentrated;or（三）属于全国重点镇、历史文 化名镇的。3. Belongingtonationalkeytownsorfamoushistoricalandculturaltowns.第十一条（单位专职消防队的建立）Article 11 (EstablishmentofUnitProfess

32、ionalFirefightingTeam)下列单位应当建立单位专职消防 队：Thefollowingunitsshallestablishaunitprofessionalfirefightingteam:（一）大型火力发电厂、民用机 场、港口、易燃易爆危险物品装 卸专业码头、大型修造船厂、城 市轨道交通综合维修基地；1. largethermalpowerplants,civilairports,ports,specializeddocksforloadingandunloadinginflammableandexplosivedangerousgoods,largeshipyards,a

33、ndcomprehensivemaintenancebasesforurbanrailtransit;（二）生产、储存易燃易爆危险 物品的大型企业；2. largeenterprisesthatproduceandstoreinflammableandexplosivedangerousgoods;（三）储备可燃的重要物资的大 型仓库、基地；3. largewarehousesandbasesforstoringcombustibleimportantmaterials;and（四）其他火灾危险性较大且与 最近的国家综合性消防救援队或 者市、区政府专职消防队相距超 过5公里的物流企业（占地面积

34、 20万平方米以上）、生产企业（占地面积50万平方米以 上）、城市综合体和展览建筑（建筑面积50万平方米以上） 等大型企业。4. otherlarge-scaleenterprises,suchaslogisticsenterprises(coveringanareaofover200,000squaremeters),productionenterprises(coveringanareaofover500,000squaremeters),urbancomplexesandexhibitionbuildings(withafloorareaofover500,000squaremeters

35、),whichhavegreaterfireriskandaremorethanfivekilometersawayfromthenearestnationalintegratedfireandrescuebrigadeorprofessionalfirefightingteamofthemunicipalordistrictpeoplesgovernment.前款规定单位的具体范围，由市 消防救援机构确定并向社会公 布。（专职消防队的ThespecificscopeoftheunitsspecifiedintheprecedingParagraphshallbedeterminedbythe

36、municipalfirefightingandrescueorganandannouncedtothesociety.第十二条建设要求）Article 12 (RequirementsfortheConstructionofProfessionalFirefightingTeam)专职消防队的组建单位应当将队 站的布局选址和新建、改建、扩 建、迁建等筹建方案报市消防救 援机构，接受其技术指导后实 施。Theestablisherunitofprofessionalfirefightingteamshallreportthelayoutandsiteselectionoftheteamstat

37、ionandthepreparationplansfornewconstruction,renovation,expansionandrelocationtothemunicipalfirefightingandrescueorgan,andtheimplementationshallbestarteduponthelatterstechnicalguidance.专职消防队的组建单位应当按照 国家和本市有关专职消防队的建 设标准，建造消防业务用房，配 备人员、消防车辆、器材装备 等。Theestablisherunitofprofessionalfirefightingteamshall,a

38、ccordingtotheconstructionstandardsoftheStateandthisMunicipalityonprofessionalfirefightingteams,buildfirefightingandpreventionbusinesspremises,andprovideitwithpersonnel,fire-fightingvehicles,equipment,etc.专职消防队投入执勤前，组建单 位应当报市消防救援机构对业务 用房、车辆装备、人员配备、执 勤管理制度等进行验收。（专职消防队的Beforetheprofessionalfirefighting

39、teamisputintoduty,theestablisherunitshallreporttothemunicipalfirefightingandrescueorganforanacceptancecheckofthebusinesspremises,vehicleequipment,staffinganddutymanagementsystem.第十三条变更和撤销）Article 13 (AlterationandCancellationofProfessionalFirefightingTeam)专职消防队业务用房、消防车 辆、人员配备的变更，以及专职 消防队队长的任免，应当报市消

40、防救援机构备案。Thealterationofthebusinesspremises,firefightingvehiclesandstaffingofprofessionalfirefightingteams,andtheappointmentanddismissalofprofessionalfirefightingteamcaptains,shallbereportedtothemunicipalfirefightingandrescueorganfortherecord.未经市消防救援机构同意，不得 撤销专职消防队。Withouttheconsentofthemunicipalfire

41、fightingandrescueorgan,theprofessionalfirefightingteamcannotbedismissed.Article 14 (FunctionsandDutiesofProfessionalFirefightingTeam)第十四条（专职消防队工 作职责）Theprofessionalfirefightingteamsshallundertakethefollowingfunctionsandduties:专职消防队承担下列工作职责:1. beingfamiliarwiththebasicsituationoffiresafetyintheirownd

42、utyarea,suchasroads,watersources,keypartsandfixedfirefightingandpreventionfacilities,andundertakingfirefightingandemergencyresponseandrescuework;（一）熟悉掌握责任区域道路、 水源、重点部位和固定消防设施 等消防安全基本情况，承担灭火 与应急救援工作；（二）制定完善责任区域灭火救 援预案，定期组织业务训练和消 防演练；3. accepting the deployment of fire fighting and rescue organs to ca

43、rry out fire fighting and emergency response and rescue;4. carrying out the fire prevention inspection, fire fighting and prevention publicity and education and business training; and5. other work stipulated by the State and this Municipality.（三）接受消防救援机构调派, 开展灭火与应急救援；（四）开展防火巡查、消防宣传 教育和业务培训；（五）国家和本市规

44、定的其他工 作。2. formulatingandperfectingthefirefightingandrescueplaninthedutyarea,andorganizingregularbusinesstrainingandfirefightingdrills;第十五条 （专职消防队的 管理）市、区人民政府建立的政府专职 消防队，由同级消防救援机构负 责具体实施管理。Article 15 (AdministrationofProfessionalFirefightingTeam)Thespecificadministrationofthegovernmentprofessionalfi

45、refightingteamsestablishedbythemunicipalanddistrictpeoplesgovernmentsshallbeexercisedbythefirefightingandrescueorgansatthesamelevel.Theprofessionalfirefightingteamofthetown/townshippeoplesgovernmentandtheunitprofessionalfirefightingteamshallbeadministeredbytheestablisherunit.Article 16 (Establishmen

46、tofUnitMini-FireStation)OtherkeyfiresafetyunitsoutsidethescopeofunitslistedinArticle11oftheseProvisionsshallsetupaunitmini-firestation.Otherunitsshallbeencouragedtosetupaunitmini-firestationaccordingtotheneedsoffirefightingandpreventionwork.乡镇政府专职消防队和单位专职 消防队，由组建单位实施管理。第十六条 （单位微型消防 站的设立）本规定第十一条所列单位范

47、围以 外的其他消防安全重点单位，应 当设立单位微型消防站。鼓励其他单位根据消防工作需 要，设立单位微型消防站。Article 17 (EstablishmentofCommunityMini-第十七条FireStation)站的设立)（社区微型消防Thetown/townshippeople,sgovernmentsandsub-districtofficesshallpromotetheestablishmentofcommunitymini-firestationsinadministrativeV川agesandresidentialcommunities,andguaranteethe

48、fundsforfirefightingandpreventionwork.Theadministrativevillageswithsimilarlocations,asmallscaleandapermanentpopulationoflessthan1,000people,orseveralresidentialcommunitiessharingafirecontrolroom,mayjointlyestablishacommunitymini-firestation.乡镇人民政府、街道办事处应当 推动在行政村、住宅小区内设立 社区微型消防站，并保障消防工 作经费。位置相近、规模较小、常住人口 IOOo人以下的行政村，或者共用 消防控制室的多个住宅小区，可 以合并建立社区微型消防站。第十八条立要求）（微型消防站设Article 18 (Requ
