7、trengtheningsupervisionandregulationofconstructionactivities,maintainingconstructionmarketorder,ensuringthequalityandsafetyofconstructionprojectsandpromotingthehealthydevelopmentofconstructionindustry,thislawisherebyformulated.第一条为了加强对建筑活动的监督管理,维护建筑市场秩序,保证建筑工程的质量和安全,促进建筑业健康发展,制定本法。Article2Constructi
8、onactivitiesandsupervisionofconstructionactivitiesconductedwithintheterritoryofthePeoplesRepublicofChinashallabidebythislaw.第二条在中华人民共和国境内从事建筑活动,实施对建筑活动的监督管理,应当遵守本法。Theterm“constructionactivitiesasmentionedinthisLawshallrefertotheconstructionofallkindsofhousesandbuildingsandtheancillaryfacilitiesther
9、eofandtheinstallationoftheirsupportinglines,pipesandequipment.本法所称建筑活动,是指各类房屋建筑及其附属设施的建造和与其配套的线路、管道、设备的安装活动。Article3ConstructionactivitieshavetoguaranteethequalityandsafetyofconstructionprojectsandcomplywiththeStatessafetystandardsforconstructionprojects.Article4TheStateassiststhedevelopmentofconstr
10、uctionindustry,supportsresearchonconstructionscienceandtechnologyinordertoraisethelevelofhousingandconstructiondesign,encouragessavingofenergyandenvironmentalprotectionandadvocatestheadoptionofadvancedtechnology,advancedequipment,advancedprocess,newbuildingmaterialsandmodernmanagerialmethods.第三条建筑活动
11、应当确保建筑工程质量和安全,符合国家的建筑工程安全标准。第四条国家扶持建筑业的发展,支持建筑科学技术研究,提高房屋建筑设计水平,鼓励节约能源和保护环境,提倡采用先进技术、先进设备、先进工艺、新型建筑材料和现代管理方式。第五条从事建筑活动应 当遵守法律、法规,不得损害 社会公共利益和他人的合法权 益。Article 5 Conductofconstructionactivitiesshallobservelawsandregulationsandshouldinnowayunderminesocialandpublicinterestsaswellasthelegitimateinterests
12、ofothers.任何单位和个人都不得妨碍和 阻挠依法进行的建筑活动。Nounitorindividualshallimpedeorobstructtheconstructionactivitiesconductedaccordingtolaw.第六条国务院建设行政 主管部门对全国的建筑活动实 施统一监督管理。第二章建筑许可Article 6 ThecompetentconstructionadministrativedepartmentundertheStateCouncilshallexerciseunifiedsupervisionandregulationoverconstructio
13、nactivitiesofthewholecountry.CHAPTERIlCONSTRUCTIONLICENSING第一节建筑工程施工许可SECTIONIWORKINGLICENSESFORCONSTRUCTIONPROJECTS第七条建筑工程开工 前,建设单位应当按照国家有 关规定向工程所在地县级以上 人民政府建设行政主管部门申 请领取施工许可证;但是,国 务院建设行政主管部门确定的 限额以下的小型工程除外。Article 7 Beforethestartofconstructionprojects,constructionunitsshall,inaccordancewiththerel
14、evantprovisionsoftheState,applytothecompetentconstructionadministrativedepartmentsundertheprefecture-countygovernmentsoraboveforconstructionlicenses,exceptforsmallprojectsbelowthethresholdvaluesetbythecompetentconstructionadministrativedepartmentundertheStateCouncil.按照国务院规定的权限和程序 批准开工报告的建筑工程,不 再领取施工
15、许可证。ConstructionprojectswhichhaveobtainedapprovalofworkstartreportsinaccordancewiththepowerlimitsandprocedurestipulatedbytheStateCouncilarenolongerrequiredtoapplyforconstructionlicenses.第八条申请领取施工许 可证,应当具备下列条件:Article 8 Toapplyforaconstructionlicense,thefollowingconditionsshallbemet:(1)Thelanduseappr
16、ovalformalitiesfortheconstructionprojecthavebeengonethrough;(一)已经办理该建筑工程用地批准手续;(2)Aconstructionprojectplanninglicenseisheldifthelawsorequires;(二)依法应当办理建设工程规划许可证的,已经取得建设工程规划许可证;(3) Ifdismantlementisrequired,theprogressofdismantlementshallcomplywithconstructionrequirements;(4) Aconstructioncontractorh
17、asbeendesignated;(5) Fundingarrangements,constructiondrawingsandtechnicalinformationasneededforconstructionareinplace;(6) (6)Specificmeasurestoensurequalityandsafetyoftheprojectareinplace.Theconstructionadministrativeauthoritiesshallissueaconstructionlicensewithinsevendaysfromthedateofreceiptofanapp
18、licationifitmeetstheconditions.(三)需要拆迁的,其拆迁进度符合施工要求;(四)已经确定建筑施工企业;(五)有满足施工需要的资金安排、施工图纸及技术资料;(六)有保证工程质量和安全的具体措施。建设行政主管部门应当自收到申请之日起七日内,对符合条件的申请颁发施工许可证。Article9Unitsinchargeofconstructionshouldstarttobuildtheprojectswithinthreemonthssinceobtainingconstructionlicenses.Ifworkcannotstartonschedule,applica
19、tionsshouldbefiledtothelicenseissuingagenciesfordelay,whichshallonlybepermittedtwiceinmaximumforeachcase,eachpermissionofdelaycoveringamaximumperiodofthreemonths.Incasesofthoseprojectsthatneitherstartonschedulenorapplyfordelayorexceedtheperiodofpermitted第九条建设单位应当自领取施工许可证之日起三个月内开工。因故不能按期开工的,应当向发证机关申请
20、延期;延期以两次为限,每次不超过三个月。既不开工又不申请延期或者超过延期时限的,施工许可证自行废止。delay,thevalidityoftheworkinglicensesautomaticallyexpires.第十条在建的建筑工程 因故中止施工的,建设单位应 当自中止施工之日起一个月 内,向发证机关报告,并按照 规定做好建筑工程的维护管理 工作。Article10Forprojectsunderconstructionthatcometoahaltduetosomereasons,theconstructingunitsshouldreporttothelicenseissuingage
21、ncieswithinonemonthfromthestoppageofconstructionandshouldalsowellmaintainandmanagetheconstructionprojectsinaccordancewithprovisions.建筑工程恢复施工时,应当向 发证机关报告;中止施工满一 年的工程恢复施工前,建设单 位应当报发证机关核验施工许 可证。Whenconstructionworkresumes,reportsshouldbefiledwiththelicenseissuingagencies;Beforetheresumptionofworkoncons
22、tructionprojectswhichhavestoppedforoveroneyear,unitsinchargeofconstructionshallapplytothelicenseissuingagenciesforverificationoftheirworkinglicenses.第十一条按照国务院有 关规定批准开工报告的建筑工 程,因故不能按期开工或者中 止施工的,应当及时向批准机 关报告情况。因故不能按期开 工超过六个月的,应当重新办 理开工报告的批准手续。Article11Forconstructionprojectswithapprovalofwork-startrep
23、ortsinlightoftherelevantprovisionsoftheStateCouncilwhichfailtostartconstructiononscheduleorsuspendtheconstructionworkduetocertainreasons,theconstructorsshouldreportthecasestimelytotheapprovingauthorities.Iftheperiodofnon-startofworkduetocertainreasonsexceedssixmonths,theconstructorsshallre-gothrough
24、theformalitiesofapprovalforwork-startreports.0F第二节从业资格SECTIONIlQUALIFICATIONSCONSTRUCTORS第十二条从事建筑活动 的建筑施工企业、勘察单位、 设计单位和工程监理单位,应 当具备下列条件:Article12Constructionengineeringenterprises,prospectingunits,designunitsandprojectsupervisoryunitswhichengageinconstructionactivitiesshallpossessthefollowingconditi
25、ons:(一)有符合国家规定的注册 资本;(1) PossessionofregisteredcapitalthatcomplieswiththeStateprovisions;(二)有与其从事的建筑活动 相适应的具有法定执业资格的 专业技术人员;(2) Possessionofspecializedtechnicalpersonnelwithstatutoryprofessionalqualificationsconsistentwiththeconstructionactivitiestheyengagein;(三)有从事相关建筑活动所 应有的技术装备;(3) Possessionofte
26、chnologiesandequipmentthatarenecessaryforrelatedconstructionactivities.(四)法律、行政法规规定的 其他条件。(4) Otherconditionsasstipulatedbylawsandadministrativeregulations.第十三条从事建筑活动 的建筑施工企业、勘察单位、 设计单位和工程监理单位,按 照其拥有的注册资本、专业技 术人员、技术装备和已完成的 建筑工程业绩等资质条件,划 分为不同的资质等级,经资质 审查合格,取得相应等级的资 质证书后,方可在其资质等级 许可的范围内从事建筑活动。Article1
27、3Constructionengineeringenterprises,prospectingunits,designunitsandprojectsupervisoryunitsareratedintodifferentclassesaccordingtotheirregisteredcapital,professionalsandtechnicians,technicalequipmentandperformancerecordofcompletedconstructionprojects,etc.Onlywhentheypassqualificationexaminationsandob
28、tainappropriatequalificationcertificatesmaytheyengageinconstructionactivitiescommensuratetothescopeoftheirqualificationclasses.第十四条从事建筑活动 的专业技术人员,应当依法取 得相应的执业资格证书,并在 执业资格证书许可的范围内从 事建筑活动。Article14Specializedtechnicalpersonnelengaginginconstructionactivitiesshallattaintherelevantcertificatesofprofessi
29、onalqualificationandconductbuildingactivitieswithinthescopeoftheircertificatesofprofessionalqualifications.CHAPTERIIICONTRACTAWARDINGANDCONTRACTINGOFCONSTRUCTION第三章建筑工程发包与承包PROJECTSSECTIONIGENERALRULES第一节一般规定Article15Contractawardingunitsandcontractorsforconstructionprojectsshallconcludewrittencoven
30、ants,specifyingtherightsandobligationsofeachparty.第十五条建筑工程的发包单位与承包单位应当依法订立书面合同,明确双方的权利和义务。Contractawardingunitsandcontractorsshouldfullyfulfilltheircontractualobligations.Failuretofulfillcontractualobligationsissubjecttocontractbreachresponsibilitiesunderthelaws.发包单位和承包单位应当全面履行合同约定的义务不按照合同约定履行义务的,依法
31、承担违约责任。Article16Thetenderingandbiddingactivitiesforcontractingofconstructionprojectsshallfollowtheprincipleofopenness,justiceandequalcompetition,andcontractorsshouldbeselectedbasedontheirmerits.第十六条建筑工程发包与承包的招标投标活动,应当遵循公开、公正、平等竞争的原则,择优选择承包单位。Tenderingofandbiddingforconstructionprojectswhicharenotcov
32、eredbythislawshallfollowtherelevantlawsontenderingandbidding.建筑工程的招标投标,本法没有规定的,适用有关招标投标法律的规定。Article17Contractawardingunitsandtheirstaffshallnottakebribery,commissionsorseekotherbenefitsintheprocessofcontractawardingforconstructionprojects.第十七条发包单位及其工作人员在建筑工程发包中不得收受贿赂、回扣或者索取其他好处。Contractorsandstaffm
33、embersthereofshallnotundertakeprojectsthroughillegitimatemeanssuchasofferingbribes,commissionsorotherbenefitstotheunitscontractingouttheprojectsorstaffmembersthereof.承包单位及其工作人员不得利用向发包单位及其工作人员行贿、提供回扣或者给予其他好处等不正当手段承揽工程。Article18Constructioncostoftheprojectsshallbeagreeduponinthecontractsbyboththecontr
34、actorsandtheout-contractingunitsin第十八条建筑工程造价应当按照国家有关规定,由发包单位与承包单位在合同中约定。公开招标发包的,其造价 的约定,须遵守招标投标法律 的规定。accordancewithrelevantregulationsoftheState.Forprojectssubjecttopublicbidding,theconstructioncostshallbeagreeduponinlinewiththeprovisionsofthetenderinglaw.发包单位应当按照合同的约 定,及时拨付工程款项。Theout-contractingu
35、nitsshallappropriateprojectfundsinatimelymannerinaccordancewiththeprovisionsofthecontracts.第二节发 包SECTIONIlCONTRACTINGAWARDING第十九条建筑工程依法 实行招标发包,对不适于招标 发包的可以直接发包。第二十条建筑工程实行 公开招标的,发包单位应当依 照法定程序和方式,发布招标 公告,提供载有招标工程的主 要技术要求、主要的合同条 款、评标的标准和方法以及开 标、评标、定标的程序等内容 的招标文件。Article 19 Constructionprojectsshallbeco
36、ntractedthroughpublicbiddingaccordingtolawandthosenotsuitableforbiddingcanbecontractedoutdirectly.Article 20 Forconstructionprojectssubjecttoopenbidding,theout-contractingunitsshall,inaccordancewithlegalproceduresandmethods,publishinvitationsforbidandprovidetenderdocumentscontainingmajortechnicalreq
37、uirementsoftheprojectssubjecttobidding,keycontractterms,standardsandmethodsforevaluationofbidsaswellastheproceduresfortheopening,evaluationanddeterminationofbids.开标应当在招标文件规定的时 间、地点公开进行。开标后应 当按照招标文件规定的评标标 准和程序对标书进行评价、比 较,在具备相应资质条件的投 标者中,择优选定中标者。Thebidsshallbeopenedatthetimeandplacespecifiedinthetende
38、rdocument,afterwhichthebidsshallbeevaluatedandcomparedinaccordancewiththeevaluationstandardsandproceduresspecifiedbythetenderdocuments.Successfulbiddershallbeselectedamongthebidderswithappropriatequalificationsbasedontheirmerits.第二十一条建筑工程招 标的开标、评标、定标由建设 单位依法组织实施,并接受有Article 21 Theopening,evaluationa

40、hecontractingunitswhichhavewonthebidinaccordancewithlaw.Forconstructionprojectssubjecttodirectcontracting,theout-contractingunitsshallcontractouttheprojecttothecontractingunitswithappropriatequalifications.Article 23 Thegovernmentanditssubordinatedepartmentsshallnotabusetheiradministrativepowerbyreq
41、uiringtheout-contractingunitstocontractouttheconstructionprojectstodesignatedcontractingunits.Article 24 Generalcontractingofprojectsisencouragedandthecontractingofconstructionprojectsinpartsshallbeprohibited.Theout-contractingunitsofconstructionprojectscancontractouteitherthesurvey,design,construct
42、ionandequipmentpurchaseoftheconstructionunitstoasinglegeneralcontractororoneorsomeofthesetaskstoageneralcontractor.However,theout-contractingunitsshallnotdividetheconstructionprojectswhichshallbeundertakenbyonecontractingunitsintoseveralpartsforout-contractingtoseveraldifferentcontractingunits.第二十二条
43、建筑工程实 行招标发包的,发包单位应当 将建筑工程发包给依法中标的 承包单位。建筑工程实行直接 发包的,发包单位应当将建筑 工程发包给具有相应资质条件 的承包单位。第二十三条政府及其所 属部门不得滥用行政权力,限 定发包单位将招标发包的建筑 工程发包给指定的承包单位。第二十四条提倡对建筑 工程实行总承包,禁止将建筑 工程肢解发包。建筑工程的发包单位可以将建 筑工程的勘察、设计、施工、 设备采购一并发包给一个工程 总承包单位,也可以将建筑工 程勘察、设计、施工、设备采 购的一项或者多项发包给一个 工程总承包单位;但是,不得 将应当由一个承包单位完成的 建筑工程肢解成若干部分发包 给几个承包单位。
44、第二十五条按照合同约 定,建筑材料、建筑构配件和 设备由工程承包单位采购的,Article 25 Forbuildingmaterials,componentsandequipmentwhichshallbepurchasedbytheprojectcontractingunitsasspecifiedbythecontracts,theout-contractingunitsshallnot发包单位不得指定承包单位购 入用于工程的建筑材料、建筑 构配件和设备或者指定生产 厂、供应商。SECTION III CONTRACTING第三节承包Article 26 The project cont
45、racting units shall hold legally-obtained certificates of qualifications and contract projects within the business scope as allowed by their level of qualification.第二十六条承包建筑工 程的单位应当持有依法取得的 资质证书,并在其资质等级许 可的业务范围内承揽工程。Project contracting units are prohibited from contracting projects beyond the busines
46、s scope as allowed by their level of qualification or in the name of other construction enterprises in any form. Construction enterprises are prohibited from allowing other units or individuals to use their own certificates of qualification, business licenses or their name in any form in order to co
47、ntract construction projects.禁止建筑施工企业超越本企业 资质等级许可的业务范围或者 以任何形式用其他建筑施工企 业的名义承揽工程。禁止建筑 施工企业以任何形式允许其他 单位或者个人使用本企业的资 质证书、营业执照,以本企业 的名义承揽工程。Article 27 Large construction projects or complex construction projects can be jointly contracted by two or more contracting units. Parties to joint project contracting shall bear joint responsibilities for the implementation of the contract.第二十七条大型建筑工 程或者结构复杂的建筑工程, 可以由两个以上的承包单位联 合共同承包。共同承包的各方 对承包合同的履行承担连带责 任。For joint contracting by two or more units with different levels of qualification, projects shall be contracted within the busine
