4、roductsthatdirectlyconcernthepublicsafety,physicalhealth,andsafetyoflifeandproperty,implementingthestateindustrialpolicy,andpromotingthehealthyandharmoniousdevelopmentofsocialistmarketeconomy.第一条为了保证直接关系公共安全、人体健康、生命财产安全的重要工业产品的质量安全，贯彻国家产业政策，促进社会主义市场经济健康、协调发展，制定本条例。Article2Thestateshallimplementthesy

5、stemofproductionlicenseforthe第二条国家对生产下列重要工业产品的企业实行生产许可证制 度：（一）乳制品、肉制品、饮料、 米、面、食用油、酒类等直接关系 人体健康的加工食品；（二）电热毯、压力锅、燃气热水 器等可能危及人身、财产安全的产 品；（三）税控收款机、防伪验钞仪、 卫星电视广播地面接收设备、无线 广播电视发射设备等关系金融安全 和通信质量安全的产品；（四）安全网、安全帽、建筑扣件 等保障劳动安全的产品；（五）电力铁塔、桥梁支座、铁路 工业产品、水工金属结构、危险化 学品及其包装物、容器等影响生产 安全、公共安全的产品；（六）法律、行政法规要求依照本 条例的规定

6、实行生产许可证管理的 其他产品。第三条国家实行生产许可证 制度的工业产品目录（以下简称目enterprisesundertakingtheproductionofthefollowingimportantindustrialproducts:1. dairyproduce,meatproduce,beverages,rice,flour,edibleoil,alcoholandotherprocessedfoodsdirectlyrelatetophysicalhealth;2. electriccarpet,pressurecooker,gas-firedwaterheater,andoth

7、erproductsthatmayendangerthepersonalandpropertysafety;3. fiscalcashregisters,moneydetectors,satellitetelevisionbroadcastgroundreceivingfacilities,wirelessradioandtelevisiontransmissionequipmentandotherproductsconcerningfinancialsafetyandthesafetyofcommunicationsquality;4. safetynet,safetyhelmet,cons

8、tructionfastenerandotherproductsthatcanensurelaborsafety;5. electricpowerirontower,bridgeabutment,railwayindustrialproducts,waterengineeringmetalstructure,hazardouschemicalsandtheirwrappagesandcontainers,andotherproductsthatmayaffectworksafetyandpublicsecurity;and6. otherproductssubjecttotheadminist

9、rationofproductionlicenseasrequiredbylawsandadministrativeregulationsinaccordancewiththeprovisionsofthepresentRegulation.Article3TheCatalogofIndustrialProducts(hereinafterreferredtoastheCatalog)subjecttothesystemofproductionlicensebythestateshallbeformulatedbythecompetentdepartmentoftheStateCouncili

10、nchargeofproductionlicenseforindustrialproductstogetherwiththerelevantdepartmentsoftheStateCouncil,andbeannouncedtothepublicupontheapprovaloftheStateCouncilaftersolicitingtheopinionsofconsumersassociationsandindustrialassociationsoftherelevantproducts.Thesystemofproductionlicenseshallnotbeapplicable

11、totheindustrialproductswhosequalitycanbeeffectivelyensuredthroughselfjudgmentofconsumers,self-disciplineofenterprisesandmarketcompetition.Thesystemofproductionlicenseshallnotbeapplicabletotheindustrialproductswhosequalitysafetycanbeeffectivelyensuredthroughthesystemofcertificationandauthentication.T

12、hecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsshalltimelymakeevaluation,adjustmentandcurtailmentstepbysteptotheCatalogtogetherwiththerelevantdepartmentsoftheStateCouncil,andannouncetothepublicafterreportingtoandbeingapprovedbytheStateCouncil.Article4Thepresent

15、s.Article5NoenterprisethatfailstoobtaintheproductionlicenseshallproduceanyoftheproductslistedintheCatalog.NoentityorindividualmayselloruseanyproductlistedintheCataloginthebusinessactivitieswithoutobtainingproductionlicense.Article6ThecompetentdepartmentoftheStateCouncilinchargeofproductionlicensefor

16、industrialproductsshallberesponsiblefortheunifiedadministrationontheproductionlicenseforindustrialproductsnationwideaccordingtothepresentRegulation.Thecompetentlocaldepartmentofproductionlicenseforindustrialproductsatorabovethecountylevelshallberesponsiblefortheadministrationofproductionlicenseforin

17、dustrialproductswithintheirownadministrativedistricts.Thestateshall,fortheindustrialproductssubjecttothesystemofproductionlicenseforindustrialproducts,unifythecatalog,theexaminationrequirements,thecertificatesymbolsandthesupervisionandadministration.律、行政法规和国家有关规定执 行。第五条任何企业未取得生产 许可证不得生产列入目录的产品。 任何单位

18、和个人不得销售或者在经 营活动中使用未取得生产许可证的 列入目录的产品。第六条国务院工业产品生产 许可证主管部门依照本条例负责全 国工业产品生产许可证统一管理工 作，县级以上地方工业产品生产许 可证主管部门负责本行政区域内的 工业产品生产许可证管理工作。国家对实行工业产品生产许可证制 度的工业产品，统一目录，统一审 查要求，统一证书标志，统一监督 管理。第七条 工业产品生产许可证 管理，应当遵循科学公正、公开透 明、程序合法、便民高效的原则。Article7Theprincipleofscienceandjustness,opennessandtransparency,legitimacyin

19、theproceduresandconvenientforthepublicaswellashighefficiencyshallbefollowedfortheadministrationofproductionlicenseforindustrialproducts.Article8Thecompetentdepartmentsofproductionlicenseforindustrialproductsatorabovethecountylevelandtheirstaffmembers,inspectioninstitutionandinspectorsshallhavetheobl

20、igationtokeepsecretthenationalsecretsandbusinesssecretstheyknow.第八条县级以上工业产品生产许可证主管部门及其人员、检验机构和检验人员，对所知悉的国家秘密和商业秘密负有保密义务。ChapterIlApplicationandAcceptance第二章申请与受理Article9Anenterpriseshallmeetthefollowingconditionsforobtainingaproductionlicense:第九条企业取得生产许可证，应当符合下列条件：1.havingthebusinesslicense;（一）有营业执照

21、;2.havingprofessionaltechniciansqualifiedfortheproductsitproduces;（二）有与所生产产品相适应的专业技术人员；3. havingproductionconditionsandmeansofinspectionandquarantinethataresuitablefortheproductsitproduces;4. havingtechnicaldocumentsandtechniquedocumentsmatchingtheproductsitproduces;5. havingsoundandeffectivequality

22、controlsystemandresponsibilitysystem;6. theproductcomplyingwiththerelevantnationalstandards,industrialstandardsandrequirementsforensuringpersonalhealthandpersonalandpropertysafety;and7. complyingwiththeprovisionsofstateindustrialpolicy,andhavingnosuch（三）有与所生产产品相适应的生产条件和检验检疫手段；（四）有与所生产产品相适应的技术文件和工艺文件

23、；（五）有健全有效的质量管理制度和责任制度；（六）产品符合有关国家标准、行业标准以及保障人体健康和人身、财产安全的要求；（七）符合国家产业政策的规定,不存在国家明令淘汰和禁止投资建 设的落后工艺、高耗能、污染环 境、浪费资源的情况。conditionsasbackwardtechnique,highenergycost,pollutingofenvironment,orwasteofresources,andetc.asarewashedoutbypublicproclamationofthestateandprohibitedfrombeinginvestedandconstructed.法

24、律、行政法规有其他规定的，还 应当符合其规定。Unlessthereareotherwiseprovisionsbyanylaworadministrativeregulation,suchprovisionsshallalsobeaccordedwith.第十条国务院工业产品生产 许可证主管部门依照本条例第九条 规定的条件，根据工业产品的不同 特性，制定并发布取得列入目录产 品生产许可证的具体要求；需要对 列入目录产品生产许可证的具体要 求作特殊规定的，应当会同国务院 有关部门制定并发布。Article10ThecompetentdepartmentoftheStateCouncilinch

25、argeofproductionlicenseforindustrialproductsshall,accordingtotheconditionsasprescribedinArticle9ofthepresentMeasures,andinlightofthedifferentcharacteristicsofindustrialproducts,formulateandissuespecificrequirementsforobtainingtheproductionlicensesfortheproductslistedintheCatalog;ifthereisnecessityto

26、makespecialprovisionsonthespecificrequirementsfortheproductionlicensesfortheproductslistedintheCatalog,itshallformulateandissuesuchprovisionstogetherwiththerelevantdepartmentsoftheStateCouncil.制定列入目录产品生产许可证的具 体要求，应当征求消费者协会和相 关产品行业协会的意见。Theopinionsoftheconsumersassociationsandtheindustrialassociation

27、softherelevantproductsshallbesolicitedfortheformulationoftheconcreterequirementsfortheproductionlicenseoftheproductslistedintheCatalog.第H一条企业生产列入目录 的产品，应当向企业所在地的省、 自治区、直辖市工业产品生产许可 证主管部门申请取得生产许可证。Article11Anenterpriseshall,whenproducinganyproductthatislistedintheCatalog,applyforobtainingtheproduction

28、licensetothecompetentdepartmentofproductionlicenseforindustrialproductsattheprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernmentwheretheenterpriseislocated.企业正在生产的产品被列入目录 的，应当在国务院工业产品生产许 可证主管部门规定的时间内申请取 得生产许可证。IncaseanyproductthatisbeingproducedbyanenterpriseislistedintheCatalo

29、g,theenterpriseshallapplyforobtainingtheproductionlicensewithinthetimeasprescribedbythecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproducts.企业的申请可以通过信函、电报、 电传、传真、电子数据交换和电子 邮件等方式提出。Theapplicationoftheenterprisemaybefiledthroughletter,telegraph,telex,fax,electronicdatai

30、nterchange,email,andotherways.第十二条省、自治区、直辖 市工业产品生产许可证主管部门收 到企业的申请后，应当依照中华 人民共和国行政许可法的有关规 定办理。Article12Thecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernmentshall,afterreceivingtheapplicationofanenterprise,handleitac

31、cordingtotherelevantprovisionsoftheAdministrativeLicenseLawofthePeoplesRepublicofChina.第十三条省、自治区、直辖 市工业产品生产许可证主管部门以 及其他任何单位不得另行附加任何 条件，限制企业申请取得生产许可 证。Article13Thecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernmentan

32、danyotherentityshallnotannexanyconditionadditionallytorestrictanyenterprisefromapplyingfortheproductionlicense.第三章审查与决定ChapterIIIExaminationandDecision第十四条省、自治区、直辖 市工业产品生产许可证主管部门受 理企业申请后，应当组织对企业进 行审查。依照列入目录产品生产许Article14Thecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autono

35、rtheCentralGovernmentshall,within5daysfromacceptingtheapplicationoftheenterprise,reportalltheapplicationdocumentstothecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproducts.对企业的审查包括对企业的实地核 查和对产品的检验。Theexaminationonanenterpriseshallincludeon-sitecheckingontheenterprisean

36、dinspectionontheproducts.第十五条对企业进行实地核 查，国务院工业产品生产许可证主 管部门或者省、自治区、直辖市工 业产品生产许可证主管部门应当指 派2至4名核查人员，企业应当予 以配合。Article15ThecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsandthecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonomousregion,andm

37、unicipalitydirectlyundertheCentralGovernmentshallappointtwotofourcheckerstomakeon-sitecheckingonanenterprise,andtheenterpriseshallcooperatewiththem.第十六条 核查人员经国务院 工业产品生产许可证主管部门组织 考核合格，取得核查人员证书，方 可从事相应的核查工作。Article16Thecheckersshallnotundertakethecorrespondingcheckingworkuntilafterhavingpassedtheexami

38、nationsorganizedbythecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsandobtainedthecertificateofcheckers.第十七条核查人员依照本条 例第九条规定的条件和列入目录产 品生产许可证的具体要求对企业进 行实地核查。Article17Thecheckersshallmakeon-sitecheckingonanenterpriseinaccordancewiththeconditionsasprescribedinArticle

39、9ofthepresentRegulationandthespecificrequirementsforproductionlicenseoftheproductslistedintheCatalog.核查人员对企业进行实地核查，不 得刁难企业，不得索取、收受企业 的财物，不得谋取其他不当利益。Thecheckersshallnot,whenmakingon-sitecheckingonanyenterprise,createdifficultiesfortheenterprise,orseekfororreceiveanypropertyoftheenterpriseorfigureforo

40、therimproperbenefits.第十八条 国务院工业产品生 产许可证主管部门或者省、自治 区、直辖市工业产品生产许可证主 管部门应当自受理企业申请之日起 30日内将对企业实地核查的结果书 面告知企业。核查不合格的，应当 说明理由。Article18ThecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproductsandthecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonom

41、ousregion,andmunicipalitydirectlyundertheCentralGovernmentshall,within30daysfromacceptingtheapplicationofanenterprise,notifytheresultoftheon-sitecheckingtotheenterpriseinwriting.Iftheenterprisedoesnotpassthechecking,thereasonsshallbeexplained.第十九条企业经实地核查合 格的，应当及时进行产品检验。需 要送样检验的，核查人员应当封存 样品，并告知企业在7日内

42、将该样 品送达具有相应资质的检验机构。 需要现场检验的，由核查人员通知 检验机构进行现场检验。Article19Ifanenterprisehaspassedon-sitechecking,itshallmakeinspectionontheproductintime.Ifthereisnecessitytosendsamplesforinspection,thecheckersshallsealupthesamplesforkeepingandnotifytheenterprisetosendthesamplestotheinspectioninstitutionthathasthecorr

43、espondingqualificationwithin7days.Ifthereisnecessitytomakeon-siteinspection,thecheckersshallnotifytheinspectioninstitutiontomakeon-siteinspection.第二十条检验机构应当依照 国家有关标准、要求进行产品检Article 20 Theinspectioninstitutionshallmakeinspectiononproductsaccordingtotherelevantnationalstandardandrequirements,验，在规定时间内完

45、fterbeingsignedbytheinspectors.Theinspectioninstitutionandtheinspectorsshallberesponsiblefortheinspectionreport.第二十一条 检验机构和检验 人员进行产品检验，应当遵循诚信 原则和方便企业的原则，为企业提 供可靠、便捷的检验服务，不得拖 延，不得刁难企业。Article 21 Theinspectioninstitutionandtheinspectorsshall,whenmakinginspectiononanyproduct,followtheprincipleofgoodfai

46、thandconvenienceforenterprises,soastoprovidereliableandconvenientinspectionserviceforenterprises,andshallnotdelayorcreatedifficultiesforenterprises.第二十二条检验机构和检验 人员不得从事与其检验的列入目录 产品相关的生产、销售活动，不得 以其名义推荐或者监制、监销其检 验的列入目录产品。Article22Noinspectioninstitutionorinspectormayundertakeanyproductionandsalesactivi

47、tyrelatingtotheproductlistedintheCatalogunderits/hisinspection,orrecommendorsupervisethemanufactureorthesaleofanyproductlistedintheCatalogunderits/hisinspectioninits/hisname.第二十三条由省、自治区、 直辖市工业产品生产许可证主管部 门组织对企业进行审查的，省、自 治区、直辖市工业产品生产许可证 主管部门应当在完成审查后将审查 意见和全部申请材料报送国务院工 业产品生产许可证主管部门。Article23Incasetheex

48、aminationonanenterpriseisconductedbythecompetentdepartmentofproductionlicenseforindustrialproductsataprovince,autonomousregion,andmunicipalitydirectlyundertheCentralGovernment,thesaiddepartmentshall,aftercompletingtheexamination,submittheexaminationopinionsandalltheapplicationdocumentstothecompetentdepartmentoftheStateCouncilinchargeofproductionlicenseforindustrialproducts.第二十四条自受理企业申请 之日起60日内，国务院工业产品 生产许可证主管部门应当作出是否 准予许可的决定，作出准予许可决 定的，国务院工业产品生产许可证 主管部门应当自作出决定之日起10 日内向
