5、10,2021;andrevisedfortheforthtimebytheDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsissuedonJuly20,2023)ChapterIGeneralProvisions第一条根据中华人民共 和国烟草专卖法（以下简称 烟草专卖法），制定本条 例。第二条烟草专卖是指国家 对烟草专卖品的生产、销售和进 出口业务实行垄断经营、统一管 理的制度。第三条烟草专卖品中的烟 丝是指用烟叶、复烤烟叶、烟草 薄片为原料加工制成的丝、末、 粒状商品。第四条国务院和省、自治

6、区、直辖市的烟草专卖行政主管 部门职责及领导体制，依照烟 草专卖法第四条的规定执行。 设有烟草专卖行政主管部门的 市、县，由市、县烟草专卖行政 主管部门主管本行政区内的烟草 专卖工作，受上一级烟草专卖行 政主管部门和本级人民政府的双 重领导，以上一级烟草专卖行政 主管部门的领导为主。第五条国家对卷烟、雪茄 烟焦油含量和用于卷烟、雪茄烟 的主要添加剂实行控制。烟草制Article 1 ThedetailedruleshavebeenformulatedpursuanttotheLawofthePeople,sRepublicofChinaonTobaccoMonopoly(hereinafter

7、referredtoastheTobaccoMonopolyLaw*).Article 2 TobaccomonopolyrefertomonopolyoftheStateoftheadministrationofproduction,marketingandimportandexportofmonopolytobaccoproducts.Article 3 Monopolycuttobaccoreferstotobaccofilaments,dustandgranulesprocessedwithtobaccoleaves,re-curedtobaccoleavesandtobaccoshe

8、etsasrawmaterials.Article 4 InstitutionoffunctionsandadministrativesystemofdepartmentsinchargeoftobaccomonopolyoftheStateCouncilandvariousprovinces,autonomousregionsandmunicipalitiesshallbedoneinaccordancewiththeprovisionsofArticle4oftheTobaccoMonopolyLaw.Forcitiesandcountieswhichdonothaveadministra

9、tivedepartmentsinchargeoftobaccomonopoly,thedepartmentsofthecitiesandcountiesinchargeoftobaccomonopolyshalltakechargeofsuchrulesunderdualleadershipofthetobaccomonopolyadministrativedepartmentsinchargeatthenexthigherlevelandthepeoplesgovernmentsatthesamelevel,withthetobaccomonopolyadministrativedepar

10、tmentsinchargeatthenexthigherleveltoassumethemainleadership.Article 5 TheStateshallcontroloverthetarcontentsofcigarettesandcigarsandmajoradditivestocigarettesandcigars.Tobaccoproductsmanufacturersshouldnotuseharmfuladditivesandcolorantsinviolationoftherelated品生产企业不得违反国家有关规provisionsbytheState.定使用有害的

11、添加剂和色素。第二章烟草专卖许可证第六条从事烟草专卖品的 生产、批发、零售业务，以及经 营烟草专卖品进出口业务和经营 外国烟草制品购销业务的，必须 依照烟草专卖法和本条例的 规定，申请领取烟草专卖许可 证。ChapterIlTobaccoMonopolyLicensesArticle6ApplicationfortobaccomonopolylicensesshallberequiredaccordingtotheprovisionsoftheTobaccoMonopolyLawandtheprovisionsofthissetofrulesforproducingandhandlingwho

12、lesaleandretailsaleoftobaccoproductssubjecttomonopolyandforhandlingimportsandexportsofsuchproductsandforhandlingpurchaseandmarketingofforeigntobaccoproducts.第七条取得烟草专卖生产 企业许可证，应当具备下列条 件：（一）有与生产烟草专卖品相适 应的资金；（二）有生产烟草专卖品所需要 的技术、设备条件；Tobaccomonopolylicensesaredividedinto:烟草专卖许可证分为:(1)TobaccoMonopolyProdu

13、ctionEnterpriseLicense;（一）烟草专卖生产企业许可证；(2)TobaccoLicense;MonopolyWholesaleEnterprise（二）烟草专卖批发企业许可证；(3)TobaccoLicense;MonopolyRetailSaleEnterprise（三）烟草专卖零售许可证。Article7ThefollowingrequirementsshallbemetinobtainingTobaccoMonopolyProductionEnterpriseLicenses:(1) Tohaveadequateamountoffundsforproducingthe

14、monopolytobaccoproducts;(2) Tohavethetechnologyandequipmentforproducingthemonopolytobaccoproducts;(3)ToadapttotherequirementsoftheStateindustrialpoliciesforthetobaccoindustry;and（三）符合国家烟草行业的产业政策要求；(4)ToconformtootherrequirementsasprovidedforbytheStateCouncildepartmentinchargeoftobaccomonopoly.（四）国务院

15、烟草专卖行政主管部门规定的其他条件QArticle8ThefollowingrequirementsshallbemetinobtainingTobaccoMonopolyWholesaleEnterpriseLicenses:第八条取得烟草专卖批发企业许可证，应当具备下列条件：(1)Tohaveadequatefundsforwholesaleofmonopolytobaccoproducts;（一）有与经营烟草制品批发业务相适应的资金；(2)Tohaveadequateoperationalsiteandpersonnel;（二）有固定的经营场所和必要的专业人员；(3) To confor

16、m to the requirements of the distribution of monopoly tobacco wholesale enterprises; and(4) To conform to other requirements as provided for by the State Council department in charge of tobacco monopoly.Article 9 The following requirements shall be met in obtaining Tobacco Monopoly Retail Enterprise

17、 Licenses:(1) To have adequate funds for retail of monopoly tobacco products;for business(2)Tohavethefixedsiteoperations;（三）符合烟草专卖批发企业合理布局的要求；（四）国务院烟草专卖行政主管部门规定的其他条件。第九条取得烟草专卖零售许可证，应当具备下列条件：（一）有与经营烟草制品零售业务相适应的资金；（二）有固定的经营场所；(3) To conform distribution of enterprises; andtotherequirementsofthemonopol

18、ytobaccoretail（三）符合烟草制品零售点合理布局的要求；（四）国务院烟草专卖行政主管 部门规定的其他条件。(4)ToconformtootherrequirementsasprovidedforbytheStateCouncildepartmentinchargeoftobaccomonopoly.第十条烟草专卖行政主管 部门依照烟草专卖法及本条 例的规定，发放烟草专卖许可证 和烟草专卖品准运证并实施管 理。Article 10 AdministrativedepartmentinchargeoftobaccomonopolyundertheStateCouncilshallber

19、esponsibleforissuanceoflicensesandadministrationofmonopolyoftobaccoproductsandtransportofsuchproductsaccordingtotheTobaccoMonopolyLawandtheprovisionsofthissetofregulations.第H条申请领取烟草专 卖生产企业许可证的，应当向 省、自治区、直辖市（以下简称 省级）烟草专卖行政主管部门提 出申请，由省级烟草专卖行政主 管部门审查签署意见，报国务院 烟草专卖行政主管部门审批发 证。Article 11 Inapplyingforali

20、censefortheproductionoftobaccoproductsformonopoly,anapplicationshouldfirstofallbefiledwiththeadministrativedepartmentsinchargeoftobaccomonopolyoftheprovince,autonomousregionormunicipality(hereinafterreferredtoasprovinciallevel),foranexaminationcommentsandsubmittedtotheadministrativedepartmentincharg

21、eoftobaccomonopolyundertheStateCouncilforapprovalandissuanceofthelicense.第十二条申请领取烟草专 卖批发企业许可证，进行跨省、 自治区、直辖市经营的，应当向 省级烟草专卖行政主管部门提出 申请，由省级烟草专卖行政主管 部门审查签署意见，报国务院烟 草专卖行政主管部门审批发证。Article 12 Inapplyingforlicensesforwholesaleoftobaccopatentproductsfortransprovincial,autonomousregionalormunicipaloperations,

22、anapplicationshouldbefirstofallfiledwiththeprovincialleveladministrativedepartmentsinchargeoftobaccomonopolyforexaminationandcommentsandthensubmittedtotheadministrativedepartmentundertheStateCouncilinchargeoftobaccomonopolyforapprovalandissuanceofthelicense.申请领取烟草专卖批发企业许可 证，在省、自治区、直辖市范围 内经营的，应当向企业所在

23、地烟 草专卖行政主管部门提出申请， 由企业所在地烟草专卖行政主管 部门审查签署意见，报省级烟草 专卖行政主管部门审批发证。Inapplyingforalicenseforwholesaleoftobaccomonopolyproductswithinaprovince,autonomousregionormunicipality,anapplicationshouldfirstofallbefiledwiththeadministrativedepartmentsinchargeoftobaccomonopolyinitsdomicileforexaminationcommentsandthe

24、nsubmittedtotheprovincialleveladministrativedepartmentsinchargeoftobaccomonopolyforapprovalandissuanceofthelicense.第十三条申请领取烟草专 卖零售许可证，依照烟草专卖 法的规定办理。第十四条烟草专卖许可证 的发证机关可以定期或者不定期 地对取得烟草专卖许可证的企 业、个人进行检查。经检查不符 合烟草专卖法和本条例规定 条件的，烟草专卖许可证的发证 机关可以责令暂停烟草专卖业 务、进行整顿，直至取消其从事 烟草专卖业务的资格。Article 13 Inapplyingforalice

25、nseforpatentretailsalesoftobaccoproducts,theprovisionsoftheTobaccoMonopolyLawshallapply.Article 14 Organsresponsibleforissuanceoftobaccomonopolylicensesshould,regularlyorirregularlycheckenterprisesorindividualsthathaveobtainedsuchlicenses.IfanycaseisfoundtohavefailedtomeettherequirementsoftheTobacco

26、MonopolyLawandthissetofregulations,theorgansthatissuedthelicenseshallorderatemporarystopofthemonopolyforcarryingoutarectificationuntilalltherequirementsaremet.烟草专卖许可证的具体管理办 法，由国务院烟草专卖行政主管 部门根据本条例的规定制定。Thespecificproceduresforcontroloftobaccomonopolylicensesshallbeworkedoutbytheadministrativedepartme

27、ntinchargeoftobaccomonopolyundertheStateCouncilaccordingtotheprovisionsofthissetofregulations.Chapter III Plantation, PurchaseAppropriation of Tobacco Leavesand第三章烟叶的种植、收购和调 拨第十五条国务院烟草专卖 行政主管部门按照合理布局的要 求，会同有关省、自治区、直辖Article 15 AdministrativedepartmentinchargeoftobaccomonopolyundertheStateCouncilshal

28、l,togetherwithpeople,sgovernmentsofrelatedprovinces,autonomousregionsandmunicipalities,mapoutplansfortobaccoplantationaccordingtotherequirementsofrationaldistributionandtheStateplansundertheprincipleofimprovedstrains,regionalizationandstandardization.市人民政府依据国家计划，根据 良种化、区域化、规范化的原则 制定烟叶种植规划。Article 16

29、 Tobaccoleavesshouldbepurchasedinaunifiedwaybytobaccocompaniesortheirentrustedunits.Tobaccocompaniesortheirentrustedunitsmay,accordingtoneeds,opentobaccopurchasingstations(points)topurchasetobaccoinareasthathavereceivedplansforpurchasingtobaccoissuedbytheState.Theopeningofsuchpurchasingstations(poin

30、ts)shouldgettheapprovalofdistrictedcityleveladministrativedepartmentsinchargeoftobaccomonopoly.Withoutapproval,nounitorindividualisallowedtopurchasetobaccoleaves.第十六条烟叶由烟草公司 或其委托单位依法统一收购。烟 草公司或其委托单位根据需要， 可以在国家下达烟叶收购计划的 地区设立烟叶收购站（点）收购 烟叶。设立烟叶收购站（点）， 应当经设区的市级烟草专卖行政 主管部门批准。未经批准，任何 单位和个人不得收购烟叶。第十七条地方烟草专

31、卖行 政主管部门组织同级有关部门和 烟叶生产者的代表组成烟叶评级 小组，协调烟叶收购等级评定工 作。Article 18 Plans for State reserves, exports and appropriation of tobacco leaves shall be issued by the planning department of the State Council.Chapter IV Production of Tobacco ProductsArticle 19 Startups of tobacco product producers shall be applie

35、有包装的烟丝，应当使用注册 商标。第五章 烟草制品的销售Article 22 Registrationsoftrademarksshouldbeundertakenforcigarettes,cigarsandpackedcuttobacco.ChapterVSalesofTobaccoProducts第二十三条取得烟草专卖 批发企业许可证的企业，应当在 许可证规定的经营范围和地域范 围内，从事烟草制品的批发业 务。Article 23 Enterprisesthathaveobtainedlicensesforpatentwholesaleoftobaccoproductsshouldope

36、ratewithinthescopeandareasspecifiedinthelicenses.取得烟草专卖零售许可证的企业 或者个人，应当在当地的烟草专 卖批发企业进货，并接受烟草专 卖许可证发证机关的监督管理。Enterprisesorindividualsthathaveobtainedlicensesforpatentretailsalesoftobaccoproductsshouldbuytheproductsforsalesfromthelocaltobaccopatentwholesaleenterprisesandacceptthesupervisionandcontrolb

37、ytheorgansissuingthetobaccomonopolylicenses.第二十四条无烟草专卖批 发企业许可证的单位或者个人， 一次销售卷烟、雪茄烟50条以上 的，视为无烟草专卖批发企业许 可证从事烟草制品批发业务。Article 24 Aunitorindividualwithoutatobaccowholesalepatentlicensetoone-timesalesofover50cartonsofcigarettesorcigarsshallberegardedasawholesalebusinesswithoutlicense.Article 25 No unit o

40、样。Article 28 State Council administrative department in charge of tobacco monopoly shall, if necessary, distribute cigarettes and cigars among different provinces, autonomous regions and municipalities according to market demand.第二十八条国务院烟草专 卖行政主管部门在必要时，可以 根据市场供需情况下达省、自治 区、直辖市之间的卷烟、雪茄烟 调拨任务。Article 2

41、9 It is forbidden to sell rotten or deteriorated tobacco products. Rotten or deteriorated tobacco products should be destroyed under the guidance of administrative departments in charge of tobacco monopoly or related administrative departments.第二十九条严禁销售霉 坏、变质的烟草制品。霉坏、变 质的烟草制品，由烟草专卖行政 主管部门或者有关行政管理部门

42、监督销毁。Article 30 Tobacco products with forged or phony trademarks discovered by related departments according to law shall be destroyed openly by administrative departments in charge of tobacco monopoly according to the related regulations but not to be resold by any means.第三十条 有关部门依法查 获的假冒商标烟草制品，应当交

44、visiondepartmentoftheStateCouncilorthepeoplesgovernmentsofprovinces,autonomousregionsandmunicipalities.第六章 烟草专卖品的运输ChapterVlTransportationofPatentSalesTobaccoProducts第三十二条烟草专卖品准 运证由省级以上烟草专卖行政主 管部门或其授权的机构审批、发 放。烟草专卖品准运证的管理办 法由国务院烟草专卖行政主管部 门制定。Article32Licensesfortransportingmonopolytobaccoproductssha

45、llbeapprovedandissuedbyadministrativedepartmentsinchargeoftobaccomonopolyatandaboveprovinciallevelortheirauthorizedorgans.ProceduresforadministrationoflicensesfortransportofmonopolytobaccoproductsshallbeworkedoutbytheStateCounciladministrativedepartmentinchargeoftobaccomonopoly.第三十三条跨省、自治 区、直辖市运输进口的

46、烟草专卖 品、国产烟草专用机械和烟用丝 束、滤嘴棒以及分切的进口卷烟 纸，应当凭国务院烟草专卖行政 主管部门或其授权的机构签发的 烟草专卖品准运证办理托运或者 自运。跨省、自治区、直辖市运输除国 产烟草专用机械、烟用丝束、滤 嘴棒以及分切的进口卷烟纸以外 的其他国产烟草专卖品，应当凭 国务院烟草专卖行政主管部门或 者省级烟草专卖行政主管部门签Article33Transprovincial,autonomousregionalandmunicipaltransportationofimportedmonopolytobaccoproducts,homemadespecialtobaccomac
