10、protectingthelegitimaterightsand第一条为了防止和纠正违法的或者不当的行政行为，保护公民、法人和其他组织的合法权益，监督和保障行政机关依法行使职权，发挥行政复议化解行政争议的 主渠道作用，推进法治政府建设， 根据宪法，制定本法。interestsofcitizens,legalpersonsandotherorganizations,supervisingandguaranteeingtheexerciseoffunctionsandpowerbyadministrativeorgansinaccordancewiththeIaw5maximizingtherol

12、stshavebeeninfringeduponbyanadministrativeactionofanadministrativeorgan,thusappliesforadministrativereconsiderationtoanadministrativereconsiderationorgan,andtheadministrativereconsiderationorganhandlesthecaseofadministrativereconsideration,thisLawshallapply.前款所称行政行为，包括法律、法 规、规章授权的组织的行政行为。Forthepurpo

14、障法律、法规的正确实 施。Administrativereconsiderationorgansshall,whenperformingfunctionsofadministrativereconsideration,followtheprinciplesoflegitimacy,impartiality,openness,efficiency,convenienceforthepeopleandserviceforthepeople,insistoncorrectingmistakeswheneverdiscovered,andensurecorrectimplementationoflaw

15、sandregulations.第四条 县级以上各级人民政 府以及其他依照本法履行行政复议 职责的行政机关是行政复议机关。Article4PeoplesgovernmentsatorabovethecountylevelandotheradministrativeorgansthatperformfunctionsofadministrativereconsiderationinaccordancewiththisLawareadministrativereconsiderationorgans.行政复议机关办理行政复议事项的 机构是行政复议机构。行政复议机 构同时组织办理行政复议机关的行 政

16、应诉事项。Theinstitutionsinadministrativereconsiderationorganswhichhandlethemattersofadministrativereconsiderationareadministrativereconsiderationinstitutions.Administrativereconsiderationinstitutionsshallconcurrentlyorganizethehandlingofadministrativeresponsemattersofadministrativereconsiderationorgans.

20、terestsorlegitimaterightsandinterestsofothers,orviolatingthecompulsoryprovisionsoflawsorregulations.第六条国家建立专业化、职 业化行政复议人员队伍。Article6Thestateshallbuildaspecializedandprofessionalteamofadministrativereconsiderationofficers.行政复议机构中初次从事行政复议 工作的人员，应当通过国家统一法 律职业资格考试取得法律职业资 格，并参加统一职前培训QAnofficerofanadminis

21、trativereconsiderationinstitutionwhichcarriesouttheworkofadministrativereconsiderationforthefirsttimeshallpassthenationalunifiedlegalprofessionalqualificationexamination,obtainthelegalprofessionalqualification,andreceiveunifiedpre-servicetraining.国务院行政复议机构应当会同有关 部门制定行政复议人员工作规范， 加强对行政复议人员的业务考核和 管理。Th

22、eadministrativereconsiderationinstitutionoftheStateCouncilshall,inconjunctionwiththerelevantdepartments,developtheworkrulesforadministrativereconsiderationofficersandstrengthenthebusinessassessmentandmanagementofadministrativereconsiderationofficers.第七条行政复议机关应当确 保行政复议机构的人员配备与所承 担的工作任务相适应，提高行政复 议人员专业

23、素质，根据工作需要保 障办案场所、装备等设施。县级以 上各级人民政府应当将行政复议工 作经费列入本级预算。Article7Anadministrativereconsiderationorganshallensurethatthestaffingofanadministrativereconsiderationinstitutioniscompatiblewiththetasksundertaken,improvetheprofessionalqualityofadministrativereconsiderationofficers,andguaranteethepremises,equip

24、mentandotherfacilitiesforhandlingcasesaccordingtotheworkneeds.Thepeoplesgovernmentsatalllevelsshallincludetheexpensesfortheadministrativereconsiderationworkintheirbudgets.第八条行政复议机关应当加 强信息化建设，运用现代信息技 术，方便公民、法人或者其他组织 申请、参加行政复议，提高工作质 量和效率。Article8Anadministrativereconsiderationorganshallstrengtheninfor

25、mationconstructionandusemoderninformationtechnologytofacilitatecitizens,legalpersonsorotherorganizationstoapplyforandattendtheadministrativereconsiderationandimprovetheworkqualityandefficiency.第九条对在行政复议工作中 做出显著成绩的单位和个人，按照 国家有关规定给予表彰和奖励。Article9Entitiesandindividualsthathavemadesignificantachievement

26、sintheadministrativereconsiderationworkshallbecommendedandrewardedintheaccordancewiththerelevantrulesofthestate.第十条公民、法人或者其他 组织对行政复议决定不服的，可以 依照中华人民共和国行政诉讼 法的规定向人民法院提起行政诉 讼，但是法律规定行政复议决定为 最终裁决的除外。Article10Acitizen,legalpersonoranyotherorganizationthatrefusestoacceptadecisiononadministrativereconsidera

27、tionmay,inaccordancewiththeprovisionsoftheCivilProcedureLawofthePeople,sRepublicofChina,instituteanadministrativelitigationwithapeople,scourt,exceptwhenthedecisiononadministrativereconsiderationis,asprovidedforbylaw,afinalruling.第二章行政复议申请ChapterIlApplicationforAdministrativeReconsideration第一节行政复议范围A

28、rticle 1 ScopeofAdministrativeReconsideration第十一条有下列情形之一 的，公民、法人或者其他组织可以 依照本法申请行政复议：Article 11 Acitizen,legalperson,oranyotherorganizationfallingunderanyofthefollowingcircumstancesmay,inaccordancewiththisLaw,applyforadministrativereconsideration:（一）对行政机关作出的行政处罚 决定不服；(1) Heoritrefusestoacceptadecisio

29、nonadministrativepunishmentmadebyanadministrativeorgan.（二）对行政机关作出的行政强制 措施、行政强制执行决定不服；(2) Heoritrefusestoacceptacompulsoryadministrativemeasureandadecisiononcompulsoryadministrativeenforcementadoptedandmadebyanadministrativeorgan.（三）申请行政许可，行政机关拒(3) Heoritappliesforanadministrativelicensing,theadminis

31、organ.（四）对行政机关作出的确认自然 资源的所有权或者使用权的决定不服；(5) Heoritrefusestoacceptadecisiononcollectionandexpropriationmadebyanadministrativeorgananditsdecisiononcompensation.（五）对行政机关作出的征收征用 决定及其补偿决定不服；(6) Heoritrefusestoacceptadecisiononcompensationoradecisiononnocompensationmadebyanadministrativeorgan.（六）对行政机关作出的赔偿

32、决定 或者不予赔偿决定不服；(7) Heoritrefusestoacceptadecisionnottoacceptanapplicationfordeterminationofwork-relatedinjuryoraconclusionofdeterminationofwork-relatedinjurymadebyanadministrativeorgan.（七）对行政机关作出的不予受理 工伤认定申请的决定或者工伤认定 结论不服；(8) Anadministrativeorganisdeemedtohaveinfringedupontheautonomyinbusinessoperat

33、ion,conventionalusufructonrurallandforagriculturaloperations,orrurallandoperatingright.（A）认为行政机关侵犯其经营自 主权或者农村土地承包经营权、农 村土地经营权；(9) Anadministrativeorganisdeemedtohaveabuseditsadministrativepowertoexcludeorrestrictcompetition.（九）认为行政机关滥用行政权力 排除或者限制竞争；（十）认为行政机关违法集资、摊(10) Anadministrativeorganisdeemedto

34、haveillegallyraisedfundsorapportionedexpenses派费用或者违法要求履行其他义 务；orillegallyrequiredperformanceofotherobligations.（十一）申请行政机关履行保护人 身权利、财产权利、受教育权利等 合法权益的法定职责，行政机关拒 绝履行、未依法履行或者不予答 复；(11) Anadministrativeorganrefusestoperformfunctions,hasfailedtoperformfunctions,ordoesnotreply,asonehasappliedtoanadministra

35、tiveorganforperformingstatutoryfunctionsofprotectingpersonalrights,propertyrights,rightstoreceiveeducation,andotherlegitimaterightsandinterests.（十二）申请行政机关依法给付抚 恤金、社会保险待遇或者最低生活 保障等社会保障，行政机关没有依 法给付；(12) Anadministrativeorganhasfailedtograntapension,socialinsurancebenefitsorminimumlivingallowanceandoth

36、ersocialsecurityaccordingtothelaw,asonehasappliedfor.（十三）认为行政机关不依法订 立、不依法履行、未按照约定履行 或者违法变更、解除政府特许经营 协议、土地房屋征收补偿协议等行 政协议；(13) Anadministrativeorganisdeemedtohavefailedtoconclude,failedtoperformaccordingtothelaworasagreedupon,or川egallymodifiedorterminated,anadministrativeagreement,suchasagovernmentcon

37、cessionagreementoranagreementoncompensationforlandandbuildingexpropriation.（十四）认为行政机关在政府信息 公开工作中侵犯其合法权益；(14) Anadministrativeorganisdeemedtohaveinfringeduponitslegitimaterightsandinterestsindisclosureofgovernmentinformation.（十五）认为行政机关的其他行政 行为侵犯其合法权益。(15) Anadministrativeorganisdeemedtohaveinfringedu

38、ponitslegitimaterightsandinterestsinotheradministrativeactions.第十二条下列事项不属于行 政复议范围：（一）国防、外交等国家行为;Article 12 Thefollowingmattersdonotfallunderthescopeofadministrativereconsideration:(1)Actsofthestateinnationaldefenseandforeignaffairs,amongothers.(2) Administrative regulations and rules or decisions, o

39、rders and other normative documents with general binding force developed and issued by administrative organs.(3) Decisions of administrative organs on rewards and punishments, appointment and dismissal of their employees.(4) Mediation made for civil disputes by administrative organs.（二）行政法规、规章或者行政机

40、关制定、发布的具有普遍约束力的 决定、命令等规范性文件；（三）行政机关对行政机关工作人 员的奖惩、任免等决定；（四）行政机关对民事纠纷作出的 调解。Article 13 A citizen, legal person or any other organization deeming that the following regulatory documents, which are the basis for an administrative action of an administrative organ, are illegal, may, when applying for adm

41、inistrative reconsiderationof anadministrative action, applyto theadministrative reconsideration organ for incidental review of thesenormativedocuments:第十三条 公民、法人或者其 他组织认为行政机关的行政行为所 依据的下列规范性文件不合法，在 对行政行为申请行政复议时，可以 一并向行政复议机关提出对该规范 性文件的附带审查申请：(1) Normative documents of the departments of the State Cou

42、ncil.（一）国务院部门的规范性文件;(2) Normative documents of the local peoples governments at or above the county level and their departments.（二）县级以上地方各级人民政府 及其工作部门的规范性文件；(3) Normative documents of the peoples governments of villages and towns.（三）乡、镇人民政府的规范性文 件；(4) Normative documents of organizations（四）法律、法规、规章授

43、权的组织的规范性文件。前款所列规范性文件不含规章。规 章的审查依照法律、行政法规办 理。Section 2 Attendeesof AdministrativeReconsideration第二节行政复议参加人authorizedbylaws,regulationsandrules.Theterm“normativedocumentsasmentionedintheprecedingparagraphdoesnotincluderules.Reviewofrulesshallbehandledaccordingtothelawsandadministrativeregulations.第十四条

44、 依照本法申请行政 复议的公民、法人或者其他组织是 申请人。Article 14 Anycitizen,legalpersonoranyotherorganizationthatappliesforadministrativereconsiderationinaccordancewiththisLawisanapplicant.有权申请行政复议的公民死亡的， 其近亲属可以申请行政复议。有权 申请行政复议的法人或者其他组织 终止的，其权利义务承受人可以申 请行政复议。Ifacitizenwhohastherighttoapplyforadministrativereconsiderationis

47、ofadministrativereconsideration,theapplicantsmayselectarepresentativetoattendtheadministrativereconsideration.代表人参加行政复议的行为对其所 代表的申请人发生效力，但是代表 人变更行政复议请求、撤回行政复 议申请、承认第三人请求的，应当 经被代表的申请人同意。Arepresentativeattendanceattheadministrativereconsiderationshallbeeffectivefortheapplicantthatherepresents.However,
