4、ientificandefficientwayandensuringtheaccuracyandtimelinessoftheresultdata,thisRegulationisformulatedinaccordancewiththeStatisticsLawofthePeoplesRepublicofChinaandtheEnvironmentalProtectionLawofthePeoplesRepublicofChina.Article2Thetaskofthenationalgeneral任务是，掌握各类污染源的数 量、行业和地区分布情况，了 解主要污染物的产生、排放和 处理情况

5、，建立健全重点污染 源档案、污染源信息数据库和 环境统计平台，为制定经济社 会发展和环境保护政策、规划 提供依据。第三条本条例所称污 染源，是指因生产、生活和其 他活动向环境排放污染物或 者对环境产生不良影响的场 所、设施、装置以及其他污染 发生源。surveyofpollutionsourcesshallbeknowingthenumberofpollutionsourcesandtheirdistributionindifferentindustriesandregions,knowingthegeneration,dischargeandtreatmentofmajorpollutant

6、s,establishingfilesforkeypollutionsources,apollutionsourceinformationdatabaseandanenvironmentalstatisticsplatform,toprovidebasisforformulatingpoliciesandplansforeconomicandsocialdevelopmentandenvironmentalprotection.第四条污染源普查按 照全国统一领导、部门分工协 作、地方分级负责、各方共同 参与的原则组织实施。Article3Theterm“pollutionsourcenasme

7、ntionedinthisRegulationreferstopremises,facilitiesandequipmentwhichdischargepollutantstoenvironmentintheprocessofproduction,livelihoodoranyotheractivityorhaveadverseimpactonenvironment,aswellasothersourcesgivingbirthtopollution.第五条污染源普查所 需经费，由中央和地方各级人 民政府共同负担，并列入相应 年度的财政预算，按时拨付， 确保足额到位。Article4Thena

8、tionalgeneralsurveyofpollutionsourcesshallbeimplementedunderunifiedleadership,withdepartmentscooperatingbasedondivisionoffunction,withlocalpeoplesgovernmentsatdifferentlevelstakingdifferentresponsibilitiesandwiththeparticipationofallcircles.污染源普查经费应当统一管 理，专款专用，严格控制支出。Article5Expensesnecessaryforthen

9、ationalgeneralsurveyofpollutionsourcesshallbepaidjointlybytheCentralGovernmentandthelocalpeoplesgovernmentsatvariouslevels,belistedintothefiscalbudgetofthecorrespondingyearandbeputinpositionintimeandinfullamount.Expensesforthenationalgeneralsurveyofpollutionsourcesshallbeunderunifiedmanagement,usedf

10、ordesignatedpurposeonlyandunderstrictcontrol.第六条全国污染源普Article 6 Thenationalgeneralsurveyofpollutionsourcesshallbeconductedonceevery10years,morespecifically,onDecember31stofthesurveyyear.Article 7 Newspapers,periodicals,broadcastingstations,TVstations,networkandothernewsmediashallreportandpublicizeth

11、egeneralsurveyinatimelymanner.ChapterIlObject,Scope,ContentandMethodArticle8Theobjectofthenationalgeneralsurveyofpollutionsourcesshallbeentitiesandself-employedhouseholdswhichhavepollutionsourceswithinthebordersofthePeoplesRepublicofChina.Article9Theobjectofthenationalgeneralsurveyofpollutionsources

12、hastheobligationtosubjectitselftotheinvestigationconductedbytheleadinggroupofficeofthenationalgeneralsurveyofpollutionsourcesanditsworkingpersonnel,reportthetruesituation,providetherelevantmaterialsandfillinthesurveyforminaccordancewiththerelevantrequirements.Noobjectmaydelaythereportofthedataneeded

13、bythegeneralsurvey,makefalsereports,hidethetruthinmakingreportsorrefusetoreport;orshuffle,refuseorimpedetheinvestigation;ortransfer,conceal,alterordestroyrawmaterialconsumptionrecords,productionrecords,pollutioncontrolfacilityoperationrecords,pollutantdischargemonitoringrecordsandothersourcematerial

14、relatedtothegenerationordischargeofpollutants.查每10年进行1次，标准时 点为普查年份的12月31 Bo第七条报刊、广播、电 视和互联网等新闻媒体，应当 及时开展污染源普查工作的 宣传报道。第二章污染源普查的对象、 范围、内容和方法第八条污染源普查的 对象是中华人民共和国境内 有污染源的单位和个体经营 户。第九条污染源普查对 象有义务接受污染源普查领 导小组办公室、普查人员依法 进行的调查，并如实反映情 况，提供有关资料，按照要求 填报污染源普查表。污染源普查对象不得迟报、虚 报、瞒报和拒报普查数据；不 得推诿、拒绝和阻挠调查；不 得转移、隐匿、篡

15、改、毁弃原 材料消耗记录、生产记录、污 染物治理设施运行记录、污染 物排放监测记录以及其他与 污染物产生和排放有关的原 始资料。第十条污染源普查范 围包括：工业污染源，农业污Article 10 Thescopeofthegeneralsurveyofpollutionsourcesshallinclude:industrial染源，生活污染源，集中式污 染治理设施和其他产生、排放 污染物的设施。第十一条工业污染源 普查的主要内容包括：企业基 本登记信息，原材料消耗情 况，产品生产情况，产生污染 的设施情况，各类污染物产 生、治理、排放和综合利用情 况，各类污染防治设施建设、 运行情况等。po

16、llutionsources,agriculturalpollutionsources,domesticpollutionsources,facilitiesforcentralizedtreatmentofpollutionandotherfacilitiesgeneratingordischargingpollutants.农业污染源普查的主要内容 包括：农业生产规模，用水、 排水情况，化肥、农药、饲料 和饲料添加剂以及农用薄膜 等农业投入品使用情况，秸秆 等种植业剩余物处理情况以 及养殖业污染物产生、治理情 况等。Article 11 Themaincontentsofthegenera

17、lsurveyonindustrialpollutionsourcesshallinclude:enterprisesbasicregistrationinformation,situationaboutrawmaterialconsumption,productionsituation,situationaboutthefacilitiesgivingrisetopollution,situationaboutthegeneration,control,dischargeandcomprehensiveutilizationofvariouskindsofpollutants,andsitu

18、ationabouttheconstructionandoperationofvariouskindsofpollutionpreventionandcontrolfacilities.生活污染源普查的主要内容 包括：从事第三产业的单位的 基本情况和污染物的产生、排 放、治理情况，机动车污染物 排放情况，城镇生活能源结构 和能源消费量，生活用水量、 排水量以及污染物排放情况 等。Themaincontentsofthegeneralsurveyonagriculturalpollutionsourcesshallinclude:scaleofagriculturalproduction,sit

19、uationaboutwateruseanddrainage,situationabouttheuseoffertilizer,pesticide,feedstuff,feedstuffadditives,agriculturalfilmandotherproductsinputinagriculture,situationaboutthedisposalofstrawandotherplantingresiduals,andsituationaboutthegenerationandtreatmentofpollutantsfromlivestockandpoultrybreedingind

20、ustry.Themaincontentsofthegeneralsurveyondomesticpollutionsourcesshallinclude:basicinformationaboutentitiesengaginginthetertiaryindustry,situationaboutthegeneration,dischargeandcontrolofpollutants,situationaboutthedischargeofpollutantsbyautomotivevehicles,situationabouturbandomesticenergystructurean

21、dconsumption,situationaboutdomesticwatersupplyvolumeanddisplacement,andsituationaboutdomesticpollutantdischarge,etc.Themaincontentsofthegeneralsurveyonfacilitiesforconcentratedtreatmentofpollutionshallinclude:basicsituationandoperationstatusofsuchfacilities,situationaboutthetreatmentanddisposalofpol

22、lutants,andsituationaboutthegeneration,disposalandutilizationofpercolate,sludge,burningresidueandwastegases,etc.Article 12 ThespecificscopeandcontentsofeachgeneralsurveyofpollutionsourcesshallbedeterminedaccordingtothegeneralsurveyplanapprovedbytheStateCouncil.Article 13 Thegeneralsurveyofpollutions

23、ourcesshallbeconductedbywayofoverallstatisticalsurvey,andthemethodofsamplingsurveymaybetakenwhennecessary.Thegeneralsurveyofpollutionsourcesshallfollowthenationallyunifiedstandardsandtechnicalrequirements.ChapterIIIOrganizationandImplementationoftheGeneralSurveyofPollutionSourcesArticle 14 Theleadin

24、ggroupofthenationalgeneralsurveyofpollutionsourcesshalltakechargeofleadingandcoordinatingthenationalgeneralsurveywork.TheofficeoftheleadinggroupofthenationalgeneralsurveyofpollutionsourcesshallbeintheadministrativedepartmentofecologyandenvironmentoftheStateCouncil,andtakechargeofthedailyworkofthenat

25、ionalgeneralsurveyofpollutionsources.集中式污染治理设施普查的 主要内容包括：设施基本情况 和运行状况，污染物的处理处 置情况，渗滤液、污泥、焚烧 残渣和废气的产生、处置以及 利用情况等。第十二条每次污染源 普查的具体范围和内容，由国 务院批准的普查方案确定。第十三条污染源普查 采用全面调查的方法，必要时 可以采用抽样调查的方法。污染源普查采用全国统一的 标准和技术要求。第三章污染源普查的组织 实施第十四条全国污染源 普查领导小组负责领导和协 调全国污染源普查工作。全国污染源普查领导小组办 公室设在国务院生态环境主 管部门，负责全国污染源普查 日常工作。第十

26、五条县级以上地 方人民政府污染源普查领导 小组，按照全国污染源普查领 导小组的统一规定和要求，领 导和协调本行政区域的污染Article 15 Theleadinggroupsofthegeneralsurveyofpollutionsourcesofthelocalpeoplesgovernmentsatorabovethecountylevelshall,inaccordancewiththeunifiedprovisionsandrequirementsoftheleadinggroupofthenationalgeneralsurveyof源普查工作。县级以上地方人民政府污染 源普查领

27、导小组办公室设在 同级生态环境主管部门，负责 本行政区域的污染源普查日 常工作。pollutionsources,leadandcoordinatethegeneralsurveyworkoftheirrespectiveadministrativeregions.Theleadinggroupofficeofthegeneralsurveyofpollutionsources(hereinafterreferredtoasleadinggroupoffice)underalocalpeoplesgovernmentatorabovethecountylevelshallbeintheadmi

28、nistrativedepartmentofecologyandenvironmentatthesamelevel,andshalltakechargeofthedailygeneralsurveyworkofthisadministrativeregion.乡（镇）人民政府、街道办事 处和村（居）民委员会应当广 泛动员和组织社会力量积极 参与并认真做好污染源普查 工作。第十六条县级以上人 民政府生态环境主管部门和 其他有关部门，按照职责分工 和污染源普查领导小组的统 一要求，做好污染源普查相关 工作。Thepeople,sgovernmentsofV川ages(towns),sub-dist

29、rictofficesandvillagers,(neighborhood)committeesshallmobilizeandorganizesocialforcestoactivelyparticipateinandearnestlydoagoodjobinthegeneralsurveyofpollutionsources.第十七条全国污染源 普查方案由全国污染源普查 领导小组办公室拟订，经全国 污染源普查领导小组审核同 意，报国务院批准。Article 16 Theadministrativedepartmentofecologyandenvironmentandotherrelate

30、ddepartmentsofthepeoplesgovernmentatorabovethecountylevelshall,accordingtothedivisionofworkandtheunifiedrequirementsoftheleadinggroup,getallworkrelatedtothegeneralsurveyofpollutionsourceswelldone.Article 17 Theplanforthegeneralsurveyofpollutionsourcesshallbedraftedbytheleadinggroupofficeofthenationa

31、lgeneralsurveyofpollutionsourcesundertheStateCouncil(hereinafterreferredtoastheleadinggroupofficeundertheStateCouncil),andreportedtotheStateCouncilforapprovalafteritisexaminedandapprovedbytheleadinggroupofthenationalgeneralsurveyofpollutionsources.全国污染源普查方案应当包 括：普查的具体范围和内容、 普查的主要污染物、普查方Theplanshalli

32、nclude:thespecificscopeandcontentsofthegeneralsurvey,themajorpollutantstobeinspectedinthegeneralsurvey,theproceduresandmethodsforthegeneralsurvey,theorganizationandimplementationofthegeneralsurveyandtheappropriationbudget,etc.Whendraftingaplanforthenationalgeneralsurveyofpollutionsources,theopinions

33、fromtherelateddepartmentsandexpertsshallbefullyheard.Article 18 TheleadinggroupofficeundertheStateCouncilshalldrawoutthegeneralsurveytableinaccordancewiththeplanforthenationalgeneralsurveyofpollutionsources,andsubmitthetabletotheNationalBureauofStatisticsforappraisal.Theleadinggroupofficeundertheloc

34、alpeoplesgovernmentofaprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentmayaddanattachedlistofthegeneralsurveyofpollutionsourcesforthisadministrativeregiontouse,andusethelistafteritisapprovedbytheleadinggroupofficeundertheStateCouncil.Article 19 Attheinitiationphaseofthegeneral

35、survey,theleadinggroupofficeshallcheckallentities.Thedepartmentsinchargeofgovernmentbodyorganization,civilaffairs,marketregulationaswellasotherdepartmentswithfunctionsofexaminationandapprovalorregistrationunderthepeoplesgovernmentatorabovethecountylevelshallprovideentitiesinformationapprovedorregist

36、eredbythemtotheleadinggroupofficeatthesamelevel,andassistthelatterintheworkofcheckingoverentities.法、普查的组织实施以及经费 预算等。拟订全国污染源普查方案，应 当充分听取有关部门和专家 的意见。第十八条全国污染源 普查领导小组办公室根据全 国污染源普查方案拟订污染 源普查表，报国家统计局审 定。省、自治区、直辖市人民政府 污染源普查领导小组办公室， 可以根据需要增设本行政区 域污染源普查附表，报全国污 染源普查领导小组办公室批 准后使用。第十九条在普查启动 阶段，污染源普查领导小组办 公室应当进

37、行单位清查。县级以上人民政府机构编制、 民政、市场监督管理以及其他 具有设立审批、登记职能的部 ,应当向同级污染源普查领 导小组办公室提供其审批或 者登记的单位资料，并协助做 好单位清查工作。污染源普查领导小组办公室应当以本行政区域现有的基Theleadinggroupofficeshall,onthebasisoftheexistingdirectoryofentitiesofthisadministrativeregionandothersuchinformationprovidedbyrelateddepartments,checkandverifypollutionsourcesone

38、byoneinaccordancewiththespecificscopeofthegeneralsurveyasspecifiedinthenationalgeneralsurveyplanofpollutionsourcessoastoformadirectoryofentitiessubjecttothegeneralsurveyofpollutionsources.Article 20 Anyofthemidandlarge-scaleindustrialenterpriseslistedintothescopeofthegeneralsurveyofpollutionsourcess

39、hallspecifyanagencytoberesponsibleforfillinginandreportingthegeneralsurveyform,whileotherentitiesshallspecifypersonneltoberesponsibleforsuchwork.Article 21 Theleadinggroupofficemay,inlightoftheactualneeds,hirepeopleorborrowworkersfromrelatedentitiestoengageinthegeneralsurveywork.本单位名录库为基础，按照全 国污染源普查

40、方案确定的污 染源普查的具体范围，结合有 关部门提供的单位资料，对污 染源逐一核实清查，形成污染 源普查单位名录。Theleadinggroupofficeshallconcludealaborcontractwithanypersonithires,giveremunerationtohimandbuysocialinsuranceforhim.Aborrowedworkershallbepaidbytheentityhiringhim,andtheemployeebenefitsshallremainthesame.Article 22 Asurveyorshallsticktothepr

41、incipleofbeingpracticalandrealistic,scrupulouslyabidebytheprofessionalethicsandhaveprofessionalknowledgeneededforexercisinghisduties.第二十条 列入污染源 普查范围的大、中型工业企 业，应当明确相关机构负责本 企业污染源普查表的填报工 作，其他单位应当指定人员负 责本单位污染源普查表的填 报工作。第二十一条污染源普 查领导小组办公室可以根据 工作需要，聘用或者从有关单 位借调人员从事污染源普查 工作。污染源普查领导小组办公室 应当与聘用人员依法签订劳 动合同，支付

42、劳动报酬，并为 其办理社会保险。借调人员的 工资由原单位支付，其福利待 遇保持不变。第二十二条普查人员 应当坚持实事求是，恪守职业 道德，具有执行普查任务所需 要的专业知识。污染源普查领导小组办公室 应当对普查人员进行业务培 训，对考核合格的颁发全国统 一的普查员工作证。Theleadinggroupofficeshallprovidebusinesstrainingsforsurveyors,andissuethenationwideunifiedsurveyorscardtosurveyorspassingtheexaminationandevaluation.Article 23 Sur

43、veyorsshallindependentlyexercisepowersofinvestigation,reporting,supervisionandinspectionaccordingtolaw,havetherighttolookuptherawmaterialconsumptionrecord,productionrecord,pollutioncontrolfacilityoperationrecord,pollutantdischargemonitoringrecordandothersourcematerialrelatedtothegenerationordischarg

44、eofpollutantsofanyobjectsubjecttothegeneralsurvey,andhavetherighttoaskanyobjecttocorrectthoseuntrueorincompetentcontentsinthegeneralsurveyformfilledinandreportedbyit.Article 24 Surveyorsshallstrictlyimplementthenationalgeneralsurveyplan,andmaynotforgeoralteranyrelateddata,norforceorinspiresurveyobje

45、ctstoprovidefalseinformationforthegeneralsurvey.Foranypollutionsourceinvestigationtask,thereshallbeatleasttwosurveyorsinvolved,whoshallproducetheirsurveyorscardwhenexecutingthetask,otherwise,thesurveyobjecthastherighttorefusetheinvestigation.Article 25 Surveyorsshalldirectlyvisitsurveyobjectsandtell

46、themhowtofillinandreportthesurveyform.Afterfinishingfillinginthesurveyform,asurveyobjectshallaffixitssignatureorsealuponitandberesponsiblefortheauthenticityofalldocumentsaffixedwithitssignatureorsealandsubmittedforthegeneralsurveyofpollutionsources.第二十三条普查人员 依法独立行使调查、报告、监 督和检查的职权，有权查阅普 查对象的原材料消耗记录、生

47、 产记录、污染物治理设施运行 记录、污染物排放监测记录以 及其他与污染物产生和排放 有关的原始资料，并有权要求 普查对象改正其填报的污染 源普查表中不真实、不完整的 内容。第二十四条普查人员 应当严格执行全国污染源普 查方案，不得伪造、篡改普查 资料，不得强令、授意普查对 象提供虚假普查资料。普查人员执行污染源调查任 务，不得少于2人，并应当出 示普查员工作证；未出示普查 员工作证的，普查对象可以拒 绝接受调查。第二十五条普查人员 应当依法直接访问普查对象， 指导普查对象填报污染源普 查表。污染源普查表填写完成 后，应当由普查对象签字或者 盖章确认。普查对象应当对其 签字或者盖章的普查资料的

48、真实性负责。污染源普查领导小组办公室 对其登记、录入的普查资料与 普查对象填报的普查资料的 一致性负责，并对其加工、整 理的普查资料的准确性负责。Theleadinggroupofficeshallberesponsiblefortheconsistencybetweenthesurveydocumentsregisteredorrecordedbyitandthesurveydocumentsfilledinandreportedbysurveyobjectsaswellastheaccuracyofthesurveydocumentsprocessedandsortedoutbyit.Th

49、eleadinggroupofficeshall,whenfindingoutanydoubtfulpointsintheprocessofregistering,recording,processingandsortingoutthesurveydocuments,checkthemupwiththerelatedsurveyobject,whichshallmaketruthfulexplanationsorcorrectthem.Article 26 Anypersoninchargeofalocalpeoplesgovernment,adepartmentoranentitymaynotillegallyalterthesurveydo
