1、特殊医学用途配方食品注册 管理办法（2023年U月28日国家 市场监督管理总局令第85 号公布自2024年1月1 日起施行）第一章总则第一条为了规范特殊 医学用途配方食品注册行 为，保证特殊医学用途配方 食品质量安全，根据中华 人民共和国行政许可法中华人民共和国食品安全 法（以下简称食品安全 法）中华人民共和国食 品安全法实施条例等法律特殊医学用途配方食品注册管理办法(2023)AdministrativeMeasuresfortheRegistrationofFormulaFoodforSpecialMedicalPurposes(2023)制定机关：国家市场监督管理总局发文字号：国家市场监

4、China,theFoodSafetyLawofthePeoplesR即UbIiCofChina(uFoodSafetyLaw),theRegulationontheImplementationoftheFoodSafetyLawofthePeoplesRepublicofChina,andotherapplicablelawsandregulationsforthepurposesofregulatingtheregistrationofformulafoodforspecialmedicalpurposesandensuringthequality法规，制定本办法。andsafetyoff

5、ormulafoodforspecialmedicalpurposes.Article2TheseMeasuresshallapplytotheadministrationofregistrationofformulafoodforspecialmedicalpurposesproducedandsoldwithinandimportedtotheterritoryofthePeoplesRepublicofChina.Article3Theregistrationofformulafoodforspecialmedicalpurposesmeanstheactivitiesinwhichth

6、eStateAdministrationforMarketRegulation(uSAMR),accordingtotheproceduresandrequirementsasprescribedintheseMeasures,examinestheapplicationsfortheregistrationofformulafoodforspecialmedicalpurposesanddecideswhethertoapproveregistration.Article4Theadministrationofregistrationofformulafoodforspecialmedica

7、lpurposesshallbebasedontheclinicaldemandsfornutrition,followtheprinciplesofScientificity,openness,fairness,andimpartiality,andencourageinnovation.Article5TheSAMRshallberesponsibleforadministeringtheregistrationofformulafoodforspecialmedicalpurposes.第二条在中华人民共 和国境内生产销售和进口的 特殊医学用途配方食品的注 册管理，适用本办法。第三条特殊

8、医学用途 配方食品注册，是指国家市 场监督管理总局依据本办法 规定的程序和要求，对申请 注册的特殊医学用途配方食 品进行审查，并决定是否准 予注册的活动。第四条特殊医学用途 配方食品注册管理，以临床 营养需求为导向，遵循科 学、公开、公平、公正的原 则，鼓励创新。第五条国家市场监督 管理总局负责特殊医学用途 配方食品的注册管理工作。国家市场监督管理总局食品 审评机构（食品审评中心， 以下简称审评机构）负责特 殊医学用途配方食品注册申 请的受理、技术审评、现场ThefoodevaluationinstitutionoftheSAMR(uCenterforFoodEvaluation,herein

9、afterreferredtoastheevaluationinstitution”)shallberesponsibleforsuchworkasacceptingapplicationsfortheregistrationofformulafoodforspecialmedicalpurposes,conductingtechnicalevaluationandon-siteinspection,preparinganddeliveringcertificates,andorganizingexpertdemonstrationasneeded.Themarketregulatorydep

10、artmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentshallcooperateinsuchworkastheon-siteinspectionfortheregistrationofformulafoodforspecialmedicalpurposes.Article6Anapplicantfortheregistrationofformulafoodforspecialmedicalpurposes(applicant)shallberesponsibleforth

11、everacity,completeness,legitimacy,andtraceabilityofthematerialssubmittedbyitandassumelegalliability.Theapplicantshallcooperatewiththemarketregulatorydepartmentinconductingon-siteinspection,samplinginspection,andotherworkrelatedtoregistration,andprovidenecessaryworkingconditions.Chapter II Applicatio

12、nandRegistration核查、制证送达等工作，并 根据需要组织专家进行论 证。省、自治区、直辖市市场监 督管理部门应当配合特殊医 学用途配方食品注册的现场 核查等工作。第六条特殊医学用途 配方食品注册申请人（以下 简称申请人）应当对所提交 材料的真实性、完整性、合 法性和可溯源性负责，并承 担法律责任。申请人应当配合市场监督管 理部门开展与注册相关的现 场核查、抽样检验等工作， 提供必要的工作条件。第二章申请与注册第七条申请人应当为 拟在中华人民共和国境内生 产并销售特殊医学用途配方 食品的生产企业或者拟向中 华人民共和国出口特殊医学 用途配方食品的境外生产企 业。Article7An

13、applicantshallbeaproductionenterpriseintendingtoproduceandsellformulafoodforspecialmedicalpurposeswithintheterritoryofthePeoplesRepublicofChinaoranoverseasproductionenterpriseintendingtoexportformulafoodforspecialmedicalpurposestothePeoplesRepublicofChina.Anapplicantshallhavetheresearchanddevelopmen

14、tcapacity,productioncapacity,andinspectioncapacitysuitablefortheproducedformulafoodforspecialmedicalpurposes,establishtheresearchanddevelopmentinstitutionforformulafoodforspecialmedicalpurposes,establishaproductionqualitymanagementsystemsuitablefortheproducedformulafoodforspecialmedicalpurposesaccor

15、dingtotherequirementsofGoodManufacturingPracticeandinspectallex-factoryproductsinbatchesaccordingtotheitemsspecifiedintherelevantlawsandregulations,nationalfoodsafetystandards,andtechnicalrequirements.Aresearchanddevelopmentinstitutionshallbestaffedbypersonnelwithseniorprofessionaltitlesinfood-relat

16、edfieldsorcorrespondingprofessionalcompetence.Article8ThefollowingmaterialsshallbesubmittedtotheSAMRinanapplicationfortheregistrationofformulafoodforspecialmedicalpurposes:申请人应当具备与所生产特 殊医学用途配方食品相适应 的研发能力、生产能力、检 验能力，设立特殊医学用途 配方食品研发机构，按照良 好生产规范要求建立与所生 产特殊医学用途配方食品相 适应的生产质量管理体系， 对出厂产品按照有关法律法 规、食品安全国家标准和

17、技 术要求规定的项目实施逐批 检验。研发机构中应当有食品相关 专业高级职称或者相应专业 能力的人员。第八条申请特殊医学 用途配方食品注册，应当向 国家市场监督管理总局提交 下列材料：（一）特殊医学用途配方食 品注册申请书；(1)Awrittenapplicationfortheregistrationofformulafoodforspecialmedicalpurposes.(2)Theapplicantsqualificationdocuments.（二）申请人主体资质文件；（三）产品研发报告;(3) Productresearchanddevelopmentreport.（四）产品配方及

18、其设计依(4) Productformulaanddesignbasis.据;(5)Productionprocessinformation.（五）生产工艺资料;(6)Productstandardsandtechnicalrequirements.（六）产品标准和技术要求；(7)Samplesofproductlabelsandinstructions.（七）产品标签、说明书样稿；(8)Productinspectionreport.（）产品检验报告;(9)Materialsonresearchanddevelopmentcapacity,productioncapacity,andinsp

19、ectioncapacity.（九）研发能力、生产能力、检验能力的材料；(10)Othermaterialssupportingproductsafety,nutritionaladequacy,andclinicalefficacyforspecialmedicalpurposes.（十）其他表明产品安全性、营养充足性以及特殊医学用途临床效果的材料。Aclinicaltrialreportshallalsobesubmittedforanapplicationfortheregistrationofspecificfull-nutritionalformulafood.申请特定全营养配方食品

20、注册，一般还应当提交临床试验报告。Article9Anapplicantshall,inaccordancewiththerelevantprovisionsissuedbythestate,markthetradesecrets,undisclosedinformation,orconfidentialbusinessinformationintheapplicationmaterialsandindicatethebasisthereof.第九条申请人应当按照国家有关规定对申请材料中的商业秘密、未披露信息或者保密商务信息进行标注并注明依据。Article10Anapplicationfor

21、registrationsubmittedbyanapplicantshallbehandledinlightofthefollowingcircumstancesrespectively:第十条对申请人提出的注册申请，应当根据下列情况分别作出处理：（一）申请事项依法不需要 进行注册的，应当即时告知 申请人不受理；(1) Informingtheapplicantofthenon-acceptanceoftheapplicationimmediatelyifnoregistrationisrequiredfortheapplicationitemsinaccordancewiththelaw.

22、（二）申请事项依法不属于 国家市场监督管理总局职权 范围的，应当即时作出不予 受理的决定，并告知申请人 向有关行政机关申请；(2) MakingadecisionofnotacceptingtheapplicationimmediatelyandinformingtheapplicanttofileanapplicationwiththerelevantadministrativeorganiftheapplicationitemsdonotfallwithinthescopeoffunctionsoftheSAMRinaccordancewiththelaw.（三）申请材料存在可以当 场更正

23、的错误的，应当允许 申请人当场更正；(3) Allowingtheapplicanttocorrecterrorsintheapplicationmaterialsonthespotifsucherrorscanbecorrectedonthespot.（四）申请材料不齐全或者 不符合法定形式的，应当当 场或者在五个工作日内一次 告知申请人需要补正的全部 内容；逾期不告知的，自收 到申请材料之日起即为受 理；（五）申请事项属于国家市 场监督管理总局职权范围， 申请材料齐全、符合法定形 式，或者申请人按照要求提 交全部补正申请材料的，应 当受理注册申请。(4) Informingtheappli

24、cantofallrequiredsupplementsandcorrectionsonthespotorwithinfiveworkingdaysatonetimeiftheapplicationmaterialsareincompleteornotofthestatutoryform;andiftheapplicantisnotinformedwithintheprescribedtimelimit,theapplicationshallbedeemedtohavebeenacceptedfromthedateofreceiptoftheapplicationmaterials.(5) A

25、cceptingtheregistrationapplicationiftheapplicationitemsfallwithinthescopeoffunctionsoftheSAMRandtheapplicationmaterialsarecompleteandofthestatutoryform,oriftheapplicanthassubmittedallsupplementedorcorrectedapplicationmaterialsasrequired.受理或者不予受理注册申Whereanapplicationforregistrationisacceptedorrejecte

27、ductformula,productionprocess,labels,instructions,productsafety,nutritionalsufficiency,andclinicaleffectsforspecialmedicalpurposesoftheproductforwhichanapplicationforregistrationisfiled,andcompletetheevaluationwithin60workingdaysofacceptingtheapplication.特殊情况下需要延长审评时 限的，经审评机构负责人同 意，可以延长三十个工作 日，延长决定应

28、当书面告知 申请人。Ifthetimelimitforevaluationneedstobeextendedunderspecialcircumstances,withtheconsentofthepersoninchargeoftheevaluationinstitution,thetimelimitmaybeextendedby30workingdaysandtheapplicantshallbeinformedoftheextensiondecisioninwriting.第十二条审评过程中 认为需要申请人补正材料 的，审评机构应当一次告知 需要补正的全部内容。申请 人应当在六个月内按照

29、补正 通知的要求一次补正材料。 补正材料的时间不计算在审 评时限内。Article 12 Whereanapplicantisrequiredtosupplementorcorrectmaterialsduringtheevaluationprocess,theevaluationinstitutionshallinformtheapplicantofallrequiredsupplementsandcorrectionsatonetime.Theapplicantshall,accordingtotherequirementsofthesupplementorcorrectionnotice

30、,supplementorcorrectmaterialsatonetimewithinsixmonths.Thetimeforsupplementingorcorrectingmaterialsshallnotincludedintheevaluationperiod.第十三条审评机构可 以组织营养学、临床医学、 食品安全、食品加工等领域 专家对审评过程中遇到的问Article 13 Theevaluationinstitutionmayorganizeexpertsfromnutrition,clinicalmedicine,foodsafety,foodprocessing,andoth

31、erfieldstodemonstrateissues题进行论证，并形成专家意 见。第十四条审评机构根 据食品安全风险组织对申请 人进行生产现场核查和抽样 检验，对临床试验进行现场 核查。必要时，可对食品原 料、食品添加剂生产企业等 开展延伸核查。encounteredintheevaluationprocessandissueexpertopinions.Article 14 Theevaluationinstitutionshallorganizeproductionsiteinspectionsandsamplinginspectionsandon-siteinspectionsofcl

32、inicaltrialsoftheapplicantaccordingtofoodsafetyrisks.Ifnecessary,itmayconductextendedinspectionsofenterprisesproducingfoodmaterialsandfoodadditives.第十五条审评机构应 当通过书面或者电子等方式 告知申请人核查事项。Article15Theevaluationinstitutionshallinformtheapplicantofinspectionmattersinawrittenorelectronicformorothermethods.申请人

33、应当在三十个工作日 内反馈接受现场核查的日 期。因不可抗力等因素无法 在规定时限内反馈的，申请 人应当书面提出延期申请并 说明理由。Theapplicantshallgivefeedbackonthedateofacceptanceoftheon-siteinspectionwithin30workingdays.Iftheapplicantfailstogivefeedbackwithintheprescribedtimelimitduetoforcemajeureorotherfactors,theapplicantshallfileanapplicationforextensioninw

34、ritingandexplainthereasontherefor.第十六条审评机构应 当自申请人确认的生产现场 核查日期起二十个工作日内 完成对申请人的研发能力、 生产能力、检验能力以及申 请材料与实际情况的一致性 等的现场核查，并出具生产 现场核查报告。Article16Theevaluationinstitutionshall,within20workingdaysfromthedateofproductionsiteinspectionconfirmedbytheapplicant,completetheon-siteinspectionoftheapplicantsresearcha

35、nddevelopmentcapacity,productioncapacity,andinspectioncapacityandtheconsistencyofapplicationmaterialswiththeactualcircumstances,andissueaproductionsiteinspectionreport.审评机构通知申请人所在地 省级市场监督管理部门参与Iftheevaluationinstitutionnotifiestheprovincialmarketregulatorydepartmentat现场核查的，省级市场监督 管理部门应当派员参与。theplace

36、wheretheapplicantislocatedtoparticipateintheon-siteinspection,theprovincialmarketregulatorydepartmentshalldispatchpersonneltoparticipateintheinspection.第十七条审评机构在 生产现场核查中抽取动态生 产的样品，委托具有法定资 质的食品检验机构进行检 验。Article17Duringtheproductionsiteinspection,theevaluationinstitutionshalltakesamplesunderdynamicpro

37、ductionandentrustalegallyqualifiedfoodinspectioninstitutiontoconducttheinspection.检验机构应当自收到样品之 日起三十个工作日内按照食 品安全国家标准和技术要求 完成样品检验，并向审评机 构出具样品检验报告。Theinspectioninstitutionshall,within30workingdaysofreceivingthesamples,completethesampleinspectionaccordingtonationalfoodsafetystandardsandtechnicalrequirem

38、ents,andissueasampleinspectionreporttotheevaluationinstitution.第十八条对于申请特 定全营养配方食品注册的临 床试验现场核查，审评机构 应当自申请人确认的临床试 验现场核查日期起三十个工 作日内完成对临床试验的真 实性、完整性、合法性和可 溯源性等情况的现场核查， 并出具临床试验现场核查报 告。Article18Fortheon-siteinspectionofclinicaltrialsinanapplicationfortheregistrationoffoodwithspecificfull-nutritionalformul

39、a,theevaluationinstitutionshallcompletetheon-siteinspectionoftheveracity,completeness,legality,andtraceabilityofclinicaltrialswithin30workingdaysfromthedateofon-siteinspectionconfirmedbytheapplicant,andshallissueaclinicaltrialon-siteinspectionreport.第十九条审评机构应 当根据申请人提交的申请材 料、现场核查报告、样品检 验报告等资料开展审评，并 作

40、出审评结论。Article19Theevaluationinstitutionshallevaluatetheapplicationmaterials,on-siteinspectionreports,sampleinspectionreports,andothermaterialssubmittedbytheapplicantandreachanevaluationconclusion.第二十条申请人的申 请符合法定条件、标准，产 品科学、安全，生产工艺合 理、可行，产品质量可控， 技术要求和检验方法科学、 合理，现场核查报告结论、 样品检验报告结论符合注册 要求的，审评机构应当作出 建议准

41、予注册的审评结论。Article20Whereanapplicationfiledbyanapplicantmeetsthestatutoryconditionsandstandards,theproductisscientificandsafe,theproductionprocessisreasonableandfeasible,theproductqualityiscontrollable,technicalrequirementsandinspectionmethodsarescientificandreasonable,andtheconclusionoftheonsiteinspe

42、ctionreportandsampleinspectionreportsatisfyregistrationrequirements,theevaluationinstitutionshallreachanevaluationconclusionrecommendingtheapprovalofregistration.第二十一条有下列情 形之一的，审评机构应当作 出拟不予注册的审评结论：Article 21 Underanyofthefollowingcircumstances,theevaluationinstitutionshallreachanevaluationconclusion

43、thatitintendstodisapprovetheregistration:（一）申请材料弄虚作假、 不真实的；(1) Theapplicationmaterialsarefraudulentorfalse.（二）申请材料不支持产品 安全性、营养充足性以及特 殊医学用途临床效果的；(2) Theapplicationmaterialsdonotsupportproductsafety,nutritionaladequacy,andclinicalefficacyforspecialmedicalpurposes.（三）申请人不具备与所申 请注册产品相适应的研发能 力、生产能力或者检验能力

44、 的；(3) Theapplicantdoesnothavetheresearchanddevelopmentcapacity,productioncapacity,orinspectioncapacityappropriatefortheproductsforwhichanapplicationforregistrationisfiled.（四）申请人未在规定时限 内提交补正材料，或者提交 的补正材料不符合要求的；(4) Theapplicantfailstosubmitthesupplementsorcorrectionswithintheprescribedtimelimitorthes

45、upplementsorcorrectionssubmittedfailtosatisfytherequirements.（五）逾期不能确认现场核 查日期，拒绝或者不配合现 场核查、抽样检验的；(5) Thedateforanon-siteinspectioncannotbeconfirmedwithinthetimelimitortheenterpriserefusestocooperateinanon-siteinspectionorasamplinginspection.（六）现场核查报告结论或 者样品检验报告结论为不符 合注册要求的；(6) Theconclusionoftheon-s

46、iteinspectionreportorsamplinginspectionreportisthattheproductfailstosatisfyregistrationrequirements.（七）其他不符合法律、法 规、规章、食品安全国家标 准和技术要求等注册要求的 情形。(7) Othercircumstancesnotinconformitywiththeregistrationrequirementsspecifiedinlaws,regulations,rules,nationalfoodsafetystandards,andtechnicalrequirements,amo

47、ngothers.Iftheevaluationinstitutionreachesan审评机构作出不予注册审评 结论的，应当向申请人发出 拟不予注册通知并说明理 由。申请人对审评结论有异 议的，应当自收到通知之日 起二十个工作日内向审评机 构提出书面复审申请并说明 复审理由。复审的内容仅限 于原申请事项及申请材料。evaluationconclusionofdisapprovingtheregistration,itshallissueanoticeofintendingtodisapproveregistrationandexplainthereasontotheapplicant.The

48、applicantthathasanyobjectiontotheevaluationconclusionshallsubmitawrittenapplicationforreviewandexplainthereasontotheevaluationinstitutionwithin20workingdaysofreceivingthenotice.Thecontentstobereviewedshallbelimitedtotheoriginalapplicationitemsandapplicationmaterials.审评机构应当自受理复审申 请之日起三十个工作日内作 出复审决定，并通知申请 人。Theevaluationinstitutionshall,within30workingdaysofacceptingthereviewapplication,makeareviewdecisiononwhethertoconductareviewornotandnotifytheapplicant.第二十二条现场核查、抽样检验、复审所需要Artic
