6、latingthesupervisionandadministrationofthepre-shipmentinspectionofimportedsolidwastethatcanbeusedasrawmaterials(hereinafterreferredtoasuwastetobeusedasrawmaterials)andthepre-shipmentinspectioninstitutions,theseDetailedRulesaredevelopedaccordingtotheRegulationfortheImplementationoftheLawofthePeoplesR

7、epublicofChinaontheInspectionofImportedandExportedCommoditiesandtheMeasuresfortheInspection,Quarantine,SupervisionandAdministrationofImportedSolidWasteThatCanBeUsedasRawMaterials.Article2TheseDetailedRulesshallapplytotherecordationadministrationofthepre-shipmentinspectionactivitiesofimportedwastetob

8、eusedasrawmaterialsandthepre-shipmentinspectioninstitutions,andtherelatedsupervisionandmanagementwork.特此公告。海关总署2018年5月28日进口可用作原料的固体废 物装运前检验监督管理实 施细则第一章总则第一条为加强和规 范对进口可用作原料的固 体废物（以下简称“废物原 料”）装运前检验和装运前 检验机构的监督管理，根据 中华人民共和国进出口 商品检验法实施条例进 口可用作原料的固体废物 检验检疫监督管理办法， 制定本细则。第二条本细则适用 于进口废物原料装运前检 验活动、装运前检验机构的 备

9、案管理，以及相关的监督 管理工作。第三条海关总署负 责对装运前检验实施监督 管理，对装运前检验机构实 施备案管理，并对其活动依 法实施监督管理。Article3TheGeneralAdministrationofCustoms(uGAC)shallberesponsibleforthesupervisionandadministrationoftheimplementationofpre-shipmentinspection,conductrecordationadministrationofpre-shipmentinspectioninstitutions,andconductsuperv

10、isionandadministrationoftheiractivitiesaccordingtolaw.Article4TheGACshallnotdesignateanyinspectioninstitutiontoconductpre-shipmentinspectionofimportedwastetobeusedasrawmaterials.Article5TheGACshallimplementrecordationadministrationofthepre-shipmentinspectioninstitutionsforimportedwastetobeusedasrawm

11、aterials.Athird-partyinspectioninstitutionshall,beforeconductingpre-shipmentinspectionofwastetobeusedasrawmaterials,fileanapplicationforrecordationwiththeGAC.Article6TheGACshallimplementriskearlywarningandrapidresponsemanagementofpre-shipmentinspectioninstitutions.Article7Apre-shipmentinspectioninst

12、itutionshall,inaccordancewiththelawsandregulationsofChinaandtherelevantprovisionsoftheGACjindependentlyandimpartiallyconductpre-shipmentinspectionofimportedwastetobeusedasrawmaterialsasathirdparty,andberesponsiblefortheauthenticityandaccuracyofthepre-shipmentinspectioncertificatesissuedbyit.Article8

13、Apre-shipmentinspectioninstitutionanditsaffiliatedinstitutionshallnotapplyforregistrationofsupplierorfileanyapplicationthereforuponcommission,orengageinproductionorbusinessoperationofwastetobeusedasrawmaterials.ChapterIlPre-ShipmentInspection第四条海关总署不 予指定检验机构从事进口 废物原料装运前检验。第五条海关总署对 进口废物原料装运前检验 机构实施备案

14、管理。第三方 检验机构在从事废物原料 装运前检验业务之前，应当 向海关总署提出备案申请。第六条海关总署对 装运前检验机构实施风险 预警及快速反应管理。第七条装运前检验 机构应当遵守中国相关法 律法规和海关总署的有关 规定，以第三方身份独立、 公正地开展进口废物原料 装运前检验工作，并对其所 出具的装运前检验证书的 真实性、准确性负责。第八条装运前检验 机构及其关联机构不能申 请或者代理申请供货商注 册登记，不能从事废物原料 的生产和经营活动。第二章装运前检验第九条装运前检验 是指在进口废物原料运往 中国境内之前，依照中国法 律法规、国家环境保护控制 标准和国家技术规范的其Article9wPr

15、e-Shipmentinspectionmeanstheinspection,loadingundersupervisionandsealsaffixing,andissuanceofapre-shipmentinspectioncertificatebyapre-shipmentinspectioninstitution,beforetheshipmentofimportedwastetobeusedasrawmaterialstoChina,inaccordancewiththelawsandregulationsofChina,thenationalenvironmentalprotec

16、tionandcontrolstandardsandothercompulsoryrequirementsofthenationaltechnicalspecifications,thepre-shipmentinspectionproceduresandotherrequirements.Article10Apre-shipmentinspectioninstitutionshallconductpre-shipmentinspectionaccordingtothenationalenvironmentalprotectioncontrolstandardsofChina,thecompu

17、lsoryrequirementsoftherelevanttechnicalspecificationsandthepre-shipmentinspectionproceduresattheoverseasloadingorshipmentplaceoftheimportedwaste.Article11Accordingtothequalityriskcharacteristicsandmanagementrequirementsofthepre-shipmentinspectionwork,apre-shipmentinspectioninstitutionshallcarryoutpr

18、e-shipmentinspectionactivitiesinthecountryorregionwhereitislegallyregistered.Article12Apre-shipmentinspectioninstitutionshallhavethescale,numberofinspectionpersonnelandinspectionfacilitiesandequipmentcommensuratewiththepre-shipmentinspectionactivitiestoensurethatthewastetobeusedasrawmaterialsittests

19、complieswiththelawsandregulationsofChina,thenationalenvironmentalprotectionandcontrolstandardsandothercompulsoryrequirementsofthenationaltechnicalspecifications.他强制性要求，以及装运前 检验规程等的要求，由装运 前检验机构对其进行检验、 监装和施加封识，然后出具 装运前检验证书的行为。第十条装运前检验 机构应当在进口废物原料 的境外装货地或者发货地， 按照中国国家环境保护控 制标准、相关技术规范的强 制性要求和装运前检验规 程实施装运

20、前检验。第十一条根据装运 前检验工作质量风险特性 与管理要求，装运前检验机 构应当在其合法注册所在 的国家或地区开展装运前 检验活动。第十二条装运前检 验机构应当具备与其实施 装运前检验活动相适应的 规模、检验人员数量和检验 设施设备，确保经其检验的 废物原料符合中国法律法 规、国家环境保护控制标准 和国家技术规范的其他强 制性要求。第十三条装运前检 验机构应当分别设置检验、 授权签字等关键岗位，保持 相互独立，同时制定任职的 专业背景条件，持续接受业 务培训和教育，确保检验Article13Apre-shipmentinspectioninstitutionshallrespectively

21、setupinspection,authorizedsigningandotherkeypositions,maintainmutualindependence,concurrentlysetprofessionalbackgroundandconditionsforofficeholding,continuetoreceivebusinesstrainingandeducation,andensurethatinspectorsandauthorizedsignatoriesarefamiliarwiththelawsandregulationsofChinaonwastetobeuseda

22、srawmaterials,thenationalenvironmentalprotectionandcontrolstandardsandothercompulsoryrequirementsofthenationaltechnicalspecifications,andrelatedmanagementregulations.Article14Apre-shipmetinspectioninstitutionshall,inaccordancewiththeprovisionsofArticle10oftheseDetailedRules,developpre-shipmentinspec

23、tionproceduresorworkinstructionssuitablefortheinstitution,andregulatetheon-sitepre-shipmentinspectionactivities.Article15Apre-shipmentinspectioninstitutionshall,byrelyingonitsowninspectioncapability,completelyimplementinspection,loadingundersupervision,sealsaffixingandotherworkingprocedures,andbeful

24、lyresponsibleforitsworkquality,andshallnotentrustanyotherinstitution,organizationorpersonneltoimplementthem.Article16Apre-shipmentinspectioninstitutionshallrecordtheprocessofthepre-shipmentinspectionactivitiescarriedoutinanappropriate,authentic,completeandtraceablemanner,andappropriatelystoreandkeep

25、theoriginalinspectionrecordsfor5yearsataminimum.ChapterIIIRecordationAdministrationArticle17Apre-shipmentinspectioninstitutionshallundergotherecordationformalitieswiththeGACinadvanceandsubmitthefollowingmaterials:员、授权签字人熟悉掌握与 废物原料有关的中国法律 法规、国家环境保护控制标 准和国家技术规范的其他 强制性要求，以及相关的管 理规定。第十四条装运前检 验机构应当依据本细则第

26、 十条的规定，制定适合本机 构情况的装运前检验工作 程序或者作业指导书，规范 现场装运前检验活动。第十五条装运前检 验机构应当依靠自身检验 能力，完整地实施检验、监 装和施加封识等工作程序， 并对其工作质量负全责，不 得委托其他机构、组织或人 贝实施O第十六条装运前检 验机构应当以适当方式，真 实、完整、可追溯地记录其 实施的装运前检验活动过 程，并妥善贮存、保管检验 原始记录，至少保存5年。第三章备案管理第十七条装运前检 验机构应当提前向海关总 署备案，并提交以下材料：（一）备案申请书（见附件 D ;(1) anapplicationforrecordation(seeAnnex1);(2)

27、 anotarizedqualificationcertificateofthethird-partyinspectioninstitutionlegallyregisteredinthecountry(region)whereitislocated;(3) thecertificationmaterialsontherighttousethefixedofficepremiseandinspectionsite;andtheplansoftheofficepremiseandsiteforbusinessoperation,andthevideoorfiveormorephotosthatm

28、aydisplaytheaforesaidsceneries;(4) thecolorcopyoftheISOIEC17020systemcertificationcertificateandtherelateddocumentsonthequalitymanagementsystem;(5) thetypeofwastetobeusedasrawmaterialssubjecttopre-shipmentinspection;(6) theinformationontheauthorizedsignatoryofthepre-shipmentinspectioncertificateandt

29、hesampleofseal;and(7) thebylawsofthecompany.Wheretheapplicationmaterialsforrecordationaresubmitted,aChineseversionoraversioninbothChineseandEnglishshallbeused.Article 18 Afterpreparingtheapplicationmaterials,anapplicantforrecordationshallsubmitacompletesetofthematerialstotheGAC,andthewrittenapplicat

30、ionmaterialsreceivedbytheGACshallprevail.Article 19 Afterreceivingthewrittenapplicationmaterialsforrecordation,theGACshallhandleitunderthefollowingcircumstances:（二）经公证的所在国家 （地区）合法注册的第三方检验机构资质证明；（三）固定的办公地点、检 验场所使用权证明材料；办 公场所和经营场所平面图， 能全面展现上述场所实景 的视频或者5张以上照片；（四）IS0IEC17020 体系认 证证书彩色复印件及相关 质量管理体系文件；（五）

31、从事装运前检验的废 物原料种类；（六）装运前检验证书授权 签字人信息及印签样式；（七）公司章程。提交的备案申请材料应当 使用中文或者中英文对照 又.本O第十八条备案申请 人在准备好申请材料后，将 全套材料提交海关总署，以 海关总署收到的书面申请 资料为准。第十九条海关总署 在收到备案申请书面材料 后，根据下列情况分别处 理：（一）备案申请材料不齐 全，或者不符合要求的，当(1) Wheretheapplicationmaterialsforrecordationareincompleteorfailtosatisfytherequirements,theGACshall,immediately

32、orwithin5workingdays,notifytheapplicantforrecordationofallnecessarysupplementsandcorrectionsatatime,andrequiretheapplicantforrecordationtocompletethesupplementsandcorrectionswithin30days.(2) Wheretheapplicationmaterialsforrecordationarecompleteandsatisfytherequirements,oraftertheapplicantforrecordat

33、ionhassupplementedandcorrectedthematerials,wherethematerialsareexaminedtobecompleteandsatisfytherequirements,theapplicationshallbeaccepted.(3) Wherethesupplementsandcorrectionsfailtobemadewithintheprescribedtimelimit,therecordationformalitiesshallbeterminated.(4) Wheretheapplicationmaterialsforrecor

34、dationarenotcompletelysupplementedorcorrectedasrequiredortheapplicationmaterialsforrecordationstillfailtosatisfytherequirementsaftersupplementandcorrection,theapplicationshallnotbeaccepted.Article20TheGACshallformanexpertgroupwithintenworkingdaysofacceptinganapplicationforrecordationofapre-shipmenti

35、nspectioninstitution,andexaminethequalificationsoftheapplicant,thecompletenessandconformityoftheapplicationmaterials,etc.,accordingtotheRecordfortheExaminationoftheRecordationofAPre-ShipmentInspectionInstitutionforImportedSolidWasteThatCanBeUsedasRawMaterials(seeAnnex2).Theexpertgroupshallmakeanexam

36、inationconclusionafterthecompletionoftheexaminationworkandsubmitanexaminationreporttotheGAC.场或者5个工作日内一次性 告知备案申请人需要补正 的全部内容，要求备案申请 人须在30天内补正完毕；（二）备案申请材料齐全、 符合要求的，或者备案申请 人补正材料后，经审查材料 齐全、符合规定要求的，予 以受理；（S）逾期未补正的，终止 办理备案；（四）未按照要求全部补正 备案申请材料或者补正后 备案申请材料仍不符合要 求的，不予受理。第二十条海关总署 自受理装运前检验机构备 案申请之日起10个工作日 内组成专家

37、组，按照进口 可用作原料的固体废物装 运前检验机构备案审核记 录表（见附件2）的要求, 审核申请人资格、申请材料 的完整性、符合性等情况。专家组应当在审核工作结 束后作出审核结论，向海关 总署提交审核报告。第二十一条海关总Article 21 TheGACshall,withintenworkingdaysofreceivinganexaminationreport,makeadecisionofapprovingtherecordationornot.Whereitisfoundthroughexaminationtobequalified,recordationshallbeapprove

38、d,andaRecordationCertificateofAPre-ShipmentInspectionInstitutionforImportedSolidWasteThatCanBeUsedasRawMaterials(seeAnnex3)shallbeissued;andwhereitisfoundtobeunqualified,therecordationshallnotbeapproved.Article 22 TheGACshall,within20workingdaysofacceptinganapplicationforrecordation,makeadecisionofa

39、pprovingrecordationornot.Theexaminationtimeoftheexpertgroupshallnotbetakenintoconsideration,buttheapplicantshallbenotifiedofthetimerequiredfortheexaminationoftheexpertgroupinwriting.Article 23 TheGACshalldisclosetheinformationofthepre-shipmentinspectioninstitutionsthathaveundergonetherecordationform

40、alitiestothepublicinatimelymanner.Intheeventofanychangeinthetelephonenumber,faxore-mailofapre-shipmentinspectioninstitution,theGACshallbenotifiedinatimelymanner.Article 24 Apre-shipmentinspectioninstitutionthatintendstoaddmoretypesofwastetobeusedasrawmaterialssubjecttopre-shipmentinspection,orchange

41、sthenameoftheinstitution,businessregistrationaddress,legalrepresentative,funderorownershipshall,within30daysofthechange,applytotheGACforre-recordation.署自收到审核报告之日起 10个工作日内作出是否同 意备案的意见。审核合格 的，同意备案，签发进口 可用作原料的固体废物装 运前检验机构备案证书（见附件3）；审核不合格 的，不予备案。第二十二条海关总 署自受理备案申请之日起 20个工作日内作出同意备 案或不予备案的意见Q专家 组审核时间不计算在内，

42、但 应将专家组审核所需时间 书面告知备案申请人。第二十三条海关总 署应及时将已备案的装运 前检验机构的信息对外公 开。装运前检验机构的联系电 话、传真、电子邮件发生变 化的，应当及时告知海关总 署。第二十四条装运前 检验机构拟增加实施装运 前检验的废物原料种类，或 者机构名称、商业登记地 址、法定代表人、出资方或 所有权发生变化的，应在变 化后的30天内向海关总署 申请重新备案。申请重新备案的流程按照 本章第十七条的规定实施。TheprovisionsofArticle17ofthisChaptershallapplytotheprocessofapplyingforre-recordatio

43、n.Article 25 Whereapre-shipmentinspectioninstitutionobtainsrecordationbyprovidingfalsematerialsandconcealingtherelevantinformation,theGACmayrevokeitsrecordation.Apre-shipmentinspectioninstitutionwhoserecordationisrevokedshallnotre-applyforrecordationwithinthreeyears.ChapterIVSupervisionandAdministra

44、tionArticle26TheGACshall,accordingtoitsduties,implementon-siteinspection,verification,trackingoftheenvironmentalprotectionqualityofgoodsandotherformsofsupervisionandadministrationofthepre-shipmentinspectioninstitutionsandtheirshipmentinspectionwork.Whereapre-shipmentinspectioninstitutionrejectsthesu

45、pervisionandadministrationorisnotcooperativeinthesupervisionandadministration,theGACmayrevokeitsrecordation.Article27Whenapre-shipmentinspectioninstitutionfalls(butnotlimitedto)underthefollowingcircumstances,theGACmayarrangeasupervisionandinspectionatanytimeasneeded:(1) Therecordationrequirementsort

46、herecordationinformationontheinstitutionarechanged.(2) Thecomplaintorotherinformationreflectedneedstobeverifiedandinvestigated.第二十五条装运前 检验机构通过提供虚假材 料、隐瞒有关情况取得备 案，海关总署可以撤销其备 案。被撤销备案的装运前检验 机构，3年内不得再申请备 案。第四章监督管理第二十六条海关总 署依照职责对装运前检验 机构及其装运检验工作实 施现场检查、验证、追踪货 物环保质量状况等形式的 监督管理。装运前检验机构不接受、不 配合监督管理的，海关总署 可以

47、撤销其备案。第二十七条装运前 检验机构出现（但不限于） 以下情况时，海关总署可视 需要随时安排监督检查：（一）备案要求或机构的备 案信息发生变化时；（二）需要对投诉或其他情 况反映进行核实调查；（三）被海关总署实施风险 预警措施的；(3) TheriskearlywarningmeasuresaretakenbytheGAC.(4) Qualityproblemsofthepre-shipmentinspectionworkarefound.(5) Anannualreportisnotsubmittedasrequiredortherelevantinformationisconcealed

48、intheannualreport.(6) TheGACthinksitnecessarytoconductaspecialexaminationandinspection.Thesupervisionandinspectionmaybecarriedoutthroughon-siteinspectionorothermethods,suchaswritteninvestigation,documentreview,etc.Article28Inspectorsmay,whenconductinganon-siteinspection,takesuchmeasuresastakingspotwitnesses,collectingsamples,consultingorcopyingrelevantmaterials,etc.Theinstitutionsinspectedshalltruthfullyreflectthesituationandprovidenecessarymaterials.Theinspectorsshallkeepthetechnicalsecretsandbusinesssecretsoftheinstitutionsinspectedconfidential.Article 29 Apre-shipmentinsp
