5、s第九章附则ChapterIGeneralProvisions第一章总贝（Article1TheseProvisionsaredevelopedinaccordancewiththePeoplesPoliceLawofthePeoplesRepublicofChina,theExit-EntryAdministrationLawofthePeoplesRepublicofChina,theRegulationofthePeoplesRepublicofChinaontheAdministrationoftheEntryandExitofForeignNationals,andotherappl

6、icablelawsandadministrativeregulationstoregulate第一条为了规范非法移民遣返机构（以下简称遣返机构）管理，保障遣返机构依法履行职责，保护被羁押、遣返人员的合法权益，根据中华人民共和国人民警察法中华人民共和国出境入境管理法中华人民共和国外国人入境出境管理条例等法律、行政 法规，制定本规定。themanagementofillegalimmigrantrepatriationinstitutions(hereinafterreferredtoasrepatriationinstitutions,),guaranteethelawfulperforman

7、ceofdutiesbyrepatriationinstitutions,andprotectthelawfulrightsandinterestsofdetaineesandrepatriatedpersonnel.第二条 遣返机构包括遣返中 心及其下辖的遣返站，由国家移民 管理局领导管理。Article2Repatriationinstitutions,includingrepatriationcentersandtheirsubordinaterepatriationstations,areundertheleadershipandadministrationoftheNationalI

8、mmigrationAdministration.第三条遣返机构负责羁押违 反出境入境管理法律法规被拘留审 查的外国人以及被决定遣送出境、 驱逐出境但无法立即执行的外国 人，依法对被羁押人员开展身份调 查、执行遣返。Article3Repatriationinstitutionsshallberesponsiblefordetainingforeignersdetainedforexaminationinviolationoflawsandregulationsonexitandentryadministrationandforeignerswhoserepatriationordeporta

9、tionhasbeendecidedbutcannotbeexecutedimmediately,andshallchecktheidentityofandrepatriatedetaineesinaccordancewiththelaw.第四条遣返机构开展羁押、 遣返工作，应当做到依法、规范、 安全。Article4Repatriationinstitutionsshallconductdetentionandrepatriationinalegal,well-regulated,andsafemanner.第五条遣返机构应当依法保 护被羁押、遣返人员的合法权益， 尊重其人格尊严、宗教信仰，

10、不得 侮辱、体罚、虐待。Article5Repatriationinstitutionsshallprotectthelawfulrightsandinterestsofdetaineesandrepatriatedpersonnelinaccordancewiththelaw,respecttheirpersonaldignityandreligiousbeliefs,andshallnotinsult,physicallypunish,ormaltreatthem.被羁押、遣返人员应当遵守法律法 规和遣返机构的管理规定。Detaineesandrepatriatedpersonnelsha

11、llabidebylawsandregulationsandtheadministrativeprovisionsofrepatriationinstitutions.第二章接收ChapterIlReception第六条 县级以上地方人民政 府公安机关或者出入境边防检查机 构（以下统称办案部门）向遣返机 构移送被羁押人员，应当出具拘留 审查决定书或者遣送出境决定书、 驱逐出境决定书等法律文书，并提 供县级以上综合医院出具的体检证 明。Article6Thepublicsecurityauthorityorexitentryborderinspectionauthorityofalocalpeo

12、plesgovernmentatorabovethecountylevel(hereinaftercollectivelyreferredtoastheucasehandlingauthorityn)thattransfersadetaineetoarepatriationinstitutionshallissuelegaldocumentssuchasawrittendecisionondetentionforexamination,awrittendecisiononrepatriation,orawrittendecisionondeportation,andprovideaphysic

13、alexaminationcertificateissuedbyacomprehensivehospitalatorabovethecountylevel.第七条 遣返机构接收被羁押 人员，应当由两名以上人民警察进 行。接收时，应当对被羁押人员的 身体和携带物品进行检查。Article 7 Adetaineeshallbereceivedbytwoormorepoliceofficersofarepatriationinstitution.Atthetimeofreception,policeofficersshallcheckthedetainee,sbodyandthearticlesca

14、rriedbyhimorher.对女性的身体检查，应当由女性人 民警察进行。Thebodyexaminationoffemalesshallbeconductedbyfemalepoliceofficers.对检查发现的违禁品和其他与案件 有关的物品，应当交由办案部门依 法处理。Prohibitedarticlesandothercase-relatedarticlesdiscoveredduringtheinspectionshallbehandedovertothecasehandlingauthorityfordisposalinaccordancewiththelaw.第八条接收被羁押

15、人员，遣 返机构应当向办案部门出具回执。Article 8 Arepatriationinstitutionthatreceivesadetaineeshallissueareceipttothecasehandlingauthority.遣返机构应当告知被羁押人员在羁押期间依法享有的权利和应当遵守的管理规定。对不通晓我国语言文Therepatriationinstitutionshallinformthedetaineeofhisorherlegalrightsandtheadministrativeprovisionsheorsheshall字的，遣返机构应当为其提供翻 译。observe

16、duringhisorherdetention.IfthedetaineedoesnotknowtheChineselanguageandcharacters,therepatriationinstitutionshallprovidehimorherwithinterpretationservices.第九条被羁押人员在羁押期 间可以随身携带适量、必要的生活 用品，其他财物交由遣返机构代为 保管。Article 9 Adetaineemaycarryanappropriateamountofnecessarydailynecessitiesduringhisorherdetention,an

17、dotherpropertyshallbehandedovertotherepatriationinstitutionforsafekeeping.办案部门向遣返机构移交代为保管 的被羁押人员财物，应当由办案部 门人民警察、遣返机构人民警察、 被羁押人员共同签字确认。Ifthecasehandlingauthorityhandsoverthepropertyofthedetaineetotherepatriationinstitutionforsafekeeping,itshallbeconfirmedbythesignaturesofpoliceofficersofthecasehandli

18、ngauthority,policeofficersoftherepatriationinstitution,andthedetainee.第十条移送的被羁押人员有 中华人民共和国出境入境管理 法第六十一条第一款规定情形之 一的，遣返机构不予接收。已经接 收的，应当经遣返中心主要负责人 批准后通知办案部门接回处理。Article 10 Arepatriationinstitutionshallrefusetoacceptadetaineeunderanyofthecircumstancesspecifiedinparagraph1ofArticle61oftheExit-EntryAdmini

19、strationLawofthePeoplesRepublicofChina.Ifadetaineehasbeenreceived,thecasehandlingauthorityshallbenotifiedtoreceivethedetaineewiththeapprovaloftheprincipalpersoninchargeoftherepatriationcenter.第三章羁押ChapterIIIDetention第十一条遣返机构应当建立 被羁押人员档案，登记被羁押人员 信息，并由专人管理。Article 11 Arepatriationinstitutionshallestab

20、lisharchivesfordetainees,registertheirinformation,andassignpersonneltomanagethem.第十二条遣返机构应当根据 被羁押人员情况实行分区羁押，并 采取相应的监管措施。Article 12 Arepatriationinstitutionshall,basedonthesituationofdetainees,detainthemindifferentareasandtakecorrespondingregulatorymeasures.不同性别人员应当分别羁押。女性 被羁押人员的直接管理由女性人民 警察进行。Detain

21、eesofdifferentgendersshallbedetainedseparately.Femaledetaineesshallbedirectlymanagedbyfemalepoliceofficers.第十三条遣返机构实行二十 四小时值班巡查制度。值班人员应 当坚守岗位，按规定开展巡视检 查。Article 13 Arepatriationinstitutionshallimplementa24-hourdutyandpatrolinspectionsystem.On-dutypersonnelshallsticktotheirpostsandcarryoutpatrolinspe

22、ctionsaccordingtotheapplicableprovisions.巡视检查由人民警察负责组织实 施。羁押女性的场所由女性人民警 察负责巡视检查。Policeofficersshallberesponsiblefororganizingandconductingpatrolinspections.Femalepoliceofficersshallberesponsibleforconductingpatrolinspectionsoftheareaswherefemaledetaineesaredetained.使用视频监控系统实施巡视检查 的，视频录像资料保存期限不得少 于九十

23、日。Ifavideosurveillancesystemisusedtoconductpatrolinspections,videorecordingmaterialsshallbekeptfornotlessthan90days.第十四条遣返机构应当定期 开展安全检查，及时消除安全隐 患。Article 14 Arepatriationinstitutionshallregularlycarryoutsecurityinspectionstoeliminatepotentialsecurityrisksinatimelymanner.第十五条 遣返机构应当制定 突发事件应急处置预案，定期组织

24、 演练。遇有突发情况时，应当立即 启动预案，快速妥善处置。Article 15 Arepatriationinstitutionshallmakeemergencyresponseplansandorganizedrillsonaregularbasis.Incaseofanyemergency,itshallstarttheemergencyplanimmediatelyandhandleitquicklyandproperly.第十六条被羁押人员有下列 行为之一的，遣返机构应当立即制 止；涉嫌违法犯罪的，移送遣返机Article 16 Arepatriationinstitutionsha

25、llimmediatelystopanyofthefollowingactscommittedbyadetainee;ifthedetaineeissuspectedofcommittinganyillegalorcriminalact,thecaseshallbetransferredtothepublicsecurityauthorityattheplacewheretherepatriationinstitutionislocatedforhandlinginaccordancewiththelaw:构所在地公安机关依法处理:(1)Disobeyingthedetentionadmini

26、strationorprovokingtrouble.（一）的；不服从羁押管理，寻衅滋事(2)Premeditatingorcommittingescape,violence,suicide,orself-injury.（二）自杀、预谋或者实施脱逃、行凶、自伤的；(3)Beating,physicallypunishing,abusing,orbullyinganyotherdetainee.（三）殴打、体罚、虐待、欺侮其他被羁押人员的;(4)Teachingmethodsofcommittingillegalorcriminalactsorincitingotherstocommitille

27、galorcriminalacts.（四）传授违法犯罪方法或者教唆他人违法犯罪的；(5)Attackingpeoplespoliceandotherstaffmembers.（五）袭击人民警察及其他工作人员的；(6)Intentionallydamagingthefacilitiesequipmentofarepatriationinstitutiondamagingothersproperty.oror（六）故意破坏遣返机构设施设备或者损毁他人财物的；(7)Possessingprohibitedarticles.（七）持有违禁物品的;(8)Committinganyotherviolati

28、onoftheadministrativeprovisionsofarepatriationinstitution.（八）违反遣返机构管理规定的其他行为。ChapterIVInvestigation第四章调查Article17Arepatriationinstitutionshallpromptlyinvestigatethenationalityandidentity第十七条对国籍、身份不明的被羁押人员，遣返机构应当及时ofadetaineewhosenationalityoridentityis调查其国籍、身份。unclear.遣返机构向有关单位或者人员核实 被羁押人员国籍、身份相关信息

29、的，有关单位或者人员应当予以协 助配合。Iftherepatriationinstitutionverifiesthenationalityandidentityinformationofthedetaineewiththerelevantentityorperson,therelevantentityorpersonshallprovideassistanceandcooperation.第十八条办案部门人民警察 依法询问被羁押人员的，遣返机构 应当予以安排。Article 18 Wherethepoliceofficerofthecasehandlingauthorityplanstoqu

30、estionadetaineeinaccordancewiththelaw,therepatriationinstitutionshallmakearrangementsforit.第十九条 办案部门因办理案 件需要将被羁押人员临时带离遣返 机构的，应当经遣返中心或者遣返 站主要负责人批准。Article 19 Wherethecasehandlingauthorityneedstotemporarilytakeadetaineeawayfromtherepatriationinstitutionforcasehandling,itshallbesubjecttotheapprovalofth

31、eprincipalpersoninchargeoftherepatriationcenterorrepatriationstation.执行临时带离任务的人民警察不得 少于两人，每次临时带离时间不得 超过二十四小时。办案部门应当确 保被羁押人员在临时带离期间的人 身安全。Atleasttwopoliceofficersshallcarryoutthetaskoftemporarilytakingawaydetainees,andeachtemporarydepartureshallnotexceed24hours.Thecasehandlingauthorityshallensurethep

32、ersonalsafetyofthedetaineewhenheorsheistemporarilytakenaway.办案部门送回被羁押人员时，遣返 机构应当对其体表和携带物品进行 检查。Whenthecasehandlingauthorityreturnsthedetainee,therepatriationinstitutionshallinspecthisorherbodyandthearticlescarriedbyhimorher.第二十条遣返机构发现被羁 押人员在被遣返机构接收前有其他 违法犯罪嫌疑的，应当通知办案部 门依法处理。Article 20 Wherearepatria

33、tioninstitutionfindsthatadetaineeissuspectedofcommittinganyotherillegalorcriminalactbeforebeingacceptedbytherepatriationinstitution,itshallnotifythecasehandlingauthoritytohandlethecaseinaccordancewiththelaw.第二十一条被羁押人员提出 举报、控告，申请行政复议或者提 供其他案件线索的，遣返机构应当 在二十四小时内将相关材料转送有 关单位。Article 21 Whereadetaineefil

34、esareportoraccusation,appliesforadministrativereconsideration,orprovidesanyothercluetoacase,therepatriationinstitutionshallforwardrelevantmaterialstotherelevantentitywithin24hours.第五章生活卫生和通信会见ChapterVDailyLife,Health,Communication,andVisits第二十二条羁押场所应当坚 固、通风、透光、清洁，能够防 潮、防暑、防寒。Article 22 Detentionfaci

35、litiesshallbesolid,well-ventilated,well-lit,andclean,andbeabletopreventmoisture,heat,andcold.第二十三条遣返机构应当为 被羁押人员提供必要的居住、饮食 等物质生活保障，尊重其民族饮食 习惯，保证被羁押人员每日不少于 2小时的羁室外活动时间。Article 23 Arepatriationinstitutionshallprovidedetaineeswithnecessaryhousing,food,andothermaterialguarantees,respecttheirethicaldietar

36、yhabits,andensurethatdetaineeshaveatleasttwohoursadayforoutdooractivities.不得强迫被羁押人员从事生产劳 动。Nodetaineeshallbeforcedtoengageinproductivelabor.第二十四条遣返机构应当做 好羁押场所的卫生防疫，对患有疾 病的被羁押人员及时予以治疗。Article 24 Arepatriationinstitutionshallensurethesanitationandepidemicpreventionofdetentionfacilitiesandpromptlyprovi

37、detreatmenttodetaineeswhosufferfromdiseases.第二十五条被羁押人员依法 享有接受其国籍国驻华外交、领事 官员探视和通信、会见等权利。被羁押人员拒绝探视、会见的，应Article 25 Detaineesshalllegallyhavetherighttoreceivevisitsandcommunicatewith,andmeetdiplomaticorconsularofficialsoftheirhomecountryresidinginChina.Ifadetaineerefusestoreceivevisitsormeetwithothers,

38、awrittenstatementshallbeissued.当出具书面声明。ChapterVlReleasefromDetention第六章解除羁押Article26Arepatriationinstitutionshallimmediatelyreleasethedetentionifadetaineefallsunderanyofthefollowingcircumstances:第二十六条被羁押人员有下列情形之一的，遣返机构应当立即解除羁押：(1)Thecasehandlingauthoritydecidestoreleasethedetentionforexamination.（一）

39、办案部门决定解除对其拘留审查的；(2)Theperiodofdetentionforexaminationhasexpired.（二）拘留审查期限届满的;(3)Thedecisionofdetentionforexaminationisrevoked.（三）拘留审查决定被撤销的;(4)Thedecisiononrepatriationisrevoked.（四）遣送出境决定被撤销的。Article27Whereadetaineefallsunderanyofthefollowingcircumstances,therepatriationinstitutionshallreleasethedet

40、entionandhandoverthedetaineetothecasehandlingauthority:(1)Thecasehandlingauthorityrepatriatesthedetaineeonitsown.第二十七条被羁押人员有下列情形之一的，遣返机构应当解除羁押，并移交办案部门：（一）办案部门自行执行遣返的;(2) Thedetaineeistobesubjecttoadministrativedetentionasdecidedinaccordancewiththelaw.(3) Thedetaineeistobesubjecttocriminalcompulsorym

41、easuresasdecidedinaccordancewiththelaw.（二）被依法决定行政拘留的;（三）被依法决定执行刑事强制措施的；（四）涉及其他案件需要移交的。移交被羁押人员时，遣返机构应当 与办案部门履行交接手续。第二十八条对被决定遣送出 境、驱逐出境的被羁押人员，具备 执行条件时，应当立即解除羁押并 执行遣返。第二十九条解除羁押的，应 当向被羁押人员出具解除羁押证明 书，返还代为保管的本人财物。第七章执行遣返第三十条对被决定遣送出 境、驱逐出境的被羁押人员，遣返 机构可以按照就近就便的原则，确 定遣返至下列国家（地区）：（一）国籍国;（二）入境前的居住国（地区）；（三）出生地国

42、（地区）；（四）入境前的出境口岸所属国(4)Thedetaineeneedstobetransferredsinceheorsheisinvolvedinanyothercase.Therepatriationinstitutionshall,whenhandingoveradetainee,undergohandoverformalitieswiththecasehandlingauthority.Article 28 Adetaineewhoisrepatriatedordeportedasdecidedshallbereleasedfromdetentionandberepatriate

43、dimmediatelywhentheconditionsforexecutionaremet.Article 29 Wherethedetaineeisreleasedfromdetention,acertificateofreleasefromdetentionshallbeissuedtothedetainee,andthepropertyheldincustodyshallbereturnedtothedetainee.ChapterVllExecutionofRepatriationArticle 30 Arepatriationinstitutionmay,undertheprin

44、cipleofproximityandconvenience,repatriateadetaineewhoistoberepatriatedordeportedasdecidedtoanyofthefollowingcountries(regions):(1) Stateofhisorhernationality.(2) Thecountry(orregion)whereheorsheresidesbeforeenteringChina.(3) Thecountry(orregion)ofbirth.(4) Thecountry(orregion)towhichtheexitportbelon

45、gsbeforeheorsheentersChina.（地区）；(5)Anyothercountryorregionwhichpermitshisorherentry.（五）其他允许其入境的国家（地区）。Article31Arepatriationinstitutionshallarrangesufficientpoliceofficerstoensureescortsafetyinrepatriation.第三十一条遣返机构执行遣返，应当安排充足的警力，确保押送安全。Ifthepersontoberepatriatedisafemale,femalepoliceofficersshallbe

46、arrangedtoparticipateintheexecutionofrepatriation.被遣返人员为女性的，应当安排女性人民警察参与执行遣返。ChapterVlllLawEnforcementSupervision第八章执法监督Article32Thepoliceofficersofarepatriationinstitutionshall,inperformingtheirduties,acceptthesupervisionoftheNationalImmigrationAdministrationandtherepatriationinstitutionatahigherle

47、velinaccordancewiththelaw.Arepatriationinstitutionshall,inaccordancewiththeprovisionsoftheseProvisionsandotherrelevantlawsandregulations,establishandimproveinternalsupervisionrules,andsuperviseandinspectthelawenforcementactivitiesofpoliceofficers.第三十二条遣返机构的人民警察执行职务，依法接受国家移民管理局和上级遣返机构的监督。遣返机构应当依照本规定和其他有关法律法规的规定，建立健全内部监督制度，对人民警察执法活动进行监督检查。Article33Anyindividualororganizationshallhavetherighttofileareportoranaccusationofanyviolationoflawordisciplinecommittedbyanypoliceofficerofarepatriationinstitution.第三十三条个人或者组织对遣返机构人民警察的违法违纪行为，有权向有关部门提出检举、控告。Article
